AN ORDINANCE AMENDING ORDINANCES NUMBERED 68-42 AND 70-2 AS AMENDED WHEREAS, pursuant to Notice as required by law, the Plan Commission of the Village of Buffalo Grove, Cook and Lake Counties, Illinois held public hearings and did consider the application of RICHARD J. BROWN, INC. , a corporation, for approval of an Amendment to its planned development on the property hereinafter described, being t Lots 1, 2 and 3 in Cambridge Countryside Unit 8, being a Subdivision in the North half of Section 9, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois ; and WHEREAS the Plan Commission recommended approval of the proposed Amendment, and WHER EAS the President and the Board of Trustees of the , Village of Buffalo Grove have publicly considered the Amendment and the recommendations of the Plan Commission, and have determined that the Amendment is in the best interest of the Village in that, among other things, the density in the area is reduced substantially and one of the seven buildings permitted under the original plan is omitted; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES , ILLINOIS, AS FOLLOWS : SECTION 1. The Planned Development as set forth in Said Exhibit eliminates one of the original seven build- ings, relocates a building, changes the structure and reduces density. (b) The owner, RICHARD J. BROWN, INC. , Developer, successor and assigns shall develop in conformity with said Exhibit "AA-2" (c) Annexation Agreement dated October 7, 1965 (approved by Ordinance No. 65-17) has by its terms expired. Notwith- standing any of the provisions of said Agreement and Ordinances numbered 68-42 and 70-2, it is a condition of passage and approval of this Ordinance that RICHARD J. BROWN, INC. , owner, every successor owner and assigns and successor developer shall be subject to and comply with all current and future applicable Ordinances of the Village of Buffalo Grove, and that any payments due or to become due the Village pursuant to the aforesaid Annex- ation Agreement, any Amendments thereto and Ordinances numbered 68-42 and 70-2 shall be paid in accordance with said Agreement and Ordinances. (d) It is further a condition of the passage and approval of this Ordinance that no building permit shall issue until all units in the total development currently occupied under a temporary occupancy certificate shall have building code violations corrected.
