2006-035 Ordinance No. 2006 - 35 An Ordinance Approving an Agreement Between the Village of Buffalo Grove, the Village of Wheeling, LaSalle Bank, N.A. Trust No 121736-05, and MidAm LCW, LLC. (Southeast Corner of Weiland Road and Armstrong Drive) WHEREAS, the Village of Buffalo Grove is a home rule unit of government pursuant to the Illinois Constitution of 1970; and WHEREAS,it has been requested of the Village of Buffalo Grove to exclude and disconnect the real property located at the southeast corner of Weiland Road and Armstrong Drive; and WHEREAS, after disconnection of said property from Buffalo Grove it is proposed that the property be annexed to and developed in the Village of Wheeling; and WHEREAS, in order to ensure that the commitments made by the parties to said development are complied with an Agreement between the Village of Buffalo Grove,the Village of Wheeling, LaSalle Bank, National Association, as Successor Trustee to American National Bank and Trust Company of Chicago, not personally but solely as Trustee under Trust Agreement dated June 14, 1996 and known as Trust No. 121736-05, and MidAm LCW, LLC. ("Agreement") has been proposed which Agreement will further the public interests and benefits to the Buffalo Grove and Wheeling communities. NOW,THEREFORE,BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,IL. that: Section 1 —The foregoing Whereas clauses are hereby made a part hereof. Section 2 — The Agreement, attached hereto, be and hereby is approved. The Village President and Village clerk are hereby authorized and directed to execute said Agreement. Section 3 — This Ordinance shall be in full force and effect from and after its passage and approval. AYES: 6 - Braiman. Glover, Berman.
