The attached resolution honors George Krug for his long service as a member of the Plan
Commission.The Village Board conferred the honor of"Commissioner Emeritus" on Mr. Krug
in June 1999.
George served on the Plan Commission in the early years of the Village's development,
including participation in drafting important documents such as the Zoning Ordinance and
Comprehensive Plan.
George began a second tenure on the Plan Commission in 1981 and resigned in 1999. It is
evident that the Village has greatly benefited from George's expertise and dedication in serving
as a Plan Commission member during key periods in the Village's development.

RESOLUTION 2000 —
COMMEDNING GEORGE KRUG
FOR SERVICE TO THE VILLAGE AS A
PLAN COMMISSION MEMBER AND OFFICER, 1981 —1999
WHEREAS, George Krug served the Village as a Plan Commission member during two
separate tenures, the second beginning in 1981, including service as Secretary; and,
WHEREAS, George performed with excellence throughout his tenure on the
Commission, providing intelligent and fair analysis in the guidance of growth and development
of the Village in its formative years and in addressing new issues as the community matured;
and,
WHEREAS, George made important contributions to the Village's comprehensive
planning process, particularly in the early years of the Village's development when sound
planning was critical in establishing the Village's form and character; and,
WHEREAS, George was recognized by the Village Board in June 1999 with
appointment as "Commissioner Emeritus," and has continued to serve the Village as a member
of the Zoning Ordinance Review Sub-committee.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE
COUNTIES, ILLINOIS THAT:
George Krug is commended and honored on behalf of the citizens of Buffalo Grove for
his excellent service to the Village as a Plan Commission member and officer.

ORDINANCE 2000-
GRANTING A VARIANCE FROM SECTIONS
14.20.010 OF THE BUFFALO GROVE SIGN ORDINANCE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, The Village of Buffalo Grove Police Department, is requesting a variation
from Section 14.20.010 of the Buffalo Grove Sign Code, for the hereinafter legally described real
property located at 51 Raupp Boulevard, Buffalo Grove, Illinois, for the purpose of displaying
a 30 foot inflatable balloon at the Public Works Building during Buffalo Grove Days, and,
WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony,
prepared minutes, made certain findings, and has made an affirmative recommendation on said
request for variation; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine
and find that said variation is in harmony with the general purpose and intent of the Sign
Ordinance, and that (1) the ordinance in question would cause undue and unnecessary hardship
to the sign user because of unique or unusual conditions pertaining to the property, (2) the
granting of the requested variances will not be materially detrimental to the property owners in
the vicinity, (3) the unusual conditions applying to the specific property do not apply generally
to other properties in the Village, and (4) the granting of the variances will not be contrary to the
general objective of this title of moderating the size, number and obtrusive placement of signs and
the reduction of clutter.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities.
Section 2. A variation is hereby granted to Sections 14.20.010 of the Village Sign Code
Ordinance to the following legally described real property:
See Exhibit "A" attached hereto.
The specific variation is to permit the Police Department to display an inflatable balloon
of a nationally recognized safety symbol, "McGruff", to attract attention to their safety display
at Buffalo Grove Days, September 2, through September 4, 2000.
Section 3. This Ordinance shall be in effect from and after its passage and approval. This
Ordinance shall not be codified.

After due notice as required by law, a copy
of said publication notice being attached
hereto as Exhibit "C" the Zoning Board of
Appeals held a Public Hearing regarding the
proposed variance on Tuesday, June 20, 2000
at the Village Hall, 50 Raupp Blvd.
The applicant' s representative, Mr. Joel
Lome, Project Manager for Sarfatty
Associates, Inc . testified at the
hearing and presented documentary evidence .
No objectors appeared at the hearing.
No written objections were received.
Attached hereto and made a part hereof as
Exhibit "J" are the minutes of the Zoning
Board of Appeals Meeting held on Tuesday,
June 20, 2000
IX. FINDINGS :
The Zoning Board of Appeals finds that the
criteria as set forth in Section 14 .44 . 010,
Subsection A, of the Sign Code have been
met in that the Petitioner has shown:
A. 1 . That not allowing the variance will cause
undue and unnecessary hardship due to the
following unique conditions :
a. When the building was approved, the
Burger King icons ( mansard roof with red
illuminated band around the top) was not
permitted, so people do not recognize it .
b. The building is obscured by the Shell
station and heavy landscaping between the
site and the Shell station.
4 . That granting of the variance will not
be contrary to the general objective of
this Title of moderating the size, number
and obtrusive placement of signs and the
reduction of clutter.
X. CONDITIONS :
The variance shall be subject to the following
conditions :
1 . Signs are to be as presented per the exhibits
submitted with the application.
XI . CONCLUSION:
The Zoning Board of Appeals, by a vote of 6 to 0,
recommends to the Village Board, that the request
of Sargent Steve Haisley, Police Department for
variance of Sign Code, Section 14 .40 . 080 for the

for the purpose of displaying a 30 foot inflatable balloon at the Public Works
Building, 51 Raupp Boulevard, on September 2, 3, and 4, 2000.

Mr.Pichman described the proposed 3 season sunroom. The design is based on the location of the rear
entrance of the house and the placement of the garage. The addition has been revised to meet the
maximum separation of five(5)feet between the principal structure and the garage. It will be 11 feet by 16
feet. The exterior will match the existing house and will be unheated. Any other location of the garage
would require the relocation of much of the mechanical equipment.
Mr.Abangan is legally blind and has difficulty walking so the addition will bring the rear exit of the house
closer to the garage for easier access.
The Commissioners had no objections
There were no comments from the audience.
Com.Windecker made the following motion:
I move we recommend to the Village Board of Trustees,that the request of
Demetrio and Kathryn Abangan, 106 Bernard Drive,for variance of Zoning
Ordinance,Section 17.32.020, pertaining to Accessory Buildings and Structures,
be granted that would permit construction of an 11 foot by 16 foot 3-season
sunroom that will be separated from the garage by five(5)feet.
The exterior of the addition will match the existing building and materials are
to be of like kind and quality. Addition to be built in accordance with plans
submitted to and approved by the Village.
Petitioner having exhibited unique circumstances and hardship,the addition
will not alter or be detrimental to the essential character of the neighborhood.

Unit,was sworn in. Notice of the public hearing was published in the Daily Herald on May 31,2000.
Sgt.Haisley described the 30 foot McGruff balloon and said they want to use it during Buffalo Grove
Days to call attention to the display and promote safety. It will be located on the west side of the public
works building south of the driveway.near the overhead door. It will be deflated every night.
The Commissioners had no objections and there were no comments from the audience.
Com. Teplinsky made the following motion:
I move we recommend to the Village Board of Trustees,that the request made
by Sargent Steve Haisely, Crime Prevention Buffalo Grove Police Department,
Community Relations Department,be granted that would permit variance of Sign

Mr.Joel Lome,Project Manager,Sarfatty Associates,Ltd.,3201 Old Glenview Road,Suite#301,
Wilmette,IL 60091 847-920-1100,ext 29 was sworn in. Notice of the public hearing was published in the
Daily Herald on May 31,2000. Mr.Lome was authorized to make the presentation for the owner. He
requested a variance that would permit installation of Burger King sign on the south elevation of the
building. A financial hardship exists because there is no sign to attract business from Lake Cook Road,
from either the east or west. Currently there is no identification on the rear elevation. When the building
was approved the Burger King icons(i.e.mansard roof with red illuminated band around the top)were not
permitted. The exterior colors were changed. Burger King is not represented on the street furniture signs
on Lake Cook Road and Route 83. The building is not recognizable to northbound traffic on Route 83
until cars are parallel to the building because of the large amount of foliage between the site and the Shell
Station. Some photographs were submitted that were taken from a car traveling past the intersection.
Com. Windecker observed that the pictures are unique because going east on Lake Cook Road,the building
is not seen past the second car making a left turn. Traffic going west on Lake Cook Road and north Route
83 would not see the sign. One photograph was taken from the ground in front of the building.
Mr.Lome said the owner initially thought that there would some identification from the development,
but no space is available on the street furniture. Three of the four directions have a difficult view of the
building,but some aspects of the elevation and the sign would be visible from Lake Cook Road. The
proposed sign would match the other wall signs on the east and west elevations with the Burger King logo.

GRANTING A VARIANCE FROM SECTION 17.32.020
OF THE BUFFALO GROVE ZONING ORDINANCE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the Owner of the hereinafter legally described real property, Demetrio
and Kathryn Abangan, 106 Bernard Drive, Buffalo Grove, Illinois, have requested a variation
from Section 17.32.020 of the Buffalo Grove Zoning Ordinance relative to the restrictions on
location of accessory structures; and,
WHEREAS, the Zoning Board of Appeals has held a public hearing, received
testimony, prepared minutes, made certain findings, and has made an affirmative recommenda-
tion on said request for variation; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby
determine and find that said variation is in harmony with the general purpose and intent of the
Zoning Ordinance, the plight of the owner is due to unique circumstances, and the proposed
variation will not alter the essential character of the neighborhood.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate

Please accept this letter on behalf of Demetrio&Kathy Abangon. They are requesting relief from
the ordinance that requires at least ten feet between the main residence and an out building. The
reason that this has become an issue is that they would like to put a 12' x 14' Sunroom Addition
on the back of their home. The only logical location for this room is off their back door and in
this location it will be encroaching into the ten foot setback appre3dfflMe1r,0feet.

The Abangons are long time residents of Buffalo Grove and are as concerned about the appear-
ance and safety of their neighborhood as anyone else. However, it is their belief, that this
particular situation will not infringe on any other citizen's rights, or the looks of the neigh-
borhood. The addition will be built to code in every other aspect and will be aesthetically
pleasing.
To move the location of the room would also create undue financial hardship. The heating
exhaust, the electrical service,the central air conditioning unit, and the exterior plumbing would
all have to be relocated. The expense involved in this would make the whole project cost
prohibitive.
The location of the new addition will also act as the new rear exit from the home and with the
closer proximity to garage it will enhance Demtrio's access to the Garage as he is legally blind and
has difficulty walking. As for Kathy, she works the Village of Buffalo Grove at the Fire dept. and
at the end of a long day, she is looking forward to relaxing in her new Sunroom.

A document was signed by contiguous neighbors who have no objection to the fence was submitted.
The Sholls back yard is a gathering place for the neighbors' children and the fence provides security
for all the children.
T.he Village Engineer's Review,dated June 9,2000,states: "We have reviewed the line of sight
requirements at the subject location. The proposed fence does not affect the line of sight."
Ch.Entman asked what Tru-Link said about the mis-placement of the fence being past the building line?
Mrs. Sholl said Mr.Levine's original response was that the fence was installed according to the survey.
They have agreed to move the fence if the variance request is not approved. She added that moving
the fence would create a hardship because it would leave holes on the outside of the fence,they would have
to eliminate one entry gate and their sprinkler heads would probably have to be moved again.
Ch.Entman asked the Sholls if they are aware that the fence is actually 51"to the top of the grade and the
posts are 67'in height. This had been confirmed upon subsequent inspection.
Mr. Sholl said when he applied for the permit, Ken(Lehmann) was assisted him in marking the plat of
survey on the building line. He submitted the original permit card and copy of the approved permit.
Tru-Link was given the survey and the fence was installed. They paid extra for the PVC.They are happy
with the fence and would like to keep it as it was installed. Mike.Levine told him this afternoon that
someone would be at the meeting.
Mrs. Sholl said they would have applied for a variance if they knew it was required.
Mrs.Janice Dlatt,360 Foxford Drive,(house next door)was present. She said the fence is beautiful and
the fence keeps her safe children because it keeps them from going into the street. She has talked to many
of the other neighbors and none of them object to the fence. The fence does not obstruct the view driving
from either direction.
Com Krakauer made the following motion:
I move we grant the request of Stuart and Suzie Sholl,370 Foxford Drive,
for variance of Fence Code,Section 15.20.040,pertaining to Residenital
Districts,that would permit the existing 6 foot 2 inch PVC fence to remain

hereto as Exhibit "C" the Zoning Board of
Appeals held a Public Hearing regarding the
proposed variance on Tuesday, June 20, 2000
at the Village Hall, 50 Raupp Blvd.
The applicant' s representative, Mr. Joel
Lome, Project Manger for Sarfatty
Associates, Inc. testified at the
hearing and presented documentary evidence .
No objectors appeared at the hearing.
No written objections were received.
Attached hereto and made a part hereof as

IX. FINDINGS:
The Zoning Board of Appeals finds that the
criteria as set forth in Section 14 .44 . 010,
Subsection A, of the Sign Code have been
met in that the Petitioner has shown:
A. 1. That not allowing the variance will cause
undue and unnecessary hardship due to the
following unique conditions:
a. When the building was approved, the
Burger King icons ( mansard roof with red
illuminated band around the top) was not
permitted, so people do not recognize it .
b. The building is obscured by the Shell
station and heavy landscaping between the
site and the Shell station.
C. There is no space on the street furniture
for identification.
2 . That granting the requested variance would
not be detrimental to the property owners in
the vicinity.
3 . That the unusual conditions applying to the
specific property do not apply generally to
other properties in the Village, and
4 . That granting of the variance will not
be contrary to the general objective of
this Title of moderating the size, number
and obtrusive placement of signs and the
reduction of clutter.
X. CONDITIONS :
The variance shall be subject to the following
conditions :
1. Sign is to match the other wall signs and
be as presented per the exhibits submitted
with the application.
XI . CONCLUSION:
The Zoning Board of Appeals, by a vote of 5 to 1,
recommends to the Village Board, that the request
of Sarfatty Associates, Ltd. on behalf of Burger
King at 80 N. Buffalo Grove Road, for variance of,
Zoning Ordinance, Section 17 .44 . 010 .E. 6 . pertaining
to Town Center signs, for the purpose of installing

Mr.Joel Lome,Project Manager,Sarfatty Associates,Ltd,3201 Old Glenview Road,Suite#301,
Wilmette,IL 60091 847-920-1100,ext 29 was sworn in. Notice of the public hearing was published in the
Daily Herald on May 31,2000. Mr.Lome was authorized to make the presentation for the owner. He
requested a variance that would permit installation of Burger King sign on the south elevation of the
building. A financial hardship exists because there is no sign to attract business from Lake Cook Road,
from either the east or west. Currently there is no identification on the rear elevation. When the building
was approved the Burger King icons(i.e.mansard roof with red illuminated band around the top)were not
permitted. The exterior colors were changed. Burger King is not represented on the sheet furniture signs
on Lake Cook Road and Route 83. The building is not recognizable to northbound traffic on Route 83
until cars are parallel to the building because of the large amount of foliage between the site and the Shell
Station. Some photographs were submitted that were taken from a car traveling past the intersection.
Com. Windecker observed that the pictures are unique because going east on Lake Cook Road,the building
is not seen past the second car making a left turn. Traffic going west on Lake Cook Road and north Route
83 would not see the sign. One photograph was taken from the ground in front of the building.
Mr.Lome said the owner initially thought that there would some identification from the development,
but no space is available on the street furniture. Three of the four directions have a difficult view of the
building,but some aspects of the elevation and the sign would be visible from Lake Cook Road. The
proposed sign would match the other wall signs on the east and west elevations with the Burger King logo.
Com.Krakauer said the building is not recognizable and the sign will help with identification.
Ch. Entman said even though the gas station blocks the building,the south elevation is blank and will
look better with the sign.
Com. Lesser made the following motion:
I move we recommend to the Village Board of Trustees,that the request of
Sarfatty Associates,Ltd,on behalf of Burger King at 80 McHenry Road,be
granted a variance of Zoning Ordinance,Section 17.44.060.E.6 pertaining to
Town Center Signs,for the purpose of installing an additional wall sign on the
south elevation facing Lake Cook Road
Signs shall be consistent with specifications submitted to and approved by the
Village.
Unique circumstances having been demonstrated,the sign will not be detrimental
to the public health,safety and welfare and will not alter the essential character
of the neighborhood
Sign is recommended pursuant to Sign Code, 14.44.010,Sub-section A.

Because she is a petitioner,Com.Krakauer recused herself from the discussion.Daniel Krakauer was
sworn in. Notice of the public hearing was published in the Daily Herald on May 31,2000.
Mr. Krakauer requested a variance of seven(7)feet that would permit the garage to be moved forward ten
(10)feet. This will permit a mud room to be located between the garage and family room,giving their
children a place to deposit their belongings before entering the house. This will also increase storage space
inside the garage. The loft area will also be increased.
Their architect designed a similar addition for a house near by and it looks nice.The materials will match
the existing structure. A new roof will be put on the entire house including the addition The existing
garage has a double doors with two(2)dormers and the addition will have a single door with one(1)
dormer They have informed all their neighbors and there were no objections.
The Village Engineer submitted no comments and the Commissioners had no comments or objections
Com.Teplinsky made the following motion:
I move we grant the request being made by Daniel and Sara Krakauer,
431 Cedar Court South,for variance of Zoning Ordinance,Section 17.40.020,
Pertaining to Area,Height,Bulk and Placement Regulations,for the purpose of
constructing an addition that would encroach a distance of seven(7)feet into
the required forty(40)foot front yard setback.
Materials for the addition are to match the existing construction in like kind and
quality including a new roof. Addition to be constructed pursuant to plans
submitted to and approved by the Village.
Petitioners having demonstrated hardship and unique circumstances,the variance
will not be detrimental to the public health,safety and welfare,and will not alter
the essential character of the neighborhood.

GRANTING A VARIANCE FROM SECTIONS
14.20.050 and 14.20.070 OF THE BUFFALO GROVE SIGN ORDINANCE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, Rogers Center For Commerce, Owner of the hereinafter legally described
real property located at 1622 Barclay Boulevard, Buffalo Grove, Illinois, on behalf of the Trane
Company, has requested a variation from Sections 14.20.050 and 14.20.070 of the Buffalo Grove
Sign Code for the purpose of installing a ground sign, and,
WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony,
prepared minutes, made certain findings, and has made an affirmative recommendation on said
request for variation; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine
and find that said variation is in harmony with the general purpose and intent of the Sign
Ordinance, and that (1) the ordinance in question would cause undue and unnecessary hardship
to the sign user because of unique or unusual conditions pertaining to the property, (2) the
granting of the requested variances will not be materially detrimental to the property owners in
the vicinity, (3) the unusual conditions applying to the specific property do not apply generally
to other properties in the Village, and (4) the granting of the variances will not be contrary to the
general objective of this title of moderating the size, number and obtrusive placement of signs and
the reduction of clutter.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities.
Section 2. Variations are hereby granted to Sections 14.20.050 and 14.20.070 of the
Village Sign Code Ordinance to the following legally described real property:
See Exhibit "A" attached hereto.
The specific variations permit the installation of a ground sign per the drawing and plat
of survey attached to the petition.
The variations are conditioned upon the sign being constructed in compliance with the plans
and exhibits submitted to and approved by the Village.

Com.Horwitz observed that the neighbor's fence is also located outside of the utility easement. He asked
who would maintain the area in between? He would prefer to have the fence setback farther than 10 feet.
Mr.Richards said the Village mows most of the space.He has been mowing the rest and will continue to
do so.
Ch.Entman referred to Mr.Schar's memo that states"the rear of this property abuts an area that provides
access to Outlot"B",which is owned and maintained by the Village of Buffalo Grove. He would also like
to have the fence set back farther the Village Engineer's recommendation.
Com Krakauer saw the neighbor's landscaping at 425 Mayfair Lane and said the fence would look better if
it is setback seventeen to twenty feet from the sidewalk.
Mr. Richards responded that he understands he could put up a three(3)foot fence out to the sidewalk if it is
broken. He is only requesting a four(4)foot fence and he does not want to go all the way to the sidewalk.
After disucssion,the Commissioners and Mr.Richards agreed on a location fifteen(15)feet from the
sidewalk.
Com.Windecker made the following motion:
I move we grant the request of Kevin and Dawn Richards,541 Mulberry Court,
for variance of Municipal Code,Section 15.20.040,pertaining to Residential
Districts,for the purpose of installing a four(4)foot wood picket fence that would
be located a distance of fifteen(15)feet from the sidewalk along Mayfair Lane,per
an amended petition to be submitted with an application to the Building Department.
Unique circumstances having been demonstrated,the proposed fence will not be
detrimental to the public health,safety and welfare and will not alter the essential
character of the neighborhood.

Mr.Joe Dudzinski,Branch Manager,Trane, 1622 Barclay Boulevard,Buffalo Grove,IL (220-1671)
Was sworn in. Notice of the public hearing was published in the Daily Herald on May 31,1 2000.
Mr.Dudzinski was authorized by Ms.Kathi Rogers to make the presentation.
Mr.Dudzinski said Trane is a commercial heating and air-conditioning company. The building is located
at the southwest comer of the fast lot in the Rogers Center for Commerce.The existing landscaping and the
Pace bus stop hides the building. The 3'6"x 3' single-faced non-illuminated sign will permit contractors to
find the building. If the sign is placed in front of the building,it will not be seen,so with the landlord's
approval,it will be located between parking lot and the pond. It will be seen after turning into the parking
lot from Aptakisic Road. They work through commercial contractors and have no walk-in business.
The main purpose of the sign is to identify the product"TRANE"and they have a five(5)year lease.

Com.Lesser asked if there were any other signs on Barclay Boulevard. He would not want to see a lot of
different signs. Would this sign set a precedence.
Mr. Schar recalled that a Havitol sign at the south end of the Rogers Center that was approved several
years ago but he did not know if it is still there.
Mr.Dudzinski said there are many other signs down Barclay. W.W.Granger and Gustave Larsons.are
competitors and both of these companies have large signs.
Com. Teplinsky had no objection to this sign and said the Zoning Board has the ability to police any
activity on Barclay Boulevard in the future.
Ch. Entman affirmed that the policy has been to review each petition on its face and act accordingly.
Com.Horwitz said he has observed many other facilities had illuminated window signs. Would Trane
consider a window sign?
Mr.Dudzinski said they typically have a logo decal on the window and doors,with ground signs.
Com.Krakauer knows the Larsons sign is quite large and Trane needs some identification.
Christine Devitt, 1253 Selwyn Lane,said she likes signs because they indicate a healthy economy.
Com. Windecker made the following motion:
I move we recommend to the Village Board of Trustees that the request
made by Rogers Center of Commerce on behalf of The Trane Company,
1622 Barclay Boulevard,be granted.that would permit variance of Sign
Code Section 14.20.050,pertaining to Industrial Districts and Section
14.20.070 pertaining to Ground Signs for the purpose of installing a
ground sign.per the drawing and plat of survey attached to the petition.
Sign to be approved pursuant to Sign Code,Section 14.44.010, Sub-
section A.

ORDINANCE NO. 2000-
AN ORDINANCE AUTHORIZING PARTICIPATION IN AN
INTERGOVERNMENTAL JOINT PURCHASING PROGRAM
RELATED TO THE PURCHASE OF ELECTRIC SUPPLY SERVICE
WHEREAS, the Village of Buffalo Grove (the"Municipality") expends a
significant amount of funds in the purchase of electricity; and,
WHEREAS,the Municipality would benefit from obtaining lower prices
for its purchases of electricity; and,
WHEREAS,the Local Government Electric Power Alliance (the
"Alliance"), an Illinois not-for-profit corporation, whose members include the City of
Chicago, Chicago Park District, Chicago Transit Authority, City Colleges of Chicago and
Chicago School Reform Board of Trustees (collectively, the"Alliance Members"),
intends to issue a request for proposals for the purchase of electric supply service (the
"RFP")by some or all Alliance Members and other governmental entities identified in
the RFP (collectively,the "Participants"); and,
WHEREAS,the Participants will be required to purchase electricity from
the electric utility or the alternative electric retail supplier selected by the Alliance
pursuant to the RFP (the "Selected RES"); and,
WHEREAS, it is anticipated that each Participant that purchases
electricity using a contract between it and the Selected RES,that is entered into pursuant
to the RFP, will be able to obtain more competitive prices for its purchases than if it
separately negotiated a purchase price; and,
WHEREAS,the Municipality has determined that it would be beneficial
to be a Participant; and,
WHEREAS, the Municipality is a home rule unit of government by virtue
of the provisions of the Constitution of the State of Illinois of 1970, and as such, may
exercise any power and perform any function pertaining to its government and affairs;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE
PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO
GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows:
SECTION 1. The foregoing recitals are incorporated as if fully set forth here.

SECTION 2. The Village Manager(the"Authorized Individual") is authorized
to sign a letter acknowledging that (i)the Alliance intends to name the Municipality in
the RFP as an entity that will purchase electricity from the Selected RES, (ii)the
Municipality will provide the Alliance with requested information relating to its
anticipated usage of electricity, and(iii) any of the Municipality's electric purchases from
the Selected RES will be counted toward the usage levels used to determine the price of
electricity to Participants purchasing electricity from the Selected RES under agreements
entered into pursuant to the RFP.
SECTION 3. In order to preserve the integrity of the RFP procurement process,
the Authorized Individual is authorized to execute a confidentiality affidavit in
substantially the form attached hereto as Exhibit A.
SECTION 4. The Authorized Individual is authorized (a)to provide the Alliance
with information it requests relating to the Municipality's anticipated usage of electricity
and (b)to enter into an agreement with the Selected RES to purchase electric power(the
"Agreement"), under terms consistent with those negotiated by the Alliance with the
Selected RES. The Authorized Individual also is authorized to execute such agreements
and documents, and perform any and all acts on behalf of the Municipality as may be
necessary or advisable to effectuate the Agreement, subject to the approval as to form and
legality of the Village Attorney.
SECTION 5. This ordinance shall become effective immediately upon its
passage.

Confidentiality Affidavit
This confidentiality affidavit("Affidavit") is executed this 1 Oth day of July, 2000 by the
Village of Buffalo Grove, Illinois, (the "Party").
I. The Local Government Electric Power Alliance (the"Alliance") intends to (but
does not commit to) issue a request for proposals for electric supply service
("UP") and enter into an agreement pursuant to that RFP (the"Electric Supply
Service Program"). During the development of the RFP, and prior to, during and
after the review, evaluation, selection and negotiation of proposals and all
subsequent phases of the Electric Supply Service Program, the Party agrees that
all Information(as described below) is property of the Alliance and is confidential
except as specifically authorized in this Affidavit or as may be required by law.
The Party must not allow the Information to be made available to any other
individual or organization without the prior written consent of the Alliance. The
Party must implement any measures that are necessary to ensure that its
employees, elected officials,representatives, agents and consultants that have
access to any Information are bound by the confidentiality provisions contained in
this Affidavit.
II. For purposes of this Affidavit, Information means:
(A)any proposals, exhibits, documents, data, charts and other information, of any
kind or nature, submitted to the Alliance(or to the Party in anticipation of
such information being submitted to the Alliance)by any person or entity
whatsoever, including without limitation any electric utility or Alternative
Electric Retail Suppliers, as defined in Section 16-102 of Illinois Public Act
90-561 (collectively, "RES"), contractor or consultant, or prepared by or
assembled by the Alliance and/or any of its consultants or contractors,relating
to any aspect of the Electric Supply Service Program, and encountered by the
Party in any way whatsoever; and
(B)any data of whatever kind or nature, including without limitation any notes,
work product, charts, graphs, evaluation sheets,numerical ratings and grades,
in any form whatsoever,prepared or encountered by the Party or acquired by
the Party during its participation in any aspect of Electric Supply Service
Program and relating to the evaluation of proposals and/or negotiation of term
sheets, agreements or any terms thereof or relating to matters of whatever
nature pertaining to the Electric Supply Service Program; and
(C)any statements or communications, whether oral or written, relating to the
evaluation of the materials referred to in paragraph (A) above or the
negotiation of term sheets, agreements or terms thereof or the materials
referred to in paragraph(B) above pertaining to the Electric Supply Service

Program, and encountered by the Party, whether in telephone calls, meetings,
discussions, negotiations, oral presentations or otherwise.
III. The Party must maintain, while in the Party's possession and/or control,the
Information in such a way as to assure confidentiality, subject to the exceptions
set forth in Sections V and VI below. The Party understands that the
dissemination of Information may jeopardize the integrity of the entire
procurement process and that the RFP process may be terminated if a violation of
confidentiality occurs. Therefore, the Party agrees to cooperate in and commit
itself to preserving the confidentiality of the process and all Information as
described herein.
IV. The Party must not issue any publicity news releases or grant press interviews
regarding the Electric Supply Service Program without the prior written consent
of a board member of the Alliance, or his/her duly authorized designee.
V. If the Party is presented with a request for documents by any administrative
agency or with a subpoena duces tecum regarding any records, data or documents
which may be in the Party's possession by reason of services performed or any
other involvement with the Electric Supply Service Program,the Party must
immediately give notice to the Alliance with the understanding that the Alliance
will have the opportunity to contest such process by any means available to it
before the records or documents are submitted to a court or other third party. The
Party, however, is not obligated to withhold the delivery beyond the time ordered
by the court of administrative agency, unless the subpoena or request is quashed
or the time to produce is otherwise extended.
VI. A. Notwithstanding the foregoing,the Party will not be prohibited from
disclosing or participating in the disclosure of any Information to the extent
(i) disclosure is required by law or legal process with the understanding that the
Alliance will have the opportunity to contest such required disclosure by any
means available to it in accordance with Section V above; (ii) such Information is
generally available to the public, other than as a result of a disclosure prohibited
hereby; (iii)that is required to be disclosed in connection with any suit, action or
proceeding in connection with the enforcement of rights by the Party or any other
participant in the RFP or any agreements executed in connection with it; (iv) such
Information is disclosed pursuant to the prior written authorization of the
Alliance; or(v)that the information is related to how the type of transaction is
generally structured but not information related specifically to the Electric Supply
Service Program.
B. In addition to the foregoing, nothing in this Affidavit will preclude the
Party from communicating (either by telephone or personal meeting)with any
RES that has been selected by the Alliance,provided that the following occurs
before such communication is initiated; (1)the Party provides the Alliance with
reasonable advance notice of the meeting or telephone conference,the

opportunity to participate in it, and a description of the matters to be discussed
during the meeting or telephone call, (2) if the Alliance elects not to participate in
the communication,the Party obtains the prior approval of the Alliance for the
Party to engage in the meeting or telephone conference and submits written
confirmation of such prior approval to the Alliance by e-mail or facsimile prior to
engaging in the communication, (3)the Party does not disclose any Information
to the RES except for(a) Information that is part of such RES's proposal, or(b)
Information that may be disclosed under paragraph VI hereof, but only elicits
information from the RES, and (4) if the Alliance elects not to participate in the
communication,the Party promptly after the meeting or telephone conference
shares the information with the Alliance.
C. This Affidavit is executed for the sole benefit of the Alliance and does not
create rights in any other party.
