ORDINANCE NO. 2012 -57
AN ORDINANCE APPROVING THE THIRD AMENDMENT
TO THE WATERBURY PLACE
PLANNED UNIT DEVELOPMENT(PUD)
VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS

Modification of Landscape Plan
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS, Village Ordinance No. 2005-14 approved a Planned Unit Development (PUD)
including Exhibit D (Preliminary Plan dated January 4, 2005) for the Waterbury Place subdivision
(as legally described in Exhibit A hereto, and hereinafter referred to as the "Property"); and,
WHEREAS, Village Ordinance No. 2007-27 approved the first amendment to the
Waterbury Place Planned Unit Development modifying the Preliminary Plan (Exhibit D to
Ordinance No. 2005-14). Said modification allowed four townhome buildings, each with six
dwelling units, to be constructed in place of three villa buildings on Lots 17, 18, 19 and 20 along
the west side of Apple Hill Lane. The modified Preliminary Plan was approved as Exhibit C to
Ordinance No. 2007-27.
WHEREAS, Village Ordinance No. 2008-78 approved the second amendment to the
Waterbury Place Planned Unit Development Modifying the Preliminary Plan (Exhibit C to
Ordinance No. 2007-27) to allow the flexibility to construct townhome buildings or rowhome
buildings on Lots 17, 18, 19 and 20 along the west side of Apple Hill Lane; and,
WHEREAS, Edward R. James Partners, developer of Waterbury Place as Waterbury Place
Venture LLC, (hereinafter referred to as "Developer") and the Waterbury Place Homeowners
Association are requesting approval of a final landscape plan for the subdivision, and said plan
incorporated herein as Exhibit C , replaces the landscape plan approved as Exhibit G to
Ordinance No. 2005-14; and,

WHEREAS, the Developer submitted the following exhibits pertaining to the proposed
final landscape plan, which are attached hereto and made a part hereof:

Association Board of Directors dated August 27, 2012
EXHIBIT C Final Landscape Plan dated as last revised July 23, 2012 by
the Lakota Group Inc.
WHEREAS, the Waterbury Place Homeowners Association reviewed the Final Landscape
Plan (Exhibit C hereto) and made said plan available for review and comment by property
owners in the Waterbury Place subdivision; and.
WHEREAS, the Waterbury Place Homeowners Association Board of Directors voted 4 to
0 on August 27, 2012 to approve said Final Landscape Plan; and,
WHEREAS, the Village Forester has reviewed said Final Landscape Plan (Exhibit C hereto)
and determined that said plan is acceptable; and,
WHEREAS, the President and Board of Trustees have determined that the Final
Landscape Plan (Exhibit C hereto) is acceptable.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS:
Section 1. This ordinance is made pursuant to and in accordance with the Village's
Development Ordinance, Zoning Ordinance and the Village's Home Rule powers. The preceding
whereas clauses are hereby incorporated herein.
Section 2. The Corporate Authorities hereby adopt a proper, valid and binding
ordinance amending Ordinance No. 2005-14 to replace Exhibit G to said ordinance with Exhibit
C hereto. Said approval is subject to completion of punch list items prepared by the Village
Engineer.
Section 3. The terms and conditions of Ordinance No. 2005-14, Ordinance No.
2007-27 and Ordinance No. 2008-78 remain in full force and effect unless specifically modified
by this Ordinance.
Section 4. This Ordinance shall be in effect from and after its passage and approval.
This Ordinance shall not be codified.

Pumuent to wftw notice delivered to unit owners on August 15, 2012, a mgular meeting of
the Waterbury Place HOA Board of Directors was convened on the property on August 27,
2012 at 7:30PM. Present at the meeting : Mark Tanis, Micheal SImuss, Mike Reardon and
Warren .lames, being Directors of the Assoc-iation and con 'ng a quorum of ft Board.

WHEREAS, The Board has been advised by the developer that perennial plant life
origina8y planned for the median strip between garages will rot survive due to salt and snow
removal damage; and
WHEREAS,The Board has been advised by the developer that working with the Village of
Buftlo Grove, new plans have been developed to use funds allocated for the median strip
plantings elsewhere to enhance established plant bads in thal common area, and
RESOLVED,The Board after reviewing the new plans presented by the developer has
determined the changes to the original landscaping plans to de an improvement over the
original planfts planned for ft median strips between the darages., and
FURTHUR RESOLVED,the Secretary to deliver a copy df this Resolution with the new
plans to the Village of Buftlo Grove, and
FURTHUR RESOLVED, The Board will select owner repriesentatives to meet with
representatives of the Village of Buffalo Grove, if such a meeting is required.
