1987-0049/17/87 ORDINANCE NO. 87 -64 AN ORDINANCE AMENDING CHAPTER 2.22, APPEARANCE COMMISSION OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, Village Ordinance No. 72 -12, as amended by Ordi- nance Nos. 74 -38 and 76 -24, established an Appearance Commission and an Appearance Code for the Village; and WHEREAS, Village Ordinance No. 73 -54, as amended by Ordi- nance No. 81 -20, approved an Appearance Plan for the Village; and WHEREAS, the Corporate Authorities have determined this ordinance to be in the best interest of the public health, safety and welfare of its citizens and that Corporate Authorities have also determined that the Village of Buffalo Grove should be beautiful as well as healthy, spacious, clean and well balanced; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. Chapter 2.22, APPEARANCE CONTROL COMMISSION of the Buffalo Grove Municipal Code is amended to read as follows: Sections: 2.22.010 2.22.020 2.22.030 2.22.040 2.22.050 2.22.060 2.22.070 2.22.080 2.22.090 2.22.100 2.22.110 2.22.120 2.22.130 2.22.140 2.22.150 2.22.160 2.22.170 2.22.180 CHAPTER. 2.22 APPEARANCE COMMISSION Title. Action of Appearance Commission. Approval by Corporate Authorities. Director of Building & Zoning's responsibilities. 2.22.010 Title. The ordinance codified in this chapter, including any regulation hereafter adopted, shall be hereafter known, cited and referred to as the "Buffalo Grove Appearance Code." 2.22.020 Intent and purposes. The intent and purpose of this chapter are as follows: A. To promote the public health, safety, morals, comfort and general welfare of the citizens of the Village; B. To enhance the values of property throughout the Village; C. To protect and to stabilize the general appearance of buildings, structures, landscaping and open areas, in all the zoning districts of the Village, including public lands and planned developments. D. To insure adequate light, air and privacy for property in the Village. E. To encourage and promote acceptability, attractiveness, cohesiveness and compatibility of new buildings, development, substantial remodeling and additions so as to maintain and improve the established standards of property values within the Village. 2.22.030 Definitions. "External architectural feature" means the architectural style and general arrangement of such portion of a building or structure as is designed to be open to view from a public.street, place, or way, including the kind, color and texture of the building material of such portion, and the types of windows, doors, lights, attached or ground signs and other fixtures appurtenant to such portion. 2.22.040 Creation - -Term of office. There is created an Appearance Commission, to consist of seven members appointed by ythe Village President by and with the approval of the Board of Trustees. The terms of the members now serving shall, in each instance, expire on the April 30th following the termination of their present term. Thereafter all reappointments and new appointments shall be for a term of three years to run from May 1st to the appropriate April 30th. Terms of appointments shall be staggered. One -third of the members, but not more than three members, shall be appointed in any one year unless required by death or resignation. 2.22.050 Qualification. All members shall serve without compensation and shall be required to be residents of the Village, but are not required to be residents of the Village for any specific length of time prior to their appointment. All efforts shall be made to have the membership consist of registered architects, landscape architects, real estate appraisers and land planners. If possible, one member shall be the owner or an officer of a firm, owning business, commercial or industrial property in the Village. In making appointments to the commission, the Village President shall seek to appoint as members persons who are recognized as experts in matters of aesthetic judgment by virtue of training, education and experience and possessing qualities of impartiality and broad judgment. The members of the Commission shall, before entering their official duties, severally take the oath of office prescribed by law for village officials. No member of the commission shall participate in discussions or vote on requests from any client he is serving or from any business of which he is owner, corporation officer or employee. 2.22.060 Chairman. The Village President, with the approval of the Board of Trustees, shall appoint one of the members to serve as chairman. The chairman shall have power to administer oaths. 2.22.070 Vacancies. Vacancies on the Commission shall be filled for the unexpired term of the member whose place has become vacant in the same manner in which original appointments are required to be made. 2.22.080 Meetings -- Quorum -- Records. Meetings of the Appearance Commission shall be held at the call of the chairman, and shall be called whenever a request is submitted for consid- eration. Three members shall constitute a quorum. The chairman shall be entitled to be counted in determining a quorum and to vote as a member. A majority of a quorum will prevail. All meetings shall be open to the public. The Commission shall keep minutes of its proceedings and shall keep records of its examina- tions and other official action. The commission may adopt its own rules of procedure not inconsistent with this chapter. 2.22.090 Powers and duties. The Appearance Commission shall have the following powers and duties: -2- A. To hold public hearings on and make recommendations for an Appearance Plan as provided in this chapter; B. To consult with and cooperate with the Plan Commission, other Village departments, and any other municipal or governmen- tal bodies on matters affecting the appearance of the Village; C. To study exterior design drawings, landscape and site plans and materials for any proposed public works or public improvements and to make recommendations to the Corporate Authorities or Village Manager as to the architectural or aesthetic aspects thereof; D. To hold hearings, when required, in connection with questions pertaining to Appearance Plan compliance. 2.22.100 Appearance Plan -- Preparation. The Appearance Commission shall, within six months after its appointment, prepare a proposed Appearance Plan. Said Appearance Plan shall be based on the intent and purposes of this chapter, which said plan shall be intended as the standards or guidelines for future physical developments and should consider, among other features: A. The external architectural features (as defined in this chapter) of proposed buildings and landscaping and site planning thereof; B. Existing Village ordinances as amended, as to, but not limited to, zoning, building, subdivision, trees and shrubs; provided, however, nothing in said Appearance Plan shall conflict with, modify or alter any provisions of the zoning, building or subdivision ordinances. 2.22.110 Appearance Plan -- Public hearing. After agreeing on a proposed Appearance Plan, the Commission shall hold a public hearing thereon. A copy of the plan shall be on file in the office of the Village Clerk for public inspection. Notice of the public hearing shall be published at least once in a newspaper of general circulation in Buffalo Grove not more than thirty and not less than fifteen days before the hearing. Written notice shall also be mailed (ordinary mail) to each property owner /occupant within a radius of five hundred feet of property involved, not more than thirty and not less than fifteen days before the hearing. The hearing may be adjourned from time to time. Within thirty days after final adjournment, the commission shall recommend a final appearance plan to the Corporate Authorities. 2.22.120 Appearance Alan -- Adoption by Corporate Authori- ties. The Corporate Authorities shall thereafter at a public meeting consider the proposed plan and, if it so desires, may adopt the same in whole or in part, with om,:,".Vi:thout, change. The Appearance Plan, as adopted, shall be by ordinance. 2.22.130 Appearance Plan -- Amendments. The Appearance Plan may be amended, from time to time, by the Corporate Authorities or by the Corporate Authorities after receiving a recommendation from the Commission regarding a proposed amendment. The Commission can make a recommendation only after holding a public hearing after notice as set forth in Section 2.22.110. 2.22.140 Appearance Plan compliance. A. No building or other permit otherwise required under the ordinances of the Village for the erection, construction, alteration or repair of any building or structure shall be issued by the Director of Building and Zoning until after review by the Appearance Commission and approved by the Corporate Authorities. B. The foregoing requirement shall not preclude the issuance of a building permit if the Director of Building and Zoning determines that the work for which the building permit is sought involves: (1) no external architectural feature (as defined in Section 2.22.030); or -3- (2) remodeling or changes or an addition in a one family zoning district; or (3) remodeling or changes in any zoning district which will not substantially change or significantly impact upon the structures overall general appearance; or (4) a custom home (as defined in the Appearance Plan). 2.22.150 Hearing on Compliance. Upon.the filing of a request for Appearance Commission review, the Director of Building and Zoning shall immediately transmit said request to the Appearance Commission. The Commission shall thereupon fix a reasonable time for a hearing. Upon such hearing, the Commission shall consider the request and, if necessary, receive additional evidence (such as exterior elevation renderings) from the applicant or his agent or attorney and from Village personnel or other persons as to whether the external architectural features of the proposed building or structure comply with the Appearance Plan. All testimony given at such hearing shall be under oath. 2.22.160 Action of Appearance Commission. The Commission may make recommendations to the applicant as to changes in the exterior drawings, sketches, landscaping, site plans and materi- als which in the judgment of the Commission would tend to effect the general purposes of the Appearance Plan. The Commission shall determine whether or not the proposed request (a) conforms to the Appearance Plan, (b) that the proposed building or structure will be inappropriate to, or incompatible with the character of the immediate neighborhood or (c) cause substantial depreciation in property values. 2.22.170 Approval by Corporate Authorities. The Appearance Commission is an advisory commission only. All rulings of the commission shall be submitted to the Corporate Authorities for final decision. The Commission shall file minutes of the proceedings along with its recommendation with the Corporate Authorities. The Corporate Authorities may overrule, approve, modify, or amend, wholly or in part, the commission's recommendation, with or without a hearing, by a majority vote. 2.22.180 Director of Building & Zoning's responsibilities. Upon the Corporate Authorities approval, the exterior drawings, sketches, landscape and site plans, renderings and materials shall be turned over to the Director of Bul..di..:and Zoning who shall insure compliance with the approval. The Director of Building and Zoning may authorize minor changes to the approval if the changes do not substantially change or significantly impact upon the overall general appearance. Section 2. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. Section 3. Any person violating the provisions of the Ordinance shall be punished according to the provisions of Chapter 1.08 GENERAL PENALTY, of the Buffalo Grove Municipal Code. Section 4. This Ordinance shall be in full force and effect from and after its passage, approval and publication. This ordinance may be published in pamphlet form. Village Pre ident ORDINANCE NO. 87- 4 AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE VILLAGE OF BUFFALO GROVE, ILLINOIS (Westchester Estates) WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, a written petition signed by the owners of record of all of the land in the territory hereinafter described, requesting the annexation of such territory to the Village of Buffalo Grove, has been filed with the Village Clerk of the Village of Buffalo Grove; and, WHEREAS, said territory is not within the corporate limits of any municipality, but is contiguous to the Village of Buffalo Grove; and, WHEREAS, notice of the proposed annexation of such territory has been given to the appropriate authorities; and, WHEREAS, it is in the best interests of the Village of Buffalo Grove that such territory be annexed to the Village of Buffalo Grove. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1.
