AN ORDINANCE APPROVING A REZONING FROM THE R-1 ONE
FAMILY DWELLING DISTRICT TO THE R-9 MULTIPLE FAMILY
DWELLING DISTRICT AND APPROVING A PRELIMINARY
PLAN AND SPECIAL USE IN THE R-9 DISTRICT
Buffalo Grove Nursing Home (Windsor Manor)
Steepleview site, Weiland Road/Armstrong Drive
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue
of the Illinois Constitution of 1970; and,
WHEREAS, the real Property legally described in EXHIBIT A attached
hereto was classified in the R-1 One Family Dwelling District by Ordinance
90-51 on July 16, 1990; and,
WHEREAS, Harold Lederman, Eileen Lederman, Bruce J. Lederman,
Sharon Trotter and David H. Trotter have petitioned to the Village for
rezoning to the R-9 Multiple Family District, approval of a Preliminary Plan
and approval of a Special Use for a nursing home facility; and,
WHEREAS, the petitioners propose to develop the nursing home facility
pursuant to the following exhibits:
EXHIBIT B Preliminary Plan dated April 16, 1992 by
Shayman and Salk.
EXHIBIT C Preliminary Engineering Plan dated
April 26, 1992 by Donald Manhard Associates.
EXHIBIT D Conceptual Landscape Plan dated
March 29, 1992 by Thompson Dyke and
Associates.
EXHIBIT E Building Elevations (east and south) dated February
19, 1992 by Shayman and Salk.
EXHIBIT F Building Elevations (north and west) dated
February 19, 1992 by Shayman and Salk.
WHEREAS, notice of the public hearing concerning the petition for
rezoning and approval of the Special Use and Preliminary Plan was given and
the public hearing was held by the Buffalo Grove Plan Commission; and,

WHEREAS, the Plan Commission determined that the criteria for a
Special Use amendment as set forth in Section 17.28.040 of the Village's
Zoning Ordinance has been met and the Preliminary Plan is appropriate for
the Property and compatible with adjacent properties; and,
WHEREAS, the President and Board of Trustees after due and careful
consideration have concluded that the development of the Property on the
terms and conditions herein set forth would enable the Village to control
development of the area and would serve the best interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE
COUNTIES, ILLINOIS:
Section I . This ordinance is made pursuant to and in accordance with
the Village's Zoning Ordinance, Development Ordinance and the Village's
Home Rule powers for the Property legally described in EXHIBIT A attached
hereto. The preceding whereas clauses are hereby made a part of this
ordinance.
Section 2. The Corporate Authorities hereby adopt a proper, valid and
binding ordinance rezoning the Property to the R-9 District, approving a
Special Use for a nursing home and approving the Preliminary Plan attached
hereto as EXHIBITS B and C. Said nursing home facility is proposed to be
a three-story building with a height of approximately 38 feet and a gross
floor area of approximately 83,720 square feet including a basement.
Development of the Property shall be in accordance with attached EXHIBITS
B through F, and further subject to the following conditions:

A. An access connection shall be provided to Steeple Drive on the
south side of the Property as depicted on EXHIBITS B and C.
Petitioner shall enter into a cross-easement agreement and shared
maintenance agreement with the Steepleview Homeowners Association
concerning said access connection.
Said agreement shall require the Steepleview Homeowners
Association to maintain Armstrong Drive free and clear of any
obstructions which would impede or obstruct access to the "fire
lane" depicted on EXHIBIT B. Such agreement is subject to
approval by the Village of Buffalo Grove.
The "fire lane" depicted on EXHIBIT B is for emergency vehicle
use and shall not be used as a public thoroughfare.
The emergency "fire lane" around the nursing home facility shall
be properly maintained at all times, including snow removal, to
ensure efficient access for emergency vehicles.
Petitioner shall provide on the plat of subdivision an easement over
the "fire lane" depicted on EXHIBIT B to the Village of Buffalo
Grove and its officers, employees and agents.
B. Petitioner shall construct left-turn lanes on Weiland Road adjacent
to the Property to permit eastbound turns to Armstrong Drive and
westbound turns into the Property. Said improvement shall be in
accordance with applicable standards of the Village of Buffalo
Grove and the Lake County Division of Transportation.
Petitioner shall dedicate right-of-way on the west side of Weiland
Road adjacent to the Property to permit future construction of a
right-turn deceleration lane into the Property. The amount and
location of said right-of-way shall be subject to review and
approval by the Village.
C. Traffic control signs shall be installed on the Property at the
direction of the Village.
D. The parking areas labeled as "future spaces" on EXHIBIT B shall
be constructed if the Village determines that said parking is
needed to serve the Property. Said future parking areas shall be
landscaped as required by the Village until said parking is
required to be installed.
E. Building appearance and materials, signage, lighting and
landscaping are subject to review and approval by the Village's
Appearance Commission and Village Board. Lighting on the
Property shall be designed to minimize light spillover onto
adjoining properties.

F. Deliveries of supplies and related materials to the Property shall
be scheduled and controlled to minimize impacts such as noise and
vehicle exhaust fumes on adjoining properties.
G. No mechanical equipment except for exhaust fans, ventilation
stacks and antennas shall be located on the roof of the nursing
home building. Said exhaust fans and ventilation stacks shall be
screened or be located on areas of the roof not visible from
properties adjacent to the site.
H. The Special Use authorization shall be revoked and the Property
shall automatically revert to the R-1 zoning classification:
(i) If a certificate of need has not been issued by the State of
Illinois by May 3, 1993;
(ii) If the Special Use has not been established on the Property
by May 3, 1993.
An extension to the foregoing time limits may be granted by the
Corporate Authorities upon petition.
Section 3. This Ordinance shall be in full force and effect on and after
its passage and approval. This Ordinance shall not be codified.
