ORDINANCE NO. 74-22
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF
THE VILLAGE OF BUFFALO GROVE AND APPROVING
PLANNED DEVELOPMENTS
WHEREAS, the Phoenix Construction Company, as contract purchaser of
the property hereinafter described, has applied for rezoning of said property
and the approval of planned developments for said property; and
WHEREAS, the Plan Commission of the Village of Buffalo Grove has
conducted public hearings on said application for rezoning and planned
developments and has recommended the approval of said rezoning and planned
developments; and
WHEREAS, the President and Board of Trustees have considered said
rezoning and planned developments and have determined that the approval of
said request for rezoning and the approval of the planned developments as
special uses is in the best interests of the Village of Buffalo Grove;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS:
SECTION ONE: That the 1961 Comprehensive Zoning Ordinance of the
Village of Buffalo Grove be and it is hereby amended by reclassifying
from the R-1 Single-Family Residence District to the R-9 Multiple-Family
Dwelling District, the following described territory, to wit:
Tract A: That part of the South 1/2 of Section 32,
Township 43 North, Range 11 East of the Third Principal
Meridian, lying South of the center line of Checker
Road described as follows: Beginning at the point of
intersection of the center line of said Checker Road
and the West line of the East 1/2 of the Southwest 1/4
of said Section 32, said point being 404.25 feet South
of the Northwest corner of said East 1/2 of the South-
west 1/4 of Section 32; thence South 000 08' 16" East
along said West line of the East 1/2 of the Southwest

SECTION TWO: The property hereinabove reclassified in Section One of
this ordinance shall be developed as a planned development in substantial
compliance with the plan prepared for Phoenix Construction Company by Sasaki ,
- Walker Associates, Inc. , which plan is attached hereto and made part of this
ordinance as Exhibit A. Said planned development shall consist of 849
multiple-family dwelling units which shall be sold as condominiums unless
the Village approves rental units. No buildings shall exceed three stories
in height. The type of construction shall include townhouse units, two-
story garden condominiums, and three-story apartment units. Said planned
development shall be constructed in phases; each phase shall be approved by
the Village Board if in substantial compliance with Exhibit A and the
provisions of this ordinance. The planned development consists of Tract A
containing 15 townhouses and 124 two-story condominium units. Tract B
consists of 242 three-story condominium units, 178 two-story townhouses,
and 38 townhouses. Tract C consists of 252 two and three-story condominium
units. All condominium agreements shall be subject to Village approval .
SECTION THREE: That the 1961 Comprehensive Zoning Ordinance of the
Village of Buffalo Grove be and it is hereby amended by reclassifying from
the R-1 Single-Family Residence District to the R-9 Multiple-Family Dwelling
District, the following described territory, to wit:
That part of the East 1/2 of the Southwest 1/4 of
Section 29, Township 43 North, Range 11 East of the
Third Principal Meridian lying North of the center
line of Illinois Route 83 as shown on the right of
way map of said road recorded November 5, 1931 as
Document Number 374979, Lake County, Illinois.
Said tract is located along the North side of Illinois
Route 83 approximately 2000 feet East of Arlington
Heights Road.
and the corresponding changes in designation on the zoning district map
are hereby made.
SECTION FOUR: The rezoning of the property hereinabove described in
Section Three of this ordinance is subject to the property being developed
as a special use planned development, consisting of 241 townhouse units.
Said planned development will be constructed in substantial compliance with
if said phase is in substantial conformance with Exhibit B and the pro-
visions of this ordinance. The Village shall have the right to approve
the condominium agreements .
SECTION FIVE: The planned developments herein provided in Sections
Two and Four of this ordinance are further subject to the following terms
and conditions :
A. The developer will pay to the Village for the benefit of the
school districts the total sum of One Hundred Three Thousand Dollars
($ 103,000) in accordance with the resolutions and policy of the Village
of Buffalo Grove respecting donations by developers in connection with
developments within the Village. Said financial contribution will satisfy
all requirements for donations or land dedication, except as hereinafter
set forth. Said cash donation shall be made to the Village for the use
of the school districts based upon issuance of building permits.
B. The owners of the property shall donate 4.8 acres on the southeast
corner of Raupp and Old Lake-Cook Road to the Village of Buffalo Grove
without further compensation. Said donation of land shall take place at
the time of first plat or phase approval and shall relieve any further
obligation to pay moneys claimed by the Village from the owners of said
property in connection with the improvement of Checker Road.
C. The owners of the property agree to execute a certain agreement
with the Village of Buffalo Grove to provide for the acquisition of the
Buffalo Grove Golf Course on terms and conditions mutually agreed upon by
the parties.
D. As part of the planned development described in Section Two of
this ordinance, retention facilities shall be provided upon the golf
course property in a manner agreeable to the Village, and such retention
facilities shall remain on the golf course for the use and benefit of
the planned development. Said retention facilities shall be constructed
and maintained by Phoenix Construction Company or its successor in title.
Construction shall take place between October 15 and April 1 so as not
to interfere with the golf season. The design of the construction is

enlarge and otherwise improve the existing ponds, and construct such
storm sewers on the course as necessary to make the facility operative.
All such work shall be done in a manner which will not interfere with the
operation of the golf course and shall be subject to the approval of the
Village.
E. All construction on the planned developments as herein approved
shall conform with the ordinances and standards of the Village of Buffalo
Grove, except as said ordinances and standards are modified by the terms
of this ordinance. Said standards are attached as Exhibit C.
F. The planned developments shall contain the following public
improvements:
1 . Checker Road shall include curbs and gutters.
2. Curbs and gutters will be installed in all four tracts
with sidewalks along all roads and drive lanes, including
interior roads .
3• Checker Road shall be widened at the developer's expense
as it abuts the planned development to the same width as
existing Checker Road immediately west of the property,
with the design and construction to conform to Village
standards.
G. The owner further agrees to dedicate Lake-Cook Road, as necessary
for County widening and improvement, provided that the County assumes the
cost for sidewalks along Lake-Cook Road.
H. The owner agrees to grant an easement to the Village along Checker
Road for sewer purposes and to construct such off-site sewer and water facilities
where necessary to service its properties. In this connection Phoenix Con-
struction Company will cooperate with other developers in the area in the
provision of sewer facilities.
I . All streets shall be dedicated to the Village at its request and a
secondary road will be constructed from the northern portion of the loop
street to the northern boundary of the property described in Section Four.
SECTION SIX: Special use permits are hereby granted for the construction
of the planned developments as provided in this ordinance.
SECTION SEVEN: This ordinance shall be in full force and effect from
and after its passage, approval , publication and recording by the
appropriate recorder's office in Lake and Cook County in the manner
provided by law.

property described in Section Three hereof shall be rented without
the prior approval of the President and Board of Trustees. Said
townhouse planned development may be developed in phases, either
on a direct sale-purchase or condominium basis, and the Village
Board shall approve each phase as submitted if it is in substantial
compliance with Exhibit "B" and the provisions of this Ordinance.
The form of all condominium agreements shall be subject to Village
approval.
SECTION FIVE: The planned developments hereinabove provided
in' Secti-ons Two and Four of this Ordinance are further subject to

Authorities of the Village of Buffalo Grove respecting donations
by developers and/or owners in connection with developments with-

Dollars ($103,000) . Such financial contributions are intended
to satisfy all requirements for donations or land dedication,
except as hereinafter set forth. Such financial contributions
shall be made to the Village for the use of the school district
or districts as the Village shall designate at the time of the
issuance of any building permits and be based pro-rata upon the
number of building permits then being issued.

B. Within five (5) days after the effective date of this
Ordinance, the owners of the above described property shall
donate and convey a tract of land consisting of 4. 36 acres , Located
on the southeast corner of Raupp and Old Lake-Cook Road to the
Village of Buffalo Grove without any compensation therefor. The
legal description of said 4. 36 acre tract of land is hereto
attached as Exhibit "C" . The conveyance and donation of said
tract of land shall relieve the owners of the property herein
being rezoned from any further obligation to pay moneys claimed

by the Village from such owners in connection with the improvement
of Checker Road.
C. The owners of the subject property agree to execute or
cause to be executed a certain Agreement with the Village of
Buffalo Grove to provide for the sale by the owners and acquisition
by the Village of the Buffalo Grove Golf Course on terms and
conditions mutually agreed upon between the parties.
D. As part of the planned development described in Section
Two of this Ordinance, storm water retention facilities shall be
provided as hereinafter provided upon and within the Golf Course
property in a manner agreeable to the Village , and such retention
facilities shall remain upon and within the Golf Course property
to service and for the use and benefit of said planned developments .
Said retention facilities shall be constructed and maintained by
the owner of the property and/or properties , Phoenix Construction
Company and/or its successors or assigns in title. Construction
work thereon shall take place only between October 15 and April 1
so as not to interfere with the golf playing season. The design
of such construction is to be approved by the Village and conform
to County and Village standards . As part of said retention
facilities, the owners , Phoenix Construction Company or their
successors or assigns in title shall have the right to construct
a new storm water retention pond at the northeast corner of the
Golf Course, enlarge and otherwise improve the existing ponds ,
and construct such storm sewers on the Golf Course as may be
necessary to make the facility operative. All such work shall be
done in a manner which will not interfere with the operation of
the Golf Course and all plans, specifications, construction and
maintenance shall be subject to the approval of the Village. In
successors or assigns in title fail to maintain the facilities ,
the Village upon reasonable notice to the then owners of the
property being rezoned hereunder shall have the right to do any
work and furnish any material required, and charge the same back
to the owners , Phoenix Construction Company, and/or their successors
or assigns in title and upon failure to pay same , recover the cost
thereof, plus expenses and reasonable attorney ' s fees, through
court action.
E. All construction on the planned developments as herein
approved shall conform with the Ordinances and standards of the
Village of Buffalo Grove, except as said Ordinances and standards
are modified by the terms of this Ordinance. Said standards are
attached hereto as Exhibit "D" .
F. The planned developments shall contain the following

G. Upon the owners arriving at a land value settlement,
the owner will dedicate such portion of the proposed Lake-Cook
right of way which it presently owns , which is adjacent to such
proposed development, and is declared necessary for county widening
and improvement provided either county or owner agrees to assume
the cost and that the county assumes the cost for the construction
of sidewalks along Lake-Cook Road right of way at no cost to the
Village. In addition, the owner will proceed without delay to

owner and Phoenix Construction Company will cooperate with other

demand and the owner and/or Phoenix Construction Company will
construct a secondary road from the northern portion of the loop
street to the northern boundary of the property described in
Section Four, when so directed by the Village in writing.
SECTION SIX: Special use permits are hereby granted for
the construction of the planned developments as provided in
this Ordinance.
SECTION SEVEN: As one of the inducements to zone as here-
inabove set forth, the owner-developer publicly represented to
the President and Board of Trustees that it is their intent to
build and sell buildings constructed on the property being
rezoned hereunder either by direct sale or on a condominium
agreement basis only. In order to allow the owner-developer
flexibility in the event units cannot be sold because of adverse '

economic conditions, this Ordinance contains provisions permitting
one third of the number of units provided for in Section Two to
be rented. Notwithstanding such provisions, and prior to
renting any of such units , the owner-developer and all subsequent
owners-developers shall provide the Village with reasonable
evidence of such economic difficulties.
SECTION EIGHT: It is hereby declared that proposed
Ordinance No. 74-22 never became effective.
