Ordinance No. 2000- An Ordinance Concerning Prevailing Wages for all
Village Public Works Projects Undertaken Within the Corporate Limits(Trustee

RECOMMENDATION: Approve by motion.
SUMMARY: This`Ordinance-deals*with the payment of prevailing,wages for all
Village Public Works projects undertaken within the Village limits for the period
June 1, 2000 through May 31, 2001. The Ordinance is required annually and when
adopted, must be filed with both the Secretary of State and Illinois Department of
Labor.

Ordinance No. 2000- An Ordinance Amending and-Clarifying Chapter 14.40: '
Signs (Trustee Braiman)
RECOMMENDATION: Approve by motion.
SUMMARY: Section 14.40.070 Public Areas of the Village of Buffalo Grove
Municipal Code requires clarification of the requirements for certain signs to be
placed in public areas.

Approval of Church Road Sidewalk Easement Agreement (Trustee Hendricks)
RECOMMENDATION:Approve by motion.
SUMMARY: Easement Agreement provided by St. Marys which will elnr the
sidewalk to be relocated into an easement which will further alow the roadway
geometrics to be improved at Church Road and Buffalo Grove Rai.

The Workforce Development Council in conjunction with donations from local businesses have
created a scholarship program to provide financial assistance to students attending college.
Scholarships were made possible this year by contributions from the following corporations:
American Enterprise Bank, CDW Computer Centers, CrossCom National,Inc,International Profit
Associates,Inc,First Midwest Bank, and LaSalle Bank.
Four students were chosen from a competitive field of applicants to receive a $1000 scholarship
award.All four winners demonstrated a high level of commitment to education, service to the
community, and all possessed commendable work ethics.
The following individuals are the winners of the 7th Annual Workforce Development Council
Scholarships.
Grace Song- Grace is a junior at the University of Illinois at Champaign-Urbana majoring in
political science.Her intention upon completion of her undergraduate degree will be to attend law
school. Grace has volunteered much of her time at the university to community service projects and
yet still is able to maintain an exemplary grade point average.
Susanna Song - Susanna will be attending Northwestern University this fall majoring in
communications. Not only did Susanna rank in the top fifth percentile of her graduating class at
Stevenson High School she also managed to participate in no less than twelve cocurricular
programs including the National Honor Society and Student Council.
Seth Kidder - Seth will be attending the University of Illinois at Champaign-Urbana this fall with an
intended major in biomedical engineering.While at Stevenson High School Seth maintained an
excellent grade point average.During his tenure at the high school Seth was involved in numerous
school and community activities.
Amina Mukati -Amina will be attending DePaul University this fall with an intended major in
computer science.Amina excelled in her academic programs while at the Buffalo Grove High
School. She has been involved with several cocurricular programs and demonstrated high levels of
responsibility and dedication at her place of employment.

Staff will update the May 1, 2000 presentation to the President and Board of Trustees on the facilities
planning efforts for the Arboretum Golf Course club house and maintenance facility.
On May 1, 2000, staff
presented a revised
concept plan for the
Arboretum that considered
a single-story club house,
maintenance building (as
currently proposed and
reviewed by the Plan
Commission) , allowance for
kitchen equipment and
furnishings, direct site
improvements and project
soft costs. The club
house was designed to
accommodate dining/banquet
service seating 150, with
overall square footage of
approximately 17,724.
While only a
"guesstimate", MTI revised
the project budget to
$4.83 million.
Construction values for
the club house and
maintenance building,
including a 100
contingency, total $3. 988
million.
As that concept plan was
presented, the Village
Board suggested space
refinements, which
included for most part,
opportunities to increase
seating within the
dining/banquet area to, at
minimum, 180 seats.
Comments further suggested
increased space in the
Conference with decreased
space within the
Administrative areas.
Quality was to be
maintained in order to
offer a premiere golf
facility and well as
provide a community
amenity for golfers and
non-golfers alike. One
overriding concern is that
any and all efforts need
to be balanced with the
primary need of having the
enterprise provide a
maximum level of revenue
to service any and all
debt issued for this
project. That in fact may
only be known as "final"
costs are known and
realistic revenue/expense
pro-forma statements are
developed and understood.
To that end, Sente & Rubel
has prepared an updated
concept design for the
club house. It appears
that all of the comments
raised by staff and
Village Board have been
incorporated into the
design alternative. While
some subtle changes are
included, most
significantly, the
dining/banquet area has
been expanded to provide
seating up to 190, the
patio area has been
designed to accommodate
overhead screening and
facility support areas
have become more defined
with better allocation of
space. Also, the site
plan has been updated to
further define the
location of the club house
in relation to the
residential dwellings that
abut the course as well as
to the first tee and ninth
green. One modification
suggested by staff has
been to the area around
the cart storage wing that
permits a flow-thru for
more efficient use of
storage through multiple
doors rather than one as
originally submitted.
Additional financial
commitment is required
when compared to May 1st
project values. This plan
is approximately 3,470
square feet larger in
order to accommodate the
dining suggestions as well
as internal space
refinement. Additional
costs are necessary to
screen the patio as well
as site work. Planning
efforts still consider a
minimal commitment of $1.5
million of internal
financing with the
remainder obtained in the
public debt market. If
the project was "rounded"
to offer a slight amount
of funds to be applied to
issues of course
softening, a bond issue of
$4 million will be
required. Structuring of
the issue and debt service
requirements would
"back-load" the repayment
schedule to begin after
2007 as original
development debt is
retired and to permit play
levels to be increased
through coordinated
marketing efforts,
generating debt service
revenue in lieu of
property taxes, the final
security for this debt.
As with past presentations
on this matter, further
discussion of project
feasibility remains
necessary. Incrementally,
the changes presented have
increased the project
estimate by $607,518,
which was based on seating
for 150. On a per seat
basis, that is equal to
$15, 187. 95; per square
foot measure, the
incremental change is
equal to $175.

The Chabad Community Center requests an amendment to the annexation agreement for this
property. The annexation agreement was originally approved in 1991 for the New Life
Evangelical Lutheran Church.
The Chabad proposes to construct a synagogue and pre-school on the property.
The Plan Commission held a public hearing on May 17 and voted 7 to 0 to recommend approval
of the amendment to Preliminary Plan and special use.
The draft annexation agreement is attached.

AMENDMENT TO THE ANNEXATION AGREEMENT
FOR THE CHABAD COMMUNITY CENTER, INC.
(Original Agreement known as New Life Evangelical Lutheran Church)

Northeast corner of Buffalo Grove Road/Deerfield Parkway
This agreement made and entered into this 17th day of July, 2000, by and between the
VILLAGE OF BUFFALO GROVE (hereinafter referred to as "Village") by and through the
President and Board of Trustees of the Village(hereinafter collectively referred to as the "Corporate
Authorities") and Chabad Community Center, Inc. (hereinafter referred to as "Owner").
WITNESSETH:
WHEREAS, the Village passed Ordinance 91-29 approving an annexation agreement dated
March 4, 1991 for the Property as legally described in EXHIBIT A attached hereto; and,
WHEREAS, the Property is zoned in the R-3 One-Family Dwelling District with a Special
Use for a church and parsonage; and,
WHEREAS, the New Life Evangelical Lutheran Church has abandoned its plan to construct
said church and parsonage and has sold the Property to the Chabad Community Center, Inc.
("Owner"); and,
WHEREAS, the Owner has petitioned to the Village to amend the Annexation Agreement
and Preliminary Plan to allow a special use for construction of a synagogue and pre-school pursuant
to the following EXHIBITS:

WHEREAS, the Plan Commission held a public hearing and determined that the criteria for
an amended Special Use have been met, and that amendment of the Preliminary Plan for
development of the Property as proposed would be compatible with adjacent properties; and,
WHEREAS, the President and Board of Trustees after due and careful consideration have
concluded that the development of the Property on the terms and conditions herein set forth would
enable the Village to control development of the area and would serve the best interests of the
Village.
NOW, THEREFORE, in consideration of the premises, mutual covenants and agreements
herein set forth, the parties hereto agree as follows:
I. That the preceding Whereas clauses are incorporated herein.
2. That certain New Life Evangelical Lutheran Church Annexation Agreement dated
March 4, 1991 approved by Ordinance 91-29, be and is hereby amended to allow
development of the property for the Chabad synagogue and pre-school pursuant to
Exhibits A through H attached hereto.
3. Owner shall reimburse the Village for the cost of construction of the public sidewalk
adjacent to the Property. Said cost shall be determined by the Village Engineer, and
said reimbursement shall be made prior to issuance of a building permit for any
building on the Property.
4. Owner shall verify that the location of the access to Buffalo Grove Road as depicted
on EXIBITS B and C attached hereto has been approved by the Lake County
Department of Transportation. In the event that the County requires revisions to said

exhibits, said revisions are subject to approval by the Village.
5. The provisions and requirements of the annexation agreement dated March 4, 1991
remain in full force and effect on the Property unless specifically modified by this
amended Agreement.
IN WITNESS WHEREOF, the Corporate Authorities and Owner have
caused this instrument to be executed by their respective proper officials duly authorized to execute
the same on the day and the year first above written.

Commissioner Dunn attended the Village Board meeting on May 15, 2000 and stated
there was a resolution commending Stephen Goldspiel on his service to the Commission.
In addition, the following items were discussed:
1. Update on the redevelopment of the Plaza Verde Shopping Center. The center is
43 percent leased and Walgreens will begin construction within one month. At
Plaza Verde West, 54 percent is leased.
2. Buffalo Grove Town Center has a new owner and is 80 percent leased and the
owner is local.
3. Discussion of a proposal for a CVS drive through pharmacy at the corner of
Dundee and Buffalo Grove Roads. The petitioner decided to come back at a
future date.

AND CONCEPTUAL LANDSCAPE PLAN
Moved by Commissioner Samuels, seconded by Commissioner Johnson to recommend
approval to the Village Board of the petition for a Preliminary Plan and Special Use for a
synagogue and pre-school in the R-3 District so that the petitioner may construct a one-
story building with a floor area of 24,800 square feet, pursuant to testimony at the public
hearing and documents submitted in support thereof and subject to:
1. Final engineering
2. Approval of parking lot lighting
3. Final approval of landscaping and Village Forester's review
4. Approval of Lake County Department of Transportation
Commissioner Trilling stated he gives his support to this project as it is consistent with
the special use criteria and it is a welcome addition to the Village.
Commissioner Johnson stated he whole heartedly supports this project noting it is a
wonderful facility and great addition to the area in addition to meeting all of the criteria.
It adds a great point of focus to the community.
Commissioner Samuels stated he also supports the project, noting especially the fact that
the primary use of the facility is staged so that it does not coincide with peak periods of
traffic. This is probably the least intensive use that can be consistent with this property
and the petitioner has done a very thorough job in preparation and in their presentation.

ORDINANCE NO. 2000 —
AN ORDINANCE AUTHORIZING PLACEMENT OF
COMMUNITY ENTRANCE SIGNS AND ORGANIZATION SIGNS
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, Section 14.36.010.M., Public Signs of the Village of Buffalo Grove Municipal
Code, provides for the Village to authorize signs on public property for a public purpose; and
WHEREAS, the Village desires to replace four community entrance signs located on
Dundee Road (2) and Lake Cook Road (2)with a total of eight (8) community entrance signs and a
maximum of two organization signs; and
WHEREAS, it is the opinion of the Corporate Authorities of the Village of Buffalo Grove that
the proposed signs serve a public purpose and benefit the residents of Buffalo Grove.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS,
as follows:
Section 1. The existing four (4) community entrance signs shall be replaced and a total of
eight (8) community entrance signs shall be placed at the locations identified on Exhibit "A". A
maximum of two community organization signs shall be placed at the locations identified on Exhibit
"B„
Section 2. This Ordinance shall be in effect from and after its passage and approval. This
Ordinance shall not be codified.

ORDINANCE NO. 2000-
AN ORDINANCE CONCERNING PREVAILING WAGES
WHEREAS, the State of Illinois enacted "An Act regulating wages of laborers, mechanics
and other workers employed in any public works by the State, county, city or any public body
or any political subdivision or by any one under contract for public works," approved June 26,
1941, as amended, (II . Complied Stat. Ch. 820, Par. 130/1 et seq. as amended, and
WHEREAS, the aforesaid Act requires that the Village of Buffalo Grove investigate and
ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other
workers in the locality of said Village of Buffalo Grove employed in performing construction
of public works, for said Village.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS that:
SECTION 1 : To the extent and as required by "An Act regulating wages of laborers,
mechanics and other workers employed in any public works by State, county, city or any public
body or any political subdivision or by any one under contract for public works," approved June
26, 1941, as amended, the general prevailing rate of wages in this locality for laborers,
mechanics and other workers engaged in construction of public works coming under the
j urisdiction of the Village of Buffalo Grove is hereby ascertained to be the same as the
prevailing rate of wages for construction work in the Cook and Lake County (Exhibits A and B)
areas as determined by the Department of Labor of the State of Illinois as of June 1, 2000,
copies of that determination being attached hereto and incorporated herein by reference. As
required by said Act, any and all revisions of the prevailing rate of wages by the Department
of Labor of the State of Illinois shall supersede the Department's June determination and apply
to any and all public works construction undertaken by the Village of Buffalo Grove. The
definition of any terms appearing in this Ordinance which are also used in aforesaid Act shall
be the same as in said Act.
SECTION 2: Nothing herein contained shall be construed to apply said general prevailing
rate of wages as herein ascertained to any work or employment except public works construction
of the Village of Buffalo Grove to the extent required by the aforesaid Act.
SECTION 3: The Village Clerk shall publicly post or keep available for inspection by any
interested party in the main office of the Village this determination or any revisions of such
prevailing rate of wage. A copy of this determination or of the current revised determination
of prevailing rate of wages then in effect shall be attached to all contract specifications.
SECTION 4: The Village Clerk shall mail a copy of this determination to any employer, and
to any association of employers and to any person or association of employees who have filed
their names and addressed, requesting copies of any determination stating the particular rates
and the particular class of workers whose wages will be affected by such rates.
SECTION 5: The Village Clerk shall promptly file a certified copy of this Ordinance with
both the Secretary of State and the Department of Labor of the State of Illinois.
SECTION 6: The Village Clerk shall cause to be published in pamphlet form a copy of this
Ordinance, and such publication shall constitute notice that the determination is effective and
that this is the determination of this public body. This ordinance shall not be codified.

SUBJECT: Ordinance Concerning Prevailing Wages
Attached, please find an Ordinance for consideration by the President and Board of Trustees that
deals with the payment of prevailing wages for all Village Public Works projects undertaken
within the Corporate limits. This Ordinance establishes the effective prevailing wages for both
Cook and Lake Counties for the calendar year beginning June 1, 2000 through May 31, 2001 . This
Ordinance is required to be adopted on an annual basis and when adopted must be filed with both
the Secretary of State and the Illinois Department of Labor. In addition to the filing it must
be maintained by the Village Clerk as a permanent record of the Village.
Based on prior practice in this area it is the staff recommendation that this Ordinance be
adopted by the President and Board of Trustees for implementation for the year so noted.

COOK COUNTY
TRUCK DRIVERS(WEST)-That part of the county West of Barrington Road.
The following list is considered as those days for which holiday rates of wages for work performed apply: New Years
Day,Memorial/Decoration Day,Fourth of July,Labor Day,Veterans Day,Thanksgiving Day, Christmas Day.
Generally,any of these holidays which fall on a Sunday is celebrated on the following Monday. This then makes work
performed on that Monday payable at the appropriate overtime rate for holiday pay. Common practice in a given local
may alter certain days of celebration such as the day after Thanksgiving for Veterans Day. If in doubt,please check
with IDOL.
EXPLANATION OF CLASSES
ASBESTOS-GENERAL-removal of asbestos material from any place in a building,including mechanical systems
where those mechanical systems are to be removed. This includes the removal of asbestos materials from ductwork or
pipes in a building when the building is to be demolished at the time or at some close future date.
ASBESTOS-MECHANICAL- removal of asbestos material from mechanical systems,such as pipes, ducts,and
boilers,where the mechanical systems are to remain.
TRAFFIC SAFETY-work associated with barricades,horses and drums used to reduce lane usage on highway work,
the installation and removal of temporary lane markings,and the installation and removal of temporary road signs.
TRUCK DRIVER-BUILDING,HEAVY AND HIGHWAY CONSTRUCTION-EAST&WEST
Class 1. Two or three Axle Trucks. A-frame Truck when used for transportation purposes;Air Compressors and

For definitions of classifications not otherwise set out,the Department generally has on file such definitions which are
available. If there is no such definition on file,the Bureau of Labor Statistics SIC list will be used. If a task to be
performed is not subject to one of the classifications of pay set out,the Department will upon being contacted state
which neighboring county has such a classification and provide such rate,such rate being deemed to exist by reference
in this document. Further,if no such neighboring county rate applies to the task,the Department shall undertake a
special determination,such special determination being then deemed to have existed under this determination. If a
project requires these,or any classification not listed, please contact IDOL at 618/993-7271 for wage rates or
clarifications.
LANDSCAPING
Landscaping work falls under the existing classifications for laborer,operating engineer and truck driver. The work
performed by landscape plantsman and landscape laborer is covered by the existing classification of laborer. The work
performed by landscape operators(regardless of equipment used or its size)is covered by the classifications of
operating engineer. The work performed by landscape truck drivers(regardless of size of truck driven)is covered by
the classifications of truck driver.

CARPENTER. The overtime payment provisions require payment of time-and-a-half for the ninth and tenth hours
worked on any day Monday through Friday and for the first eight hours on Saturday. All other overtime is at double
time.
CEMENT MASON-HWY. Requires time-and-a-half for work performed Mondays through Fridays from 7:00 am.to
8:00 am.and from 4:30 p.m.to 5:30 p.m. Double time must be paid for all hours worked before and after the
aforementioned hours as well as for all time worked on Saturdays,Sundays and Holidays.
GLAZIER. Overtime consists of time-and-a-half for the ninth and tenth hours worked Monday through Fridays. All
other overtime must be compensated at double time.
LABORER. Overtime is paid at the rate of time-and-a-half for the first two-and-a-half hours after the regular eight
hour shift from Monday through Friday with an increase to double time for any hours worked in excess of
ten-and-a-half from Monday through Friday.
PLUMBER. Overtime is paid at the rate of time-and-a-half for any work performed in excess of forty hours per week,
Monday through Saturday; including eight hours per day for five days,ten hours a day for four days,forty hours
Monday through Saturday shall constitute the working week.
ROOFER. Overtime consists of straight time for the first nine hours,with the tenth hour being paid at time-and-a-half

and the eleventh hour paid at double time for the period of Monday through Friday. For any time worked in excess of
forty hours in any one week roofers receive time-and-a-half.
SHEET METAL WORKER. Overtime is paid at the rate of time-and-a-half for the first four hours after the regular
eight hour day from Monday through Friday,with time-and-a-half on Saturday. All other overtime work is paid at
double time.
SIGN HANGER. Overtime is paid at the rate of time-and-a-half for the first three hours worked after the end of the
regular eight-hour day on Mondays through Fridays,and for work on Saturdays during regular hours. Double time is
paid in excess of three hours beyond regular hours,or for work on Saturdays outside of regular hours.
TERRAZZO MASON. The ninth hour on Mondays through Fridays is paid at time-and-a-half. All other overtime on
Mondays through Fridays is paid at double time.
Other Classifications of Work:
For definitions of classifications not otherwise set out,the Department generally has on file such definitions which are
available. If there is no such definition on file,the Bureau of Labor Statistics SIC list will be used. If a task to be
performed is not subject to one of the classifications of pay set out,the Department will upon being contacted state
which neighboring county has such a classification and provide such rate,such rate being deemed to exist by reference
in this document. Further,if no such neighboring county rate applies to the task,the Department shall undertake a
special determination,such special determination being then deemed to have existed under this determination. If a
project requires these,or any classification not listed,please contact IDOL at 618/993-7271 for wage rates or
clarifications.
LANDSCAPING
Landscaping work falls under the existing classifications for laborer,operating engineer and truck driver. The work
performed by landscape plantsman and landscape laborer is covered by the existing classification of laborer. The work
performed by landscape operators(regardless of equipment used or its size)is covered by the classifications of
operating engineer. The work performed by landscape truck drivers(regardless of size of truck driven)is covered by
the classifications of truck driver.

Signs 14.40.070
Dear Ed,
As you and I have discussed, Section 14.40.070 of the Village's Sign Code needs some
clarification. As currently written subsection A. of this section requires that certain signs [Section
14.36.010(A), Directional or Instructional Signs, 14.36.010(C), Government Signs, 14.36.010(L),
Public Notices, 14.36,010(M), Public Sign(s)] not only need to meet the requirements of their
specific sections but that they also must meet the five (5)requirements of subsection B. of section
14.40.070. This would mean for example, that a directional or instructional sign could only be
allowed on Sundays between twelve to 6:00 p.m. which is one of the five requirements under
subsection B. I think it goes without saying that this was not the intent of this section.
I am enclosing an ordinance which would clarify section 14.40.070. Also enclosed is a
highlight/strikeout version of this ordinance. Both ordinances can be found on the N-Drive under
14.40A& 14.40B.

AN ORDINANCE AMENDING CHAPTER 14.40• SIGNS
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970.
WHEREAS, Section 14.40.070 Public Areas of the Village of Buffalo Grove Municipal
Code requires clarification of the requirements for certain signs to be placed in public areas.

TRUSTEES OF THE VILLAGE OF BUFFALO GROVE,COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. Section 14.40.070 Public Areas of the Village of Buffalo Grove Municipal Code
is hereby amended to read as follows:
14.40.070 Public areas.
A. No sign shall be permitted which is placed on any crosswalk,
curb, curbstone, sidewalk, post, pole, state, electrolier, hydrant,
bridge, tree or other surface located on public property or over or
across any street or public thoroughfare except as otherwise express!
authorized by this Title in Sections 14.36.0M(ft Directionai or
Signs, subsection B of this
section.
B. Signs shall be allowed in the public areas designated in subsection
A. of this section so long as they meet the following requirements:
1. Nonilluminated, single- or double-faced ground sign;
2. Not exceeding the height of thirty-six inches above the top of the curb;
3. Not exceed six square feet in area;
4. Only allowed on Sundays between the hours of twelve to six p.m.
5. No Village sign permit will be required for a sign under this section.
C. Any sign located on public property in violation of this section
may be removed by the Village. The person responsible for any such
illegal sign shall be liable for the costs incurred in the removal thereof
and the Village is authorized to effect the collection of said cost. The
remedy is not exclusive. The Village reserves the right to prosecute
violators as set forth in Chapter 1.08 of this Code.
D. Nothing in this section shall apply to the painting of house
numbers upon curbs or curbstones.

WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970.
WHEREAS, Section 14.40.070 Public Areas of the Village of Buffalo Grove Municipal
Code requires clarification of the requirements for certain signs to be placed in public areas.
NOW, THEREFORE,BE IT ORDAINED BY THE PRESIDENT AND BOARD OF

ILLINOIS, as follows:

EASEMENT AGREEMENT
THIS AGREEMENT,
made this day

and between the VILLAGE OF BUFFALO GROVE, an Illinois Municipal
Corporation, 50 Raupp Boulevard, Buffalo Grove, Illinois 60089-2198 (hereinafter referred to as the
• VILLAGE- ) and The Catholic Bishop of Chicago (hereinafter referred to as • OWNER• ).
WITNESSETH
WHEREAS, OWNER is the owner of certain real estate situated in the County of Lake, State
of Illinois, which real estate is legally described in Exhibit • A• , which is attached hereto and by
this reference incorporated herein and made a part hereof, and which real estate shall be referred to
hereinafter as the • EASEMENT PREMISES;- and
WHEREAS, the VILLAGE desires to locate a portion of its sidewalk system in,upon,under,
along and across the EASEMENT PREMISES.
NOW, THEREFORE, in consideration of the foregoing and for the sum of Ten and No/100
Dollars ($10.00) and other good and valuable consideration paid by the VILLAGE to OWNER, the
receipt and
sufficiency of which are hereby acknowledged, the parties hereto mutually agree as follows:
1. OWNER hereby grants, conveys,warrants, and dedicates to the VILLAGE,its agents,
servants, employees, its successors and assigns an exclusive perpetual public
sidewalk easement and the right to survey, construct, reconstruct, use, operate,
maintain, inspect,repair,replace, alter or remove a sidewalk together with necessary
grading required, said sidewalk and grading hereinafter collectively referred to as the
• SIDEWALK- , subject to the terms and conditions hereinafter set forth, in, upon,
under, along and across the EASEMENT PREMISES together with all reasonable
rights of ingress and egress across any adjoining lands of OWNER necessary for the
exercise of the rights herein granted.
2. Upon completion of any construction, the VILLAGE agrees to replace and grade all
topsoil removed. All fences,roads, landscaping, and improvements will be restored
to former condition by the VILLAGE if disturbed or altered in any manner by
construction. All sod removed will be replaced by sod of like quality and all natural
grass removed will be replaced by seeding with a good quality seed.
3. OWNER hereby reserves the right to use the EASEMENT PREMISES and its
adjacent property in any manner that will not prevent or interfere with the exercise
by the VILLAGE or the public of the rights granted hereunder;provided, however,
that OWNER shall not in any manner disturb, damage, destroy, injure, obstruct, or
permit to be obstructed, the SIDEWALK nor obstruct or permit to be obstructed the
EASEMENT PREMISES at any time whatsoever without the express prior written
consent to the VILLAGE.
4. All rights,title, and privileges herein granted,including all benefits and burdens, shall
run with the land and shall be binding upon and inure to the benefit of the parties
hereto,their respective heirs, executors, administrators, grantees, successors, assigns,

AN ORDINANCE APPROVING REZONING TO THE
R-3 ONE-FAMILY DWELLING DISTRICT
AND APPROVING A PRELIMINARY PLAN,
VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS
MATRIX DEVELOPMENT

WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS, the real property legally described in EXHIBIT A ("Property") attached
hereto is zoned in the R-E Residential Estate District; and,
WHEREAS, Matrix Development Company, Inc. is the contract purchaser, hereinafter
referred to as "Developer" of the Property; and,
WHEREAS, Developer has petitioned to the Village for rezoning to the R-3 One-Family
Dwelling District and approval of a Preliminary Plan for development of three single-family
homes pursuant to the following exhibits:

WHEREAS, notice of public hearing concerning the rezoning and Preliminary Plan was
given and the hearing was held by the Buffalo Grove Plan Commission; and,
WHEREAS, the Plan Commission determined that the rezoning and Preliminary Plan,
including variations of the Village Development Ordinance and Zoning Ordinance, are
appropriate for the Property and compatible with adjacent properties; and,
WHEREAS, the President and Board of Trustees after due and careful consideration have
concluded that the use of the Property on the terms and conditions herein set forth would enable
the Village to control development of the area and would serve the best interests of the Village.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLIOIS:
Section 1. This Ordinance is made pursuant to and in accordance with the Village's
Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding
whereas clauses are hereby made a part of this Ordinance.
Section 2. The Corporate Authorities hereby adopt a proper, valid and binding
ordinance approving rezoning to the R-3 District, approving a Preliminary Plan (EXHIBIT B)
and Preliminary Engineering Plan (EXHIBITS C and D) for the development of three (3) single-
family homes.
Section 3. Development of the Property is subject to the following conditions:
A. Variations of the Development Ordinance are granted as follows:
Section 16.50.070.D.2.: To defer widening the pavement of Arlyd Road
from twenty(20) feet to the Village standard of twenty-four(24) feet;
Section 16.50.070.I.: To defer required curb and gutter along Arlyd Road.
B. A variation of Section 17.40.020.B. of the Zoning Ordinance is granted to
allow a lot width of seventy (70) feet instead of eighty (80) feet and a
north side yard of seven (7) feet instead of eight (8) feet for proposed Lot
1 as depicted on EXHIBIT B.
C. During the development and construction of the proposed single-family
homes and related site improvements, construction vehicles and
equipment shall enter and exit the Property via Prairie Road. The
Developer shall install signs as directed by the Village to regulate
construction traffic. The Developer shall inform all contractors that
construction vehicles and equipment are not allowed to use Arlyd Road
for access to the Property. The Developer shall ensure that construction
vehicles and equipment and the personal vehicles of construction workers
involved in development of the Property are not parked on Arlyd Road.
Street pavements adajcent to the Property shall be kept in a clean and safe
condition as determined by the Village Engineer. Any damage to
parkways adjacent to the Property (including along both sides of Arlyd
Road) during development of the Property shall be repaired as approved
and directed by the Village Engineer.
D. Any portion of the Property not under construction or completed shall be
maintained in a neat and orderly condition as determined by the Village
Manager.

E. The architectural appearance and building materials for the proposed
homes are subject to Village review and approval, and plans for said
homes shall be submitted as required by the Village.
F. Prior to land grading or other development on the Property, the Developer
shall obtain the Village Forester's approval for the removal of any trees on
the Property.
G. The Developer shall annex any part or all of the Property to the Buffalo
Grove Park District at the request of said District.
H. Developer shall pay to the Village $3,600.00 for eight(8)parkway trees,
$2,750.00 for 183 lineal feet of street curb and gutter, $750.00 for 50
square yards of pavement widening, $960.00 for street surfacing and
$5,600.00 for drainage improvements related to the Development
Ordinance requirements for development of the Property. Said
improvements to be installed by the Village. Said payments shall be made
on a schedule as directed by the Village.
I. Any changes or amendments to the plans approved herein are subject to
Village approval, and the Village will determine if additional public
hearings are necessary for proposed changes or amendments.
Section 4. This Ordinance shall be in full force and effect on and after its passage and
approval. This Ordinance shall not be codified.

ORDINANCE NO. 2000-
AN ORDINANCE PROVIDING
FOR THE RECOUPMENT OF
ADVANCES FOR CONSTRUCTION
OF WATERMAIN ALONG
PRAIRIE ROAD
WHEREAS, the Village of Buffalo Grove, Cook and Lake Counties, Illinois,
hereinafter referred to as "Village", and Matrix Development Company, Inc., an Illinois
Corporation hereinafter referred to as "Developer", have agreed that inasmuch as the
watermain, when constructed, would benefit neighboring properties not owned by the
Developer, the Developer should recover a proportionate amount of the cost of
construction from the benefited owners; and,
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the
Illinois Constitution of 1970; and,
WHEREAS, the property benefited, as shown on Exhibit "A" attached hereto and
made a part hereof, is described as follows:
PROPERTY 1: THE SOUTH 660.00 FEET OF THE NORTH 1/4 OF THE EAST
'/2 OF THE SOUTHWEST 1/4 OF SECTION 21, TOWNSHIP 43 NORTH, RANGE 11,
EAST OF THE THIRD PRINCIPAL MERIDIAN, LAKE COUNTY, ILLINOIS.
WHEREAS, it has been estimated that the amount to be recaptured for the cost of
the watermain is as follows:

2 Fire Hydrants @ $1,400.00/each $ 2,800.00

WHEREAS, it has been agreed that the estimated amount to be recaptured shall
be proportioned on a front footage basis to the property, as follows:

WHEREAS, the Village and Developer have agreed that payment shall be made
in accordance with the respective proportional share based on the actual costs of the
project, which shall be submitted to the Village upon completion and approved by the
Village Engineer.
NOW, THEREFORE, be it ordained by the President and Board of Trustees of
the Village of Buffalo Grove, Cook and Lake Counties, Illinois.
Section 1: The hereinbefore stated whereas clauses are incorporated herein and
made a part hereof.
Section 2: No person firm or corporation as owner of, or party interested in, or
any contractor, agent or other representatives of such owners or party interested in the
property set forth above, shall connect to, or tap onto, the improvement described without
having first obtained a permit from the Village. No permit shall be issued unless the
applicant shall pay the proportionate share of the actual cost of construction as approved
by the Village Engineer plus interest at the rate of 6%per annum computed from the date
of final acceptance by the Village of the project construction. The applicant shall pay the
fee in one lump sum.
Only one basic fee shall be recovered from the parcel. The first applicant shall
pay the same in one lump sum. The single charge shall be in addition to the then current
charges for water tap-on fees including, but not by way of limitation, those charges
required to be made to the Village by virtue of the Lake County, Illinois, Water
Agreement, and the customary meter and the water services charges made pursuant to the
Water Rate Ordinance, as it now exists, and as amended from time to time.
Section 3: All monies collected from the applicant for such permit shall be
remitted to Buffalo Grove. Five percent (5%) of all monies collected shall be retained by
the Village as the cost of collection.
Section 4: Any person, firm or corporation being the owners of any parties
interested in any property herein above described or any contractor, agent or
representative of such person, firm or corporation making any connection with the above
improvements without first making application and paying the amount required, shall be
subject to a fine of not less than $50.00, no more than $500.00, upon conviction thereof,
and the Village shall have the right to enter on the property without notice or permission
and remove all such connections so made.

Section 5: Improvement described shall be a public improvement, and Title shall
be vested in the Village. Nothing herein contained shall vest any proprietary rights in
said improvement.
Section 6: This Ordinance shall only be effective and enforceable until June 19,
2010.
Section 7: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication according to law.

WHEREAS, on June 18, 1984 the Buffalo Grove Board of Trustees adopted personnel
policies and procedures by Resolution No. 84-43 and amended same in 1988, 1990, 1993, 1996,
and 1998; and,
WHEREAS, in order to reflect current trends in personnel administration, occasional
amendments to the Personnel Rules are necessary; and,
WHEREAS, attached hereto as Exhibit A is the Village's Sexual Harassment and Anti-
Harassment Policy.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES of the Village of Buffalo Grove, Cook and Lake Counties, Illinois that the changes
to the Personnel Rules that are contained in Exhibit A attached hereto are adopted by the Village
of Buffalo Grove amending the personnel policies and procedures adopted by Resolution No. 84-
43; and,
BE IT FURTHER RESOLVED that the amendments hereto referenced shall be in full
force upon their passage and approval and,
BE IT FURTHER RESOLVED that all Village employees and all Village elected and
appointed officials are required to review and sign a copy of the Village of Buffalo Grove Sexual
Harassment and Anti-Harassment Policy as set forth in Exhibit A.

VILLAGE OF BUFFALO GROVE
SEXUAL HARASSMENT AND ANTI-HARASSMENT POLICY
The Village of Buffalo Grove is committed to providing its employees, vendors and
visitors with a productive environment which is free of intimidation and harassment,
whether based on race, color, gender, marital or parental status, age, religion, disability,
national origin, ancestry or sexual orientation. Harassment is a violation of federal, state
and local laws. The Village will not tolerate harassment of any kind in the workplace.
To ensure that no employee, vendor or visitor is subjected to such harassment, the Village
strictly prohibits any offensive or unwelcome,physical, written, or spoken conduct
regarding any person's race, color, gender, marital or parental status, age, religion,
disability, national origin, ancestry, or sexual orientation. It is the policy of the Village
that all employees avoid offensive or inappropriate behavior at work, including behavior
among employees and between employees and visitor. All employees must continue to
act responsibly to help maintain a comfortable working environment free from
harassment and intimidation. Any Village employee who violates this policy will be
subject to disciplinary action, including termination.
Sexual Harassment means any unwelcome sexual advances, requests for sexual favors
and other verbal or physical conduct of a sexual nature when:
a. submission to such conduct is made either explicitly or implicitly a term or
condition of an individual's employment or receipt of Village services; or
b. submission to or rejection of such conduct by an individual is used as the
basis of any employment or service decision affecting the individual; or
C. such conduct has the purpose or effect of substantially interfering with the
work performance of an employee or creating an intimidating, hostile or
offensive environment for employees or patrons.
No Village manager, director, supervisor, or other employee has the authority to engage
in such conduct or to alter another employee's terms or conditions of employment based
on the employee's refusal to submit to such conduct. The Village strictly prohibits its
managers, directors, supervisors and other employees from implying or suggesting that an
applicant or employee's submission to or refusal to submit to sexual advances or
participation in such sexual conduct is a condition of continued employment or receipt of
any job benefit(including job assignment, compensation advancement, career
development, or any other term or condition of employment).
Examples of Sexual Harassment Include:
a. Pressure for sexual activity(subtle or overt);
b. Unwelcome touching or intimacy, including pinching,patting or hugging;
C. Insulting, degrading or obscene sexual remarks, innuendoes,jokes or
conduct;
d. Posting or display of sexually offensive or degrading materials in the
workplace such as pictures or cartoons;
e. Epithets, slurs, derogatory remarks or negative stereotyping based on
gender;
f. Comments about sex life or body parts; and
g. Repeatedly asking out for a date someone who has refused.
Factors that Establish Hostile Work Environment include Sexual Conduct which is:
a. frequent and severe; or
b. physically threatening or humiliating; or
C. interferes with job performance; or
d. discourages employee(s) from remaining on the job, or keeps employee(s)
from advancing in their career.
Furthermore, the following behaviors, if based on race, color, gender, marital status, age,
religion, disability, national origin, ancestry or sexual orientation, are improper and
against the policies of the Village:
a. Use of epithets, slurs, derogatory remarks, negative stereotyping, or other
threatening, intimidating or hostile acts that relate to such status; or
b. Posting, displaying or circulating written or graphic material that
denigrates or shows hostility or aversion to an individual because of such
status.
All employees are encouraged to raise questions that they may have regarding these issues
with his or her Department Director, the Director of Human Resources or the Assistant
Village Manager(s). Any Village employee who feels he or she has been the victim of any
type of harassment from anyone, including supervisors, staff, co-workers, or in some
cases non-employees such as vendors or visitors, should report the matter immediately to
his or her Department Director, the Director of Human Resources, or the Assistant
Village Manager(s). Likewise, any employee who believes he or she is being
discriminated against because other employees are receiving favored treatment in
exchange for sexual favors, should bring this to the attention of his or her Department
Director, the Director of Human Resources or the Assistant Village Manager(s). This is
the proper and required course. The very nature of harassment and discrimination make it
virtually impossible to detect unless the employee being harassed registers a complaint
with an appropriate Village representative.
All complaints of harassment are serious. Thorough and appropriate investigations of
complaints will be conducted promptly. Appropriate measures will be taken to keep the
complaint as confidential as possible. There will be no retaliation or reprisals of any kind
against any person for having made a good faith inquiry, complaint or report of sexual
harassment or discrimination, or for participating in an investigation of sexual harassment
or discrimination.
If You Believe You Are a Victim of Harassment:
a. Tell the harasser to stop, that his or her conduct is unwelcome and that you
will not tolerate the behavior;
b. REPORT the incident or situation to your Department Director, Director
of Human Resources or Assistant Village Managers;
C. If your Department Director is the harasser, report the behavior to the
Director of Human Resources or the Assistant Village Manager(s);
d. Regardless of who receives the initial report, the matter will be promptly
addressed and handled as appropriate.
Village Procedure for Reporting Harassment:
1) An employee who believes he or she has been the subject of any form of
harassment or discrimination should immediately make a complaint to his or her
Department Director, Director of Human Resources or Assistant Village
Manager(s).
2) The Department Director or Assistant Village Manager(s) will document any
reported incident and promptly forward the complaint to the Director of Human
Resources. The Director of Human Resources will notify the Village Manager that
a complaint has been made.
3) A prompt and thorough investigation of all allegations will be conducted and all
persons will be treated respectfully. The investigation will be coordinated by the
Director of Human Resources.
a. The complaining employee, the alleged wrongdoer and any witnesses, as
appropriate will be interviewed as part of the investigation;
b. A record of the complaint and findings will be prepared and become part
of the complaint investigation file;
C. The complaint investigation file will be maintained separately from any
employee's personnel file;
d. Registering a complaint will in no way be used against an employee, nor
will it have any adverse impact on the complaining individual's
employment.
4) The Village Manager, the Assistant Village Manager(s), the Department Director
and the Director of Human Resources will review the results of the investigation,
unless one of them happens to be the alleged harasser. Any Village employee
who is found after appropriate investigation to have violated this policy will be
subject to corrective action, including disciplinary action, up to and including
termination. Disciplinary actions can range from issuance of a documented
warning up to and including termination of employment, depending on the
evidence uncovered in the investigation and the nature and severity of the offense.
A written record of each action taken pursuant to this policy will be maintained
separately from any employee's personnel file. The record will reflect the conduct
or alleged conduct and the disciplinary measure(s), if any, imposed. The
complaining employee and alleged wrongdoer will receive written notification
regarding the outcome of the investigation upon its completion.
An effective sexual harassment and anti-harassment policy requires the support and
example of Village personnel in positions of authority. Employees, officials or agents of
the Village who engage in harassment or retaliation or who fail to cooperate with a
Village sponsored investigation of harassment or retaliation will be subject to disciplinary
measures. Likewise, employees, officials or agents of the Village who refuse to
implement remedial measures, obstruct remedial efforts of other Village employees
and/or retaliate against complainants or witnesses will be subject to disciplinary
measures.
All employees and other personnel, including elected and appointed officials, are required
to review and sign a copy of this Village Sexual Harassment and Anti-Harassment Policy
and return a copy to the Director of Human Resources. By signing a copy of this policy,
each person acknowledges its receipt, and his or her agreement to act in accordance with
the guidelines set forth above and as they may from time to time be modified by the
Village.
An employee who believes that he or she has been the subject of harassment or retaliation
for complaining about harassment may also contact the Illinois Department of Human
Rights. For further information, contact the Illinois Department of Human Rights at(312)

Organizations serving the Village of Buffalo Grove have the opportunity to have a aTilowiltiallik
sign posted at the Lake Cook Road display board to celebrate their participation and `
involvement in the community. As a service to our organizations, community
information may also be posted on the Village's web site and special events featured
on the municipal marquee located off of Lake Cook Road, on the municipal complex.

✓ Buffalo Grove and Stevenson High School Champions shall have their school name, club, award,

is greater. The school/club is exempt from the fee requirement of this form.
✓ The Village reserves the right to accept or reject all request forms.

provide benefits to Buffalo
Grove in terms of favorable
pricing with some degree of
improved quality over the long
term.
Because the final documentation
related to the confidentiality
agreement has not received final
approval from the Village
Attorney, I would present the
latter document to the Village
Board at our July 10 meeting.
With regard to natural gas
purchase, our analysis has
concluded that it is not cost
effective at this point to join the
Lake County Joint Purchasing
Contract Consortium and I am
recommending deferral of that
action until next January to
determine the direction of
pricing.
Since the Village Board has
previously created an enabling
resolution for the Chicago
Electrical Purchasing Alliance,
which we have been holding, a
motion to accept staff
recommendation on electrical
power is requested, along with
the acceptance of the staff
recommendation for deferral of
natural gas power aggregation
purchasing at this time. Final
documentation will be presented
to the Board on July 10.

SUBJECT: Chicago Electrical Purchase Alliance
In follow-up to our attendance at yesterday's informational meeting which was sponsored
by the Chicago Electrical Purchase Alliance, the following pros and cons to participation
which came to mind are denoted as follows:
Reasons to Participate in the Chicago Alliance Power Purchase Option
• The Chicago Purchase Alliance expresses a high degree of confidence that they can
achieve power savings of at least 15% compared to the best rates available from the
Commonwealth Edison Company.
• The City of Chicago staff who are spearheading this activity have worked closely
with the Northwest Municipal Conference and other councils of governments on
various regional issues and participation in this program is likely to continue to foster
the broadened scope and effectiveness of activities which this group can pursue
related to mutually beneficial issues.
• The Chicago Alliance is continuing to bear all administrative expenses related to
analysis and bid specification development.
• The environmental provisions of the specifications can result in positive public
relations and possibly contribute to an improved environment.
Reasons to Not Participate in the Chicago Alliance Power Purchase Option
• The City of Chicago staff spearheading this effort have stated that there are a number
of environmental issues related to requiring use of renewable resources and the
elimination of a brown fields area in the City of Chicago which will play a factor in
the selection of the power provider, and, as a result, although they are committed to
achieve a significant cost savings, the total cost savings is likely to not be maximized
to the greatest extent possible, if strictly cost and reliability factors were part of the
selection process.
• Although it would be difficult and likely to involve a somewhat significant initial cost
for organization, analysis, intergovernmental agreement development and
bidding/solicitation administration, it would appear that a broad organization of
suburban local governments could bid power supply without environmental criteria
that would achieve a somewhat less expensive power rate.

Conclusion
It would seem desirable to proceed with the Chicago Alliance Power Purchase and then
continue to evaluate other alternative joint purchasing scenarios which could be
implemented at the end of the three-year initial commitment which the current process
anticipates beginning on January 1, 2001.
In order to proceed, the Village Board would need to take action at their next regular
meeting scheduled for Monday, June 15, 2000 to approve any documents determined to
be necessary by the Village Attorney in order to comply with the Chicago Power
Purchase Alliance's requirements.

SUBJECT: Pursuit of Natural Gas Power Aggregation Cost Saving Partnership
As you know, I have been pursuing the goal of implementing power aggregation
partnerships in order to accomplish cost savings without compromising reliability.
Past discussions had initiated with Dave Bennett,NWMC Executive Director, who
referred me to the NWMC's power purchasing consultant who then referred me to the
Lake County Joint Purchasing Program. The Lake County Joint Purchasing Program
staff referred me to their contractor, WPS Energy Services Inc. For your information, I
am transmitting a copy of the June 1, 2000 evaluation of the Village's Nicor and North
Shore Gas Company gas customer accounts. This review of our accounts indicates that it
is not currently cost effective to switch over to the Lake County Joint Purchasing
contract, but the WPS staff anticipates that the current price swing is anticipated to return
to more normal levels later this year, at which time the WPS staff will notify me once
conditions for initiating participation in the Lake County joint gas purchase contract for
our Nicor accounts is cost effective. An evaluation of our North Shore Gas Co. accounts
indicates the currently available joint purchasing options are not currently cost effective
but the WPS staff will notify me of additional options which may become cost effective
in the future when North Shore Gas Company initiates additional gas purchase options.

of natural gas, please let me know.

RE: Lake County Joint Purchase Program—Natural Gas
Dear Mr. Boysen:
After analyzing the usage data provided to me by NICOR Gas and North Shore Gas, it appears that
it would not benefit the Village of Buffalo Grove to take advantage of the Lake County Joint
Purchase Program for natural gas. My recommendation is to revisit the issue early next year to
assess the then current pilot program price offering and the natural gas market to determine where
the greatest opportunity for savings lies.
NICOR Gas—Please review the spread sheet that follows. You will see three different analyses of
utility distribution rates. The top tier, marked `Rate 4', shows the distribution charges associated
with the 51 Raupp location on the normal,non-transportation rate. This rate is identical to the pilot
program distribution rate. The middle tier, marked `Rate 4 - Rider 25', shows the distribution
charges associated with transporting natural gas,but without putting in the telemetering device. This
is the level of service that requires you purchase an insurance policy from the utility. This insurance
policy is called a Demand Charge on the spreadsheet. The third tier, marked"Rate 74" shows the
charges associated with transporting natural gas and having the telemetering device. No insurance
policy is required for this level of service.
You will note that the least expensive distribution rates are associated with the top tier which is
direct utility service or via the pilot program called Customer Select. Rate 74 service provides the
second best distribution rate. This leads us to the question,does the natural gas market provide an
opportunity for savings over the utility rate that would compensate for the higher distribution costs?
The answer for the summer of 2000 is no. Currently we are seeing the highest natural gas rates we
have seen since the winter of 1996-97. In fact for the month of June, it is likely that the utility rate
for natural gas will be less than the price to Lake County. While we do not expect the market to
remain at these levels, and we don't expect the utility rates to remain as competitive as they are for
June, we can not in good faith recommend that you convert your accounts to Rate 74 in order to
participate in the unregulated natural gas market. We will continue to monitor the rates and,
knowing your desire to participate in the savings usually provided by transporting gas, we will
inform you of the best time to make that change.
NORTH SHORE GAS—All of the accounts served by NORTH SHORE GAS are on a residential
rate with the utility. This means that they are ineligible to transport natural gas at this time. North
Shore Gas' sister utility initiated transportation service to these sorts of accounts on a trial basis and
we expect that North Shore will do the same within a year or two. However, until that time, the
utility will not allow us to serve those accounts.

the market to inform you of the best time to take advantage of the potential savings offered by the

Douglas Bean of Terraco, Inc. has submitted the attached letter and site plan concerning the
proposed Starbucks store. Starbucks would occupy a space of 2,200 sq. ft. on the north end of the
13,000 square foot commercial building. The commercial building is directly south of the
Walgreens store. The site is planned as a P.U.D. with shared parking and access between the two
buildings. The annexation agreement allows up to 2,000 square feet of restaurant use and up to
2,000 square feet of office use in the commercial building.
The plan depicts a drive-through service window on the north side of the commercial building.
The approved site plan would need to be amended to allow this drive-through lane; the approved
landscaping plan would also be modified. The plan provides a stacking lane for six vehicles. The
Zoning Ordinance requires stacking lanes for service windows at eating and drinking and
establishments to accommodate a minimum of ten vehicles .
The drive-through lane would eliminate 15 parking spaces from the approved plan. A total of
134 spaces would be provided. The Zoning Ordinance requires 120 spaces, using the retail
parking standard for the Walgreens store and the shopping center parking standard for the
commercial building.
The Plan Commission review would include an analysis of traffic circulation and parking
demand to assess the impact of the proposed drive-through facility on the overall traffic now on
the property as well as compatibility with the existing Walgreens drive-through. The current and
proposed tenant mix is pertinent to traffic circulation and parking demand. The petitioner should
review the current tenant mix and discuss the strategy for filling the remaining tenant spaces.
The Board may want to provide direction concerning whether a workshop is necessary or if the
project could be scheduled for a public hearing.
