ORDINANCE NO. 91- 68
AN ORDINANCE VACATING CERTAIN PUBLIC STREETS, BUILDING
LINES, EASEMENTS AND RESERVATION OF EASEMENTS IN
COLUMBIAN GARDENS UNIT #3
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit
pursuant to the Illinois Constitution of 1970; and
WHEREAS, the hereinafter described public streets, building
lines and easements in Columbian Gardens Unit No. 3 are municipal
right of ways and easements and are currently unimproved or no
longer necessary; and
WHEREAS, it has been determined that the lands abutting the
platted Subdivision of Columbian Gardens Unit #3 have not
contributed to nor are they encumbered by said- public streets and
right of ways; and
WHEREAS, the Corporate Authorities have determined that the
nature and extent of the public use or public interest to be
subserved is such as to warrant the vacation of said public
streets, building lines and easements and that the relief to the
public from any burden and responsibility of maintaining same
constitutes a public use or public interest authorizing said
vacation; and
WHEREAS, certain easements as hereinafter delineated have
been reserved.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1 . The preambles hereto are hereby incorporated and
made a part of this ordinance.
Section 2. The following part of Linden Avenue is hereby
vacated:
That part of Linden Avenue in Columbian Gardens Unit No. 3 ,
being a subdivision according to the plat thereof recorded
May 22, 1929 as Document No. 337110, in Lake County,
Illinois, falling within a parcel of land being that part of
Sections 34 and 35, Township 43 North, Range 11, East of the
Third Principal Meridian, in Lake County, Illinois and that
part of Section 2, Township 42 North, Range 11, East of the
Third Principal Meridian, in Cook County, Illinois,
described as follows: Beginning at the Southeast corner of
Chevy Chase Business Park East - Unit 1 , being a subdivision
according to the plat thereof recorded June 20 , 1989 as
Document No. 2803358, , in Lake County, Illinois, said
Southeast corner of Chevy Chase Business Park East - Unit 1
being a point on the North line of Lake-Cook Road; thence
North 00 degrees 03 minutes 09 seconds East along the East
line of said Chevy Chase Business Park East - Unit 1, 473 .17
feet to the Northeast corner of said Chevy Chase Business
Park East - Unit 1, being a point on the Northerly line of
Columbian Gardens Unit No. 3, aforesaid; thence Easterly
along the Northerly line of said Columbian Gardens Unit No.
3, being a curved line convex Northerly and having a radius
of 995 . 35 feet ( record 996 . 87 feet) , an arc distance of
1006 . 04 feet ( the chord of said arc bears South 89 degrees
40 minutes 11 seconds East, 963.76 feet) ; thence South 00
degrees 43 minutes 11 seconds East, 458.89 feet to the North
line of Lake-Cook Road; thence South 89 degrees 16 minutes
49 seconds West along said North line of Lake-Cook Road,
728 . 25 feet to an angle point in said line; thence North 89
degrees 56 minutes 51 seconds West along said North line of
Lake-Cook Road, 241 .75 feet to the place of beginning .
Section 3. The following part of South Chevy Chase Drive is
hereby vacated:
That part of 33 feet wide South Chevy Chase Drive in
Columbian Gardens Unit No. 3, being a subdivision according
to the plat thereof recorded May 22, 1929 as Document No.
337110, in Lake County, Illinois, falling within a parcel. of
land being that part of Sections 34 and 35, Township 43
North, Range 11 , East of the Third Principal Meridian, in
Lake County, Illinois and that part of Section 2 , Township
42 North, Range 11 , East of the Third Principal Meridian, in
Cook County, Illinois, described as follows: Beginning at
the Southeast corner of Chevy Chase Business Park East -
Unit 1, being a resubdivision according to the plat thereof
recorded June 20, 1989 as Document No. 2803358 , in Lake
County, Illinois, said Southeast corner of Chevy Chase
Business Park East - Unit 1 being a point on the North line

seconds East along the East line of said Chevy Chase

Section 4 . The following easement premises is hereby
vacated and released:
That part of the easement over the North 5 .00 feet of Lots 1
to 15, inclusive and over the South 5. 00 feet of Lots 16 to
31, inclusive, in Columbian Gardens Unit No. 3, being a
subdivision according to the plat thereof recorded May 22 ,
1929 as Document No. 337110, in Lake County, Illinois,
falling within a parcel of land being that part of Sections
34 and 35, Township 43 North, Range 11, East of the Third
Principal Meridian, in Lake County, Illinois and that part
of Section 2, Township 42 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois, described as
follows: Beginning at the Southeast corner of Chevy Chase
Business Park East - Unit 1, being a resubdivision according
to the plat thereof recorded June 20, 1989 as Document No.
2803358, in Lake County, Illinois, said Southeast corner of

Section 5. The following 20 foot building line is hereby
vacated and released:
That part of the 20 foot building line in Columbian Gardens
Unit No. 3, being a subdivision according to the plat
thereof recorded May 22, 1929 as Document No. 337110 , in
Lake County, Illinois, falling within a parcel of land being
that part of Sections 34 and 35, Township 43 North, Range
11 , East of the Third Principal Meridian, in Lake County,
Illinois and that part of Section 2, township 42 North,
Range 11, East of the Third Principal . Meridian, in Cook
County, Illinois, described as follows: Beginning at the
Southeast corner of Chevy Chase Business Park East - Unit 1 ,
being a resubdivision according to the plat thereof recorded
June 20, 1989 as Document No. 3803358, in Lake County,
Illinois, said Southeast corner of Chevy Chase Business 'Park
East - Unit 1, being a point on the North line of Lake-Cook

Section 6. The following easement premises is hereby
vacated and released:
That part of the 15.00 feet wide easement granted to Chevy
Chase Sewer and Water Company by instrument recorded May 19,
1961 as Document No. 1108938, falling within a parcel . of
land being that part of Sections 34 and 35, Township 43
North, Range 11, East of the Third Principal Meridian, in
Lake County, Illinois and that part of Section 2 , Township
42 North, Range 11, East of the Third Principal Meridian, in
Cook County, Illinois, described as follows: Beginning at
the Southeast corner of Chevy Chase Business Park East -
Unit 1 , being a resubdivision according to the plat thereof
recorded June 20, 1989 as Document No. 2803358 , in Lake
County, Illinois, said Southeast corner of Chevy Chase

Section _7 . The following easement premises is hereby
reserved for and granted to the Village of Buffalo Grove for
sanitary sewer purposes:
That part of Linden Avenue in Columbian Gardens Unit No. 3 ,
being a subdivision in Sections 34 and 35, Township 43
North, Range 11, East of the Third Principal Meridian,
according to the plat thereof recorded May 22, 1929 as
Document No. 337110, falling within a strip of land 10.00
feet in width and being described as follows : Commencing at
the Southeast corner of Chevy Chase Business Park East, Unit
1, being a res"ubdivision according to the plat thereof
recorded June 20, 1989 as Document No. 2803358 , in Lake
County, Illinois, said Southeast corner of Chevy Chase
Business Park East - Unit 1 being a point on the North line
of Lake-Cook Road; thence South 89 degrees 56 minutes 51
seconds East along the North line of said Lake-Cook Road,
241 . 75 feet to an angle point in said line; thence North 89
degrees 16 minutes 49 seconds East along the North line of
said Lake-Cook Road, 728 . 25 feet; thence North 00 degrees 43
minutes 11 seconds West, 245 . 30 feet to an intersection with
the Southwesterly line of the 10 . 00 feet wide strip of land
crossing said Linden Avenue as shown on the Plat of Easement
recorded November 22, 1985 as Document No. 2401516, said
last described point being the place of beginning of the
easement premises herein described; thence North 58 degrees
06 minutes 16 seconds West along the Southwesterly line of
said 10. 00 feet wide strip of land shown on the Plat of

intersection with the North line of said Linden Avenue;
thence Easterly along the North line of said Linden Avenue
to an intersection with the Southeasterly extension of the
Northeasterly line of the 10. 00 feet wide easement premises
shown on the Plat of Easement recorded July 25, 1986 as
Document No. °,, 2464272, said Northeasterly line having a
bearing of South 66 degrees 52 minutes 52 seconds East ;
thence South 66 degrees 52 minutes 52 seconds East along the
Southeasterly extension of said last described line to an
intersection with the Northeasterly line of the 10. 00 feet
wide strip of land crossing said Linden Avenue as shown on
the Plat of Easement recorded November 22, 1985 as Document
No. 2401516; thence South 54 degrees 17 minutes 51 seconds
East along said, last described Northeasterly line, 0. 38 feet
to an angle point in said line; thence South 58 degrees 06
' minutes 16 seconds East along the Northeasterly line of- the
10. 00 feet wide strip of land crossing Linden Avenue as
shown on the Plat of Easement, recorded November 22, 1985 as
Document No. 2401516, 7 . 32 feet to an intersection with a
line bearing North 00 degrees 43 minutes 11 seconds West
from said point of beginning; thence South 00 degrees 43
minutes 11 seconds East, 11 . 87 feet to the point of
beginning, in Lake County, Illinois.
Section 8 . A Plat of Vacation of said public streets,
building lines, easements and reservation of easements is
attached hereto and made a part hereof as Exhibit "A" .
Section 9 . That title to said vacated public streets,
building lines, easements and reservation of easements is hereby
declared to be vested in the owners of the subdivided land
abutting said public streets and right of ways and that title to
those public streets and right of ways on the border of said
Subdivisions is not vested in abutting land owners whose land has
not contributed to nor encumbered by said public streets and
right of ways. Said vacation is subject to the hereinbefore
mentioned reservation of easements .

effect from and after its passage by the affirmative vote of at
least three-fourths ( 3/4ths) of the Village Trustees then holding
office. This ordinance shall not be codified.
