Those present stood and pledged allegiance to the Flag. ROLL CALL Roll call indicated the following present:President Hartstein;Trustees Braiman,Glover, Berman,Trilling, Stone, and Sussman. Also present were: Ghida Neukirch,Village Manger Pro Tem;William Raysa,Village Attorney;Katie Skibbe, Assistant Director of Finance;Art Malinowski,Director of Human Resources;Robert Giddens,MIS Director; Robert Pfeil,Village Planner;Brian Sheehan,Village Health Officer;Rick Kuhl,Village Forester;Police Sgt. Scott Kristiansen;Fire Chief Vavra; and Joseph Tenerelli,Village Treasurer. APPROVAL OF MINUTES Moved by Glover, seconded by Braiman,to approve the minutes of the Rescheduled Regular Meeting of July 12,2010. Trustee Stone moved to amend the minutes of July 12,2010 to reflect that she requested that the minutes from the previous meeting be amended to reflect the lost Executive Session audio tape of April 18,2005 pertaining to the Shaw Environmental Evaluation of the Land&Lakes Landfill and a lengthy discussion that followed. There was no second to the motion, and after discussion,it was determined that Trustee Stone would present the wording in written form for the proposed amendment and that it be brought forth for consideration at the next Village Board Meeting. Trustee Stone wants the topic memorialized in the minutes that the audio tape from the 4/18/2005 Executive Session is missing. Upon roil call,Trustees voted as follows on the approval of the July 12,2010 minutes: AYES: 5—Braiman,Glover,Berman,Trilling, Sussman NAYS: 1 —Stone Motion declared carried. WARRANT#1149 Mr. Tenerelli read Warrant#1149. Moved by Braiman, seconded by Glover,to approve Warrant#1149 in the amount of$3,373,963.62, authorizing payment of bills listed. VILLAGE PRESIDENT'S REPORT President Hartstein wished the Village Clerk a Happy Birthday. 12401 07/26/2010 President Hartstein alerted residents that the Buffalo Grove Fire Department will again be conducting a Fill the Boot campaign to raise funds for the Muscular Dystrophy Association. The drives will be on August 6,2010 at Lake Cook and Arlington Heights Roads, and on August 13,2010 at Dundee and Buffalo Grove Roads. President Hartstein commended the Buffalo Grove Park District for a tremendous production of Seussical,and he applauded the Park District and the entire cast,including Trustee Berman,for a great performance. President Hartstein noted that we just concluded the 51h week of our Farmer's Market, and that it continues to get better and better each week. Everyone is enjoying it and finding it to be a very worthwhile project and he thanked everyone involved in the event. President Hartstein stated that the 91h Annual Invitational Art Festival was held this past weekend. It was a great festival with artists from all over the country. Thanks to the Arts Commission, and especially all of the volunteers who worked tirelessly throughout the weekend to make all of the artists feel welcome. President Hartstein made the following appointments to the Buffalo Grove Ethics Commission: Brian Rubin, Chairman. Moved by Berman, seconded by Trilling,to concur with President Hartstein's appointment of Brian Rubin as Chairman of the Ethics Commission. Upon voice vote,the motion was unanimously declared carried. President Hartstein appointed the following members to serve on the Ethics Commission: Waiter Jasinski, Bruce Bohrer,John Green,Nancy Aldrich,Lenna Scott and Debra Rybarczyk. Moved by Braiman, seconded by Sussman,to confirm President Hartstein's appointments. Upon voice vote,the motion was unanimously declared carried. President Hartstein then addressed the recent newspaper article referring to Shaw Environmental Report. President Hartstein noted that this is a five-year old report,and has been brought up to date with the 2010 data, which shows no violations. Everyone should have access to this report, and President Hartstein noted that the report, along with updated information, will be available to every resident,either by e-mail or hard copy,by making a request on the website,by phone or in person. VILLAGE MANAGER'S REPORT Mrs. Neukirch noted that the next Village Board Meeting will be held on August 9,2010,and will begin with a Finance Committee Meeting at 6:15 P.M. Mrs. Neukirch noted the submittal and posting to the website and the e-library of the Monthly Management Report for June,2010;there were no questions on the report. QUESTIONS FROM THE AUDIENCE President Hartstein asked if there were any questions from the audience on items not listed on the agenda. Gary Stone,Beverly Lane,commented on the events that took place at the July 12,2010 meeting,noting that he believed that President Hartstein acted inappropriately. President Hartstein responded to Mr. Stone's comments. Mr. Stone also referred to a group wishing to use the Rotary Village Green, who were unable to do so because they could not afford the insurance needed to obtain a permit. Mr. Stone then referenced a group that recently used the same space without obtaining a permit or insurance, and he stated that he believes there is inequity in the use of this public space. Mrs. Neukirch reviewed the possible uses for the Village Green, a public park. Staff is in the process of better defining when a permit needs to be utilized and what conditions would require notification to the Village. It was noted that this is a public park, and unless the park is used for an exclusive event,the public space is open for use by anyone. Further discussion on the issue ensued. 12402 07/26/2010 TRUSTEE REPORTS Trustee Glover,Chief Vavra and FF/PM Rusin reviewed the PINK HEALS program,noting that the 2010 tour will be in Buffalo Grove on September 1,2010. They all urged our residents to come out and support this terrific endeavor that will raise money to fight cancer. CONSENT AGENDA There is no Consent Agenda at tonight's meeting. ORDINANCE#2010-43-EMBASSY,LLC Moved by Trilling, seconded by Braiman,to pass Ordinance#2010-43, variation of Sign Code, Sections 14.20.030 and 14.20.070 for Embassy, LLC, 1101-1165 Weiland Road. Trustee Glover recused herself from any discussion on this issue because she is employed by an office in the subject shopping center. Mrs. Neukirch,reviewed the proposed ordinance,details of which are contained in the Village Board Meeting Agenda Item Overview prepared by Mr. Sheehan. Mr. Raysa pointed out that the petitioner is only requesting one variation for Section 14.20.070. Trustees Trilling and Braiman accepted this change in the ordinance. Upon roil call,Trustees voted as follows on the amended motion: AYES: 5—Braiman,Berman,Trilling, Stone, Sussman NAYS: 0—None RECUSED: 1 —Glover Motion declared carried. ORDINANCE#2010-44- QUALITY CAR CENTER-CAR WASH Moved by Stone, seconded by Sussman,to pass Ordinance#2010-44,granting variations to the Village Sign Code for Quality Car Center-Car Wash. Mrs. Neukirch reviewed the proposed ordinance,details of which are contained in the Village Board Meeting Agenda Item Overview prepared by Mr. Sheehan. Trustee Braiman asked that the motion be amended to add the words "successors or"before"assigns"in Section 3. B. Trustees Stone and Sussman agreed to this amendment. TAKE ONE VIDEO SERVICES Moved by Glover, seconded by Berman,to renew the contract for Take One Video Services according to the memo dated 7/26/2010 for the costs that are budgeted in the memo and the recommendation from staff. TRUCK PURCHASE Moved by Braiman, seconded by Berman,to authorize waiver of bids and purchase two 2011 International 7400 160"Wheelbase Trucks from the State of Illinois Department of Central Management Joint Purchasing Contract#4015050 in an amount not to exceed$283,978.00. It was noted that bids are being waived because this is under the State Central Purchasing Contract. There are sufficient in the Central Garage Fund for payment of this purchase. Mr. Kuhl reviewed the process whereby the current vehicles will be sold and the proceeds will be returned to the funds from which the original trucks were purchased. The total budget for the entire village is $62,353,665 offset by revenue expectations of$64,409,704. The 2010 budget was constructed using conservative expectations of revenue and revenue growth. Based upon a review of revenue and expenditure/expense trends the Village's overall fiscal operations appear to be, in most line items, consistent with budget assumptions made during development of the current budget. From a Village-wide perspective, mid-year expenditure(expense)totals reflect cautious and well managed spending within each department as staff has communicated concerns over the current economic environment's impact upon the Village's major revenue sources. The current economic climate continues to provide challenges as consumer spending remains low,personal savings as a percentage of disposable income is increasing, and personal income remains flat. State shared revenue has been fairly close to expectations as both Home Rule and Base Sales Tax have come in at approximately 50%of budget.Income Tax receipts,although trending above 50%,have decreased 11.41%compared to 2009 mostly due to the state's high unemployment rate which was posted at 10.4% as of June. It will be imperative that staff continue to monitor the financial activity and individual departmental performance with a proactive eye upon fluctuating economic conditions and changes in service demands within the Village.This report will be used to validate budget methodologies and where modifications are needed,adjustments will be integrated into the development of the FY 2011 budget. Historically,virtually 100%of taxes levied are collected so it is anticipated that budget estimates will be realized by year- end. • Sales/Home Rule Sales Taxes 49.14%/49.86% Base Sales Tax net receipts total$2,278,994,which represents a decrease from FY 2009 of nearly$90,000. Home-Rule Sales Tax receipts total$1,385,517 compared to$1,462,618.These receipts account for all taxable customer spending through March 2010. This compares to$54.55 in FY 2009,a decrease of $5.73 or 11%per capita. In terms of a dollar change,income is$270,843 below similar FY 2009 receipts. Any major shifts in the unemployment rate or corporate earnings will continue to impact this revenue.The Village has experienced significant delays in payment from the State of Illinois. As of June 301h,the state was behind five months in payments totaling$1.5 million. Additionally,the General Assembly of the State of Illinois has discussed reducing the current 10% local government distributive share of the state income tax. • Real Estate Transfer Tax 46.09% Receipts from the Real Estate Transfer Tax total$228,790 as compared to$371,411 in FY 2009.This tax traditionally is budgeted very conservatively with the methodology remaining consistent for this year. The downturn in the housing market that began in late 2006 continues to significantly impact this revenue source. For comparative purposes,to date in 2010,there has only been one extraordinary transaction(sales>$1,000,000)accounting for over 4%of total revenue. The performance in 2009 is skewed by one extraordinary transaction($60M) accounting for 48% of revenue earned. Traditional residential sales transactions continue to post record lows as measured against available Village data. RETT revenue may take several years to recover. From a national perspective,it is estimated that it will take about 2.5 years to deplete existing inventory and clear the path for a housing recovery. • Telecommunications Tax 47.40% Receipts from the Telecommunications Excise Tax levied at a rate of 6%totaled$1,146,470 or 47.40%of the approved fiscal period budget.This revenue should remain fairly consistent year to year and a large part of any monthly variance is attributable to the timing of disbursements.The state collects the revenue and remits payment.If the due date falls on a weekend the payment is not credited until the next month. A potential threat is the reduction in the number of phone lines (consumers canceling land lines) and Voice over Internet Protocol(VOID). • Prepared Food and Beverame Tax 48.16% Total revenue generated from the Village's 1%Prepared Food and Beverage Tax equaled$334,242.The amountposted this year is comparable to last year. The revenue has been fairly predicable to date. Nationally and regionally the recession has had more of an impact on higher end dining.Establishments offering value dining have experienced little to no decline in revenues.We will continue to monitor receipts closely to identify trends for the next year. • Motor Fuel Tax 47.94% Motor Fuel Taxes did not cross the 50%benchmark. The drop in collections is a source of concern as the Annual Street Maintenance Program is reliant upon these funds in connection with Corporate Fund operating transfers to meet our construction obligations.This tax is levied on a unit(gallon)basis and does not fluctuate with fuel prices.Indirectly,as fuel prices increase,driving activity is reduced.Total revenue for Motor Fuel Tax is about$59,019 less than last year. • Development Fees/Permits 81.42% Construction and development related fees and licenses are generated in both the Corporate and Water Funds. This is the first year the Village has begun collecting a contractor registration fee which has generated$43,670 in income as of June 30,2010. Additionally,the development at Villas of Chestnut Ridge and the sale of Whispering Lake Estates has had a positive impact on revenue. There are several parcels within the Village that are currently being marketed. • Interest Income 29.76% Much of the revenue is not realized until the close of the fiscal year through the accrual of unamortized income. Revenue is lower than last year's total by about$55,000.The remainder of investments held by the Village is limited in duration by state statute and cannot be invested in any equity products.Yields on current assets hover around 026%to 0.6%for CDs and about 0.4%for money markets. At this point it appears the FOMC will not increase Federal Funds Rates(Village's short term investments are tied to this rate)until the end of the fiscal year at the soonest,but more likely, at some point in middle to late 2011. Two of the five commercial billing months had monthly totals that were the lowest in 19 years. Based upon continued unusual usage patterns,it doesn't appear that the revenue target will be attained. In concluding the revenue analysis,it appears that overall combined fund revenue targets should attain a level around 97- 100%of budget by December 31,2010. Certain revenue,such as Interfund Transfers,generally are not posted until the second half of the period and then only based on the need of the receiving fund. If there is no identified need within a fund for an operating transfer, an expenditure reduction will also be realized in the granting fund. All revenue categories will be monitored closely and all efforts maximized in order to enhance revenue potential with specific emphasis directed toward monitoring those high impact revenues that are affected by both local and/or national economic trends and conditions. GOLF ENTERPRISE COURSE PERFORMANCE: Buffalo Grove Golf Club: Through June 30,2010,a total of$534,349 in operating and non-operating revenue has been realized against a budget of $1,365,000 amounting to 39.15%of budget. This compares to June 30,2009 revenue of$537,656 or 38.13%of budget. Per round revenue is$38.15, which is up$0.83 per round from last year. Of the paid rounds, residents accounted for over 50% of the play. Membership rounds totaled 3,995 (455 less than last year) with per membership round revenue equal to$19.88,based upon membership revenues of$79,429.The overall weighted average greens fee for non-membership rounds was $21.60. As the season progresses, the total value of memberships will be more evident as the average fee per round decreases with the accumulation of more membership rounds. From a historic perspective, encompassing the last ten years, total rounds played each month were below historical averages for all of the six months. May and June posted the lowest paid rounds played in the last ten years.June was abysmal as there was a significant amount of rain,particularly during the weekends,resulting in a 19%drop against the average. Since 2000 the average rounds played through June 30 is 15,965. The rounds posted this year trail that benchmark by 12.26%. Fiscal mid-year revenue realized at the Buffalo Grove Golf Club was $3,307 or about 0.62% less than the FY 2009 period.All major revenues are down against the previous year with membership revenue showing the biggest decrease of $6,263. Services/Personal Benefits 45.82%/50.64% Personal Services is the single largest expense account category budgeted by the Village. In terms of total budget, Personal Services account for 36.43%of expenditures,which compares to the FY 2009 commitment of 35.9%.Salaries and wages paid through June 30,2010 total$9,752,038.Personal Services is trending lower than the 50%due to decision to modify staffing(full time to part time)as well as not filling some vacant positions.The largest account within Personal Benefits is Group Health,Dental and Life Insurance. Expenditures are trending as anticipated in this account group. • Capital Proiects and Improvements 22.25% Budget authorizations for capital projects,equipment and improvements total$11,606,424 or 18.6%of budget.Several major capital programs are underway that account for a majority of the authorization: 1. Street improvement programs within the Motor Fuel Tax Fund, which includes local annual street maintenance and reconstruction along with major multi-agency street and highway construction programs within Buffalo Grove. 2. The continuation of various capital improvement projects as identified within the Village's FY 2010 through FY 2014 Capital Improvement Plan. 3. Capital equipment acquisition across all departmental budgets,most specifically from the Reserve for Capital Replacement and the Reserve for Computer Replacement. 4. Major programs and acquisitions are moving ahead within planned implementation schedules. It is anticipated that the some of the budget authorizations may not be drawn by year-end, as some approved programs will be carried forward into FY 2011. A status report on those projects will be presented to the Village Board on September 131n 5. Village Drainage Improvement Program • Operating Transfers 44.79% This expense category accounts for about 9.83%of the budget.Operating transfer are designed to provide for transfers between various Village funds for activities performed on behalf of the transferring fund,for cash contributions toward capital development programs, or to supplement debt service fund balances as an offset for prior period property tax abatement • Debt Service 14.93% The approved budget is developed around established principal and interest schedules for each series of general obligation or revenue bond indebtedness,the entire budget will be expended by December 31,2010. The five identified expenditure categories referenced above account for 72.02% of FY 2010 budget expenditures/expenses. Commodities, which account for an additional 9.4% of budget are heavily skewed with $4,352,880 budgeted for transfer to Lake County for sanitary sewer treatment and sewer tap-on fees. As with revenue, the expense commitments will need to be closely monitored for the remainder of the fiscal period. Interior, exterior, roof, foundation, ADA compliance updates?Will landscaping be included? What is the existing or proposed use of the facility once improvements are completed? Anticipated benefits - Briefly list the anticipated economic, social and/or environmental benefits of the proposed project. Is this part of a Sustainable & Livable Community development? Safety. - If the project addresses a safety issue, explain the existing problem and describe the mitigating effects of your proposed project. For example, an off-road bicycle facility would eliminate auto-bicycle conflicts or a pedestrian/bike bridge would improve crossing safety at a busy intersection. Project Status • Project Relationship— Identify whether application is for a new project, a continuation of an existing project or relates to a similar project. • Previous Project Funding— Indicate whether funds have previously been committed to this project (along with the amount and the reason for a second request); then indicate whether the project relates to another ITEP project and describe how. For example a previously funded historic rehabilitation project might be followed by a streetscape or bike/pedestrian trail to complement. • Predicted usage of the facility— Examples—for a bike trail, state who the intended users are. P it vil r - �1 1 t July 21, 2010 To the members of the zoning appeals board, was greatly disappointed with the recent decision of the board of appeals to grant permission for Cambridge on the Lake to erect a six foot white plastic fence on the perimeter of their property. I agree that the existing fence needs to be replaced, as it is in danger of falling down. I also agree that it should be six feet high because there is a drainage ditch along part of the fence so that the bottom of the fence is two to three feet below the surface of the existing perimeter road. I do, however, object strongly to the prospect of the white plastic fence as did all of the other Cambridge homeowners who spore at your resent meeting. I recognize that the residents of Cambridge on the Lake do not have the same interest in the fence as those of us who back up to it. To them it Is really a perimeter fence. Theirs is a huge property. Their buildings are separated from the fence by 100 or more feet containing a road, parking areas, and perimeter bushes and trees. The back of their buildings which are adjacent to the fence are not living areas and are primarily garage doors and access from parking lots. There are no balconies or patios looking out at the fence. If the condo owners wish to spend time outside they do so in the front of their buildings around their lake. There is a small picnic area behind the southeast corner of the complex. The number of times it is used during the year can be counted on one hand. On the other hand I, and many or my neighbors, live in our backyards from spring until fall. We have very small yards. There is less than fifty feet between the back of our patios and the fence. We work, play, party, garden and enjoy our children and pets in our yards and on our patios. I have lived in my house on Cambridge Drive for thirty-seven years. I am a gardener and have spent a considerable amount of effort and money building my perennial gardens against the backdrop of the natural wood fence. I am in my yard every day. The whole character of that garden will be altered by a white plastic fence. It will adversely affect my enjoyment of my property. I will no longer see my flowers because the eye will be drawn to this big white plastic fence. I am not sure that I would have purchased this property had there been a plastic fence in place many years ago. It surely cheapens the appearance of my yard as well as the appearance of the condos behind it. What will this fence look like after a rain storm has splashed black dirt on it? I can get no relief by avoiding my yard. There are 12 windows in the back of my house looking out on this fence. I cannot even do the dishes ' without it looming before me. Is it too late for this decision or that of the condo association to be changed? I would suggest that those who have made this decision get themselves a chair and sit thirty feet in front of a six foot white plastic fence. This matter first became known to us late in May by a workman who said that he was in charge of maintenance for Cambridge On the Lake.He informed me that an AT&T line,. which runs along the fence was going to be cut by him when the fence was taken down to be replaced,beginning in a few weeks.He told me that I had better call AT&T and have that matter taken cane of.I told hire that he had no right to cut that line,and he said it was what he was told to do.I slid notify AT&T at that time. I proceeded to call.the Building Dept of B.G.to find out what was going on,and was placed on"hold"while the woman I was speaking to tried to get answers to my questions from someone else. My first question was,"Is a new fence going up7"She told me,"Yes,we gave them the permit yesterday".The second question was,"Was a variance given for the height of six feet". I was placed on"hold"while she got an answer,which was,"It's not Hai yet".Are permits issued before a final determination is made7l expressed my concerns and left my name and phone number,however no one ever called back. We eventually received a 2-page letter from the B.G.Dept of Building and Zoning informing us that a hearing was on the agenda regarding Cambridge on the Lake replacing"the existing six(6)-foot wooden fence with a new six(6)foot wooden fence". However,at the meeting,which we attended,the attorney immediately asked the Board to amend that statement to indicate their plan to put up a six(6)-foot whits PVC fence, which was approved. All ofthe homeowners in the Cambridge subdivision who are affected by the fence were led to believe(lay your letter)that the existing fence would be replaced by a comparable "wooden"fence.'Therefore,many felt that there was no need to attend the meeting.This explains the low turnout by our subdivision.Those of us who slid attend the meeting expressed our concerns,but to no avall,the only interest being in the height ofthe fence. The Chairman of the Zoning Board stated that the only issue was on the height of the fence and`nothing else". When I recently received a notice of a public meeting regarding the proposed replacement of the existing peripheral fence separating the Cambridge on the Lake Condominiums from the neighboring properties surrounding it, the principal point of the letter appeared to be that this replacement would require that there would be a several week period after the existing fence was removed before the replacement fence was installed. I now hear that the proposed new fence is not only not in kind with the fence it is proposed to be replacing, but is in fact to be a white plastic vinyl fence. A six feet tall stark white fence would be wholly out of character with the back yards of the homeowners of the properties surrounding and abutting the Cambridge Condominiums, Nowhere did the notice clearly advise that the replacement fence would not be a replacement in kind, but rather replacement with a fence of substantially different character. Had this been spelled out, I would have cancelled the activity I had previously committed to and attended the Zoning Board meeting. In my opinion it could be reasonably argued that, since the notice given to us did not provide adequate description of this substantial difference in character of the proposed new fence, the notice was not sufficient to its task. The proposed fence is not a wood fence, it is a vinyl fence. He explained that Cambridge on the Lake is made up of six (6) buildings, each of which has its' own Association. There are a total of three hundred ninety two (392) units in the six (6) buildings, approximately five hundred fifty (550) total residents, and is comprised of approximately twenty six (26) acres of land. There is a one (1) mile perimeter road called Lake Boulevard that runs along the east, south and west perimeters within the property. For the past thirty (30) plus years there has been approximately four thousand (4,000) lineal feet of six (6) foot wooden fence running continuously around the three (3) borders of the property and separating Lake Boulevard from approximately fifty (50) residences in the neighboring homes along Cambridge Drive, Saxon Place, Anthony Road and Harvard Lane. The fence also separates the commercial property to the west and Cambridge Park. After thirty five (35) years the fence needs to be replaced. There is an area of fence next to Rogan Shoes that was knocked down by a car that has yet to be replaced. The Association applied for the permit to replace the fence and learned that Village Ordinance has a five (5) foot restriction. The four thousand (4,000) lineal feet of fence are interior to Dundee Road and abut exclusively residential property, except for the west side. None of the fence being requested is visible to Dundee Road. The fence would be four thousand (4,000) continuous feet of fence. The Association is not going to create any type of jigsaw effect or modeled look. This will be a very lengthy run of uniform and beautiful fence. Mr. Wolf submitted a booklet which depicts the type of fence being requested. This booklet was accepted and marked as Exhibit "F". Mr. Wolf also submitted a Google map printout. This map was accepted and marked as Exhibit"E". Mr. Wolf continued that the proposed fence would not alter the essential character of the neighborhood. They are replacing a six (6) foot fence with another six (6) foot fence. The proposed fence will enhance the character of the neighborhood because it is a much more attractive and durable fence as opposed to the current worn wood stockade fence. The standard manufacturing of this fence is six (6) feet in height. To get a five (5) foot fence from this manufacturer would require a custom order and would require the six (6) foot fence to be manually cut down section by section to five (5) feet. The expensive of that would be extraordinary compared to the expense of the project which is eighty seven thousand (87,000) dollars. It would materially affect the cost of the project to the Association and would impact all five hundred fifty (550) unit owners who would ultimately absorb the cost. This variance would not be detrimental to the health, safety and welfare. This will benefit the public health, safety and welfare. The six (6) foot fence not only protects the residents of Cambridge on the Lake from intruders but also protects the children of residents of the surrounding neighborhoods. The Cambridge on the Lake property has a very large retaining pond at its center. The fence would maintain privacy for Cambridge on the Lake residents and the surrounding neighbors. Many people are at eye level above five (5) feet but not many are at eye level above six (6) feet. All the residents that have enjoyed their privacy for all these years would continue to enjoy their privacy. The neighboring residents would be looking into the parking lot if the fence was at five (5) feet. Ch. Entman read the Village Engineer's memorandum addressed to Brian Sheehan dated July 7, 2010 which states: "I have no comments on the proposal." Ch. Entman confirmed with Mr. Wolf that the proposed fence is exactly as submitted in Exhibit 'F". He asked if the fence would be six (6) feet to the top rail or the top of the posts. Mr. Wolf stated that the fence would be six (6) feet to the top of the rail. Ms. Jenny Spallone, 324 Anthony Road, was present and sworn in. She stated that she is excited about the fence. Last year a neighbor broke through the fence. She has three (3) small dogs that keep getting through the fence. Her only concern is that in a letter sent by Cambridge on the Lake they advised to watch children or pets. Having three (3) small dogs across from the complex and the dogs love to sneak out she is concerned. It is a busy area on Lake Boulevard. She is concerned that it will be too long a period of time for the fence to be built. She wants to know what the time frame is for the work to be done and what can be done temporarily to provide some kind of barrier. Mr. Wolf stated that it is his understanding that the entire project from start to end will be approximately thirty (30) days. How each individual homeowner is affected will depend on what conditions are there on the particular day or when they get to that section. He does not know if temporary fencing is part of the project. Ms. Spallone asked if the project will affect her for only one (1) day. Ch. Entman responded that the project was stated to be thirty (30) days from the day it starts. Ms. Spallone replied that Mr. Wolf stated, "on that particular day." Mr. Belli explained that this is a large construction project. The first phase is to tear down the entire existing fence. The second phase will start at a determined point and install the fence. The installation is a post and panel installation. They will not install all of the posts and then come back and put the panels in. As the fence project is moving along people's security will be back in place. Total duration is approximately thirty (30) days. Ms. Spallone asked how long will it take for each house. Mr. Belli stated that it depends on where you live. Com. Stein asked Mr. Belli if five (5) years from now someone were to drive a car through the fence would the same material be available. Mr. Belli explained that this product is made by a company called CertainTeed. CertainTeed is one of the biggest manufacturers of asphalt shingles for homes and they provide approximately eight (80) percent of the vinyl siding in the United States. They are the biggest vinyl extruder in the country. This is not an imported product. They are located in Buffalo, New York. Mr. Larry Arends, 344 Anthony Road, was present and sworn in. Mr. Arends stated that his backyard abuts the subject property. The fence would be in his backyard. For the thirty(30) years he has lived as a neighbor to Cambridge he has appreciated the way they do keep up their property. Their maintenance is impeccable and they have been wonderful neighbors. This would be the third fence since he has lived here. They have all been six (6) foot stockade fences. He understands a wood fence has deterioration problems. He understands the advantages of vinyl fences. His concern is not the height of the fence but the white plastic wall that will be in his backyard. For thirty (30) years he has seen the stockade fence back there. He has added stockade on his sides. Now there will be this white, stark, plastic, institutional looking fence going across their backyards. He believes that the fence will detract from the appearance of the yards. He realizes that not everyone driving by on the street is going to see it, but the fifty (50) people that live in the neighborhood will see it everyday. A lot of the neighbors have already discussed what option may be available to them. If they have no other option than the white fence going up, can the individual homeowners put up a stockade fence in front of the white fence as a visual barrier. The proposed fence looks more like a sound barrier off an expressway than a neighborhood fence to him. Mr. Jay Mills, 987 Harvard Lane, was present and sworn in. Mr. Mills explained that he has lived here sixteen (16), or seventeen (17) years. When he bought the house he was concerned about having a condominium complex behind him, but they have not been a problem. There are trees and shrubbery. One of the best things they have is the wooden fence. He has no objections to the height. That wooden fence to them is part of their property. He understands that it is a wood fence and it has to be replaced from time to time. But to replace that fence with a piece of white plastic is not acceptable. He likes living here and likes everything about this community. He likes where he lives. This is not the type of fence that they want. He was hoping more neighbors would have been here to voice their opinions. He agrees with everything except the type of fence. He does not believe that this fence would enhance anyone's property. Ms. Alton stated that she also objects to the plastic fence on two counts. She does not believe that it will look as natural as what is there now. She also objects to the appearance. She thinks that what is there is very natural looking wood fence and she would prefer to see that continue. Mr. Wiley Miller, 977 Harvard Lane, was present and sworn in. Mr. Miller agrees with the concept of a six (6) foot fence. Like the others he disagrees with the material being used, a white plastic fence will look exactly like a white plastic fence. It may or may not last longer than a stockade fence. He has been in his house for forty two (42) years and that stockade fence has been there for more than thirty five (35) years. He would highly recommend a wooden fence rather than a plastic fence. He would like to know what alternatives they have if they are stuck with a white fence. He asked if they could paint or stain it. He asked if they could cover their side with a stockade fence. Ms. Nancy Pawelski, 352 Anthony Road, was present and sworn in. Ms. Pawelski agrees the six (6) foot fence is great. She also objects to the white fence. She asked if they could keep their portion of the stockade fence so they could lean it against the white fence in their yards to hide the white plastic. If not, they would like to keep the stockade as it is. Her house backs up to the park area of the complex which has been maintained wonderfully. Ms. Dawn Kowynia, 999 Harvard Lane, was present and sworn in. Ms. Kowynia has lived in her home sixteen (16) years. She lives next door the Mills. She does not own any of the fencing on her property. There is the stockade fence in the rear, a stockade fence to the left, and a cyclone fence to the right. So now she will have a cyclone fence, a white fence and a stockade fence. There will be three (3) different kinds of fencing in her yard. She approves the height of six (6) feet. But the white is bothersome. She asked if the white fence would fade, or stain if there is vegetation growth on it, or warp at all. Ch. Entman asked about the cost difference between a wood fence and a vinyl fence. Mr. Belli stated that he does not recall. Ch. Entman asked if it would be twice as much for a wood fence as opposed to vinyl. Mr. Belli stated that it would be a little bit cheaper. That is why they chose the vinyl instead of wood. Woods life span is only one third (1/3) the life span of vinyl. Ch. Entman explained the variance request and the neighbor's rights. The Petitioner's are seeking a variance for a six (6) foot fence. If they wanted to replace the six (6) foot fence with a five (5) foot fence, they would not need a variance. At five (5) feet they could place the fence on the perimeter of their property just as anyone else could. It could be a five (5) foot white vinyl fence. He explained that the neighbor's have the ability to put up a five(5) foot fence along the perimeter of their property, similar to the complex,without a variance. He also explained that if the individual homeowners wanted to put up a six (6) foot fence along their rear property lines they would need to request a variance. Cam. Shapiro asked if there are any options for the coloring of the fence. He asked if they can they get one that looks like natural wood. Mr. Belli stated that there are color options. Com. Shapiro stated that the color seems to be biggest objection. Com. Shapiro asked if white is the least expensive option. Mr. Belli stated that white is the most popular and therefore the least expensive. Ch. Entman stated that the booklet submitted as Exhibit "F" shows white and tan. He asked if tan is more expensive than the white. Mr. Belli stated that the tan is more expensive but he is not sure by how much, somewhere around ten thousand (10,000) dollars more. Com. Lesser stated that the Board has to balance the interests of the community. Based upon some of the objections he would look at the proposed fence as altering the character of the neighborhood and may be detrimental to the welfare of the neighborhood. Hopefully a compromise can be reached to address the concerns of the neighbors. Com. Shapiro asked about the reasoning behind choosing the white fence. Ms. Irali stated that the tan fence does not match the buildings. The white fencing matches the exterior of the buildings. The buildings are red brick and white stucco. They are English style buildings. White fencing would match them. Mr. Wolf added that they respect the comments of the neighbors.They know that they cannot please everyone all of the time. They do acknowledge the importance of the aesthetics of their homes and yards. The factors that are set forth in the Ordinance question whether the proposed variation would be detrimental to the public health, safety and welfare. The variation being sought is the height. The Association could have come in and put up a five (5) foot fence with no problem. There is nothing in the Ordinance that dictates material. Com. Shapiro asked Mr. Wolf if he would agree that the neighbor's believe that the fence would alter the characteristic of the neighborhood. Mr. Wolf stated that all of the neighbors have testified consistently that they do not have an objection to the height. Of the fifty (50) adjacent homeowners, only seven (7) or eight (8) do not like the white. There are fifty (50) neighboring owners that are affected. There about five hundred fifty (550) residents in the complex. Their Board of Directors has selected this fence on behalf of those five hundred fifty(550)residents. Com. Stein asked Mr. Belli if there is a salvage value to the wood fence that will be removed. Mr. Belli responded that they bring in recycle dumpsters where the wood gets turned into chips and mulch. They pay for those. Com. Stein asked if Mr. Belli would be willing to make available portions of the wood fence for the neighbor's that are asking to keep sections that are reusable to block the view of the white fence. He understands that those neighbors' would have to request a variation for a six (6) foot fence. Mr. Belli stated that is not his decision. The posts would not be reusable. Mr. Belli explained that there would be a certain amount of liability. There would be nails popping out, this would not be a clean product that someone could just take. The fence is literally fall apart. Ms. Spallone stated that there is a six (6) foot fence now. She wants to know why they should have to go through all of that. Also in this day and age people are trying to do things that are more environmentally friendly. Vinyl is something that will stay in the atmosphere for years to come as opposed to wood. Ch. Entman confirmed that the thickness of the vinyl fence would be five eights (5/8) of an inch. Mr. Wolf submitted a sample material of the proposed vinyl fence, This was accepted and marked as Exhibit "G". Ch. Entman asked staff if the vinyl fence could be placed up against the wood fence on the condo side so that the existing wood fence stays up. Mr. Sheehan explained that if the condominium received approval to install a six foot (6) fence inside of the fence that is currently in place, they would then have two (2) fences to maintain, with no easy access to the outside fencing. The existing wood fence has been -under continual repair over the last several years. There have been numerous complaints regarding the condition. The condo association has been putting a lot of money and upkeep into that fence for the last couple of years. It would probably not be practical for them to do so. However, there is nothing is in the Code that precludes installing two,fences. Mr. Wolf stated that he would advise his clients against doing that because of the liability factor. Now there would be a decaying fence that they cannot even see or effectively monitor in someone else's yard. If a child or a dog or someone rubs up against a rusty nail or a broken piece of wood there could be a big problem. He also addressed the concern of Ms. Spallone that if this fence is approved and individual property owners want to erect a stockade fence on their side to mask the vinyl fence he believes that would be a unique circumstance. They would incur a cost in doing so. The complex has no obligation to have a fence at all. They could take the existing fence down and not replace it. Ch. Entman asked how the fence will be paid for. Ms. Kali stated that the fence would be paid for out of the reserve fund and that money has been saved up to replace the fence. Ch. Entman stated that a question was made by one of the Commissioners concerning the color and that it was testified that it would increase the cost by about ten thousand (10,000) dollars. He stated that if there are five hundred fifty (550) units owners that would be approximately eighteen (18) dollars per unit additional. Mr. Wolf responded that this color was chosen to be consistent with the character of the complex buildings. The other colors, in addition to being more expensive, were not as desirable to the unit owners. Ms. Pawelski stated that the complex has a wrought iron fence in front of the building along Dundee Road. She asked why they do not put up a wrought iron fence to match. Mr. Wolf stated that the concept was considered but they wanted more privacy and security. Mr. Craig Freeman, 910 Saxon Place, was present and sworn in. He stated that he would like to replace his fence with a white vinyl fence. He believes that the existing fence is ugly. He asked if there is a reason why the residents could not paint their side of the fence if they do not like white. Ms. Irali stated that it is not their fence.
