1987-068 ORDINANCE NO. 87-68 AN ORDINANCE APPROVING A PRELIMINARY PLAN (Lot 9006, Villas of Buffalo Creek Unit 1) WHEREAS, the Village of Bufflao Grove is a Home Rule Unit by virtue of the Illinois Consitution of 1970; and, WHEREAS, the Property legally described in attached EXHIBIT A is zoned R-7 (Dwelling District) Planned Unit Development pursuant to Ordinance No. 78-55 (Strathmore Estates P.U.D.) ; and, WHEREAS, the Village has received a petition for Preliminary Plan approval for the property; and, WHEREAS, the Owner proposes to construct two single-family residences and subdivide the property pursuant to a Preliminary Plan dated October 8, 1987 (revised) attached hereto as EXHIBIT A; and, WHEREAS, Proper and due notice of the public hearing concerning the Preliminary Plan was given and the public hearing held; and, WHEREAS, the President and Board of Trustees after due and careful con- sideration have concluded that the development of the property on the terms and conditions herein set forth would further enable the village to control the development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS as follows: 1 . Applicable Law. This Ordinance is made pursuant to and in accord- ance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. 2. Approval of Preliminary Plan. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Preliminary Plan attached hereto as EXHIBIT A, for the property legally described in attached EXHIBIT A. -1- -2- 3. SLecial Conditions. Approval of the Preliminary Plan is hereby made subject to the following conditions: a. Fencing on the Property shall be non-opaque (a see-through fence) ; said fencing shall be reviewed and approved by the Village's Appear- ance Commission. b. No fence shall be allowed on proposed Lot 2 east of the east wall (of the proposed house) measuring 20.58 feet as shown on EXHIBIT A attached hereto, and as further noted on EXHIBIT A. C. A plat of resubdivision and a plat of vacation shall be submitted for Village review and approval. 4. This Ordinance shall be in full force and effect from and after its passage.
