2019-12-02 - Ordinance 2019-069 - AMENDING CHAPTER 5.09 RAFFLES ORDINANCE NO. 2019 - 069 AN ORDINANCE AMENDING CHAPTER 5.09 ENTITLED RAFFLES BY DELETING SECTION 5.09.050 RESTRICTING THE MAXIMUM VALUE OF PRIZES WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the Village of Buffalo Grove maintains a Raffles ordinance in the Village Municipal Code (Section 5.09 et seq.); and WHEREAS, Section 5.09.050 (B)of the Raffles Ordinance imposes limitations on the maximum value of prizes and maximum ticket price for chances for fifty-two-week charitable raffles; and WHEREAS,pursuant to Section 5.09.030 (B) applies only to fifty-two-week charitable raffles; and WHEREAS, the current restriction on the maximum value of prizes and ticket prices in Section 5.09.050 (B)has limited the effectiveness of fundraising efforts for those organizations; and WHEREAS, Village Board finds that it is in the best interests of public health, safety and welfare of the residents of the Village to remove the restriction on the maximum value of prizes. NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,ILLINOIS, as follows: Section 1. The foregoing recitals are hereby adopted and incorporated into and made a part of this Ordinance as if fully set forth herein. Section 2. That the restriction on the maximum value of prizes and the maximum ticket price issued pursuant to the fifty-two-week charitable raffle ordinance is hereby amended and the Section 5.09.050 (B)of the Village Raffles Ordinance is hereby amended as follow: 5.09.050 - Licensing conditions and limitations. B. A fifty-two-week charitable raffle license is subject to the following conditions and limitations: 1. . 2--The maximum retail value of a non-cash prize awarded in any raffle shall be one t o san tve luxdfed dollars. 32. If any section,paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this Ordinance. Section 4.
