1988-120 12/5/88 ORDINANCE NO. 88- 120 AMENDMENT TO THE RIVERWALK PLANNED UNIT DEVELOPMENT ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the provisions of the Constitution of the State of Illinois of 1970; and, WHEREAS, Hamilton Partners (hereinafter referred to as the "Developer") is the Developer of a certain tract of property comprising 17.5 acres legally described and identified in EXHIBIT A attached hereto, and made a part hereof (hereinafter referred to as the "Property") and which real estate is within the corporate limits of the Village; and, WHEREAS, said Property was zoned in the Village of Buffalo Grove by Ordinance No. 85-64 dated October 14, 1985, which zoned the Property as a Planned Unit Development in the B-3 District; and, WHEREAS, the Village has received a request for revision of the Prelimi- nary Plan approved by Ordinance No. 85-64; and, WHEREAS, the Developer proposes to construct Phase I of the Riverwalk development as depicted on EXHIBITS C, D, and GROUP EXHIBIT E attached hereto; and, WHEREAS, said Phase I will consist of a 12-story office building with a maximum height of 175 feet, a two-story concourse structure, and a 4-level parking structure; and, WHEREAS, the gross floor area of Phase I will be approximately 259,000 square feet as depicted on EXHIBIT C, and the gross floor area of Phases I and II will not exceed 455, 109 square feet, and the overall floor area ratio (F.A.R.) for the Property will not exceed 0.60; and, WHEREAS, the Plan Commission of the Village has reviewed the Preliminary Plan and made their recommendations pursuant to Chapter 17.28 and 17.44 of the Zoning Ordinance with respect to the requested Preliminary Plan revision 1 in the B-3 District and amendment of the Planned Unit Development Ordinance; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the zoning and development of the Property on the terms and conditions herein set forth would further enable the Village to control the development of the area and would serve the best interests of the Village; and, WHEREAS, the President and Board of Trustees of the Village (sometimes hereafter referred to as the "Corporate Authorities" do hereby find that the evidence presented meets the requirements for approval of a revised Prelimi- nary Plan and amendment of a Planned Unit Development. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS as follows: 1. Applicable Law. This Ordinance is made pursuant to and in accor- dance with the Village's Zoning Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. 2. A rova1 of Amendment. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving an amendment to the Planned Unit Development Ordinance and Preliminary Plan for the Property legally described in EXHIBIT A subject to the restrictions further contained herein and all applicable ordinances of the Village of Buffalo Grove as amended from time to time. Said amendment shall be further conditioned on the development of the Property in accordance with a revised Preliminary Plan (EXHIBIT C) and EXHIBITS D and E attached hereto. 3. Compliance with Applicable Ordinances. Development of the Property shall comply with the provisions of Ordinance No. 85-64, except as amended herein. 2 4. Exhibits. The following EXHIBITS, some of which were presented in testimony given by the Developer or the witnesses during the review by the Plan Commission and the Corporate Authorities prior to the execution of this Ordinance, are hereby incorporated by reference herein, made a part hereof, and designated as shown below. This Ordinance, together with copies of all EXHIBITS, shall be kept on file with the Village Clerk and be available for inspection to the parties hereto. EXHIBIT A Legal Description EXHIBIT B Phasing Plan - Phase 2 Site Plan, no date (approved as EXHIBIT C to Ordinance No. 85-64) • EXHIBIT C Revised Preliminary Plan by Wilson/Jenkins dated November 16, 1988 EXHIBIT D Building Elevation by Wilson/Jenkins dated November 3, 1988 EXHIBIT E-1 Building Floor Areas by Wilson/Jenkins dated through E-6 November 21, 1988 5. Special Conditions. A. Developer shall provide pedestrian access to public transpor- tation serving the Property. B. Developer shall provide pedestrian access across the Des Plaines River to adjacent areas of the Lake County Forest Preserves. C. The office building to be constructed in Phase II shall have design symmetry with the building constructed in Phase I. D. The Developer acknowledges that it is the intent of the Village and the Cook County Highway Department to improve the intersection of Lake-Cook Road and Milwaukee Avenue by construction of a grade-separated intersection system. The Developer shall reserve for right-of-way acquisi- tion by Cook County, through the normal land acquisition procedures used by the County, all the area of the Property south of the north lake depicted on EXHIBIT C. Said area shall remain undeveloped and vacant until Cook County has had an opportunity to plan the intersection improvement and commence 3 construction of the access roadway adjacent to the Property as depicted on EXHIBIT C. Notwithstanding the above, the Developer shall: i. dedicate for right-of-way that area shown on EXHIBIT H to Ordinance No. 85-64 for Lake- Cook Road and Milwaukee Avenue; ii. Developer shall pay $55,000 for the design engineering costs for the Lake-Cook/Milwaukee Avenue intersection improvement (said amount has been determined by the Village to be approximately 50 percent of the design engineering costs for Phase I and II [using FAUS guidelines] for the Intersection Design Study. depicted on EXHIBIT H to Ordinance 85-64) ; E. EXHIBIT C contains the following: "Parking required (1/300 s.f. of rentable) - 864 cars." Notwithstanding the foregoing, parking required is one space per 300 square feet of gross floor area or a total of 864 parking spaces. Said parking ratio shall pertain also to Phase II.' 6. This Ordinance shall be in full force and effect from and after its passage and approval. This Ordinance shall not be codified.
