1989-005 1/4/89 ORDINANCE NO. 89- 5 AN ORDINANCE APPROVING A PRELIMINARY PLAN IN THE B-3 PLANNED BUSINESS CENTER DISTRICT (Mobil Oil Cor oration, Dundee/Arlin ton Hei hts Roads) WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the Property legally described in EXHIBIT A hereto is zoned in the B-3 (Planned Business Center) District and is occupied by a gasoline service station; and, WHEREAS, the Village has received a petition from the Mobil Oil Corporation for approval of a Preliminary Plan dated November 23, 1988 (revised) attached hereto as EXHIBIT B to construct a new gasoline service station; and, WHEREAS, proper and due notice of the public hearing concerning the Preliminary Plan was given and the public hearing was held; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would further enable the Village to control the development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS as follows: 1. Applicable Law. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance, and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. 1 2. Approval of Preliminary Plan. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Preliminary Plan attached hereto as EXHIBIT B, including the requested variations of the Zoning Ordinance as defined in Section 4 below. 3. Exhibits. The following EXHIBITS, some of which were presented in testimony given by the Developer or the witnesses during the review by the Plan Commission and the Corporate Authorities prior to the execution of this Ordinance, are hereby incorporated by reference herein, made a part hereof, and designated as shown below. This Ordinance, together with copies of all EXHIBITS, shall be kept on file with the Village Clerk and be available for inspection to the parties hereto. Special Conditions. A. The following variations are hereby granted from the Buffalo Grove Zoning Ordinance: i. Section 17.36.040.F. 1: To allow 3 off-street parking spaces instead of 4 spaces; ii. Section 17.44.040.D.4: To allow a 16-foot landscaped yard along Arlington Heights Road instead of 22 feet, and to allow a 7-foot landscaped yard along Dundee Road instead of 17 feet, pursuant to EXHIBITS B and D. B. The project is subject to Appearance Commission approval, including building materials, signs, lighting, and landscaping. 2 C. For any snowfall of 4 inches or more, the snow shall be removed from the Property. Said snow removal shall occur within 24 hours of said 4-inch snowfall. 5. This Ordinance shall be in full force and effect from and after its passage and approval. This Ordinances shall not be codified.
