1998-078 11/13/98 ORDINANCE NO. 98- 78 AN ORDINANCE APPROVING A REZONING FROM THE INDUSTRIAL DISTRICT TO THE OFFICE AND RESEARCH DISTRICT, APPROVING A PRELIMINARY PLAN AND APPROVING VARIATIONS OF THE VILLAGE FLOODPLAIN REGULATIONS AND THE LAKE COUNTY WATERSHED DEVELOPMENT ORDINANCE Office building, southeast corner of Weiland Road/Deerfield Parkway Lots 2 and 3 in the Busch Weiland Subdivision WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in EXHIBIT A ("Property") attached hereto is zoned in the Industrial District; and, WHEREAS, the Village passed Ordinance 93-96 approving an Annexation Agreement Amendment dated December 6, 1993 and said agreement requires approval by the Village of the development and use of the Property; and, WHEREAS, the Busch Weiland Partnership (hereinafter referred to as "Developer") has petitioned for approval of rezoning of the Property from the Industrial District to the Office and Research District and approval of a Preliminary Plan with variations of the Village Floodplain Regulations and the Lake County Watershed Development Ordinance; and, WHEREAS, Developer proposes to construct a two-story office building with a floor area of approximately 51 ,200 square feet on Lot 3 pursuant to the following exhibits: EXHIBIT A Legal Description 2 EXHIBIT B Concept Site Plan (Preliminary Plan) dated November 16, 1998 by Archideas EXHIBIT C Concept Engineering Plan (Preliminary Engineering Plan) dated October 19, 1998 by SPACECO, Inc. EXHIBIT D Concept Landscape Plan dated November 16, 1998 by Archideas EXHIBIT E Sightline Sections dated November 16, 1998 by Archideas EXHIBIT F Enlarged Site Section (retaining wall detail) dated November 16, 1998 by Archideas EXHIBIT G Exterior Building Elevations dated November 16, 1998 by Archideas WHEREAS, pursuant to due notice and advertisement, the Plan Commission of the Village has held a public hearing and made their recommendations pursuant to the requested rezoning, approval of a Preliminary Plan and variations of the Village Floodplain Regulations and the Lake County Watershed Development Ordinance; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1 . This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt. a proper, valid and binding ordinance rezoning the Property to the Office and Research District and approving a Preliminary Plan for a two-story office building with a floor area of approximately 51 ,200 square feet pursuant to EXHIBITS B, C, D, E, F and G for the Property as legally described in EXHIBIT A hereto. Section 3. The approval by the Corporate Authorities is subject to the following conditions: . V A. A variation of Section 18.20.010.d. of the Village Floodplain Regulations is hereby granted to reduce the development setback from centerline of Aptakisic Creek from 100 feet to 55 feet pursuant to EXHIBIT C attached hereto. B. A variation of Article IV, Section 13.1 .0)(a)(1) of the Lake County Watershed Development Ordinance is hereby granted to reduce the linear buffer requirement from the Aptakisic Creek channel from 30 feet to 0 feet. C. Developer shall comply with requirements of the Village Development Ordinance concerning submission of a Development Plan, Development Improvement Agreement (DIA) and security for public and private improvements. D. Developer shall cause written authority to be provided to the Village for creation of emergency lanes for police and fire access. E. Any changes or amendments to the plans approved herein are subject to Village approval, and the Village will determine if additional public hearings are necessary for proposed changes or amendments. Section 4. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified. AYES: 4 - Marienrhal .
