ORDINANCE NO. 96 - 49
AN ORDINANCE AMENDING THE VILLAGE OF BUFFALO GROVE
ZONING ORDINANCE
Concerning Special Uses in the B-5
Town Center Planned District
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the
Illinois Constitution of 1970; and.
WHEREAS, a developer has petitioned to the Village to operate a retail store
with a drive-through service facility in the Commercial/Recreational Sub-district of the B-5
District; and,
WHEREAS, said drive-through facility is not a permitted or special use for retail
stores in the B-5 District; and,
WHEREAS, the Buffalo Grove Plan Commission has conducted a public hearing and
made recommendation to the Village Board; and,
WHEREAS, the Village has determined that a special use would be the appropriate
zoning procedure to regulate drive-through service facilities for retail stores; and,
WHEREAS, as a special use, a drive-through facility would be required to meet the
criteria for a special use set forth in Section 17.28.040. of the Village's Zoning Ordinance; and,
WHEREAS, as a special use the Corporate Authorities may impose such conditions or
restrictions upon the subject property as may be deemed necessary or appropriate to comply with
said special use criteria and other applicable Village codes and regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1. Section 17.44.060.C.Le. "Special Uses" of the Village of Buffalo Grove
Zoning Ordinance is hereby amended by adding:
9. Drive-through facilities for retail uses, not including restaurants,
in the Commercial/Recreational Sub-district.
Section 2. This ordinance shall be in full force and effect immediately from and after its
passage, approval and publication. This ordinance may be published in pamphlet form. This
ordinance shall not be codified.
