Chairman Smith called the hearing to order at 7:30 pm in the Village Council Chambers, Buffalo
Grove Municipal Building, 50 Raupp Boulevard, Buffalo Grove, Illinois. Chairman Smith read
the Notice of Public Hearing as published in the Buffalo Grove Daily Herald, explained the
procedure to be followed for the public hearing, and swore in all persons who wished to give
testimony.

Ms. Nassir stated she is here asking for a special use to operate a home child day care at her
home. She has been a day care teacher since 2000 for KinderKare. She stated she has a
passion for educating young children and helping them grow and she has the proper training
and education to qualify and succeed as a home day care teacher and providing a service to
better the community.
Ms. Nassir stated she will have only 3 to 5 children and at this time she does not foresee
requiring additional help nor does she see any detrimental impact to the neighborhood. The
children will be inside the home except for those times, weather permitting, they go out into her
backyard for play time or to the neighboring park. She also noted she does not believe her
home day care business will negatively affect the use or enjoyment or the valuation of other
properties in her neighborhood.
Ms. Nassir stated she anticipates children being dropped off weekdays between the hours of 6-8
am and there is ample parking space in the driveway which will result in very little traffic
congestion and will be a safe means for the children to enter the home. Children will go outside
for playtime during the hours of 10-11 am and again from 3-4 pm and she noted there will be no
undue noise or nuisance created to adjacent properties.
Ms. Nassir stated the Village has already approved the fencing around the backyard as well as
performed and approved a field inspect report inside her home. The Buffalo Grove Fire
Department has also inspected the home and reported no violations.
Ms. Nassir stated she has one cat in her home that has been licensed with the Village and she
has completed all of the necessary paperwork for her DCFS license and is awaiting their
response within the next 1-2 months.
Commissioner Weinstein reviewed the special use criteria with the petitioner. He asked if the
petitioner feels the use of the child day care at this residence will serve the public convenience
in some way.
Ms. Nassir stated she hopes this would make things somewhat easier for some of the people in
the community.
Commissioner Weinstein asked if there is any reason to believe that this activity would in any
way be harmful to the neighbors or anyone around the residence.
The petitioner stated she did not believe it would be harmful.
Commissioner Weinstein asked if there were any concerns that the size of the house was in any
way inappropriate to house 3-5 children.
Ms. Nassir stated she could have more children but is looking only to have 3-5.
Commissioner Weinstein asked how many cars are currently in the house and if they are
typically parked inside the garage.
Ms. Nassir stated there are 2 cars parked in the garage and 4 additional cars could be parked in
the driveway if necessary.
Commissioner Weinstein asked when people would be picking children up from the home.
Ms. Nassir stated no later than 6 pm.
Commissioner Goldspiel asked what the square footage of the house is.
Ms. Nassir stated it is around 2,100 square feet.
Commissioner Goldspiel asked how many bathrooms are in the house.
Ms. Nassir stated there are 2.
There being no further comments or questions from anyone else present, Chairman Smith
closed the public hearing at 7:45 pm.

Special Use For a recreation facility in the Industrial District
Chairman Smith called the hearing to order at 7:55 pm in the Village Council Chamber, Buffalo
Grove Municipal Building, 50 Raupp Boulevard, Buffalo Grove, Illinois. The Notice of Public
Hearing had already been read at the first public hearing and he swore in all persons who

Ms. Kogan stated this facility at 1553 Barclay Boulevard is 2,100 square feet and the school
teaches both children and adults the art of self-defense and judo. She stated her husband is a
grand master, tenth degree black belt and he has a couple of volunteers to help him out.
Mr. Kogan stated he has people who work with him and help him who are world champs in judo
and kung fu. His goal is to teach kids what to do properly. Last year they won 16 medals from
the U.S. Open to world champs in different arts. He has been in this country for 24 years and
he has been teaching martial arts his whole life.
Mr. Kogan stated during the day they have about 10 open parking spaces and they probably
have about 2-3 cars arrive in the place. In the evening they do not have more than 10 cars in
front and does not think he will interrupt his neighbors. He stated he trains not only civilians but
military and police. He stated they have a very professional business and he would like to bring
more business and service to Buffalo Grove.
Commissioner Goldspiel asked what is the peak number of students that would be in the facility.
Mr. Kogan stated a typical class usually has between 10-12 people. He also does do some
private lessons on the side which would only have 1-2 people.
Commissioner Goldspiel stated he is trying to find out what the maximum number of students
would be in the building at one time.
Mr. Kogan stated 12.
Commissioner Goldspiel noted a large number of hours had been listed with only one person
there.
Mr. Kogan stated that is what he has been doing his whole life.
Ms. Kogan noted if it is an evening class he has volunteer instructors who are with him. Evening
classes are over about 9:00 pm.
Commissioner Goldspiel asked what the maximum number of people in the facility would be, not
counting these extra volunteers.
Ms. Kogan noted it might be Mr. Kogan and either 1 or 2 instructors.
Commissioner Goldspiel noted that therefore it might be a total of 3 staff people and 12
students. He asked if they were currently operating in this location.
Mr. Kogan stated yes.
Commissioner Stark asked since they have already been operating was that without Village
consent.
Mr. Pfeil stated no. He noted there was some misunderstanding about getting the special use. In
December Mr. Kogan was in a situation where the lease where he had been operating at a
different location was up and he needed to stay in business, so the Village Manager requested
that the Village Board allow staff to issue a temporary permit to allow the business to open,
subject to successful completion of the special use process.
Commissioner Stark asked if the numbers of 1 to 3 staff and 10 to 12 people per class has been
pretty consistent.
Mr. Kogan stated yes.
Commissioner Goldspiel asked if there have been any problems with this operation.
Mr. Pfeil stated that Mr. Sheehan, the Village Building Commissioner, is monitoring the situation
and he has not had issues with the use as being operated.
Commissioner Weinstein reviewed the special use criteria. He asked if this use at this particular
location will serve the public convenience.
Mr. Kogan stated yes.
Commissioner Weinstein asked if there is any reason to believe that operating there will be
detrimental or endanger anyone in any way.
Mr. Kogan stated no.
Commissioner Weinstein asked if the size of the facility is adequate for the intended use.
Ms. Kogan stated yes.
Commissioner Weinstein asked if this use will cause any issues with neighboring buildings or
properties or tenants.
Ms. Kogan stated no.
Commissioner Weinstein asked if there is sufficient parking at the building.
Ms. Kogan stated yes.
Commissioner Goldspiel asked how well the parking area is lit at night.
Mr. Kogan noted there is more than enough lights and at night there is a lot of light.
Ms. Kogan stated their parking area is fully lit as well as lots of light from the gym.
Commissioner Goldspiel asked when the maximum number of students would be at the facility.
In other words what hours would have the most parking?
Ms. Kogan stated Saturday morning up to 11:00 am when parents are waiting for the kids.
Evenings are heaviest on Friday from 6-9 pm.
Commissioner Goldspiel asked if they have more people in the evening or morning.
Mr. Kogan stated evenings.
Ms. Kogan stated on the weekends it is mornings and weekdays it is evenings.

APPROVAL OF MINUTES
Moved by Commissioner Weinstein, seconded by Commissioner Johnson to approve the
minutes of the public hearing of December 18, 2013. All Commissioners were in favor of the
motion and the motion passed unanimously.

of the regular meeting of December 18, 2013. All Commissioners were in favor of the motion

COMMITTEE AND LIAISON REPORTS
Commissioner Cohn stated he did not actually attend the meeting on January 6, 2014 but does
know what was discussed. The medical marijuana issue did pass and his objection was noted
by one of the council members.

Moved by Commissioner Weinstein, seconded by Commissioner Cohn to recommend approval
to the Village Board of the petition of a special use to operate a child day care home at 1211
Lockwood Drive, a single-family Dwelling District, subject to:
1. Receiving Illinois DCFS license
Chairman Smith called for a vote on the motion and the vote was as follows:

SPETSNAZ MARTIAL ARTS, 1553 BARCLAY BOULEVARD - SPECIAL USE FOR A
RECREATION FACILITY IN THE INDUSTRIAL DISTRICT
Moved by Commissioner Weinstein, seconded by Commissioner Cohn to recommend approval
to the Village board of the petition for a special use for a recreation facility in the Industrial
District to operate a martial arts training facility in the space at 1553 Barclay Boulevard.
Commissioner Goldspiel stated he was originally concerned about the number of students for
this facility but it appears those issues have been adequately explained by the petitioner's
testimony.
Commissioner Cohn stated he will be voting yes but he would like to reiterate a comment he has
made. He believes the Industrial District is largely recreational now and he feels we need to
look at the entire Industrial District and all the recreational uses and decide if this is truly meeting
the objectives of the Industrial District or should we be doing something more fundamental. On
top of that since we have identified the Industrial District as the place for a special use for
potential medical marijuana facilities and how that might fit. There are some fundamental
planning and zoning questions related to the Industrial District that should be looked at.
Chairman Smith called for a vote on the motion and the vote was as follows:

Mr. Pfeil commented in response to Commissioner Cohn's concerns with recreation uses in the
Industrial District that the Commission should review the issues and evaluate the impact of
these types of uses. He said the number of special uses for recreation doesn't seem to be that
large, but he will prepare a list and map of the currently approved facilities.
Mr. Pfeil noted that he and Mr. Sheehan, Village Building Commissioner, have been considering
whether some of the smaller facilities should require a special use. Administrative approval may
be acceptable if the proposed use is limited in impact and size. Perhaps there's a threshold
concerning the size of a facility- if it would occupy a small tenant space, it may not be necessary
to conduct a public hearing for a special use.
Commissioner Goldspiel noted that since approval of the buildings in the Industrial District years
ago there has been a big change in the way industrial buildings are used. One of the problems
that makes it difficult for these buildings to find tenants is that now the market and user needs
are calling for large bulk storage and less individual small units. He wonders if there is really a
re-development issue. He suggested that if we are going to open up the issue of special uses in
the industrial zone we ought to think about re-development as well as changing the zoning
criteria.
Commissioner Johnson asked where recreation businesses normally locate in the Village.
Mr. Pfeil said various recreation uses are allowed as are permitted uses in business districts, so
location within strip shopping centers is common.
Commissioner Johnson noted that the Industrial District this is actually a better place for these
uses as far as sales tax revenue since they aren't occupying spaces in a business district that
could be used by retail tenants. She said it allowing smaller facilities in the Industrial District may
encourage re-development.
Mr. Pfeil noted that from a business operator's point of view, space in an industrial building is
relatively less expensive that a retail location, and the parking is usually adequate. In some of
the shopping center locations parking may be more limited and the rent more expensive.

Moved by Commissioner Cohn, seconded by Commissioner Johnson and carried unanimously
to adjourn. Chairman Smith adjourned the meeting at 8:10 pm.
