THIRD AMENDMENT TO THE SEIGLE'S
PLANNED UNIT DEVELOPMENT ORDINANCE

WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the
Illinois Constitution of 1970; and,
WHEREAS, Harry J. Seigle and Mark S. Seigle (hereinafter referred to as
"Owner'), is the Owner of a certain tract of property consisting of Lots 1, 2 and 3 of
Seigle's Resubdivision legally described in EXHIBIT A attached hereto, which exhibit
is made a part hereof, (hereinafter referred to as the "Property') and which real estate
is within the corporate limits of the Village; and,
WHEREAS, the Property was zoned in the Village of Buffalo Grove by Ordinance
88-110, dated November 7, 1988, which zoned the Property as part of a Planned Unit
Development in the B-2 District (Lots 1 and 3 and a portion of Lot 2) and B-4 District
(a portion 'of Lot 2), with approval of a Preliminary Plan dated October 31, 1988

depicting a fast-food restaurant on Lot 1 , a Seigle's Home and Building Center on Lot
2 and a future office building on Lot 3; and,
WHEREAS, the first amendment to Ordinance 88-110 was approved by
Ordinance 92-35 on April 6, 1992 allowing the construction of a gatehouse to serve
the Seigle's Home and Building Center on Lot 2; and,
WHEREAS, the second amendment to Ordinance 88-1 10 was approved by
Ordinance 96-11 on March 4, 1996, rezoning Lot 2 to the B-3 Planned Business
Center District, amending the Planned Unit Development ordinance, and, allowing
Crate and Barrel, Inc. to lease the building on Lot 2 for operation of a retail outlet
store; and,
WHEREAS, Congregation Beth Am (hereinafter referred to as "Developer," as
contract purchaser of Lot 2 and Lot 3, has petitioned to the Village for amendment of
the Planned Unit Development Ordinance and approval of a Preliminary Plan and a
Special Use to use the building on Lot 2 as a place of religious worship and related
uses including education programs and social events; and,
WHEREAS, Congregation Beth Am proposes to use Lot 2 and Lot 3 pursuant to
the following exhibits:

WHEREAS, a notice of public hearing concerning amendment of the Planned
Unit Development ordinance and approval of a Preliminary Plan and Special Use was
was published and the Buffalo Grove Plan Commission has held a public hearing
and made their recommendations; and,
WHEREAS, the President and Board of Trustees after due and careful
consideration have concluded that the development of the Property on the terms and
conditions herein set forth would enable the Village to control development of the area
and would serve the best interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1 . This Ordinance is made pursuant to and in accordance with the
Village's Zoning Ordinance, Development Ordinance, and the Village's Home Rule
powers. The preceding whereas clauses are hereby made a part of this Ordinance.
Section 2. The Corporate Authorities hereby adopt a proper, valid and binding
ordinance amending the Planned Unit Development ordinance and approving a
Preliminary Plan and a Special Use for use of the building on Lot 2 as a place of

religious worship and for related educational programs and social events subject to the
following conditions:
A. Developer hereby authorizes and approves of the creation of fire
lanes as depicted on EXHIBIT C. Said fire lanes shall be created
and provided for by Village ordinance and said ordinance shall be
approved prior to issuance of a certificate of occupancy for the
building on Lot 2.
Developer shall install fire lane signage as approved by the Village
or shall pay for any fire lane signage installed by the Village.
Access for emergency purposes to said fire lanes shall be
maintained at all times. Developer shall take all actions required to
maintain said emergency access, including the use of traffic
control personnel if necessary.
B. Re-striping and modifications of paved areas shall be completed by
the Developer prior to issuance of a certificate of occupancy for
the building on Lot 2. Said modifications include:
1. The parking areas adjacent to the building on Lot 2 shall be
re-striped, appropriate signage shall be installed to establish
a one-way traffic circulation route on Lot 2 and curbing
shall be installed adjacent to the southwest corner of said
building, all as depicted on EXHIBIT C attached hereto.

2. The paved surfaces on Lot 2 and the north/south access
road on the west side of Lots 2 and 3 shall be repaired as
as required by applicable Village regulations.
C. The west door of the building on Lot 2 shall not be used for drop-
offs and pick-ups of students attending school sessions or other
educational programs at the building.
D. The existing gates and guardhouse on Lot 2 shall be removed prior
to issuance of a certificate of occupancy for the building on Lot 2.
E. The warehouse and perimeter warehouse shall be used for parking
of vehicles as depicted on EXHIBIT C. Said structures shall be
maintained to prevent infestation by birds or other animals, shall
be kept free of litter and debris and shall be kept in good repair to
avoid any detrimental impacts on adjacent properties.

F. In the event that the Developer uses the building on Lot 2 as a
facility for banquets and other events not directly serving members
of the Congregation Beth Am, parking for said occasions shall
meet the Zoning Ordinance standard for restaurants of one off-
street parking space per 100 square feet of gross floor area for the
portions of the building used for said occasions.
G. Any changes to the exterior building appearance, exterior lighting
or landscaping is subject to review and approval by the Village.

H. Any signage for the Property shall conform to the Village
Appearance Plan and Sign Code. If the Village determines that
additional directional signage is needed on or adjacent to the
Property to manage traffic in the area, Developer shall install said
signage as directed by the Village or shall pay for any directional
signage installed by the Village.
I. Developer has represented that applicable parking requirements as
set forth in the Village Zoning Ordinance shall be met, except for
three events per calendar year when off-site parking will be
necessary to accommodate uses on Lot 2. Developer shall make
adequate provisions for off-site parking to accommodate all
occasions and events when off-site parking is required to
accommodate uses on Lot 2. The Village reserves the right to
review and approve Developer's parking management plan for off-
site parking.
Developer has represented that adjacent streets, including
Brunswick Lane, Woodstone Drive and Woodstone Circle will not
be used for parking to accommodate uses on Lot 2. Developer
shall inform all users of the Congregation Beth Am facility that said
adjacent streets are not to be used for parking.

J. Use and zoning of Lot 3.
1 . In order to ensure that adequate parking is available to
accommodate the uses (excluding Yom Kippur eve, Yom
Kippur and Rosh Hashanah) of the building on Lot 2, Lot 3
shall be kept vacant for a period of three (3) years after
issuance of a certificate of occupancy for the use of the
building on Lot 2.
2. During this three (3) year period, the Developer may use
Lot 3 for parking to accommodate uses at the building on
Lot 2. Said Lot 3 shall be properly graded and maintained as
a grass area to accommodate parking. Said lot shall be
maintained as required by Village regulations, and any
refuse, debris or trash shall be removed and disposed of in
a timely manner.
3. If, after said three year period, the Village (with input from
the Developer) determines that Lot 3 is needed to
accommodate the uses (excluding Yom Kippur eve, Yom
Kippur and Rosh Hashanah) of the building on Lot 2,
Developer shall improve said Lot 3 as a parking area in
compliance with standards of the Village Zoning Ordinance
and Development Ordinance, including pavement, parking

Section 3. This Ordinance shall be in full force and effect on and after its
passage and approval. This Ordinance shall not be codified.
