Those present stood and pledged allegiance to the Flag. ROLL CALL Roll call indicated the following present: President Braiman;Trustees Berman,Trilling, Sussman,Terson, Stein and Ottenheimer. VILLAGE PRESIDENT'S REPORT President Braiman appointed Larry Meyer to the Bicycle Committee. Moved by Berman, seconded by Trilling,to concur with President Braiman's appointment. Upon voice vote,the motion was unanimously declared carried. President Braiman appointed Denice Bocek as Vice Chair, and Zill Khan as Secretary of the Plan Commission. Moved by Ottenheimer, seconded by Stein,to concur with President Braiman's appointments. Upon voice vote,the motion was unanimously declared carried. President Braiman asked Mrs. Neukirch to present an overview of the 101h Annual Buffalo Grove Invitational Fine Art Festival. Details of this overview are contained in the Village Board Meeting Agenda Item Overview. President Braiman thanked the Arts Commission and all of the volunteers who did such a tremendous job in representing our community. President Braiman noted that there are currently volunteer opportunities to serve on the Plan Commission and the Electrical Commission, and he urged residents to submit an application to our Talent Bank. 12544 07/25/2011 President Braiman asked Mr. Bragg to comment on the July llt"Storm. Mr. Bragg summarized the events of that day and subsequent power outages and recent storms. Representatives from Comcast,ComEd and AT&T will attend the August 8,2011 Village Board meeting to respond to concerns of residents and the Village. Staff then answered questions from the Board,primarily with regard to the communication between the Village and the utilities. Village staff was commended for their outstanding response. President Braiman summarized the status of the Land&Lakes/IEPA inquiry. The 108 page report will be placed on the Village website. President Braiman wished Trustee Sussman and Clerk Sirabian a Happy Birthday, and presented them with a birthday cake, which they were not allowed to eat until the meeting was over. VILLAGE MANAGER'S REPORT Mr. Bragg noted the submittal and posting to the website and the e-library of the Monthly Management Report for June 2011;there were no questions on the report. Mr. Anderson presented the FY 2011 Budget—Six Month Status Update,details of which are contained in his memo to Mr. Bragg of July 21,2011. Mr. Bragg commented on the proposed videographer contract with Magic Dreams to cover the Village Board meetings. QUESTIONS FROM THE AUDIENCE President Braiman asked if there were any questions from the audience on items not on tonight's agenda. A resident at 197 Willow Parkway,questioned the status of the proposed hotel adjacent to the Arboretum Golf Club. President Braiman stated that the developer had only appeared before the Board for a pre-application conference with a concept plan, and there has been no further word from the developer. TRUSTEE REPORTS Trustee Stein reported that our Health Department did inspect all of the food service establishments that were affected by recent power outages to ensure that all food was being handled properly. Trustee Stein reported on the Farmer's Market that is held each Sunday morning from 7:30 A.M. until 12:30 P.M. in the Spray&Play parking lot on Route 83. Trustee Terson reported that National Night Out will be held on Tuesday, August 2,2011 from 5:00 P.M. until 8:30 P.M. at Willow Stream Park and he urged all residents to attend and participate in this activity. Trustee Trilling reported that the Artists' League will be presenting the first All Members' Show on August 2,2011 from 7:00 P.M. until 8:30 P.M. at the Indian Trails Public Library. Trustee Berman reported on the recent meeting of the Metra Citizen's Advisory Board,noting that Metra is going to post a questionnaire on their website with regard to their budget, and he urged all resident to weigh in on this topic. 12545 07/25/2011 CONSENT AGENDA President Braiman explained the Consent Agenda, stating that any member of the audience or the Board could request that an item be removed for full discussion. There were no such requests. The Village Clerk read a brief synopsis of each of the items on the Consent Agenda. Street Light Maintenance Contract Motion to authorize execution of the Third Year Option of a 3-year Street Light Maintenance Contract. Magic Dreams Video Productions Motion to waive bids and enter into an agreement with Magic Dreams Video Productions. Moved by Stein, seconded by Ottenheimer,to approve the Consent Agenda. LICENSES AND PERMITS Moved by Terson, seconded by Stein,to pass Ordinance#2011-37, amending Chapter 1.12, Suspension and Revocation of Licenses and Permits,of the Buffalo Grove Municipal Code. Trustee Berman asked if it would be prudent to address this item after the next item on the agenda is addressed. Mr. Bragg stated that he believes it would generally make sense for the Village to have the ability to suspend or revoke a business license for violations of zoning regulations, and specifically Special Use permits. Trustee Sussman stated that she believes it is a good ordinance to have on the books for any business. In answer to a question from Trustee Trilling,Mr. Bragg stated that if there were a business where there was a violation of zoning or other applicable laws,the Village would have the ability to suspend or revoke a license if they chose to do so. In answer to a question from Trustee Ottenheimer,Mr. Raysa stated that there is no retroactivity. Trustee Stein stated that he believes it is important to have the proposed ordinance on the books in the event that it is needed. Trustee Berman stated that, according to the proposed ordinance,the Village could revoke a business license if someone owes as little as $5, and he finds that troubling;he believes there needs to be some type of threshold written into the document. After further discussion,it was moved by Berman and seconded by Ottenheimer to defer action on this item until further information is received from staff. Upon roil call,Trustees voted as follows: AYES: 6—Berman,Trilling, Sussman,Terson, Stein,Ottenheimer NAYS: 0—None Motion declared carried. 12546 07/25/2011 ORDINANCE #2011-37—XTREME TRAMPOLINES Moved by Terson, seconded by Trilling,to approve a Special Use for a recreation facility in the Industrial District, Xtreme Trampolines,900 Busch Parkway. Mr. Bragg reviewed the proposed ordinance,details of which are contained in the Village Board Meeting Agenda Item Overview. Trustees Terson and Trilling amended the motion to include the draft of the ordinance dated July 20,2011, which included Exhibits A,B,C, and D as modified. Lengthy discussion took place with the amount of insurance that the Village is requiring the petitioner to carry, primarily whether or not the Village should get involved in the petitioner's business decisions. Mr. Beck stated that he does not have any problem with the insurance requirement;he did not recall the amount of insurance that will be required by the landlord when the lease is signed. Trustee Stein noted that he believes the provision to disinfect the mats belongs in the safety plan;he would like to see the word"serious"removed from Section 2.,H., (iv);he is concerned with three lanes going at one point with only one monitor in the foam pit;he would like to see provision that requires the operator to call 9-1-1 rather than a private ambulance when there is an injury;he would like to see the area for smaller children separated from the older children. Trustee Trilling stated that he believes it is important for the Village to determine how important it is to have a business like this in the Village, and also how taxing it will be to our own Fire Department and our own Village services by having this particular business in the Village. Trustee Terson again noted that he believes that the Village is getting too much into the running of this business;he believes this is a legal activity and a common activity, and he believes it should be the decision of a parent to decide what is right for their child. President Braiman has a concern about Village staff being burdened with monitoring compliance. Trustee Berman stated that he is open to considering this proposal if the detailed ordinance can specify reasonable operation requirements that staff believes can be enforced in a meaningful way. Mr. Bragg noted that staff has spent a considerable amount of time discussing this, and staff does believe that this can be managed. Trustee Sussman believes that parents must be required to stay with small children; she is concerned that the residents of Buffalo Grove might not have access to the paramedics to serve them in an emergency; she believes that there should be separate safety videos for different age groups; she is concerned about the rules being followed; she believes the Board has an obligation to its residents to ensure the safety of its businesses. In answer to a question from Trustee Trilling,Deputy Chief Ciecko stated that there have not been a high volume of calls from either the racing facility or the skate park;the Fire Department would recommend a fire pre-plan, as well as an EMS plan;the Fire Department would request that all calls must go to 9-1-1 so they can be tracked. Trustee Stein confirmed that the statistics from Carol Stream show less than one emergency call per week. Mr. Beck stated that the reason they do not use 9-1-1 is because they want to reserve that for real emergencies, rather than just a sprained ankle. 12547 07/25/2011 Trustee Ottenheimer stated that"serious"is very subjective, and is a judgment call; he does not believe that leaving the word"serious"in will make any difference. There was discussion as to whether or not it should be a requirement to call 9-1-1. Mr. Bragg suggested that it might be beneficial to put a type of addendum to the ordinance that all calls should be cycled through 9-1-1 unless otherwise approved by the Fire Chief. Trustee Berman stated that he believes that is a perfect item for the management and safety plan, and dealt with on an administrative level. The counsel for Mr. Beck noted that there is a memo from Chief Vavra dated July 6,2011 indicating that the emergency incidences would be able to be addressed by the Buffalo Grove Fire Department and would not tax the service in an unreasonable way and would be able to be handled by existing staff. Also,not all rules can be enforced at all times,but Mr. Beck has an extremely vested interest in making this operation a going concern. Mr. Beck stated that Carol Stream does not have a requirement to call 9-1-1;the average age of patrons is 16 years old and the average injury age is 16 also;if necessary, he will move the disinfecting of the trampolines from the closing checklist to the safety and management plan. Trustee Berman stated that, as to the nature of the use,there are a lot of activities in the Village that have an element of risk to them, and parents have the opportunity to deem whether or not they believe the activity is appropriate for their children, and he is hesitant to exercise that judgment as a Village Board,even though he does believe there are legitimate concerns; he believes that staff has crafted an ordinance that will work and strike an appropriate balance between the interest of promoting business and insuring the safety of our residents. Trustee Ottenheimer echoed Trustee Berman's comments, and also complimented staff on the hard work and research they have done to come up with a comprehensive set of rules and regulations to help insure the health and safety of our residents; he also thanked the public for their input to this proposal; and he thanked the petitioner for accepting a number of the changes requested. President Braiman also agreed with Trustee Berman's comments, and noted that the Board must look at the use and not the user;this use is not unlike other uses currently in the Village. Upon roil call,Trustees voted as follows: AYES: 4—Berman,Trilling,Terson,Ottenheimer NAYS: 2—Sussman, Stein Motion declared carried. FINANCIAL SYSTEMS SOFTWARE Moved by Berman, seconded by Trilling,to authorize staff to solicit proposals and waive bids for Financial Systems Software in accordance with the memorandum and draft proposal contained in Board packets. Mr. Anderson presented a status report on our current financial software,details of which are contained in the Village Board Meeting Agenda Item Overview;he also reviewed how the requirements for the software were developed. 12548 07/25/2011 Trustee Berman clarified that this proposal is at the specific recommendation of our auditors. Physically present were: Jeffrey Braiman,Village President;Jeffrey Berman, Steve Trilling,Beverly Sussman, Mike Terson,Andy Stein, Les Ottenheimer,Village Trustees;Dane Bragg,Village Manager;Ghida Neukirch, Deputy Village Manager; Scott Anderson,Director of Finance;Katie Skibbe, Assistant Director of Finance; Art Malinowski,Director of Human Resources; Leisa Niemotka,Assistant to the Village Manager; and William Raysa,Village Attorney. Staff members presented reports and updates on the Agenda items. General Board discussion on all items followed, with staff answering questions on each of the items. FY 2010 Audit Internal Control Review Mr. Anderson reviewed reports compiled by the Village's independent auditors,Wolf&Company LLP. The first report,dated June 15,2011,is the SAS 114 Board Communications letter. The intent of the letter is to make the Board aware of any significant audit findings. Reviewed within the context of significant audit findings are issues related to: the qualitative aspects of accounting practices,difficulties encountered in performing the audit,corrected or uncorrected misstatements,disagreements with management, management representations,management consultations with other independent accounts, and other audit findings or issues. FY 2010 Fund Balance Report Annually,the Village's Fund Balance Policy and Practice is reviewed at the conclusion of the independent audit for the relevant fiscal period. This review incorporates the fiscal activities ending December 31,2010 and fund balance totals as stated in the audited Comprehensive Annual Financial Report. Five Year Operating Proiections—Corporate Fund The goal of the Five-Year Financial Forecast is to assess the Village's ability over the next five years to continue current service levels based on projected growth,preserve our long-term fiscal health,cease the draw on balance reserves, and resume reserve funding for capital equipment and facility improvements. Water/Sewer Fund Status—Rate Discussion As part of the FY 2008 water rate and fee adequacy report, a recommended increase in the combined rate to $2.40/1,000 gallons was approved. A second rate increase was proposed for FY 2010 to a combined rate of $3.00/1,000 gallons and remains in effect. The combined rate includes water and the Village's cost of maintaining the sanitary sewer delivery system. The treatment of sewage is handled by the respective counties. The Metropolitan Water Reclamation District of Greater Chicago bills Cook County residents through an ad valorem tax. Lake County charges system users $4/1,000 gallons. Staff presented a worksheet proving data on the Water and Sewer Fund. Centralized Purchasing Program Buffalo Grove faces increasing demands and decreasing resources. Centralized purchasing operations— appointing a single agent to serve as liaison between vendors and departments and adopting written procedures for administrating purchasing policies will help ensure the efficient and cost-effective purchase of goods and services for the Village. According to the Illinois Association of Public Procurement Officials,Buffalo Grove could achieve 15-20%cost savings per year through volume buying and improving the Village's bidding and quotation procedures. Voluntary Separation Incentive Status Update In January 2011,the Village offered the Voluntary Separation Incentive program to all non-represented employees. The program was structured to provide a severance payment based upon years of experience, and was purposefully designed to encourage higher-salaried personnel to retire or separate from service in order to re-fill positions at lower wages. Faced with an aging workforce and increasing personnel expenses as a percentage of total operational costs,this strategy was and is necessary to weather the current economic downturn that has had a prolonged effect on the Village's finances. Tier II Wame Program Staff presented a document containing the current Tier I salary structure that became effective for all current, non-represented,Village of Buffalo Grove employees on January 1,2011, as well as the newly approved Tierl salary structure for members of the Fire bargaining group, which became effective on December 31,2011, and a draft of the proposed Tier 11 salary ranges for all Village positions.. Health Plan Status Update On June 20,2011,the Village Board authorized staff to enter into an agreement with the Intergovernmental Personnel Benefit Cooperative(IPBC)Pool to provide Village employees with their health,dental and life insurance coverage for the period of January 1,2012 to July 1,2014. Staff presented plan structure scenarios, plan offerings and ancillary services available., ADJOURNMENT Moved by Berman, seconded by Sussman,to adjourn the meeting. Representatives from the following utility providers will be in attendance at the Village Board meeting to discuss the impact of the storm on their operations: • Art Barsema, Director, and Diane Emerson, External Affairs Manager, ComEd • Christopher Nelson, Manager of Government Affairs, Comcast Cable • David Strahl, External Affairs Manager,AT&T The Health Department will also discuss their role during the power outage. Mr. Barsema and Ms. Emerson from ComEd have provided the attached PowerPoint presentation. Their presentation will include the following matters: 1. Reason for the duration of the outages 2. Damage that occurred 3. How restoration is prioritized 4. Communications 5. Plans and proposals for grid upgrade and modernization in order to prevent or minimize future outage 6. Opportunities for improvement Residents and businesses who wish to contact any of the utility providers to discuss questions or concerns specific to their property can contact Office of the Village Manager staff at 847-459-2518 where staff will relay the concern or inquiry to the appropriate contacts. Village staff members will also be available to collect this information at the Village Board meeting to relay to the appropriate utility contact. This was at the request of Sergeant William Adam Chapman,nephew of Firefighter Paramedics Jim and Kevin Hauber. It may seem like a fairly ordinary occurrence that the Marines would fly an American flag over their base, and that is true. What is striking to me is that this soldier thought about his uncles and the Buffalo Grove Fire Department while on his tour of duty. Sergeant Chapman took time out of his duty to request that the Base Commander and First Sergeant gave their approval for this honor. They show their dedication to all of us by thinking of us first. This act has touched many of us who hold the military in the highest esteem. When you look at this flag you can not help but feel proud of these men and women and the sacrifices they are making for us. Sergeant Chapman is here to present the flag that he flew over the base in our honor, accompanied by his uncles and the Buffalo Grove Honor Guard. We will place the flag in a case and proudly display it at the station. The Buffalo Grove Fire Department will be wearing red shirts on Fridays as a way of showing our support of our troops. Several of the members of the department will be wearing these special shirts at the Village Board meeting. The public hearing notice published in the Daily Herald on June 28, 2011 was read. Mr. Parker explained that last fall they replaced their furnace. At the same time, they replaced their air conditioner. When they applied for the permit to replace their air conditioner they were advised that the existing air conditioner unit, which was located in the side yard, could not be in the side yard. They would like to keep the unit in the location that it currently exists. It would cause them hardship to relocate the unit to the rear of the house due to the location of the electric meter and patio. It would also be a significant cost to them to relocate the unit because they would have to move the electrical disconnect. They do not want to put in more holes in the house. If moved, the unit would then be closer to their neighbor to the rear of them. Ch. Entman read the Village Engineer's memorandum addressed to Brian Sheehan dated June 30, 2011 which states: "I have no comments on the proposal." Ch. Entman also read the Appearance Review Team (ART) minutes of July 6, 2011 which requests a landscaping plan to be submitted to the Village for review and approval and that the specifications on the unit be provided to the ZBA. Mr. Parker stated that he did submit a landscaping plan that was reviewed by the Village Forester. He made corrections based on comments from the Village Forester and provided a revised landscaping plan which has been marked as Exhibit"F". Com. Windecker asked about when the permit was applied for. Mr. Parker stated that he applied for the permit in November 2010. Com. It was more economical to replace the air conditioning along with the furnace. During the permitting process it was brought to our attention that we needed to have a variance due to the placement of the air conditioning unit. We have lived at this house since 1993 and the air conditioning unit has always been on the side yard. It would be a great hardship to have the unit moved from the side yard to the backyard. First of all, if the unit was in the backyard, we would have to tear down a portion of the fence to be able to perform maintenance on the unit. The unit needs to be on the fence line in order not to block the electric meter. We would also have to reconfigure the patio in order to accommodate the air conditioner. It is true that we could put the unit in another spot in the backyard so that we would not have to reconfigure the patio or move the fence; however, that would involve hiring an electrician to get electricity to the unit and running all new copper lines to it. Moving the unit would also require cutting more holes into the siding of the house. If the unit were located in the backyard, there would be more noise for our neighbor. The side of their house is just off our back property line. It is currently located on our side yard and is even with the side door cement stoop. We would be willing to incur the costs associated with placement of some sort of vegetation or wood screening. It would be an economic hardship on our family to have the electric and unit moved to the back yard. Please consider approving this variance. Thank you. Mr. Sheehan explained that the air conditioning unit was installed without a permit. The unit was replaced in the same location as the previous unit. Mr. Sheehan believes that the current unit appears to be very large. He would like to see some type of vegetation screen placed in front of the unit to block the view from the street. He would prefer arborvitae or a similar year-round plant material. So long as there is vegetation screening the unit from the right of way, he does not have any issues with the unit remaining in its current location. The landscape plan shall be reviewed by the Village Forester. Other ART members agreed that the unit did indeed appear very large. It was suggested that the specification information for the unit be provided for the ZBA to review. There were no additional questions or comments. RECOMMENDATION ART recommends approval of the variance subject to the following: 1. A landscaping plan is to be submitted to the Village for review and approval. There is an existing wall sign on the west elevation of the building that they will be replacing and there is an existing ground sign that they will be refacing. The proposed ground sign face will be opaque with cut out letters and logo. Only the letters and logo will be illuminated at night. They will install landscaping around the base of the ground sign pursuant to the Sign Code requirements. Ch. Entman read the Letter of Authorization dated June 21, 2011 and the ART minutes dated July 6, 2011. The ART recommends that a landscaping plan be submitted for review and approval by the Village and to provide the hours of illumination for the proposed signs. Com. Cesario asked about the proposed hours of illumination. Mr. O'Brien stated that there is no residential located in close proximity to the site and Mr. Flink would prefer to keep to signs illuminated all night. Com. Shapiro asked about the typical visitor to the site. Mr. O'Brien stated that it would be mostly employees with the occasional vendor. Com. Shapiro asked if the desire to leave the signs illuminated all night is for name recognition. Mr. O'Brien believes that is the case. Com. Shapiro explained that the Village likes to have some restrictions on the hours that signs are illuminated. Mr. O'Brien stated that they will comply with whatever restrictions the Village places on the signs but would like as much recognition as they can get. Com. Shapiro stated that he would like to see the signs turned off at 10:00 p.m. Com. Mr. Sheehan stated that landscaping is required around the base of all ground signs by the sign code. Landscapping that will be visible and present year round is preferred. He suggested that the Petitioner provide a landscaping plan for the ZBA to review. He has no issues with the proposed signs as depicted. Com. Windecker inquired about the hours of illumination for the signs. Mr. Flink replied that he has not thought about the hours that they would have the signs illuminated. Mr. Sheehan advised Mr. Flink to discuss the proposed hours of illumination and bring that information to the ZBA meeting as well, Mr. Sheehan added that there may be a residential area located across the street. Com. Windecker stated that the ZBA typically requires signs to be turned off at 10.00 p.m. Mr. Flink stated that they would most likely like to keep the sign on all night. Mr. O'Brien added that the sign face is routed aluminum and only the lettering will be illuminated. The grey background will not be illuminated. The lettering will not be very bright. The DEPARTMENT reserves the right to withdraw the privilege of timing signals from the GOVERNMENTAL BODY at any time. Traffic signals interconnected with an at-grade railroad crossing shall not be modified without prior Illinois Commerce Commission and DEPARTMENT notification and approval. Interconnected signals at an at-grade railroad crossing may be repaired to the original condition; however, the Illinois Commerce Commission and the DEPARTMENT must be notified thereof. i e. Interconnections: Installation & Damage. The DEPARTMENT is not responsible for the cost of installing or maintaining traffic signals not on (but interconnected to traffic signals on) U.S. or State routes. Any damage done to State traffic signals in the attempt to connect local traffic signals shall be repaired to the DEPARTMENT's satisfaction and shall be the responsibility of the GOVERNMENTAL BODY. f. Master Monitoring Costs. Master controllers installed on State intersections for the coordination of traffic signals are primarily used for the traffic signals located on U.S.or State routes. The GOVERNMENTAL BODY may connect traffic signals to a State owned master controller for the coordination or operation of non-State owned traffic signals, for the purpose of synchronizing time or gaining remote access. If the GOVERNMENTAL BODY desires a communications link to their office for monitoring purposes, the GOVERNMENTAL BODY shall pay the entire cost of installing and maintaining such monitoring system. g. Payment for Energy Costs. The GOVERNMENTAL BODY will reimburse the DEPARTMENT for the GOVERNMENTAL BODY's proportionate share of the energy charges. h. Indemnity. The GOVERNMENTAL BODY shall indemnify and hold harmless the DEPARTMENT for any and all third party claims for personal injury and property damage arising solely out of the maintenance of the signals and devices listed in Exhibit A. i. Emergency Vehicle Preemption Devices. The costs of installation, timing, phasing, and maintenance of emergency vehicle preemption systems shall be the sole responsibility of the GOVERNMENTAL BODY. Any Governmental Body must notify the DEPARTMENT of any change in the emergency vehicle preemption system. However, the DEPARTMENT reserves the right to approve or reject, at any time, the placement of such systems on its traffic signal equipment. j. Previous Agreements. All traffic signal and traffic control device maintenance and electrical energy provisions contained in presently existing agreements or understandings between the DEPARTMENT and the GOVERNMENTAL BODY for traffic signals and/or other traffic control devices covered by this Master Agreement shall upon execution of this Master Agreement by the DEPARTMENT be superseded and be of no force or effect. All parking ordinances and provisions bearing on items other than traffic signal and traffic control device maintenance and energy charges contained in presently existing agreements or letters of understanding between the DEPARTMENT and the GOVERNMENTAL BODY shall remain in full force and effect. k. Modification. Exhibit A can be modified to add or delete signals or devices, but only by written revision signed by the Regional Engineer, the Engineer of Operations and the authorized representative for the GOVERNMENTAL BODY. The modification shall be 2 effective when fully executed and filed with the Department and the Clerk or Secretary of the GOVERNMENTAL BODY. This provision applies only to modification of Exhibit A. I. Plan Review. All traffic signal plans prepared by others for installation on State highways within municipal corporate limits, which are to be added to this agreement, must be reviewed and approved by the DEPARTMENT and the GOVERNMENTAL BODY. m. Cost Sharing. As indicated in Exhibit A, the cost of energy and maintenance of traffic signals, and/or other traffic control devices shall be shared in proportion to the number of approaches maintained by each unit of government. The maintenance cost of the interconnect and interconnect related equipment, as listed in Exhibit A, as well as engineering costs for any approved coordination and timing studies, shall be shared in proportion to the approaches maintained by each unit of government at all intersections within the interconnected system. n. Billing. Bills shall be submitted by the DEPARTMENT on a three (3) month basis. The amount billed shall be the costs incurred less any proceeds from third party damage claims received during the billing period for repair of signals or devices that are the responsibility of the GOVERNMENTAL BODY. i. Any proposed single expenditure in excess of$10,000 for repair or damage to an installation must be approved by the GOVERNMENTAL BODY before the expenditure is made. ii. The hours, or parts thereof, billed for each maintenance item will be at the actual time directly related to the work task. The DEPARTMENT reserves the right to examine the records of the GOVERNMENTAL BODY to determine that costs billed are fully documented. iii. THE DEPARTMENT costs are composed of labor, equipment, materials and the quantity of each. The cost for labor will be determined by the actual hourly rate for the employee plus a multiplier to include direct and indirect labor related costs, retirement, social security, health, hospitalization and life insurance, holidays, vacation, sick leave and workers compensation. Equipment costs will be as listed in the Schedule of Average Annual Equipment Ownership Expense. Materials will be at cost. iv. The cost for contracted work will be the actual cost for the contractor. 3 3. GENERAL PROVISIONS 1. CABINET PACK Wiring diagrams, phase diagrams, and manuals that are required to be in each traffic signal controller cabinet at the time of construction completion shall remain in the cabinet. Written documentation of all traffic signal timing changes shall be provided in the cabinet. All entries shall be written in a clear and concise manner. The agent of the maintaining agency making any entries shall provide his/ her signature and date of entry. These shall be kept in the cabinet to assist the DEPARTMENT on emergency call outs. 2. HARDWARE SPECIFICATIONS All equipment and material used shall comply with the requirements of the DEPARTMENT's Standard Specifications for Road and Bridge Construction. 3. HIGHWAY LIGHTING For maintenance involving combination traffic signal and lighting unit mast arm assemblies and poles, the foundation, traffic signal mast arm assembly, pole and all signal cable shall be considered part of the traffic signal system. The lighting arm, luminaire and all lighting cable shall be part of the highway lighting system. The highway lighting system components of each combination mast arm assembly and pole shall be tested for proper operation and physical condition during the intersection cabinet inspection. All cost of inspecting and maintaining the highway lighting system equipment, is the responsibility of the GOVERNMENTAL BODY. In addition to regular inspection and maintenance, all cost of repairing or replacing damaged or missing highway lighting system equipment is the responsibility of the GOVERNMENTAL BODY. 4. EMERGENCY VEHICLE PREEMPTION SYSTEM Test Emergency Vehicle Preemption System (EVPS) equipment for proper operation and physical condition during the intersection cabinet inspection,. All program settings and each sequence of operation must be verified to be correct during each inspection. All cost of inspection and maintaining the EVPS equipment, including the light detectors, light detector amplifiers, radio transmitters and receivers, antennas, confirmation lights, and cables and related components, is the responsibility of the GOVERNMENTAL BODY. In addition to regular inspection and maintenance, all cost of repairing or replacing damaged or missing EVPS equipment is the responsibility of the GOVERNMENTAL BODY. 5. RAILROAD PREEMPTION At all locations with railroad/traffic signal interconnects, respond to any and all emergency and all red flash alarms in a timely manner and notify the Illinois Commerce Commission and the GOVERNMENTAL BODY of the malfunction. None of the traffic signal railroad preempt parameters including but not limited to the phase timings, phase sequences and pedestrian and vehicular clearance intervals can be modified without prior approval from the Illinois Commerce Commission. Maintain unique spare controller data modules or sets of data chips containing the final railroad preemption parameters for each location. Cooperate in any inspection as deemed necessary by the DEPARTMENT or the Illinois Commerce Commission. The DEPARTMENT shall provide contact personnel available at all times to who railroad preemption malfunctions must be reported. 6. DAMAGE REPAIRS Repair or replace any and all equipment damaged by any cause whatsoever. 7. ACCIDENT DAMAGE Be responsible to make recovery for damage to any part of the installation or system from the party causing the damage. Whenever third party claims cannot be recovered, the GOVERNMENTAL BODY shall share in the loss. 8. TEMPORARY TRAFFIC CONTROL Provide temporary traffic control during a period of equipment failure or for when the controller must be disconnected. This may be accomplished through the installation of a spare controller, placing the intersection on flash, manually operating the controller, manually directing traffic through the use of proper authorities, or installing temporary stop signs which will be removed once the signal is in working condition. 9. EMERGENCY PERSONNEL Provide skilled maintenance personnel who will be available to respond without delay to emergency calls. This may be provided by agency forces, contract, or maintenance agreement. Controller failure, lights out, knockdowns, or two (2) red lights out at intersection are considered emergencies. 10. L.E.D. SIGNAL HEADS Install all light emitting diodes (L.E.D.) signal heads according to instructions provided by each head's manufacturer and vendor so as to prolong their life and assure compliance under any warranties. Maintain logs of the dates of the L.E.D. modules installation for warranty and for end of service life determination purposes. B. AS REPORTED OR OBSERVED 1. LAMP REPLACEMENT Replace burned out lamps for all red signal indications within twenty-four(24) hours of notification of burnout or on the next business day following the notification. However, if two or more red indications for an approach are burned out, these lamps must be replaced as soon as possible, and under no circumstances longer than twenty-four (24) hours after notification. Replace all other burned out lamps within forty-eight (48) hours or next business day of notification of burnout. Lamp changes shall always include a lens cleaning. 2 2. SIGNAL ALIGNMENT Keep signal heads properly adjusted, including plumb, and tightly mounted. All controller cabinets, signal posts and controller pedestals should be tight on their foundations and in alignment. 3. CONTROLLER PROBLEMS Check the controllers, relays, and detectors after receiving complaints or calls to ascertain that they are functioning properly and make all necessary repairs and replacement. 4. L.E.D. SIGNAL HEAD AND L.E.D. MODULE REPLACEMENT An L.E.D. module shall be considered failed and shall be replaced if at least one-fourth of the signal indication is dark or if the module fails to meet ITE specification on minimum maintained luminous intensity. Replace failed modules for all red signal indications within twenty-four(24) hours of notification of failure or on the next business day following the notification. However, if two or more red indications for an approach are failed, these modules must be replaced as soon as possible, and under no circumstances longer than twenty-four (24) hours after notification. Replace all other failed modules within forty-eight (48) hours or next business day of notification of faillure. Provide replacement light emitting diodes (L.E.D.) signal heads and modules that fully comply to the latest applicable Institute of Transportation Engineers (I.T.E.) specifications for vehicular and pedestrian L.E.D. signal modules. including but not limited to, color and intensity requirements. The signal and pedestrian housings shall also comply with the applicable ITE specifications. 5. PAINTING Repaint all signal components exposed to weather as needed. C. WEEKLY 1. MASTER CONTROLLER SYSTEMS At locations that are a part of a closed loop signal system maintained by the GOVERNMENTAL BODY, repair any and all malfunctions in a timely manner so that the signals remain under the control of the master at all times. As needed assist in the implementation of the signal system timing plans. Maintain the central signal system software on a PC so that the signal system is monitored weekly. Check weekly by phone or location visit for any malfunction. Verify software accuracy to central office software. D. ANNUAL 1. CABINET INSPECTION Check the controllers, relays, and detectors to ascertain that they are functioning properly and make all necessary repairs and replacement. Keep interior of controller cabinet in a clean and neat condition at all times. 2. OBSERVE SIGNALS Observe the signals at the time of the annual cabinet inspection. This involves stopping and watching for correct detection and timing operation. 3. DETECTION TESTING Test and inspect vehicle detection inductance loops, loop detectors, and pedestrian detection during cabinet visit annually. 4. VIDEO DETECTION TESTING Inspect, maintain, and clean all video detection and surveillance systems annually or as needed, to achieve clean lenses, proper alignment and proper focus. This shall include system camera, lenses, camera housings and hood/shield, pan, tilt, and zoom mechanisms and motors, mounting brackets and hardware, poles, microprocessors, controller, cables and communication equipment, and other related components. Maintenance shall include modifications to programmable detection zones. 5. RELAMP For the remaining incandescent signal heads, clean reflectors, lenses and lamps once at least every twelve (12) months or more often, if necessary. Replacement of lamps shall be performed on the same occasion as the cleaning required in this provision. 6. CONTROLLER CHECK When solid state controllers malfunction, they shall be removed, repaired, and bench checked. Solid state controllers shall not be removed for annual maintenance inspections. This annual check should verify software with central office software and reprint cabinet pack timings sheet. Controller check shall occur during a annual cabinet inspection. 7. FUSE AND BREAKER CHECKS Fuse and breaker check should occur during a annual cabinet inspection. Replace burned out fuses or deteriorated breakers as needed. &. CLEARANCE TRIMMING Remove any obstruction blocking the line of sight of the traffic signal face to the motorist. The maintaining agency shall trim trees, bushes or any other form of vegetation blocking said lines of sight. The maintaining agency shall remove, or order the removal of, any man-made obstructions such as signs or banners blocking said line of sight. Visibility for line of sight shall meet the standards established and contained in the Manual on Uniform Traffic Control Devices (MUTCD). All trimmed vegetation shall be legally disposed of by the maintaining agency off the right of way. 9. HARDWARE INSPECTION Inspect all mast arm assemblies, mast arm poles, brackets (or other types of hardware) supporting traffic heads or pedestrian signal heads on an annual basis. The inspection shall focus on the structural elements of the mast arm assembly and must include a close up, arms length investigation of the mast arm, pole, mast to pole connection, base plate, and anchor bolts. The arm of the assembly shall be visually inspected at all signal head connections for any defects, such as cracks or buckles. Inspect the mast arm to pole connection for significant loss of section, cracks in welds or base metal, and deterioration of the connection plates. The bolts 4 of the arm to pole connection shall be inspected for tightness and condition. Check the pole for external corrosion, impact damage, rust through perforation, deflection, distortion, or cracking. Closely inspect pole for corrosion near the base plate, especially if mounted on a grout bed. Check welds of the pole to base plate connection for cracks. Inspect base plate for section loss or deformation. Inspect mast arm anchor bolts for any corrosion or bending, and for loose or missing nuts.
