1999-018 2/16/99 ORDINANCE NO. 99-18 FIRST AMENDMENT TO THE WOODLAND COMMONS SHOPPING CENTER PLANNED UNIT DEVELOPMENT ORDINANCE Northwest Suburban Jewish Community Center (JCC) 370 Half Day Road (IL Route 22) WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, Inland Real Estate Corporation (hereinafter referred to as "Owner"), is the Owner of the property (hereinafter referred to as the "Property") described in EXHIBIT A attached hereto, which exhibit is made a part hereof, and which real estate is within the corporate limits of the Village; and, WHEREAS, the Property is zoned in the B-3 Planned Business Center District by Ordinance 88-109, and said Ordinance approved a Preliminary Plan (Exhibit B, dated September 8, 1988); and, WHEREAS, Paragraph 19.F. of said Ordinance 88-109 allows an outdoor sales area for certain supplies and materials for a hardware store use, and said outdoor sales area is depicted on the Preliminary Plan (Exhibit B) to said ordinance; and, 2 WHEREAS, Paragraph 19.G. of said Ordinance 88-109 states: Uses in the B-3 Planned Business Center District shall be limited to retail shopping and related service uses, restaurants, and business and professional offices. Uses are subject to review and approval by the Village, which shall determine if said uses are compatible and appropriate for the area. WHEREAS, the Northwest Suburban Jewish Community Center (hereinafter referred to as the "JCC") proposes to lease the 21 ,173 square foot space on the Property in the area formerly occupied by a hardware store (designated as Space E on EXHIBIT D attached hereto); and, WHEREAS, the JCC has petitioned to the Village for approval of a preschool in an 11 ,723 square foot portion of Space E as depicted on EXHIBIT D, and said petition also requests amendment of the approved Preliminary Plan (Exhibit B to Ordinance 88-109) to allow an outdoor playground in the area approved as an outdoor sales area by Ordinance 88-109; and, WHEREAS, the JCC requests approval for said preschool and outdoor playground pursuant to the following exhibits: EXHIBIT A Legal Description EXHIBIT B Memorandum dated January 25, 1999 from Stuart B. Lenhoff, Childs Realty Group EXHIBIT C Letter dated January 25, 1999 from Gerald E. Lindgren, KLOA and Memorandum dated January 13, 1999 from Kenig, Lindgren, O'Hara and Aboona, Inc. (KLOA) 3 EXHIBIT D "Woodland Common Mall" site plan (1 1 "x17," no date) EXHIBIT E Site plan dated January 29, 1999 (1 1 "x17") by Sara E. F. Gensburg, Ltd. EXHIBIT F Playground site plan titled "JCC at Woodland Commons" (8.5"x14," no date) WHEREAS, the Buffalo Grove Plan Commission has reviewed the proposed plans and exhibits submitted by the JCC and the request for approval of said preschool and outdoor playground, and the Plan Commission recommends approval of said uses and amendment to the Preliminary Plan approved by Ordinance 88- 109; and,, WHEREAS, the President and Village Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1 . This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance, and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. 4 Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance amending the Planned Unit Development Ordinance 88-109 and approving an amendment to the Preliminary Plan (Exhibit B to Ordinance 88-109) to replace the formerly approved outdoor sales area with the outdoor playground as depicted on EXHIBIT F attached hereto, subject to the following conditions: A. Vehicles delivering and picking up children at the preschool shall park in designated parking spaces and shall not park in the access aisle adjoining the JCC facility. The JCC shall take appropriate measures, including (if necessary) using personnel to supervise parking, to ensure that vehicles using the facility park in designated spaces and do not park in the access aisle adjoining the facility. B. The playground shall be properly fenced and protected by bollards as approved by the Village. The outdoor playground shall be managed to ensure that no noise or other nuisances affect the adjacent residential area. C. Employees at the JCC facility shall park in designated parking spaces at the rear of the facility, and safe and convenient access to the rear of the facility shall be provided for employees. D. The mezzanine area as depicted on EXHIBIT E shall be used only as office space by the JCC and for storage, and shall not be used as program space for the preschool or any other use involving public access. 5 E. All traffic control devices, including striping for pedestrian walkways, as depicted on EXHIBIT E are subject to review and approval by the Village. F. Any use of the remaining portion of the 21 ,173 square foot space leased by the JCC is subject to approval by the Village in its sole discretion. G. Any provisions and conditions of Ordinance 88-109 not specifically modified by this Ordinance remain in effect. Section 3. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
