ROLL CALL Roll Call indicated the following present: President Hartstein;Trustees Braiman,Glover,Berman,Johnson,Kahn and Trilling. PROCLAMATION-PUBLIC WORKS WEEK President Hartstein read the proclamation i nd commended the Village's Public Works Department for the exemplary job they do daily. Acting Superintendent uhl,on behalf of the Forestry Division,presented the Village President and Board of Trustees with the 2003 Tree City Award for the 16th consecutive season and thanked the Board for their continued support of the program. 11488 4/19/2004 SOLUTION No..2004-9-Commending Superintendent Douglas Parks President Hartstein read the resolution cor imending Dr.Parks for his distinguished years of service as superintendent of School District 102. Moved by Braiman,seconded by Berman o approve Resolution No.2004-9. Upon voice vote the motion was unanimously declared carried. TRANSPORTATION ISSUES Trustee Berman reminded residents of a h aring of the House committee of the State Toll Highway Authority to discuss transportation issues effecting our ommunity including Route 53 extension. The meeting will be held on Friday,April 23 at 10:00 a.m.at Village E all. Representatives Ryg and Mathias are participants in the House Committee. He extended an invitation to 4 ome in person or send testimony to their offices. MANAGEMENT REPORT Mr.Balling noted the submittal of the Mat agement Report for the month of March,2004;there were no questions on same. PROPERTY TAX Mr.Balling announced that property tax r es for tax year 2003 were the lowest real estate rates for Lake County in the history of Buffalo Grove. Cook County ru mbers will be released this summer which will give the total levy for Buffalo Grove. PUBLIC HEA G-2004-2005 APPROPRIATION ORDINANCE The Public Hearing was called to order at :05 p.m. Mr.Anderson summarized the Appropriation Ordinance. Trustee Berman clarified that the appropri ion numbers are not spending numbers and that spending will not rise }� above the approved budget numbers withoi it coming back to the Board for approval. President Hartstein asked if there were any other questions or comments from any member of the public or other taxing districts or the Board. There were none. The Public Hearing was adjourned at 8:09 .m. QUESTIONS FROM THE AUDIENCE President Hartstein asked if there were any questions from the audience on items not on the agenda;there were none. CONSENT AGENDA President Hartstein explained the Consent genda,stating that any member of the audience or the Board could request that an item be removed for full discussion there were no such requests. He noted that Clark is the only applicator in the area willing to participate e, in the bidding process. He recommended a contract extension as recommended by Health Officer Brian Sheehan. Moved by Braiman,seconded by Glover t adopt the 2004 Clarke Environmental Mosquito Management contract in accordance with the information provided. BUF ALO GROVE BANK&TRUST-Water and Sewer Service Agreement Amy Kurson representing the Bank addre ed the Board requesting a temporary connection to the water and sewer service for a temporary office on the site. hould the annexation not take place,there is a sunset clause that would take effect and the service would be revoked. Trustee Berman asked why there was a nei d to open a temporary bank and ask for the water and sewer connection before the petitioner met with the Plan Co 'ssion. He sees no need to provide services outside the corporate boundaries. He wants the Plan Commissi to decide the zoning first and not think the Board has already approved the project without going through the entire pr cess. Trustee Braiman reminded Ms.Kurson th the Village will be held harmless and that it is at the risk of the petitioner that this agreement be approved before anr xation takes place. He sees this as an opportunity to be business friendly. 11490 4/19/04 Trustee Glover does not want the Plan Cc mniission to feel pressure from the Board to approve something they may not feel is in the best interest of the Village. he sees traffic and safety as problems that face the Plan Commission with this project. Staff has been working with ASAP Software representatives regarding expansion of their business in Buffalo Grove. The company is one of the largest and fastest-growing software service providers in the nation and their "worldwide headquarters" are located at 850 Asbury Drive. The property is zoned in the Industrial District. ASAP's existing facility at 850 Asbury Drive is approximately 40,000 sq.ft. on a site of 5.71 acres. The proposed expansion includes annexation of an unincorporated parcel of 6.676 acres west of the current site. The expansion is planned in two phases. Phase 1 would include a building addition of approximately 24,000 s.f. and new parking areas. Phase 2 is planned as a 25,000 building addition and additional parking. The plan also contemplates a future warehouse area of 13,000 sq.ft.on the south side of the existing building. The annexation agreement approves the site plan dated April 28, 2004 and would allow the expansion to proceed with submittal of the plat of subdivision, appearance plans and the appropriate permit documents. WITNESSETH: WHEREAS, in compliance with the Village's Development Ordinance and pursuant to the Annexation Agreement (Annexation Agreement or PUD Ordinance or Agreement) dated February 4, 1991 , Developer has submitted to the Village a Plat of Subdivision designated as Exhibit "A , attached hereto, which Subdivision Plat has been approved by the Plan Commission of the Village, and, Developer desires to improve the real property described in said Subdivision Plat; and, WHEREAS, the Village is willing to approve said Subdivision Plat, provided that this Agreement is executed to insure the completion of certain site improvements, as a condition precedent to the issuance of building permits for any buildings to be constructed on the property. NOW, THEREFORE, it is mutually agreed as follows: 1. Developer shall furnish, or cause to be furnished, at their own cost and expense, all the necessary material, labor, and equipment to complete the improvements listed on Exhibit "B" attached hereto, and all other site improvements not specifically set forth, which are required by applicable ordinances or agreements, all in a good and workmanlike manner and in accordance with all pertinent ordinances and regulations of the Village and in accordance with the plans and specifications, dated March 23, 2004 as shown on Exhibit "C" attached hereto, including any subsequent revisions requested by the Developer and approved in writing by the Village pursuant to the Village's Development Ordinance, which Exhibit has been prepared by Doherty & Associates, who are registered professional engineers and Exhibit "D", attached hereto consisting of the Landscaping Plan and as approved by the Village. All utility lines and services to be installed in the street shall be installed prior to paving. 2. Attached hereto as Exhibit "E" is a complete cost estimate for the construction of the improvements described in Exhibit "B" hereto. Upon the execution of this Agreement and prior to the recordation of the Plat of Subdivision, the Developer shall deposit a Letter of Credit, or other security, acceptable to and in a form and substance approved by the Village as further described in Paragraph 9 herein. The Letter of Credit or other security shall originally be in the amount of $68,429.00. 3. All work shall be subject to inspection by and the approval of the Village Engineer. It is agreed that the contractors who are engaged to construct the improvements described in Paragraph 1 hereof are to be approved by the Village Engineer and that such approval will not be unreasonably withheld. 4. The Developer has paid the Village a Review and Inspection Fee, as required by Ordinance. It is understood that said fee is based on the amount of the contracts or cost estimate for those items listed in Exhibit "B" . 5. Prior to the time the Developer or any of its contractors begin any of the work provided for herein, the Developer, and/or its contractors shall furnish the Village with evidence of insurance covering their employees in such amounts and coverage as is acceptable to the Village. In addition, by its execution of this Agreement, the Developer agrees to protect, indemnify, save and hold harmless, and defend the Village of Buffalo Grove and its employees, officials, and agents, against 2 any and all claims, costs, causes, actions, and expenses, including but not limited to attorney's fees incurred by reason of a lawsuit or claim for damages or compensation arising in favor of any person, corporation or other entity, including the employees or officers or independent contractors or sub-contractors of the Developer or the Village, on account of personal injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly, from the performance of work by the Developer, independent contractors or sub- contractors or their officers, agents, or employees. The Developer shall have no liability or damages for the costs incident thereto caused by the sole negligence of the Village. This hold harmless shall be applicable to any actions of the Developer, independent contractor, or sub-contractor prior to the date of this Agreement if such prior actions were approved by the Village. 6. The Developer shall cause said improvements herein described to be completed within twenty-four (24) months following the approval of the Plat as shown in Exhibit "A" by the President and Board of Trustees, except Public Parks and Detention Areas which shall be completed within twelve (12) months, and except any improvements for which specified time limits are noted on the approved plans, Exhibit "C" which shall be completed within the specified time limits shown on the plans. If work is not completed within the time prescribed herein, the Village shall have the right to call upon the Letter of Credit, or other security, in accordance with its terms, for the purpose of completing the site improvements. Upon completion of the improvements herein provided for, as evidenced by the certificate or certificates of the Village President and Board of Trustees, the Village shall be deemed to have accepted said improvements, and thereupon, the Letter of Credit, or other security, shall automatically be reduced to serve as security for the obligations of the Developer as set forth in Paragraph 7 hereof. The Developer shall 3 cause its consulting engineers to correct drawings to show work as actually constructed and said engineers shall turn over high quality Mylar reproducible copies thereof to the Village to become the village's property prior to acceptance of the improvements by the President and Board of Trustees. 7. The Developer for a period of one year beyond formal acceptance by the Village of any improvement described in Exhibit "B" hereof, shall be responsible for maintenance repairs and corrections to such improvements which may be required due to failures or on account of faulty construction or due to the developers and/or contractors negligence. The obligation of the Developer hereunder shall be secured by the Letter of Credit, or other security as further described in Paragraph 9 hereof. 8. It is agreed that no building permit shall be granted by any official for the construction of any structure until required utility facilities (to include, but not by way of limitation, sanitary sewer, water and storm sewer systems) have been installed and made ready to service the individual lots concerned; and that roadways (to include curbs) providing access to the subject lot or lots have been completely constructed except for the designed surface course. It is understood and agreed that building permits may be granted for buildings on specific lots to which utility facilities have been installed and made ready for service and to which roadways have been constructed as described above, notwithstanding the fact that all improvements within the Development may not be completed. 9.A. The obligations of the Developer hereunder as to the deposit of security for the completion of improvements (Exhibit "B" hereof) and the one year maintenance of said improvements after acceptance by the Village (Paragraph 7) shall be satisfied upon delivery to the ^Village of a Letter of Credit, or other security, issued by �i /�n/,�� in 4 favor of the Village in a form acceptable to the Village. The Letter of Credit or other form of security shall be made subject to this Agreement. B. In addition to the terms, conditions, and covenants of the Letter of Credit, or other security, the Village hereby agrees to draw funds or to call said performance guarantee under such security solely for the purpose of payment for labor and materials supplied or to be supplied, by engineers, contractors, or subcontractors, to, or for the benefit of Lot 2 - Maristal Resubdivision, or the Village, as the case may be, under the provisions of this Agreement and the said improvements for which payment is being made shall have been completed, or will be completed, in substantial accordance with the plans and specifications described herein. C. The village further hereby agrees that to the extent that the Developer causes the commitments of this Agreement to be completed, the outstanding liability of the issuer of the Letter of Credit, or other security, under said security, shall during the course of construction of the improvements, approximate the cost of completing all improvements and paying unpaid contract balances for the completion of the improvements referred to in this Agreement. Until all required tests have been submitted and approved by the village for each of the construction elements including, but not limited to, earthwork, street pavements, parking area pavements, sanitary sewers and watermains, a minimum of that portion of the surety for each element shall be subject to complete retention. All improvements are subject to a minimum fifteen (15%) percent retention until final acceptance by the Village. D. In order to guarantee and warranty the obligations of paragraph 7 herein, an amount equal to fifteen (15%) percent of the total amount of the Letter of Credit, or other security, or an amount equal to fifteen (15%) percent of the cost estimate of the individual improvement (s) shall be retained in the Letter of Credit, or other 5 security for a period of one year beyond formal acceptance by the Village of the improvement(s) . E. As a portion of the security amount specified in Paragraph 2, the Developer shall maintain a cash deposit with the Village Clerk in the amount of Five Thousand Dollars ($ 5,000.00--------) . If roads are not maintained with a smooth and firm surface reasonably adequate for access of emergency vehicles such as fire trucks and ambulances, or if any condition develops which is deemed a danger to public health or safety by the Village of Buffalo Grove due to the actions of the Developer or his failure to act; and after written notice of this condition, the Developer fails to immediately remedy the condition; then the Village may take action to remedy the situation and charge any expenses which results from the action to remedy the situation to the cash deposit. Upon notification that the cash deposit has been drawn upon, the Developer shall immediately deposit sufficient funds to maintain the deposit in the amount of Five Thousand Dollars ($ 5,000.00------- ) . If the Developer has not made the additional deposit required to maintain the total cash deposit in the amount of Five Thousand Dollars ($ 5,000.00---------) within three (3) days from the date he received notice that such additional deposit was required, it is agreed that the Village may issue a Stop Work Order or also may revoke all permits which the Developer had been granted. This cash deposit shall continue to be maintained until the maintenance guarantee period has lapsed. The deposit may be drawn upon by the Village if the conditions of this Agreement, except in cases of danger to public health and safety as determined by the Village in which case the deposit may be drawn upon immediately following notice to the Developer and his failure to immediately remedy the situation. After termination of the one year maintenance period and upon receipt by the Village Clerk of a written request for release of the deposit, the Village will either notify the 6 Developer that the improvements are not in a proper condition for final release of the deposit, or shall release the deposit within fifteen (15) days. F. In addition to the terms, covenants, and conditions of the Letter of Credit, or other security, the Developer hereby agrees that no reduction shall occur in the outstanding liability of the issuer thereunder, except on the written approval of the Village; however, in all events, the Village shall permit such Letter of Credit, or other security, to expire, either by its terms, or by return of such Letter of Credit, or other security to the Developer, upon the expiration of one (1) year from the acceptance of the improvements referred to herein by the Village. To the extent that the provisions of Paragraph 9 herein, and of the Letter of Credit, or other security, permit the Village to draw funds under such Letter of Credit, or other security, the Village hereby agrees to reduce the outstanding liability of the issuer of the Letter of Credit, or other security to the extent that funds are disbursed. 10. Any Letter of Credit, or other security shall provide that the issuer thereof shall not cancel or otherwise terminate said security without a written notice being given to the Village between thirty (30) days and forty-five (45) days in advance of termination or cancellation. 11. Developer shall install any additional storm sewers and/or inlets which are required in order to eliminate standing water or conditions of excessive sogginess which may, in the opinion of the Village Engineer, be detrimental to the growth and maintenance of lawn grasses. 12. No occupancy permit shall be issued until all exterior lighting specified on Exhibit "C" is installed and operational. 13 . The Developer acknowledges that until final acceptance, he is responsible for providing snow and ice control along any streets within the Development, which are adjacent to occupied properties or necessary to provide access to occupied properties. The Developer agrees to pay the 7 Village an annual fee for providing snow and ice control along these streets. The fee rate shall not exceed the Village's average budgeted snow and ice control cost per mile of Village streets for which this service is provided with a minimum charge being based upon one-half (1/2) mile. It is the Developers responsibility to provide a map of the applicable areas and the fee payment within thirty (30) days of notification of the annual fee rate. If not paid, the fee may be withdrawn by the Village from the cash deposit described in Paragraph 9-E. 14. The Developer acknowledges that he is responsible for the proper control of weeds, grass, refuse, and junk on all property which he owns within the Village in accordance with Chapter 8.32 of the Buffalo Grove Municipal Code. It is further agreed that the Developer shall continue to be responsible for the proper maintenance of any parcels of property for which the Developer transfers ownership to the Village until such time as the Development's improvements are accepted by the Village in writing in accordance with the provisions of this agreement. If the Developer fails to perform his maintenance responsibilities established in either this paragraph or Chapter 8.32, the Village may provide a written notice to the Developer of the improper maintenance condition. If proper maintenance is not completed within ten (10) days after the Developer is provided this notice, the Village may perform the maintenance and deduct the costs of the maintenance from the cash deposit described in Paragraph 9. is. The Developer agrees that no improvements constructed in conjunction with this project are sized or located in such a way as to warrant any recapture payment to the Developer pursuant to any applicable previous agreements. 16. This Agreement and the obligations contained herein are in addition to, and not in limitation of, all other agreements between the 8 Parties hereto including, without limitation, the Annexation Agreement (Annexation Agreement or PUD Ordinance) dated February 4, 2001 and the obligations contained therein. 17. We proposed a no parking restriction throughout the subdivision which was consistent with the County's "no parking throughout the subdivision" regulation. Several residents asked the Village to consider parking along Linden and Chevy Chase Drive; a deferral of the proposed Ordinance was recommended so staff could meet with the residents on site and review their recommendation(s). Below is an overview of issues, and a recommendation consistent with the attached Ordinance. 1) The streets in the subdivision are approximately twenty feet in width. The Village's regulations prohibit parking of a vehicle at any location were the remaining pavement width would be reduced to less than 18 feet. By allowing cars on one side of the street, the width of the roads in this subdivision would be reduced from 20 feet to approximately 12 to 14' - not providing sufficient access for emergency vehicles. 2) The area is of a "ditch and shoulder" design as described by Dick Kuenkler, Village Engineer; as a result, parking on the roadway would likely damage the pavement edge and shoulder and cause increased maintenance costs for the Village. 3) Due to the fact that Chevy Chase Drive and Linden Avenue have homes on one side of the street only, it is possible to allow vehicles to park on one side of the roadway. RECOMMENDATION. Implement a no parking restriction on Marquette Place, Columbus Parkway, Prague Avenue, south side of Linden Avenue, and north and west portions of Chevy Chase Drive. The no parking regulation is consistent with the County's regulation that has been in place for many years. Allowing vehicles to park on one side of Linden and Chevy Chase could be permissible since there are no homes on the opposite side of the street thereby allowing emergency vehicles to access. Due to these emergency response and engineering concerns, on-street parking is not recommended throughout the subdivision. In an effort to accommodate the residents,homeowners would be allowed to call the Police Department if they were entertaining guests and needed temporary approval for street parking. The Police Department would provide a specific area where parking would be permitted, and during an established, temporary time frame,the Ordinance would not be enforced. Purpose Attached are is a proposed Ordinance to authorize Buffalo Grove Police Officers to seize and impound motor vehicles that are used in connection with illegal activities. Illegal activities include driving under the influence (DUI), 625 ILCS 5/11-501(a); and driving with a suspended or revoked license as a result of a DUI conviction, 625 ILCS 5/6-303. The fees that may be imposed are an administrative penalty of $500.00. The proposed policy embraces the philosophy that the Village Board has enacted of a safe community and high quality services. The Village has adopted a zero tolerance policy for certain traffic offenses such as impaired driving. This proposed program reinforces this zero tolerance policy, and also enables the abandoned vehicle to be removed from the roadway for safety purposes. The Village has had preliminary discussions with two authorized towing companies regarding the proposed program. The tow companies would charge for a towing fee and would waive the normal impound fee. Tow companies are reviewed on a regular basis by the Police Department and must meet standards such as hours of operation, 24 hour security, response time and other factors. The proposed policy also provides for additional revenue that would be used to continue to carry out the mission of the Village. Overview of the attached Proposed Ordinance - Addin2 Chapter 10/20, Vehicle Seizure & Impoundment. 1) Seizure/Impoundment When a police officer has reason to believe that a vehicle is subject to seizure and impoundment, the police officer and department shall: a.) Conduct the arrest of the driver. b.) Provide for the towing of the vehicle to an authorized facility approved by the Chief. c.) A designated civilian employee or sworn officer would be dispatched to the site to attend to the vehicle until the tow company provides service. This procedure would allow the police officer to carry forth their duties with the arrest and subsequent responsibilities. d.) The "owner of record" shall be notified by certified mail. A bond may be posted with the Department in the amount of$500; in which case the vehicle would be released to the owner of record (towing charges would still apply). A penalty of $500 paid to the Village and all applicable towing fees paid to the towing agenda, would also result in the release of the vehicle to the owner of record. 2) Notice &Hearing Within 5 business days after a vehicle is seized and impounded, the Police Department would notify the owner of record by certified mail of the alleged violation, of the fact of the seizure, the penalty assessed, and of their right to request a vehicle impoundment hearing. The notification documents are already prepared and available for review upon request. If a hearing is requested by the record owner, it must be made in writing to the Chief of Police no later than 10 business days after notice was mailed. The hearing date would be no more than 10 business days after a request for a hearing has been filed. The formal rules of evidence would not apply at the hearing and hearsay evidence shall be admissible. If the hearing officer determines by a preponderance of evidence that the vehicle was used in violation of the Village's regulations, then the owner would incur a penalty of$500. If the hearing officer does not determine by a preponderance of the evidence that the vehicle was used in such violation, an order would be issued for the return of the vehicle. ADMINISTRATIVE HEARING SYSTEM Purpose The primary purpose of the Administrative Hearing System is to enforce and adjudicate violations from the vehicle seizure and impoundment program. This System would provide for the Village Manager to appoint one or more qualified Hearing Officers to perform the functions set forth in the proposed Ordinance. The Hearing Officer would be employed as an independent contractor of the Village. They must be an attorney licensed to practice law in the State of Illinois for at least three years; be in good standing with the Illinois Supreme Court Attorney Registration and Disciplinary Commission; and complete a formal training program approved by the Village Manager and Attorney. Compensation for a Hearing Officer would be subject to Village Board approval. William Raysa, Village Attorney and Trustee Chuck Johnson, Public Safety Trustee Liaison, have met to review potential candidates to serve as Hearing Officers. Their reports will be sent to the Chief of Police for review and recommendation to the Village Manager for final approval. At the hearing, the Village would staff existing clerks to assist in the management of the hearings. The clerks would be responsible for tasks including but not limited to preparation of the docket, collection of payments made as a result of fines and/or penalties, and keeping accurate records of appearances and non--appearances at hearings,pleas entered,and others. ESTIMATED REVENUE/EXPENSES Based on a probable estimate of 500 DUI arrests in Buffalo Grove, the Village could generate approximately$200,000 to $250,000 gross from this proposed policy. Expenses incurred by the Village would include the following: 1) Cost of a Hearing Officer 2) Cost of a Clerk to process the paperwork during proceedings. In-house staff time would be utilized for the day-to-day operations of the program. 3) Towing fee (the impound fee would be waived). Reimbursement would be provided to towing agent based on hearing officer finding. 4) Certified mail expenses 5) Police Department Staffing - seizure ordinance operations would be sustained by current Police Department field operations staff. RECOMMENDATION It is recommended that the Village Board adopt the proposed program, to be effective beginning June 1, 2004. If approved, the Village would begin procedures to carry forth the policy as directed including identifying Hearing Officer(s) to carry forth the duties as detailed in the proposed Ordinance, executing agreements with authorized tow companies, printing Notice of Impoundments and other documentation, and conducting training for the Police Department. Chapter 10.20 is hereby added to the Village of Buffalo Grove Municipal Code as follows: Chapter 10.20 VEHICLE SEIZURE AND IMPOUNDMENT 10.20.010 Use of motor vehicles for unlawful purposes A. Definitions. For purposes of this Chapter: 1. "business day"means any day in which the office of the Village Clerk of the Village of Buffalo Grove is open to the public for a minimum of seven (7)hours. 2. "motor vehicle"means every vehicle which is self-propelled,including but not limited to automobiles, trucks,vans, motorcycles and motor scooters. 3. "owner of record"means the record title holder(s) of the vehicle. B. Conduct Prohibited. A motor vehicle that is used in connection with any of the following violations may be subject to seizure and impoundment by the Village, and the owner of record of said vehicle shall be liable to the Village for an administrative penalty of$500.00 plus any applicable towing fees. 1. Driving under the influence, as provided in section BG-11-501(a) of the Buffalo Grove Municipal Code or section 5111-501(a) of the Illinois Vehicle Code (625 ILCS 5111-501(a)), or 2. Driving with suspended or revoked license, as provided in section BG-6-303 of the Buffalo Grove Municipal Code or section 5/6-303 of the Illinois Vehicle Code (625 ILCS 5/6-303), as a result of a conviction pursuant to section 5111-501(a) of the Illinois Vehicle Code or section BG- 11-501(a)of the Buffalo Grove Municipal Code. C. Seizure and Impoundment. 1. Whenever a police officer has reason to believe that a vehicle is subject to seizure and impoundment pursuant to this Section, the police officer shall provide for the towing of the vehicle to a facility approved by the Chief of Police. This Section shall not apply if the vehicle used in the violation was stolen at that time and the theft was reported to the appropriate police authorities within 24 hours after the theft was discovered or reasonably should have been discovered. 2. The police officer shall notify any person identifying himself as the owner of the vehicle or any person who is found to be in control of the vehicle at the time of the alleged violation, if there is such a person, of the fact of the seizure and of the vehicle owner's right to request an administrative hearing to be conducted under this Section. D. Administrative Hearing. Within five (5) business days after a vehicle is seized and impounded pursuant to this Section, the Village shall notify by certified mail the owner of record of the owner's right to request a hearing to challenge whether a violation of this Section has occurred. The owner of record seeking a hearing must file a written request for a hearing with the Chief of Police or his designee no later than ten (10)business days after notice was mailed. The hearing date must be no more than ten (10) business days after a request for a hearing has been filed. All interested persons shall be given a reasonable opportunity to be heard at the hearing. The formal rules of evidence shall not apply at the hearing and hearsay evidence shall be admissible. If, after the hearing, the hearing officer determines by a preponderance of evidence that the vehicle was used in violation of this Section, then the hearing officer shall enter an order finding the owner of record of the vehicle civilly liable to the Village for the administrative penalty of$500.00. If, after a hearing, the hearing officer does not determine by a preponderance of the evidence that the vehicle was used in such a violation, the hearing officer shall enter an order finding for the owner and for the return of the vehicle If the owner of record requests a hearing but fails to appear at the hearing or fails to request a hearing in a timely manner, the owner of record shall be deemed to have waived his or her right to a hearing and the hearing officer shall enter a default order in favor of the Village in the amount of the administrative penalty . However, if the owner of record pays such penalty and the vehicle is returned to the owner, no default order need be entered if the owner is informed of his or her right to a hearing and signs a written waiver, in which case an order of liability shall be deemed to have been made when the Village receives the written waiver. E. Disposition of impounded vehicle. A penalty imposed pursuant to this Section shall constitute a debt due and owing the Village. A vehicle impounded pursuant to this Section shall remain impounded until: 1. the penalty of$500.00 is paid to the Village and all applicable towing fees are paid to the towing agent,in which case the owner of record shall be given possession of the vehicle, 2. a bond in the amount of$500.00 is posted with the Police Department and all applicable towing fees are paid to the towing agent, at which time the vehicle will be released to the owner of record, or 2 3. the vehicle is deemed abandoned, in which case the vehicle shall be disposed of in the manner provided by law for the disposition of abandoned vehicles. F. Posting of bond. If a bond in the amount of$500.00 is posted with the Police Department, the impounded vehicle shall be released to the owner of record; the owner of the vehicle shall still be liable to the towing agent for any applicable towing fees. If a $500.00 penalty is imposed for violation of this Section, the $500.00 bond will be forfeited to the Village; however if a violation of this Section is not proven by a preponderance of the evidence, the $500.00 bond will be returned to the person posting the bond. All bond money posted pursuant to this Section shall be held by the Village until the hearing officer issues a decision, or, if there is a judicial review, until the court issues its decision. G. Vehicle Possession. Any motor vehicle that is not reclaimed within 30 days after the expiration of the time during which the owner of record may seek judicial review of the Village's action under this Section, or the time at which a final judgment is rendered in favor of the Village, or the time a final administrative decision is rendered against an owner of record who is in default, may be disposed of as an unclaimed vehicle as provided by law, provided, however, that where proceedings have been instituted under state or federal drug asset forfeiture laws, the subject vehicle may not be disposed of by the Village except as consistent with those proceedings. Section 2. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict,hereby repealed. Section 3. If any provision, clause, sentence, paragraph, section, or part of this ordinance or application thereof to any person, firm, corporation,public agency or circumstance, shall, for any reason,be adjudged by a court of competent jurisdiction to be unconstitutional or invalid, said judgment shall not affect, impair or invalidate the remainder of this ordinance and the application of such provision to other persons, firms, corporations, or circumstances,but shall be confined in its operation to the provision, clause, sentence, paragraph, section, or part thereof directly involved in the controversy in which such judgment shall have been rendered and to the person, firm, corporation, or circumstances involved. Pursuant to the authority conferred upon home rule units under the Constitution of the State of Illinois of 1970, the President and Board of Trustees of the Village of Buffalo Grove finds that it is necessary and in the public interest of the Village of Buffalo Grove that the Municipal Code of the Village of Buffalo Grove, as amended, be and the same is hereby further amended by adding the following Chapter 2.62: CHAPTER 2.62: VILLAGE ADMINISTRATIVE HEARING SYSTEM 2.62.010 Establishment of Administrative Hearing System. A. There is hereby established and created within the Village an Administrative Hearing System to enforce and adjudicate violations ("Violations") of the following Chapters of the Municipal Code of the Village of Buffalo Grove (the "Code"), as the same have been, and may from time to time hereafter be, amended: 1. Chapter 10.20, Vehicle Seizure and Impoundment. 2. Such other Village ordinances and Code provisions as the President and Board of Trustees may from time-to-time designate. B. The provisions of Division 2.1 of Article 1 of the Illinois Municipal Code are hereby adopted and incorporated into this Chapter as if fully set forth herein. C. The provisions of this Chapter shall apply to administrative adjudication proceedings to the extent that they are not inconsistent with the provisions of the Code which set forth specific procedures for the administrative adjudication of particular Code provisions. 2.62.020 Hearing Procedures Non-Exclusive. The provisions of this Chapter shall not preclude the Village from using other methods or proceedings to enforce and adjudicate the Code or other ordinances of the Village, including, 1 without limitation, the institution of an action in the Lake County Circuit Court, the Cook County Circuit Court, the United States District Court, or any administrative proceeding. 2.62.030 Administrative Composition. The Administrative Hearing System shall provide for one or more Hearing Officers and a Code Hearing Unit, all with the power, authority, and limitations as set forth in this Chapter. 2.62.040 Hearing Officer. A. Appointment. The Village Manager shall appoint one or more qualified Hearing Officers to perform the functions set forth in this Section. B. Independent Contractor. A Hearing Officer shall be employed as an independent contractor of the Village and shall not be considered an employee of the Village. A Hearing Officer may be removed, with or without cause, by the Village Manager. C. Qualifications. To qualify as a Hearing Officer, an individual must: 1. Be an attorney licensed to practice law in the State of Illinois for at least three years; 2. Be in good standing with the Illinois Supreme Court Attorney Registration and Disciplinary Commission; 3. Complete a formal training program approved by the Village Manager and the Village Attorney consisting of: a. Instruction on the rules of procedure for administrative hearings; b. Orientation to each subject area of the Code that will be adjudicated; C. Observation of hearings conducted by Illinois municipalities that have adopted the administrative hearing system; and d. Participation in hypothetical hearings, including ruling on evidence and issuance of final orders. D. Compensation. Authorization for compensation for a Hearing Officer shall be made by the President and Board of Trustees through the Village's annual budget process. Compensation shall be determined by the Village Manager within approved budget limitations. E. Authority and Powers. Hearing Officers shall have all powers necessary to conduct fair and impartial hearings including, but limited to, the power to: 1. Hold conferences for the settlement or simplification of the issues; 2. Administer oaths and affirmations 3. Hear testimony and accept evidence that is relevant to the allegation of a Violation; 2 4. Issue subpoenas directing witnesses to appear and give relevant testimony at the Hearing, upon the request of the parties or their representatives; 5. Preserve and authenticate the record of the Hearing, including all exhibits and evidence introduced at the Hearing; 6. Issue a determination, based on the evidence presented at the Hearing, on whether a Violation occurred or exists. The Hearing Officer's determination shall be in writing and shall include a written finding of fact, decision, and order, including the fine, penalty, or other action with which the defendant must comply; and 7. Impose penalties consistent with applicable Code provisions and assess costs upon finding a defendant liable for the charged Violation, except as expressly provided in this Chapter. 2.62.050 Code Hearing Unit. A. Appointment. The Village Manager shall establish a Code Hearing Unit to perform the functions set forth in this Section. B. Authority and Jurisdiction. The Code Hearing Unit is hereby authorized, empowered, and directed to: 1. Recommend rules and regulations reasonably required to manage the Administrative Hearing System; 2. Adopt, distribute, and process all notices as may be required under this Chapter, or as may reasonably be required to carry out the purpose of this Chapter; 3. Collect payments made as a result of fines and/or penalties assessed after a final determination of liability; 4. Certify copies of final determinations of violations adjudicated pursuant to this Chapter, and any factual reports verifying the final determination of any liability that was issued in accordance with this Chapter or the laws of the State of Illinois, as from time to time amended; and 5. Keep accurate records of appearances and non-appearances at hearings, pleas entered, fines, and other penalties assessed and paid. 2.62.060 Violation Notice. A. A notice of any Violation ("Violation Notice") shall be issued by the persons authorized under this Chapter, shall contain information as to the nature of the Violation, shall be certified, and shall constitute prima facie evidence of the Violation cited. B. All full-time and part-time police officers, as well as other specifically authorized individuals of any department of the Village, shall have the authority to issue Violation Notices. 3 C. Any individual authorized to issue Violation Notices who detects a Violation, is authorized to issue a Violation Notice thereof and shall serve the Violation Notice in the manner set forth in the Code. D. The correctness of facts contained in any Violation Notice shall be certified by the person issuing the notice through signing his or her name to the Violation Notice at the time of issuance. E. The Code Hearing Unit shall retain the original or a facsimile of the Violation Notice and keep it as a record in the ordinary course of business. F. The Violation Notice or a copy thereof shall be admissible in any subsequent administrative or judicial proceeding to the extent permitted by law. 2.62.070 Service. A. Service of any Violation Notice shall be made as follows: 1. Handing the notice to the registered owner, operator or lessee of the vehicle, if present; or 2. Handing the notice to the person responsible for the ordinance Violation; or 3. Mailing the notice by certified mail to the person responsible for the ordinance Violation; or B. If service of notice is provided by mail for any Violation Notice or for any Hearing notice, said service shall be deemed sent and shall be complete on the date the notice is deposited, postage prepaid, in the United States mail. The counting of any time period as set forth in the Code shall begin to run on the date the notice is deposited, postage prepaid, in the United States mail. 2.62.080 Hearings. All Hearings conducted under the Administrative Hearing System shall be conducted by a Hearing Officer and shall be in accordance with the following rules and procedures: A. A record of the Hearing shall be made by tape recording or other appropriate means. B. The parties may be represented by counsel, present witnesses, and cross-examine opposing witnesses. C. The Hearing Officer may grant continuances only upon a finding of good cause. D. All testimony shall be given under oath or affirmation. E. Parties may request the Hearing Officer to issue, and the Hearing Officer shall have the authority to issue, subpoenas to direct the attendance and testimony of relevant witnesses and produce relevant documents. 4 F. The formal and technical rules of evidence shall not apply. Evidence, including hearsay, may be admitted only if it is of a type commonly relied upon by reasonably prudent persons in the conduct of their affairs. G. In a Hearing on the propriety of impoundment of a vehicle any sworn or affirmed report that (i) is prepared in the performance of a law enforcement officer's duties and (ii) sufficiently describes the circumstances leading to the impoundment, shall be admissible evidence of the vehicle owner's liability, unless rebutted by clear and convincing evidence H. Each Hearing shall culminate in a determination of liability or non-liability by the Hearing Officer or a determination of liability based upon the failure of the defendant to appear at the Hearing. I. The Hearing Officer shall, upon a determination of liability, assess fines and penalties in accordance with the Code. In addition, the Hearing Officer shall have the discretion to assess costs upon finding a defendant liable for the charged Violation. In no event shall the Hearing Officer have authority to: (a) impose a penalty of incarceration; or (b) impose a fine in excess of $1,000.00 for a Violation. J. The maximum monetary fine imposed under the Code shall be exclusive of costs of enforcement or costs incurred by the Village to secure compliance with the Village's Code and ordinances, and shall not be applicable to cases to enforce the collection of any tax imposed and collected by the Village. 2.62.090 Judicial Review. Any final decision by a Hearing Officer that a Violation does or does not exist shall constitute a final determination for purposes of judicial review and shall be subject to review under the Illinois Administrative Review Law (735 ILCS 5/3-101 et seq.). 2.62.100 Debt to the Village. Any fine, penalty or part of any fine or penalty assessed in accordance with the provisions of the Code and remaining unpaid after the exhaustion of, or the failure to exhaust, administrative procedures under this Chapter and the conclusion of any judicial review procedures, shall be a debt due and owing the Village, and, as such, may be collected in accordance with applicable law. 2.62.110 Enforcement of Judgments. A. After expiration of the period that judicial review under the Illinois Administrative Review Law may be sought for a final determination of any Violation, unless stayed by a court of competent jurisdiction, the findings, decision, and order of the Hearing Officer may be enforced in the same manner as a judgment entered by a court of competent jurisdiction. B. Prior to any expenses being fixed by the Hearing Officer pursuant to this subsection (B), the Village shall provide a notice to the defendant that states that the defendant shall appear at a Hearing before the Hearing Officer to determine whether the defendant has failed to comply with the judgment. The notice shall set the date for such Hearing that shall not be less than seven days from the date that notice is served. If notice is served by mail, the seven-day period shall begin to 5 run on the date that the notice is deposited in the mail. 2.62.120 Schedule of Fines /Penalties. For a Violation of any Village ordinance, fines and penalties shall be as established from time to time by the President and Board of Trustees. Section 2. In the event any part or parts of this ordinance shall be found to be unconstitutional by a court of competent jurisdiction, such unconstitutionality shall not affect the validity of the remaining parts of this ordinance. Section 3. This ordinance shall be in full force and effect after its passage, approval, and publication in the manner provided by law, but in no event prior to June 1, 2004. B. The solicitation or acceptance of gifts prohibited to be solicited or accepted under the Act, by any officer or any employee of the Village, is hereby prohibited. -1- C. The offering or making of gifts prohibited to be offered or made to an officer or employee of the Village under the Act, is hereby prohibited. D. The participation in political activities prohibited under the Act, by any officer or employee of the Village, is hereby prohibited. E. For purposes of this Chapter,the terms"officer"and"employee"shall be defined as set forth in 5 ILCS 430/70-5(c). F. The penalties for violations of this Chapter shall be the same as those penalties set forth in 5 ILCS 430/50-5 for similar violations of the Act. 2.49.020 Existing Ethics Ordinance. This Chapter does not repeal or otherwise amend or modify Chapter 2.48 of the Village Code which regulates the conduct of Village officers and employees. To the extent that Chapter 2.48 is less restrictive than this Chapter,then the provisions of this Chapter shall prevail in accordance with the provisions of 5 ILCS 430/70-5(a). 2.49.030 Future Amendments to State Officials and Employees Ethics Act. Any amendment to the Act that becomes effective after the effective date of this Chapter shall be incorporated into this Chapter by reference and shall be applicable to the solicitation, acceptance, offering and making of gifts and to prohibited political activities. However, any amendment that makes its provisions optional for adoption by municipalities shall not be incorporated into this Chapter by reference without formal action by the Corporate Authorities of the Village. 2.49.040 Future Declaration of Unconstitutionality of Act. A. If the Illinois Supreme Court declares the Act unconstitutional in its entirety, then this Chapter shall be repealed as of the date that the Illinois Supreme Court's decision becomes final and not subject to any further appeals or rehearings. This Chapter shall be deemed repealed without further action by the Corporate Authorities of the Village if the Act is found unconstitutional by the Illinois Supreme Court. B. The first bill,BB 3412,creates the"State Officials and Employees Ethics Act"and was enacted into law by Public Act 93-0615 and was effective November 19, 2003. The second bill, SB 702,became law pursuant to Public Act 93-0617 and was effective December 9, 2003. These two public acts must be read in conjunction with each other since P.A. 93-0617 made several amendments to P.A. 93-0615 that affect local governments. Both bills have now been codified into the Illinois statutes at 5 ELCS 430/1-1 et seq. The following discussion will set forth the combined requirements of these two new legislative acts. Application to Local Governments Section 5-15, entitled"Prohibited Political Activities"and Article 10, entitled"Gift Ban",of the new legislation are made applicable to governmental entities by means of Article 70. A "governmental entity"is defined as a unit of local government or a school district. (Section 1-5). Article 70, which is entitled"Governmental Entities", is set forth as follows: Article 70 Governmental Entities Sec. 70-5. Adoption by governmental entities. (b) Within 3 months after the effective date of this amendatory Act of the 93rd General Assembly,the Attorney General shall develop model ordinances and resolutions for the purpose of this Article. The Attorney General shall advise governmental entities on their contents and adoption. (c) As used in this Article, (i) an "officer"means an elected or appointed official;regardless of whether the official is compensated, and(ii) an"employee"means a full-time,part-time,or contractual employee. Sec.70-10. Penalties. A governmental entity may provide in the ordinance or resolution required by this Article for penalties similar to those provided in this Act for similar conduct. Sec. 70-15. Home rule preemption. This Article is a denial and limitation of home rule powers and functions in accordance with subsection (i)of Section 6 of Article VU of the Illinois Constitution, A home rule unit may not regulate the political activities of its officers and employees and the soliciting, offering, accepting, and making of gifts in a manner less restrictive than the provisions of Section 70-5 (as amended by 93-0617). The Illinois Attorney General's office has drafted a model ordinance pursuant to the Act which is available at the Attorney General's website(wwwag.state.iLus). The Attorney General's model ordinance has several provisions that are not statutorily required,e.g. creation of a Local Ethics Officer and Local Ethics Commission. Home rule units are preempted by this legislation from enacting any requirements that are less restrictive than the state public acts. Gift Ban P.A. 93-0617 (at Section 85)has repealed the Illinois State Gift Ban Act(5 ILCS 425/1 et seq.) ("Gift Ban Act") and replaced it with various provisions that are now contained in Article 10, entitled"Gift Ban", within the State Official and Employees Ethics Act("Ethics Act"). Several of the provisions found in Article 10 of the Ethics Act are the same as those previously set forth in the Gift Ban Act. The new Gift Ban RAYSACZIMMERMANN, LTD. The general concept remains the same between the previous Gift Ban Act and the new Gift Ban Article 10 of the Ethics Act and that is that an"officer"or"employee"of a "governmental entity"is prohibited from either soliciting or accepting a"gift"from a "prohibited source." The definition of"gift" (at Section 1-5)remains the same as before and is defined as: any gratuity,discount,entertainment,hospitality,loan,forbearance,or other tangible item having monetary value including,but not limited to,cash,food and drink, and honoraria for speaking engagements related to or attributable to government employment or the official position of an employee, . . ., or officer." A"prohibited source"is defined as any person or entity who: 1. Is seeking official action-by an officer or employee; 2. Does business or seeks to do business with an officer or employee; 3. Conducts activities regulated by the officer or employee; 4. Has interests that may be substantially affected by the performance of the official duties of the officer or employee;or 5. Is registered or required to be registered under the Lobbyist Registration Act. Under the previous State Gift Ban Act, an official was included within the definition of employee. Pursuant to new Section 70-5(c),separate definitions are created whereby an"officer" means an elected or appointed official regardless of whether the official is compensated. An"employee"retains the same broad definition as including a full-time,part-time or contractual employee. The Ban also applies to and includes the spouse of and immediate family living with the officer or employee. The Gift Ban Act provided that no "prohibited source"shall offer or make a gift that violates this Section". The new Section 10-10 provides that no prohibited source shall"intentionally"offer or make a prohibited gift. The difference in these two sections is the mens rea or mental state necessary for a violation has increased to require an intentional violation. RAYSA&ZIMMERMANN, LTD. ATTORNEYS AT LAW Mr.William Balling April 27,2004 Page 4 In the former Illinois State Gift Ban Act,there were 23 exceptions to the ban on gifts. The new law only has twelve(12)exceptions. Briefly,here are the 12 exceptions in a condensed format: 1. Opportunities,benefits and services available to the general public; 2. Anything which the official bought at fair market value; 3. Political/fundraising contributions; 4. Educational materials and missions; 5. Travel expenses to a meeting to discuss State business; 6. Gifts from relatives; 7. Personal friendship gifts; 8. Food or refreshments not exceeding$75 per person per day,provided they are consumed on the premises from which they were purchased or prepared or were catered; 9. Any benefits resulting from outside business or employment; 10. Intra-office or inter-office gifts; 11. Transfers at time of death; 12. Any items with a cumulative calendar year total of less than$100 from one source. Each of these exceptions is mutually exclusive and independent of one another. These twelve categories of exceptions have been written into the law so that by state statutory standards these gifts are allowed if they meet the standards of the exception category. Those exceptions that were in the former Gift Ban Act but NOT retained in the new Ethics Act are: 1. Commercially reasonable loans; 2. Legal defense fund contributions; 3. Pension/benefit plans; 4. Informational materials; 5. Open public competitions/random drawings, awards, or prizes (although this category could be considered to similar to the available to the general public exceptions above); RAYSA�ZIMMERMANN, LTD. New Section 10-30 is similar to Section 25 of the former Gift Ban Act and is entitled "Disposition of Gifts". An officer or employee does not violate the ban on gifts if they promptly take reasonable action to either return the gift to its source or give the gift or an amount equal in value to a charity exempt under section 501(c)(3)of the Internal Revenue Code. The two new provisions are that(a)the action taken must now be prompt and reasonable and(b)the charity must be IRS exempt rather than just an"appropriate charity"which was the requirement under the Gift Ban Act. The new Ethics Act does not provide for(a) a local government ethics officer; or(b) state legislative ethics commission to whom complaints under the Gift Ban Act were to be made to. The Village of Buffalo Grove enacted the now repealed State Gift Ban Act, as Chapter 2.49 of the Buffalo Grove Municipal Code. State Officials and Em _lo ees Ethics Act Public Act 93-0615 creates new legislation which is entitled"The State Officials and Employees Ethics Act" ("Ethics Act"). Several of the reasons for enactment of the new Act were to "stop campaigning on State time" and to make it illegal to have a supervisor direct or require a subordinate to perform campaign functions,for example, sell tickets to a political fund raiser. ATTORNEYS AT LAW Mr.William Balling April 27,2004 Page 6 The definition of an officer and employee of a governmental entity is the same for Section 5-15 purposes, Section 5-15(a)of the Ethics Act(as applicable to local governments by Section 70-5) provides that an employee shall not intentionally perform any prohibited political activity during any compensated time(other than vacation,personal or compensatory time off). You then must go to Section 1-5 for the definition of"prohibited political activity. Section 1-5 lists the following 15 separate categories of what constitutes a prohibited political activity. (1) Preparing for,organizing,or participating in any political meeting,political rally,political demonstration, or other political event. (2) Soliciting contributions,including but not limited to the purchase of, selling, distributing,or receiving payment for tickets for any political fundraiser,political meeting, or other political event. (3) Soliciting, planning the solicitation of,or preparing any document or report regarding any thing of value intended as a campaign contribution. (4) Planning,conducting, or participating in a public opinion poll in connection with a campaign for elective office or on behalf of a political organization for political,purposes or for or against any referendum question. (5) Surveying or gathering information from potential or actual voters in an election to determine probable vote outcome in connection with a campaign for elective office or on behalf of a political organization for political purposes or for or against any referendum question. (6) Assisting at the polls on election day on behalf of any political organization or candidate for elective office or for or against any referendum question. (7) Soliciting votes on behalf of a candidate for elective office or a political organization or for or against any referendum question or helping in an effort to get voters to the polls. (10) Preparing or reviewing responses to candidate questionnaires in connection with a campaign for elective office or on behalf of a political organization for political purposes. (11) Distributing,preparing for distribution,or mailing campaign literature,campaign signs,or other campaign material on behalf of any candidate for elective office or for or against any referendum question. (12) Campaigning for any elective office or for or against any referendum question. (13) Managing or working on a campaign for elective office or for or against any referendum question. (14) Serving as a delegate, alternate,or proxy to a political party convention. (15) Participating in any recount or challenge to the outcome of any election. The foregoing categories are broad and all inclusive. By way of example,they would prohibit a local government employee during normal paid duty hours from participating in a political event,selling political fundraising tickets,soliciting votes on behalf of a candidate, or circulating a petition on behalf of a candidate. While "political" is defined, a"political meeting"or"rally"is not defined. For an employee to violate the act, four requirements are necessary: 1. an employee, 2. during compensated time, 3. must intentionally perform, 4. a prohibited political activity. An officer of a local governmental entity is defined in Section 70-5(c) as an elected or appointed official "regardless of whether the official is compensated." ATTORNEYS AT LAW Mr.William Balling April 27,2004 Page 8 Penalty A known violation of the former Illinois Gift Ban Act constituted a business offense and was subject to a fine of up to$5,000. Under new Section 50-5(c), any person who intentionally violates the gift ban restriction is guilty of a business offense and is subject to a fine of at least$1,001 and up to$5,000. Two changes are apparent in the new penalty section. First, a minimum fine of at least$1,001 is instituted. Second,there is a change in the mental state necessary for a violation. The previous requirement was that a person"knowingly" committed the violation; with the new requirement being"intentionally"violates the Act. The Illinois Criminal Code defines "knowingly"as when a person is consciously aware that his/her conduct is practically certain to cause a specific result. (720 ILCS 5/4-5). Whereas, "intentionally"is defined as when an individual's conscious objective or purpose is to accomplish a specific result. (720 ILCS 5/4-5). Selected Sections from the Act ARTICLE 70. GOVERNMENTAL ENTITIES 5 ILCS 430/70-5 §70-5.Adoption by governmental entities. (a)Within 6 months after the effective date of this Act, each governmental entity shall adopt an ordinance or resolution that regulates,in a manner no less restrictive than Section 5-15 and Article 10 of this Act,(i)the political activities of officers and employees of the governmental entity and(ii)the soliciting and accepting of gifts by and the offering and making of gifts to officers and employees of the governmental entity. (b)Within 3 months after the effective date of this amendatory Act of the 93rd General Assembly,the Attorney General shall develop model ordinances and resolutions for the purpose of this Article.The Attorney General shall advise governmental entities on their contents and adoption. (c)As used in this Article,(i)an"officer"means an elected or appointed official; regardless of whether the official is compensated, and(ii)an "employee"means a full- time,part-time, or contractual employee. ARTICLE 5. ETHICAL CONDUCT 5 ILCS 430/5-15 §5-15. Prohibited political activities. (a)State employees shall not intentionally perform any prohibited political activity during any compensated time(other than vacation,personal,or compensatory time off). State employees shall not intentionally misappropriate any State property or resources by engaging in any prohibited political activity for the benefit of any campaign for elective office or any political organization. (b)At no time shall any executive or legislative branch constitutional officer or any official,director, supervisor, or State employee intentionally misappropriate the services of any State employee by requiring that State employee to perform any prohibited political activity(i)as part of that employee's State duties,(ii)as a condition of State employment,or(iii)during any time off that is compensated by the State(such as vacation,personal,or compensatory time off). (c)A State employee shall not be required at any time to participate in any prohibited political activity in consideration for that State employee being awarded any additional compensation or employee benefit,in the form of a salary adjustment,bonus, compensatory time off,continued employment,or otherwise. (d)A State employee shall not be awarded any additional compensation or employee benefit,in the form of a salary adjustment,bonus, compensatory time off continued employment,or otherwise,in consideration for the State employee's participation in any prohibited political activity. (e)Nothing in this Section prohibits activities that are otherwise appropriate for a State employee to engage in as a part of his or her official State employment duties or activities that are undertaken by a State employee on a voluntary basis as permitted by law. (f)No person either(i)in a position that is subject to recognized merit principles of public employment or(ii)in a position the salary for which is paid in whole or in part by federal funds and that is subject to the Federal Standards for a Merit System of Personnel Administration applicable to grant-in-aid programs,shall be denied or deprived of State employment or tenure solely because he or she is a member or an officer of a political committee,of a political party,or of a political organization or club.. ARTICLE 10. GIFT BAN 5 ILCS 430/10-10 § 10-10.Gift ban. Except as otherwise provided in this Article,no officer,member,or State employee shall intentionally solicit or accept any gift from any prohibited source or in violation of any federal or State statute,rule,or regulation. This ban applies to and includes the spouse of and immediate family living with the officer,member, or State employee.No prohibited source shall intentionally offer or make a gift that violates this Section. 5 ILCS 430/10-15 § 10-15.Gift ban; exceptions. The restriction in Section 10-10 does not apply to the following: (1)Opportunities,benefits, and services that are available on the same conditions as for the general public. (2)Anything for which the officer,member, or State employee pays the market value. (3)Any(i)contribution that is lawfully made under the Election Code or under this Act or(ii)activities associated with a fundraising event in support of a political organization or candidate. (4)Educational materials and missions. This exception maybe further defined by rules adopted by the appropriate ethics commission or by the Auditor General for the Auditor General and employees of the Office of the Auditor General. (5)Travel expenses for a meeting to discuss State business.This exception may be further defined by rules adapted by the appropriate ethics commission or by the Auditor General for the Auditor General and employees of the Office of the Auditor General. (6)A gift from a relative,meaning those people related to the individual as father, mother,son,daughter,brother,sister,Uncle, aunt,great aunt,great uncle,first cousin, nephew,niece,husband, wife,grandfather, grandmother,grandson, granddaughter, father-in-law,mother-in-law, son-in-law,daughter-in law,brother-in-law, sister-in-law, stepfather, stepmother,stepson,stepdaughter,stepbrother, stepsister,half brother,half sister, and including the father,mother, grandfather,or grandmother of the individual's spouse and the individual's fiance or fiancee. (7)Anything provided by an individual on the basis of a personal friendship unless the member,officer,or employee has reason to believe that,under the circumstances,the gift was provided because of the official position or employment of the member,officer, or employee and not because of the personal friendship. In determining whether a gift is provided on the basis of personal friendship,the member, officer, or employee shall consider the circumstances under which the gift was offered, such as: (i)the history of the relationship between the individual giving the gift and the recipient of the gift,including any previous exchange of gifts between those individuals; (ii)whether to the actual knowledge of the member, officer,or employee the individual who gave the gift personally paid for the gift or sought a tax deduction or business reimbursement for the gift; and (iii)whether to the actual knowledge of the member, officer,or employee the individual who gave the gift also at the same time gave the same or similar gifts to other members,officers,or employees. (8)Food or refreshments not exceeding$75 per person in value on a single calendar day; provided that the food or refreshments are(i)consumed on the premises from which they were purchased or prepared or(ii) catered.For the purposes of this Section, "catered" means food or refreshments that are purchased ready to eat and delivered by any means. (9)Food,refreshments,lodging,transportation,and other benefits resulting from the outside business or employment activities(or outside activities that are not connected to the duties of the officer,member,or employee as an office holder or employee)of the officer,member,or employee,or the spouse of the officer,member,or employee,if the benefits have not been offered or enhanced because of the official position or employment of the officer,member,or employee, and are customarily provided to others in similar circumstances. (10)Intra-governmental and inter-governmental gifts.For the purpose of this Act, "intra- governmental gift"means any gift given to a member,officer, or employee of a State agency from another member,officer,or employee of the same State agency, and"inter- governmental gift"means any gift given to a member,officer,or employee of a State agency,by a member,officer, or employee of another State agency, of a federal agency, or of any governmental entity. (11)Bequests,inheritances, and other transfers at death. (12)Any item or items from any one prohibited source during any calendar year having a cumulative total value of less than$100. Each of the exceptions listed in this Section is mutually exclusive and independent of one another. 5 ILCS 430/10-30 § 10-30. Gift ban; disposition of gifts. A member, officer, or employee does not violate this Act if the member, officer,or employee promptly takes reasonable action to return the prohibited gift to its source or gives the gift or an amount equal to its value to an appropriate charity that is exempt from income taxation under Section 501 (c)(3)of the Internal Revenue Code of 1986,as now or hereafter amended,renumbered,or succeeded. 5 ILCS 430/10-40 § 1040. Gift ban; further restrictions. A State agency may adopt or maintain;policies that are more restrictive than those set forth in this Article and may continue to follow any existing policies,statutes,or regulations that are more restrictive or are in addition to those set forth in this Article. ARTICLE 50. PENALTIES 5 ILCS 430/50-5 §50-5.Penalties. (a)A person is guilty of a Class A misdemeanor if that person intentionally violates any provision of Section 5-15, 5-30,540,or 5-45 or Article 15. (b)A person who intentionally violates any provision of Section 5-20, 5-35, 5-50,or 5- 55 is guilty of a business offense subject to a fine of at least$1,001 and up to$5,000. (c)A person who intentionally violates any provision of Article 10 is guilty of a business offense and subject to a fine of at least$1,001 and up to$5,000. (d)Any person who intentionally makes a false report alleging a violation of any provision of this Act to an ethics commission, an inspector general,the State Police,a State's Attorney,the Attorney General,or any other law enforcement official is guilty of a Class A misdemeanor. (e)An ethics commission may levy an administrative fine of up to$5,000 against any person who violates this Act,who intentionally obstructs or interferes with an investigation conducted under this Act by an inspector general,or who intentionally makes a false,frivolous,or bad faith allegation. (f)In addition to any other penalty that may apply,whether criminal or civil,a State employee who intentionally violates any provision of Section 5-15, 5-20, 5-30, 5-35, 5- 40,or 5-50,Article 10,Article 15, or Section 20-90 or 25-90 is subject to discipline or discharge by the appropriate ultimate jurisdictional authority. This is a follow-up to the written report that was provided to the Village Board the last week in March, 2004. The purpose of this information and the presentation this evening is to provide to the Village Board a proposed work plan to conduct an update to the Village's Comprehensive Plan. The last Plan update was conducted in 1998. Since the majority of Village is established, a comprehensive review of the entirety of the community is not recommended, rather it is suggested that corridors and segments of the community be reviewed in a comprehensive nature to identify specific policies relating to land use and planning for the subject areas. The review will also include a specific analysis of unincorporated properties surrounding the community and sites suitable for redevelopment. Examples include, but are not limited to Didier Farms and the Half Day Road and Prairie Road intersection. The goal of the comprehensive plan is to serve as a guide to the Village Board, Plan Commission, and staff in making appropriate planning decisions. Such decisions encompass many aspects of planning including rezoning, annexation,historical preservation, affordable housing, capital improvement and community design. Work Plan 1) The first step in the process would be to obtain feedback from the Village Board in an effort to set priorities, establish themes, consider proposals and ideas, and overall, establish a framework for moving forward. For example, Board members may identify as overabundance of townhome developments, or the desire for higher-scale single family developments. These initial considerations from the policy-makers of the community would be carried forward as the team worked throughout the process. Some issues, such as residential teardowns and religious uses may need to be priorities due to current and short-term future economic and social factors. Although these are zoning issues, some level of planning analysis will be warranted to develop appropriate zoning tools. With the evolving transportation improvements, specifically the doubletrack system, consideration will be given to transit oriented development surrounding the Metra station. 2) Establish a Comprehensive Plan Committee (CPC) to coordinate this project. The Team shall include the Asst. Village Manager-OVM, Village Planning, Associate Planner, Plan Commission Chair, and Plan Commissioner(s). Two Trustees would be selected to serve as liaisons to the CPC. All correspondence would be copied to the Village Manager and Asst. Village Manager-F&GS. Other Village staff members would be included throughout the process; areas of staff specialty include building/zoning, engineering, finance, fire,police and public works. 3) The CPC would meet on a regular basis with meeting minutes and agendas posted on a database which would available to the Village Board and Plan Commission. Formal updates would be provided to the full Plan Commission as needed. Updates from the CPC will also be posted within the Manager's Briefing, and a final presentation provided to the Village Board for formal consideration. 4) The CPC would review the corridors that should be evaluated as well as specific sites that should be reviewed. This has become a common practice among municipalities. For example,the Village of Libertyville mailed a survey to all property owners in the community as part of their review process;they received an approximate 26%response rate. 3) Community involvement/meetings. a) Buffalo Grove Area Chamber of Commerce—involve throughout the process. b) Buffalo Grove Park District, as-needed basis. c) Commercial/industrial/office property owners and managers, as-needed basis. d) Homeowners associations,as-needed basis. e) Consideration will be given to focus group meetings with residents to discuss a specific site plan or corridor plan. OTHER CONSIDERATIONS TO BE REVIEWED AS PART OF THE PROCESS 1. Provide a recommendation on policy goals for the ratios of detached to attached housing and what is realistic; 2. Affordable housing programs; 3. Transit oriented development for both commuter stations; and 4. Establishing targets for business development and redevelopment districts,particularly for the Row and Dundee Village. New regulation considerations: 5. Teardown standards; 6. Adult use regulations; 7. Implementation of bank and financial institution moratorium objectives; and 8. Protecting private drainage corridors (White Pine area). Consultant(s) There are several consultants that specialize in comprehensive planning and will assist a community with traffic studies, corridor redevelopment, neighborhood planning, and more. According to the Director of Community Development at the Village of Libertyville, the organization recently completed their comprehensive plan update and spent approximately $100,000 on the Plan. According to the Asst. Village Manager in River Forest,they recently conducted an update to their comprehensive plan, focusing on a few areas within the community. The cost of the project was approximately $20,000 and took approximately 18 months to complete. It is recommended that the Village obtain consultants to assist with land use planning and traffic reports. Consultant(s)with expertise in commercial redevelopment and identifying retailers are also recommended to review specific properties. However, due to the fact that the Village does not need to conduct a comprehensive review of the entire community (rather, focus on corridors and specific sites in and around the community),the consultant fees should not be as significant. GRANT OPPORTUNITIES Assuredly, the Village will explore grant opportunities to assist with offsetting the cost of the comprehensive plan. The Comprehensive Plan does need to address the community scale in terms of compliance with the Local Planning Tech Assistance Act and the Affordable Housing Act: LOCAL PLANNING TECHNICAL ASSISTANCE ACT HB 4023 was passed in 2002 and sets forth 4 significant objectives: Provides the first definition in state law of what a comprehensive plan is; Allows several state agencies to give preference in programs to communities that have passed comprehensive plans in accordance with the legislation; Creates a Local Planning Fund and allows the Department of Commerce and Economic Opportunity to make technical assistance grants for planning and development; and Maintains that local governments' land use actions should be consistent with their comprehensive plans. The Plan has received favorable feedback throughout the state. AFFORDABLE HOUSING PLANNING AND APPEAL ACT Public Act 93-0595, enacted by Governor Blagojevich, created the Affordable Housing Planning and Appeal Act. The Act was presented as HB 625 and adopted as a Public Act on August 26, 2003. The Act requires that any municipality with less than 10%of its year-round housing units qualifying as affordable must submit an approved affordable housing plan to the Illinois Housing Development Authority. Beginning 1/1/2009, any affordable housing developer whose application in a municipality with under 10% affordable housing that is either denied or approved with conditions that render the provision of affordable housing infeasible will be able to appeal the decision to the State Housing Board. The Village is working closely with the Northwest Municipal Conference and the Illinois Municipal League to manage the requirements of the Act. Consideration will be made concerning the provisions of the Act as we conduct the comprehensive plan review.
