AN ORDINANCE AUTHORIZING AN INTERGOVERMENTAL AGREEMENT WITH

RELATING A STUDY OF BUFFALO CREEK
WHEREAS, the Village of Buffalo Grove is a home rule unit pursuant to the Illinois Constitution of
1970; and
WHEREAS,the Village of Buffalo Grove seeks to enter into an Intergovernmental Agreement with
the Village of Wheeling for a study of Buffalo Creek; and
WHEREAS, the Village of Buffalo Grove will lead the procurement process and directly contract
with Christopher B. Burke Engineering Ltd. and invoice the Village of Wheeling for their costs.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows:
SECTION 1. The foregoing recitals are hereby adopted and incorporated and made a part of this Ordinance
as if fully set forth herein.
SECTION 2. The Village Manager is authorized to enter into an Intergovernmental Agreement with the
Village of Wheeling a study of Buffalo Creek, a copy of said agreement is attached hereto, pending
attorney review.
SECTION 3. If any section, paragraph, clause, or provision of this Ordinance shall be held invalid, the
invalidity thereof shall not affect any other provision of this Ordinance.
SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval and
shall not be codified.

INTERGOVERNMENTAL AGREEMENT FOR A STUDY OF BUFFALO
CREEK WITH CHRISTOPHER B. BURKE ENGINEERING LTD.
This Service Agreement (the "Agreement") is made and entered into by and between the Village
of Wheeling ("Wheeling"), a body politic and corporate of the State of Illinois, and the Village of
Buffalo Grove (`Buffalo Grove"), a body politic and corporate of the State of Illinois Wheeling and
Buffalo Grove are sometimes collectively referred to as the "Parties."
RECITALS
WHEREAS, Buffalo Creek, as known as the Wheeling Drainage Ditch, runs through Whee(ing and
Buffalo Grove from approximately the Buffalo Creek Reservoir to the Des Plaines River; and
WHEREAS, the objective of this study will be to find sustainable solutions to stormwater
management, flood control, streambank stabilization, water quality and any number of
stormwater related matters along the waterways; and
WHEREAS,the Parties, by this instrument, desire to memorialize their respective costs, obligations, and
responsibilities of the study.
NOW THEREFORE, in consideration of the promises, covenants, terms and conditions set forth in this
Agreement,the Parties hereto agree as follows:
SECTION 1. INCORPORATION OF RECITALS
The above recitals are incorporated into this Agreement as set forth herein.
SECTION 2. TERM AND TERMINATION
This Agreement shall not become effective unless authorized and executed by the Wheeling Village
President and the Buffalo Grove Vil(age President. This Agreement is a legal, valid and binding
agreement, enforceable against the Parties. This Agreement shall continue until it is terminated by
Agreement of the parties.
SECTION 3. VILLAGES' RESPONSIBILITIES
3.1 Project Study with Christopher B. Burke En ineering Ltd. (CBBEL Responsibilities of the
Parties. Throughout the project the Village of Wheeling and the Village of Buffalo Grove shall
have the following obligations:
a. The Village of Buffalo Grove will lead the procurement process. A scope of services will be
defined with associated costs being demonstrated toward the responsible Parties, serving as
budget numbers for each Party. These documents are attached as Attachments A and B
respectively. Attachment C demonstrates the extent ofthe study.
b. The Village of Buffalo Grove will award the CBBEL contract after the scope is agreed to by
both Parties.

c. The Village of Buffalo Grove will pay (CBBEL) according to the terms and conditions of
their contract. The Village of Buffalo Grove will then invoice the Village of Wheeling for
their share quarterly starting in 2024. Wheeling will make payment to Buffalo Grove within
ninety (90) days of receipt of the invoice.
d. The total costs for this work will be determined by hours billed by Christopher B. Burke
Engineering Ltd. Invoices, not to exceed the costs indicated within Exhibit B. The cost share
between the Vil(age of Wheeling and the Village of Buffalo Grove will be as indicated in
Exhibit B.
e. The Village of Buffalo Grove will update existing conditions with CBBEL in 2023 to match
the Village of Wheeling's previous efforts. Starting in 2024 both Parties will support the
design, review and collaborative processes of the study, which may or may not include Public
Meetings.
SECTION 4. GENERAL PROVISIONS
4.1 Governing Law and Venue. This Agreement shall be interpreted under, and governed by, the
laws of the State of Illinois, without regard to conflicts of laws principles. Any claim, suit,
action, or proceeding brought in connection with this Agreement shall be in the Circuit Court of
Cook County and each Party hereby irrevocably consents to the personal and subject matter
jurisdiction of such court and waives any claim that such court does not constitute a convenient
and appropriate venue for such claims, suits, actions, or proceedings.
4.2 Default. A Party shall be in default hereunder in the event of a material breach by such Party (the
"Defau(ting Party") of any term or condition of this Agreement including, but not limited to, a
representation or warranty, where the Defaulting Party has failed to cure such breach within thirty
(30) days after written notice of breach is given by another Party (the '`Non-Defaulting Party"),
setting forth the nature of such breach. Failure of a Non-Defaulting Party to give written notice
of breach to the Defaulting Party shall not be deemed to be a waiver of the right of such Non-
Defaulting Party to assert such breach at a later time. Upon defau(t the Non-Defaulting Party shall
be entitled to exercise all available remedies at law and in equity. The Non-Defaulting Party shall
be entitled to reasonable attorneys' fees and costs relating to litigation initiated by the Non-
Defaulting Pariy. In the event of a default by either of the Villages, the County shall be notified
in writing by the Non-Defaulting Party. If the County assumes the maintenance obligation of the
Defaulting Party for any period of time and incurs expenses in so doing, the County may charge
the Defaulting Party for any such reasonable expense.
43 Modification. This Agreement may not be altered, modified or amended except by a written
instrument signed by all Parties. Provided, however, the Parties agree that provisions required to
be inserted in this Agreement by laws, ordinances, rules, regulations or e�ecutive orders are
deemed inserted whether or not they appear in this Agreement and that in no event will the failure
to insert such provisions prevent the enforcement of this Agreement.
4.4 Force Majeure. Neither the County, nor Buffalo Grove, nor Wheeling, shall be liable for failing
to fulfill any obligation under this Agreement to the extent any such failure is caused by any
event beyond such Party's control and which event is not caused by such Party's fault or
negligence. Such events shall include but not be limited to acts of God, acts of war, fires,
lightning, floods, epidemics or riots.

4.5 Notices. Unless otherwise specified, any notice, demand or request required under this
Agreement must be given in writing at the addresses set forth below by any of the following
means: personal service, overnight courier or first-class mail.

4.6 Entire Agreement. This Agreement constitutes the entire agreement between Buffalo Grove and
Wheeling, and merges all discussion between them and supersedes and replaces any and every�
other prior or contemporaneous agreement, negotiation, understanding, commitment and
writing with respect to such subject matter hereof.
IN WITNESS WHEREOF, the Parties have caused this Agreement to be executed by their respective
officials on the dates as shown.

Subject: Proposal for Professional Engineering Services
Buffalo Creek Watershed Stormwater Management Plan
Dear Mr. Johnson:
Christopher B. Burke Engineering, Ltd. (CBBEL) is pleased to provide this proposal for
professional engineering services related to the preparation of a Stormwater Management
Plan for the Buffalo Creek Watershed within the Village of Buffalo Grove (Village). Included
in this proposat are our Understanding of the Assignment, Scope of Services, and Estimated
Fee.
UNDERSTANDING OF THE ASSIGNMENT
It is our understanding that the Village would like a detailed hydrologic and hydraulic study of
Buffalo Creek and Farrington Ditch. Both watercourses have mapped regulatory floodplain
and floodway. The limits of the study will be the Village of Buffalo Grove and the Village of
Wheeling, and it is our understanding that the two municipalities will be entering into an
Intergovernmental Agreement (IGA) regarding the study.
We understand that this study will be used to develop projects in partnership with the Village
of Wheeling, the Park District, the Buffalo Creek Watershed Group, and regulatory agencies
to alleviate flooding within the Village and downstream communities. This study will consist
of updating the latest hydrologic and hydraulic models for these watercourses with the Illinois
State Water Survey (ISWS) Bulletin 75 rainfall depths that were adopted in 2020 and
delineate a new floodplain for Buffalo Creek, Farrington Ditch, and White Pine Ditch within
the Village. CBBEL has previously studied Buffalo Creek through the Village of Wheeling,
and this previous work will be added to the current modeling to create a comprehensive set
of models through both municipalities. It should be noted that the previous study for the
Village of Wheeling utilized ISWS Bulletin 70 rainfall depths, and the current study will result
in higher peak flowrates and flood elevations through the Village of Wheeling with the updated
rainfa►I depth. It is not anticipated that the new flood elevations will be submitted to FEMA for
flood mapping.
Using the model results, CBBEL will work with the Village to determine comprehensive
projects that align with the Village's Infrastructure Modernization Program to alleviate
flooding, provide a water quality component, and focus on natural and resilient solutions. We
will review and incorporate information from available documents, including but not limited to
the Village's Stormwater Master Plan, Comprehensive Plan, and the Lake-Cook Corridor
Study. We understand that these projects may include realigning of the creeks in coordination
with Park District plans and public/private partnership opportunities related to future
development scenarios within the watershed. It is anticipated that the Village of Wheeling
will have projects to include as well, which may be more focused on water quality, natural
solutions, and streambank stabilization.
Concept level exhibits and cost estimates of the proposed improvements will be prepared,
and the qualitative benefits/quantitative costs of each alternative will be summarized in a
matrix that allows for easy comparison across a�ternatives. The alternatives will also be
evaluated for their grant funding opportunities. The resuits of the study will be summarized
in a digital report that includes narrative, exhibits, modeling and all calculations.
Based on this experience and discussions with Village staff, we are recommending the
following Scope of Services for the Buffalo Grove Watershed Stormwater Study.
SCOPE OF SERVICES
CBBEL has identified the tasks that will lead to a successful completion of the Buffalo Creek
Watershed Stormwater Management Plan:
Task 1 — Kickoff Meetinas: We will meet with the Village staff to memorialize the project
goals and schedule. We understand that importance of the schedule and will work to perform
the highest professional service while meeting the schedule set forth by the team. It is
important to the overall project to engage the various stakeholders at the onset. After our
initial meeting with the Village, we will meet with the Village of Wheeling, Buffalo Grove Park
District, LCDOT, CCDOTH, IDOT, LCSMC, MWRDGC, and the Buffalo Grove Watershed
Group(s).
Task 2 — Data Collection: We will collect, review, and analyze the following data for use in
the initial phases of the drainage analysis. A GIS database will be developed using the
spatially oriented data.
. Lake and Cook County 1-foot aerial topographic mapping and LIDAR data,
. Village GIS mapping and database information,
. Reported flooding problem areas, photographs, written accounts, etc.,
. All available GIS including utilities, land use, zoning, soils, etc.,
. Historic rainfall data from Lake and Cook County and the Village that resulted in
flooding will be reviewed and analyzed,
. Relevant County, FEMA and IDNR-OWR data for the Village,
. Coordination with local public utilities to obtain copies of their respective utility atlases,

. MWRDGC hydrologic and hydraulic modeling for the Buffalo Creek Reservoir
Expansion,
. Roadway plans for upcoming and past roadway projects, including but not limited to
Aptakisic Road,
. Village and Park District Comprehensive Plans and other relevant planning
documents,
. Village stormwater master plan and associated hydrologic and hydraulic modeling,
. Previously prepared Watershed studies, inciuding the FIS, MWRDGC, and CBBEL
studies for Buffalo Creek, and
. Additional information provided by the Village of Wheeling.
Task 3 — Field Reconnaissance: We will perform a field reconnaissance with Village staff to
visit the areas of known flooding as well as areas where potential projects may be proposed
including the golf course, Public Works facility, Park District property and various roadway
crossings.
Task 4 — Topoqraphic Survey: We will identify the survey needs to supplement the data
collected in Tasks 2 and 3. The survey will focus on critical flood areas, Farrington Ditch,
additional creek cross-sections, and hydraulic structures that have been modified since the
hydraulic analyses prepared for the Buffalo Creek Reservoir Expansion and the CBBEL
LOMR that was prepared for the Village of Wheeling. Under this task we have allowed for 5
days of field survey and the corresponding office work.
Task 5—Existinq Conditions Hydroloqic and Hvdraulic Modeling: The most recent HEC-
HMS hydrologic modeling for the Buffalo Creek Watershed that was used for the Buffalo
Creek Reservoir Expansion and the LOMR for Buffalo Creek through Wheeling will be
updated using the Illinois State Water Survey (ISWS) Bulletin 75 rainfall depths and
distributions. Additionally, the tributary area to Farrington Ditch will be modeled explicitly.
The HEC-HMS model will be used to determine the 10-, 50-, 100-, and 500-year peak flow
rates to be input into the HEC-RAS hydraulic model.
We will compile all previous hydraulic modeling and topographic survey data to develop a
comprehensive and up-to-date unsteady HEC-RAS hydraulic model of the watershed,
including Buffalo Creek and Farrington Ditch, within the Villages of Wheeling and Buffalo
Grove. Using County 1-foot aerial topography and the computed flood elevations from the
model, we will determine the limits of and delineate the existing floodplain by elevation along
both watercourses through both municipalities. Using this information and any reported
flooding problems collected in Task 2, we will identify vulnerable structures (residential,
commercial, etc.) and roadways to target for flood protection. These areas will be targeted
for improvements that will be analyzed in Task 6. As part of this task, we wil� also identify
public/private partnership opportunities for flood prone areas as determined by the revised
analyses based on likely future development or redevelopments in the area.

Task 6 — Proposed Conditions Hvdroloqic and Hydraulic Modelinq: CBBEL will work
with the Village and all stakeholders to develop proposed drainage improvements to reduce
the risk of future flooding and improve water quality where possible. This will include all
identified drainage problem locations identified in Tasks 2 and 5. A range of projects will be
investigated for the drainage problems to determine what would be necessary to provide the
100-year level of protection and provide water quality and other benefits. This could include
new storm sewers, stormwater storage basins, overland flow path revisions, green
infrastructure, rerouting of creeks, and other drainage improvements that will require multiple
iterations. We will identify and combine alternatives as necessary to pair projects, specifically
flood storage and conveyance improvements. We will work closely with the Village to
determine unique solutions to problem areas that may require more than one iteration (e.g.
the relocation of Farrington Ditch). All alternatives will be designed such that there are no
adverse impacts downstream. Joint projects with other jurisdictions (Village of Wheeling,
LCSMC, LCDOT, IDOT, MWRDGC, CCDOTH, etc.) and proposed private development
projects in the watershed will be investigated for potential cost-sharing and grant
opportunities.
Considering the possible number of projects, we estimate that the total number of alternatives
to be investigated would be approximately 12-15. If more alternatives are investigated, we
will work with the Village to determine if a budget supplement is required.
Task 7 — Concept Plan Development and Prioritization Matrix: A concept level GIS
exhibit will be prepared for each alternative. The cost estimates will be broken down into unit
costs and quantities for different pay items. The unit costs will be based on recent bid
openings where possible. The engineer's estimate of probable cost will include design
engineering, permitting and construction engineering costs. Calculation of the costs relies on
years of experience in cost estimating projects of this nature and anticipating cost such as
sanitary sewer and water service replacement. Upon meeting with Village staff, the estimates
will be updated based on comments received. A prioritization matrix with separate sections
for each drainage problem area and associated projects with exhibits, costs, number of
structures benefited, and other benefits (water quality, transportation, etc.) will be prepared.
This matrix will allow for easy comparison of projects across the Village as funding becomes
available. We will work on a ranking system with the Village based on the criteria in the
matrix.
Task 8 — Stakeholder Meetinqs and Coordination with Outside Aqencies: Throughout
the study, we will meet with various stakeholders and outside agencies to present the updated
floodplain exhibits, including flood problems reported to the Village. As part of this
coordination effort, we will also meet with regulatory agencies that may require permitting for
all projects including those that are aligned with the stakeholders' future plans within the
watershed. These projects may include but are not limited to Park District improvements
within the Buffalo Grove Golf Course, private developments, CCDOTH, LCDOT, and IDOT
roadway improvements, and streambank stabilization projects identified by the Buffalo Creek
Watershed Group(s).
Task 9 — Fundinq of Capital Proiects: As projects are developed, we will outline available
funding opportunities for the identified conceptual plans. These opportunities could include

State, FEMA, LCSMC, MWRDGC, LCDOT, CCDOTH, IDOT, for both locai and regional
projects. We will provide support on grant funding applications. It should be noted that some
grant applications are extremely lengthy(i.e. FEMA grants) and may require a separate scope
of services.
Task 10 — Review of Concept Plans for Potential Developments: During the course of
the project, it is anticipated that various developments will be proposed within the Village of
Buffalo Grove. We will review the concept plans to determine their compatibility with the
watershed study, the impact that each will have on the watershed, and potential modifications
to the development plans that could be incorporated into the watershed improvement
alternatives.
Task 11 — Summary Report: We will summarize the Buffalo Creek Watershed Stormwater
Plan in a written report. The report will include the following:
. plan purpose,
. past flooding events within the Villages and floodplain maps,
. comprehensive summary of updated floodplain mapping and all flooding reports
from residents and Village staff,
. existing drainage problem areas and evaluation standards,
. summary of drainage projects, including a list of potential project partners,
summary of benefits, costs and prioritization matrix,
. identify any available sources for grant and/or matching funding to design and
construct the proposed prioritized projects,
• coordination with all applicable outside agencies (FEMA, IDNR-OWR, USACOE,
LCSMC, MWRDGC, etc.) to determine all required permits and approvals for the
identified prioritized projects,
. determination of public outreach activities that could be undertaken to increase
awareness and prevention of flooding and flood damages,
Task 12—Presentation to Villaqe Staff: Upon completion of Tasks 1-11, CBBEL will present
the Draft Stormwater Study to the Village staff. This will include two separate meetings, and it
is assumed that the Village of Wheeling will be present at both meetings. The second meeting
will incorporate comments from the first meeting and the preliminary designs, cost estimates,
and PowerPoint will be updated accordingly prior to presenting to the stakeholders and general
public.
FEE ESTIMATE
Please refer to attached spreadsheet for fee estimate.
We will bill you at the hourly rates specified on the attached Schedule of Charges and
establish our contract in accordance with the attached General Terms and Conditions. Direct

costs for blueprints, photocopying, mailing, mileage, overnight delivery, permit fees, data
collection fees, messenger services and report compilation are included in the fee estimate.
These General Terms and Conditions are expressly incorporated into and are an integral part
of this contract for professional services. It should be emphasized that any requested
meetings or additional services are not inciuded in the preceding fee estimate and will be
billed at the attached hourly rates.
