N= 38 AN ORDINANCE AMENDING A SPECIAL USE AND APPidO,, ,im A PRELIMINARY PLAN IN THE R-1 ONE-FAMILY DWELLING DISTRICT, VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILL INOiS Kin swood United Methodist Church 401 W. Dundee Road _.� �.. ' WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the hereinafter legally described real property is zoned in the R-1 One- Family Dwelling District with a Special Use for a church facility; and, WHEREAS, Kingswood United Methodist Church has petitioned for an amendment of the Special Use and approval of a Preliminary Plan to expand the existing church facility, to construct a new parking area and to add two driveways for access to Park View Terrace pursuant to the following exhibits: EXHIBIT A Preliminary Plan ("proposed site plan") dated as last revised March 28, 1995 by David F. Schultz Associates, Ltd. EXHIBIT B Preliminary Engineering Plan, dated as last revised March 29, 1995 by Scott R. Triphahn, P.E. EXHIBIT C Landscape Plan dated as last revised March 28, 1995 by David F. Schultz Associates, Ltd. EXHIBIT D Lighting Plan dated as last revised March 20, 1995 by David F. Schultz Associates, Ltd. WHEREAS, a notice of public hearing concerning the Special Use amendment and Preliminary Plan and variation of the Development Ordinance was published and the hearing was held by the Buffalo Grove Plan Commission; and WHEREAS, the Plan Commission determined that the criteria for a Special Use as set forth in Section 17.48.040 of the Village's Zoning Ordinance have been met and 1 adequate infer{-na1ion concerning the variation of the Development Ordinance was presented by the petitioner; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Sect This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Special Use amendment and Preliminary Plan for the expansion of the Kingswood United Methodist Church facility pursuant to EXHIBITS A, B, C and D with a variation of Sections 16.50.070.D.2. and 16.50.080.A.1. of the Development Ordinance to waive the requirement for right-of-way dedication and construction of a sidewalk along the north side of Park View Terrace for the following legally described property: Parcel 1: The West 85 feet of the East 840 feet of the North 653.45 feet of the East half of the Northeast Quarter of Section 8, Township 423 North, Range 11 East of the Third Principal Meridian; also Parcel 2: The West 250 feet of the East 755 feet of the North 653.45 feet of the East half of the North East Quarter of Section 8, Township 42 North, Range 11, East of the Third Principal Meridian; also Parcel 3: The West 65 feet of the East 505 feet of the North 653.45 feet of the East half of the North East Quarter of Section 8, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. Section 3. Said approval by the Corporate Authorities is subject to: a. Revision of the Landscape Plan as required by the Village to ensure adequate line-of-sight at driveway entrances to the Property; 2 b. Revision of the Preliminary Engineering Plan es Village Engineer to ensure proper placement of c �.4tch ba,,iinF. ri.::zE! curbing and proper storage of storrnwater; C. Signs shall be installed as approved by the Village to restrict ffi - r:pitii: driveway to Park View Terrace for ingress-only to the Property and to restrict the west driveway to Park View Terrace to egress-only from the Property. The petitioner shall monitor the efticicacy of said sicns in regulating traffic flow in and out of the Property and inform -tree Village if any traffic congestion or hazards occur on the Properill or on Park View Terrace. The Village reserves the right to require modification of said signs if necessary to mitigate traffic congestion or hazards. d. Phase 2 improvements, including the proposed driveway connection to Dundee Road, depicted on EXHIBITS A, B, C and D are not approved by this Ordinance and are subject to future review and approval by the Village. Section 4. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified. AYES: 5 - Marienthal Ru in.
