1998-029 4/16/98 ORDINANCE NO. 98- 29 AN ORDINANCE APPROVING A PRELIMINARY PLAN IN THE B-3 PLANNED BUSINESS CENTER DISTRICT, VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Wendy's restaurant. Half Day Road (IL Route 22) Woodland Commons shopping center WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in EXHIBIT A ("Property") attached hereto is zoned in the B-3 Planned Business Center District; and, WHEREAS, the Preliminary Plan approved by Ordinance 88-109 for the Woodland Commons shopping center delineates Parcel B, and said Ordinance requires Village approval of development on said Parcel; and, WHEREAS, Wendy's International, Inc. has requested approval of a Preliminary Plan to construct a restaurant with a floor area of 2,910 square feet and a drive-through service window on Parcel B pursuant to the following exhibits: EXHIBIT A Legal Description EXHIBIT B Geometric Plan, CE-1 (Preliminary Plan) dated as last revised April 16, 1998 by Marchris Engineering, Ltd. EXHIBIT C Landscape Plan dated March 27, 1998 by Countryside Industries, Inc. EXHIBIT D Building Exterior Elevations (Sheet Al ) dated April 16, 1998 by Wallin Gomez Architects, Ltd. 2 WHEREAS, the Buffalo Grove Plan Commission has reviewed the proposed development and recommends approval of the Preliminary Plan ; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1 . This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Preliminary Plan for a Wendy's restaurant pursuant to EXHIBITS B, C, D for Parcel B of the Woodland Commons shopping center as legally described in EXHIBIT A hereto. Signs for the development are subject to provisions of the Village Sign Code, and this Ordinance approving the Preliminary Plan does not approve any variations of said Sign Code. Any provisions and conditions of Ordinance 88-109 not specifically modified by this Ordinance remain in effect. Section 3. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
