ORDINANCE N0. 90-39
AN ORDINANCE APPROVING A PRELIMINARY PLAN
Northwest Building Material and Supply
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of
the Illinois Constitution of 1970; and,
WHEREAS, the real property legally described in Exhibit A attached
hereto is zoned in the B-1 Limited Retail District; and,
WHEREAS, the Village has received a petition to approve a Preliminary
Plan dated March 28, 1990 (revised) attached hereto as Exhibit B depicting a
one-story retail store with a gross floor area of 21,605 square feet; a
Preliminary Engineering Plan dated April 20, 1990 (revised) attached hereto
as Exhibit C; and a Conceptual Building Layout Plan dated March 31, 1990
(revised) attached hereto as Exhibit D; and,
WHEREAS, the Plan Commission has held a public hearing and made a
recommendation concerning the Preliminary Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS:
Section 1. This Ordinance is made pursuant to and in accordance with
the Village's Zoning Ordinance, Development Ordinance and the Village's Home
Rule powers. The preceding whereas clauses are hereby made a part of this
Ordinance.
Section 2. The following variations are hereby granted:
Zoning Ordinance - Section 17.36.040.F. 1 - to allow 86 off-street
parking spaces instead of 87 spaces;
Development Ordinance - Section 16.50.040.C.3 - to allow a side slope of
4:1 instead of 6: 1 in a stormwater detention basin.
Section 3. The Corporate Authorities hereby approve the Preliminary
Plan attached hereto as Exhibit B and the Preliminary Engineering Plan
attached hereto as Exhibit C, and development of the Property shall be in
compliance with said plans.
Section 4. Approval of said plans is subject to:
a. Documentation satisfactory to the Village Attorney that an easement
or permit is in force guaranteeing that the off-site detention area
will be available to serve the Property;
b. Developer shall install curb and gutter on the north side of Old
Weiland Road adjacent to the site;
C. The operator of the retail store understands and agrees that any
sale on the Property will be credited with sales tax in the Village
of Buffalo Grove, and sales in said retail store shall not be
posted to any other facility, including the Developer's facility at
21775 N. Weiland Road, Prairie View, IL.
d. A sidewalk shall be provided adjacent to the parking spaces on the
north side of the building;
e. The sidewalk adjacent to the northwest side of the building shall
be increased from four feet to six feet in width; and,
f. A "do not enter" sign shall be posted adjacent to the south end of
the one-way driveway east of the building.
Section 5. This Ordinance shall be in full force and effect on and
after its passage and approval. This Ordinance shall not be codified.
