1994-023 413/94 ORDINANCE NO. 94-2 3 EIGHTH AMENDMENT TO THE TOWN CENTER PLANNED UNIT DEVELOPMENT ORDINANCE (Theater and Retail Center- Phase I and Phase II) WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, Buffalo Grove Joint Venture, an Indiana General Partnership, is the owner of a certain tract of property legally described in EXHIBIT A attached hereto, which exhibit is made a part hereof, (hereinafter referred to as the "Property") and which real estate is within the corporate limits of the Village; and, WHEREAS, the Property was zoned in the Village of Buffalo Grove by Ordinance 86-61, dated November 3, 1986, which zoned the Property as part of a Planned Unit Development in the B-5 District, with the Property being zoned in the B-5 Commercial/Recreational Sub-District with approval of a Preliminary Plan dated November 1, 1986 and later approved with revisions on April 27, 1987;said plan depicts a retail shopping center with a total floor area of 218,345 square feet to be constructed in two phases; and, WHEREAS, the Village approved Ordinance 91-44 on March 18, 1991 amending Ordinance 86-61 to allow a revision to the Preliminary Plan for a building of approximately 60,600 square feet and an adjoining building of approximately 4,000 square feet pursuant to the Preliminary Plan dated March 12, 1991, also known as EXHIBIT C to Ordinance 91-44; and, WHEREAS, the buildings approved by Ordinance 91-44 have not been constructed and the Buffalo Grove Buffalo Grove Joint Venture has submitted to the Village a revised Preliminary Plan indicating on Phase II of the retail center a theater (12,300 square feet), a future expansion of the theater(11,000 square feet), a building adjoining the east wall of the theater(LL/06, 6,000 to 9,000 square feet), a building adjoining the south wall of the theater(LL/07, 11,500 to 17,000 square feet) 1 and an outlot building(LL/05, 2,800 square feet); which Preliminary Plan dated as received March 2, 1994 is attached hereto as EXHIBIT C; and, WHEREAS, Buffalo Grove Joint Venture has submitted to the Villlage an overall Town Center site plan (Number 48) dated November 30, 1993 which is attached hereto as EXHIBIT B; and, WHEREAS, the Buffalo Grove Joint Venture has represented to the Village that the first phase of the theater will have approximately 995 seats and the future expansion will have approximately 800 seats; and, WHEREAS, the Village has reviewed the request for a 12,300 square foot theater and a future expansion of the theater(11,000 square feet) and determined that they may be approved as a minor change to said plan subject to the conditions of this Ordinance; and, WHEREAS, there has been constructed on Phase II of the retail center, as indicated on EXHIBIT B, small shops (21,981 square feet) and 2nd floor offices (11,978 square feet); and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance, and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. Village Ordinance 91-44 is hereby repealed. 2 Section 3. The Corporate Authorities hereby adopt a proper, valid and binding ordinance amending the Town Center Planned Unit Development as follows: - A.. Phase I of the Town Center retail center, as depicted on EXHIBIT B, is hereby approved in the amount of 117,056 square feet. B. In Phase II, as depicted on EXHIBIT B and C, approval is hereby given only for LL/04 of 2,500 square feet, the proposed theater of 12,300 square feet and 11,000 square foot "Future Theater Expansion". The proposed LL/05, LL/06 and LL/07 are specifically not approved and any planning of these areas is subject to Village review and approval. Section 4. The approvals granted in Section 3 hereof are subject to: A. Village approval of building materials, floor plans, elevations, signage, landscaping and modification to parking areas and access roads. Any roof-top mechanical equipment shall be screened as approved by the Village. B. Documentation to the Village that parking for the "Future Theater Expansion" will µ be adequate. Prior to issuance of any permits for the "Future Theater Expansion" the Village will review parking adequacy on the Property and determine if additional theater space can be accommodated. The Owner of the Property shall make provisions through easements to provide and construct additional parking on the Property or off-site if so directed by the Village. C. The Buffalo Grove Joint Venture shall construct a bikepath on the west and north sides of the Property and shall coordinate with the developer of the Town Place residential project concerning the construction of said bikepath and the wall previously approved pursuant to the Town Place Preliminary Plan approved by Ordinance 88-89. Said bikepath shall be constructed prior to issuance of a certificate of occupancy for the initial phase of the theater. 3 D. LL/05, LL/06,LIJ07 and the "Future Theater Expansion" as depicted on EXIIIBITS B and C shall be landscaped as approved by the Village. If the Village determines that any of these areas are needed to provide additional parking for the 12,300 square foot theater, or the 11,000 square foot Future Theater Expansion, the Buffalo Grove Joint Venture shall construct said parking as approved by the Village. Section 5. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
