ORDINANCE 2020- 013 AN ORDINANCE AUTHORIZING A SUPPLEMENT FOR DESIGN ENGINEERING SERVICES WITH CIORBA GROUP INC. WHEREAS,the Village of Buffalo is a home rule unit pursuant to the Illinois Constitution of 1970; and WHEREAS,the Village seeks to enter into a Supplement for Design Engineering Services Agreement with Ciorba Group, Inc. for Design of the Chatham Lift Station Reconstruction, NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE,COOK AND LAKE COUNTIES, ILLINOIS, as follows: SECTION 1. The foregoing recitals are hereby adopted and incorporated and made a part of this Ordinance as if fully set forth herein. SECTION 2. The Village Manager is authorized to enter into a Supplement for Design Engineering Services Agreement with Ciorba Group, Inc. for Design of the Chatham Lift Station Reconstruction at a price not to exceed $7,917.00. SECTION 3. If any section,paragraph,clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this Ordinance. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval and shall not be codified. AYES: 6 - Stein Ottenheimer,Weidenfeld Johnson Smith Pike NAYES: 0—None ABSENT: 0—None PASSED: February 18, 2020 APPROVED: February 18 2020 Beve Sussman, Village President ATTEST: Janet M. , biun, Village Clerk Supplemental Agreement for Engineering Services Village of Buffalo Grove Chatham Lift Station Reconstruction Design Engineering Services This is a SUPPLEMENTAL AGREEMENT between the Villa e of Buffalo Grove (hereinafter referred to as the VILLAGE, and CIORBA GROUP, INC located at 8725 W Higgins Road, Suite 600 in Chicago, Illinois, a firm of Consultants (hereinafter referred to as "CIORBA"). The VILLAGE and CIORBA previously entered into an AGREEMENT (hereinafter referred to as the PRIME AGREEMENT), dated March 19 , 2019, in which CIORBA agreed to provide certain professional engineering services for the Chatham Lift Station Reconstruction Project (hereinafter referred to as the PROJECT). The VILLAGE now proposes that CIORBA provides additional design engineering services in connection with the PROJECT. The VILLAGE has determined that this change is in the best interest of the VILLAGE and is authorized by law. NOW THEREFORE, the VILLAGE and CIORBA, in consideration of the mutual covenants hereinafter set forth, agree to as follows: SECTION ONE - GENERAL PROVISIONS All work completed under this SUPPLEMENTAL AGREEMENT and any remaining work under the PRIME AGREEMENT shall be bound by the provisions of the PRIME AGREEMENT except as amended hereinafter. SECTION TWO- SCOPE OF WORK CIORBA agrees to perform the following additional work: Perform a wet weather analysis of the lift station performance as it relates to existing station capacity and allowable capacity allowed by MWRD; Summarize analysis in letter report to the Village including recommendations; Coordinate lift station capacity pre-approval request from MWRD. Review the operating conditions of the Cambridge Court lift station as it relates to the new force main construction being installed in the Village's 2019 capital improvements program. Review the lift station assessment prepared for the Village by another consultant and provide feedback on the accuracy and implications of the assessment report findings; Provide input on basin characteristics for the Cambridge Court and Cambridge on the Lake Lift Stations. SECTION THREE - PROJECT SCHEDULE There is no change in the Project Schedule due to the additional work described in this SUPPLEMENTAL AGREEMENT.
