2012-046 9/4/2012A ORDINANCE NO. 2012—46 AN ORDINANCE APPROVING A PRELIMINARY PLAN AND AMENDMENT OF A PLANNED UNIT DEVELOPMENT(PUD) BURDEEN'S JEWELERS LTD., 1151 LAKE COOK ROAD VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Preliminary Plan and PUD amendment concerning a new retail building, 1151 Lake Cook Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, Burdeen's Jewelers LTD. proposes to construct a new building on a portion of the real estate parcel occupied by PNC Bank, 1177 Lake Cook Road; and, WHEREAS, said parcel is legally described in Exhibit A hereto (the "Property"), and, WHEREAS, Burdeen's Jewelers LTD. proposes to acquire a portion of the Property for development of said new building, and said acquisition area shall hereinafter be referred to as the "Burdeen's Parcel;" and, WHEREAS, the Property is approved as a planned unit development (PUD) zoned in the B-3 Planned Business Center District; and, WHEREAS, Burdeen's Jewelers LTD. has petitioned for an amendment of the PUD and approval of a Preliminary Plan to construct a building of 6,000 square feet in the east portion of the Property; and, WHEREAS, Burdeen's Jewelers LTD. has represented in the petition for amendment of the planned unit development and approval of the Preliminary Plan that the proposed building and related site improvements will be competed pursuant to the following exhibits: EXHIBIT A Legal Description of Property 2 EXHIBIT B Owner and Petitioner Acceptance and Agreement concerning approval of Planned Unit Development EXHIBIT C Proposed Site Plan dated August 30, 2012 by the Dobbins Group EXHIBIT D Detail Site Plan dated August 30, 2012 by the Dobbins Group EXHIBIT E, E-1 Landscape Plan dated as last revised August 30, 2012 by McCallum Associates EXHIBIT F Building elevations, Burdeen's Jewelry dated August 22, 2012 by the Dobbins Group EXHIBIT G, G-1 Color perspective building renderings dated July 25, 2012 by the Dobbins Group EXHIBIT H Proposed building floor plan dated August 30, 2012 by the Dobbins Group EXHIBIT I Sightline diagram of screening for roof-top equipment dated August 30, 2012 by the Dobbins Group EXHIBIT J, J-1, 1-2, J-3 Preliminary Engineering Plan dated as last revised August 27, 2012, including Proposed Grading & Drainage Plan (Sheet C-2.1), Proposed Utility Plan (Sheet C-2.2), Proposed Water Main Plan (Sheet C-2.3) and Geometric Plan (Sheet C-3) by Bono Consulting, Inc. EXHIBIT K Outdoor lighting plan and fixtures (no date) WHEREAS, the Village Plan Commission conducted a public hearing on August 15, 2012 concerning the petition for amendment of the Planned Unit Development and approval of a Preliminary Plan, including variations of the Village Sign Code; and, WHEREAS, the Plan Commission determined that the testimony and exhibits presented by Burdeen's Jewelers LTD. at the public hearing demonstrated that the requested variations of the Village Sign Code are warranted based on the location of the Property and the Burdeen's Parcel; and, WHEREAS, the Plan Commission voted 8 to 0 to recommend approval of the amendment of the Planned Unit Development, approval of the Preliminary Plan and the requested variations of the Village Sign Code; and, 3 WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove have determined that the amendment of the Planned Unit Development, approval of the Preliminary Plan and variations of the Village Sign Code as set forth in the exhibits hereto will allow appropriate development of the Property and will be compatible with adjacent properties. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance (the "Ordinance") is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby incorporated herein. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving the an amendment of the planned unit development and approving a Preliminary Plan for the building to be constructed on the Burdeen's Parcel in the east portion of the Property pursuant to the exhibits hereto, with the following conditions: A. Variations of the Village Sign Code are granted for the signs as depicted in the exhibits hereto: i. Section 14.16.030 Business Districts - to allow more than one ground sign;to allow each of the two ground signs to be located closer than 10 feet from the property line; and to allow more than one wall sign, and ii. Section 14,16.060 Ground Signs- to allow each of the two ground sign to be located closer than 250 feet to an existing ground sign, and iii. Section 14.16.070 Wall Signs -To allow more than one wall sign, and iv. Section 14.20.100 Off-Premise Signs - to allow two off-premise ground signs. B. The signage for the awnings on the Burdeen's Jewelry building shall be of a uniform color and size. C. A plat of resubdivision shall be submitted for Village approval. Said plat shall delineate the Burdeen's Parcel and provide public access easements, utility easements and fire lane designations as required by the Village D. The final landscape plan is subject to approval by the Village Forester E. Site development plans pursuant to the requirements of the Village Development Ordinance are subject to approval by the Village Engineer. F. Burdeen's Jewelers LTD. shall make appropriate arrangements for supplementary off-site parking for events creating a demand for more parking 4 than can be provided on the Burdeen's Parcel. Section 3. This Ordinance shall be in full force and effect upon the submittal of the executed Acceptance and Agreement, Exhibit B of this Ordinance. This Ordinance shall not be codified.
