1993-05-03 - Ordinance 1993-031 - AMENDING ORD 92-039 CONCERNING SPECIAL USE FOR 150 WEILAND RD 4/29/93 ORDINANCE NO. 93- 31 AN ORDINANCE AMENDING ORDINANCE NO. 92-39 CONCERNING THE SPECIAL USE FOR THE HARBOR RIDGE NURSING HOME Harbor Ridge Nursing Home, Steepleview site, Weiland Road Armstrong Drive WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the Village approved Ordinance No. 92-39 on May 4, 1992 granting a Special Use for a nursing home in the R-9 Multiple Family zoning district for the Property legally described in EXHIBIT A attached hereto; and, WHEREAS, said Ordinance 92-39 stipulates in Section 2.H. that: The Special Use authorization shall be revoked and the Property shall automatically revert to the R-1 zoning classification: (i) If a certificate of need has not been issued by the State of Illinois by May 3, 1993; (ii) If the Special Use has not been established on the Property by May 3, 1993. An extension to the foregoing time limits may be granted by the Corporate Authorities upon petition. WHEREAS, the Developer of said nursing home has represented to the Village that certification for the facility has been received from the State of Illinois, and construction permits for said facility are under review by the Village; and, WHEREAS, the Developer has requested an extension of the Special Use approval to May 4, 1995 to complete construction of the nursing home; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that said extension of the Special Use approval is warranted and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1 . Section 2.H. (ii) of Ordinance No. 92-39 is hereby amended to extend the time limit for establishment of the Special Use to May 4, 1995. The Special Use shall be considered "established" when a certificate of occupancy for the nursing home facility has been issued by the Village. An extension to the foregoing time limit may be granted by the Corporate Authorities upon petition. 2 Section 2. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
