NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1 The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. The petitioner, testified at the public hearing and presented documentary evidence. No individuals testified on behalf of the applicant. No objectors appeared at the hearing. No written objections were received. V. FINDINGS: The Zoning Board of Appeals finds that the Petitioner's request for a variation for the purpose of constructing an addition that would encroach a distance of meets the criteria, set forth in Section 17.52.070, in that: A.1. Notice of the public hearing was published in the Daily Herald on September 29, 2000. Mr. Pfingston requested a variance because they need more living space and do not want to move to a different home. They have a Buckingham model and there many houses in the area that have this hind of addition. He asked for the specific reason for requiring a variance. Mr. Schar explained that the house was constructed with the combined side yards less than fourteen (14) feet and the variance will bring the house in to conformance with the requirements of the Ordinance. The Commissioners had no questions or objections. Mr. Pfingston said the materials for the addition will match the existing house. Com. Windecker made the following motion: I move we recommend that the Village Board of Trustees grant the request made by Robert and Nancy Pfingston, 1073 Whitehall Drive, for variance of Zoning Ordinance, Section 17.40.020, pertaining to Area, Height, Bulb and Placement Regulations, that would permit construction of an addition that would allow the combined side yards to be thirteen (13) feet, six(6) inches, which is six (6) inches less than the required fourteen (14) feet, per the plat of survey submitted with the application. Petitioner having exhibited hardship and unique circumstances, the variance will not affect the essential character of the neighborhood.
