2011-027 a 6/6/2011 ORDINANCE NO. 2011-27 AN ORDINANCE APPROVING THE THIRD AMENDMENT TO THE WALGREENS (15 BUFFALO GROVE ROAD) PLANNED UNIT DEVELOPMENT (PUD) VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Walgreens store In-store medical services 15 Buffalo Grove Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the Walgreens store at 15 Buffalo Grove Road is located on Lot 1 of the Walgreens Buffalo Grove Resubdivision as legally described in Exhibit A attached hereto; and, WHEREAS,Village Ordinance No.96-48 approved a Planned Unit Development(PUD) for development of a Walgreens store with a special use for a drive-through service facility on Lot 1,and a shopping center known as the Buffalo Grove Shoppes on Lot 2; and, WHEREAS, amendments of Ordinance No. 96-48 were approved for Lot 2 concerning development of the Buffalo Grove Shoppes by Ordinance No. 2007-7 (first amendment) and Ordinance No. 2000-70 (second amendment); and, WHEREAS, Bond Drug Company of Illinois (hereinafter sometimes referred to as "Walgreens")requests approval of an amendment of the PUD concerning Lot 1 (hereinafter referred to as the"Property") to allow medical services to be provided in the existing retail store; and, WHEREAS,said medical services will be provided by Walgreens operating under the name of"Take Care Clinic,"in a space of approximately 279 square feet as depicted on Exhibit G hereto, and, 2 WHEREAS,Walgreens has represented that the 73 existing off-street parking spaces on the Property will be adequate to serve the incremental parking demand created by the proposed in-store medical services, as well as the customers using the existing retail space and related services at the store; and, WHEREAS,Walgreens is proposing modifications to the south and west exterior elevations of the building to allow the installation of new windows; and, WHEREAS, said proposed modifications of the exterior building elevations have been reviewed and recommended for approval by the Village Appearance Review Team (ART); and, WHEREAS, the proposed medical services in the existing Walgreens retail store require amendment of the Planned Unit Development for the Property, and Walgreens has requested said amendment pursuant to the following exhibits: EXHIBIT A Legal Description of Property EXHIBIT B Petitioner Acceptance and Agreement concerning Planned Unit Development approval EXHIBIT C Letter dated May 10, 2011 from Bernard Citron, Thompson Coburn LLP EXHIBIT D Site Plan (Sheet 100-c) dated 5/31/11 by SHA Schroeder & Holt Architects EXHIBIT E Accessible parking plan(Sheet C-520)dated 5/31/11 SHA Schroeder &Holt Architects EXHIBIT F Proposed exterior building elevations(Sheet K-210 and K-211)dated as last revised May 31,2011 EXHIBIT G Proposed floor plan (Sheet D-1) dated February 4,2011 WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove have determined that the proposed in-store medical services and the proposed modifications of the exterior building elevations as set forth in the exhibits hereto, are appropriate for the Property and would be compatible with adjacent properties. NOW,THEREFORE,BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: 3 Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Home Rule powers.The preceding whereas clauses are hereby incorporated herein. Section 2. The Corporate Authorities hereby adopt a proper,valid and binding ordinance approving the amendment of the Planned Unit Development pertaining to the request by Walgreens to provide in-store medical services as an accessory use and to modify the exterior elevations of the building on the Property,pursuant to the exhibits hereto,with the following conditions: a. The sidewalks along the south and west sides of the building shall be modified to improve accessibility for customers with disabilities,as depicted on Exhibits D and E hereto, subject to approval by the Village. Said modifications shall be completed in conjunction with the proposed changes to the exterior windows and building alterations for the in-store medical services approved by this Ordinance. b. Signs depicted on Exhibit E are not approved by this Ordinance. Signs are subject to the requirements of the B-5 District of the Village Zoning Ordinance and the Village Sign Code. Section 3. This Ordinance shall be in full force and effect upon the submittal of the executed Petitioner's Acceptance and Agreement, Exhibit B of this Ordinance. This Ordinance shall not be codified.
