1993-006 1/13/93 ORDINANCE NO. 93- 6 AN ORDINANCE APPROVING A SPECIAL USE AND PRELIMINARY PLAN IN THE R-1 ONE FAMILY DWELLING DISTRICT, VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Grove (Woodland) Park WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the hereinafter legally described real property ("Property") was classified in the R-1 One Family Dwelling District by Ordinance 88-29 on March 7, 1988; and, WHEREAS, the Buffalo Grove Park District, as owner of the Property, has petitioned to the Village for approval of a Special Use and Preliminary Plan to develop recreation facilities, including outdoor lighting, on the Property; and, WHEREAS, the petitioner proposes to develop said recreation facilities pursuant to the following exhibits: EXHIBIT A Preliminary Plan (Grading and Drainage, Sheet 1 of 2)_.,Jast_,revised _.December 2, 1992 by Lindley and Sons; EXHIBIT B Lighting and Landscape Plan (Sheet 2 of 2) last revised December 22, 1992 by Lindley and Sons; EXHIBIT C Plan last revised December 22, 1992 depicting footcandle distribution of outdoor lights by LS1 Lighting Systems; EXHIBIT D Data Sheet (2 sheets) concerning outdoor lighting fixtures dated 1990 by LSI Lighting Systems. WHEREAS, notice of the public hearing concerning the petition for approval of the Special Use and the Preliminary Plan was given and the hearing was held by the Buffalo Grove Plan Commission; and, 1 WHEREAS, the Plan Commission determined that the criteria for a Special Use as set forth in Section 17.28.040 of the Village's Zoning Ordinance have been met and development of the Property would be compatible with adjacent properties; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms - and conditions herein set forth would further enable the Village to control the development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS as follows: Section 1 . This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Special Use and Preliminary Plan to allow development of recreation facilities pursuant to EXHIBITS A, B, C and D attached hereto for the following legally described Property: Outlot 14-B, excepting therefrom the North 653.40 feet of the East 400.00 feet (as measured along the North and East lines thereof) in the Woodlands at Fiore Unit 14, being a subdivision of part of the West half of the Northeast Quarter of Section 20, Township 43 North, Range 11 East of the Third Principal Meridian, according to the plat thereof recorded August 30, 1988, as Document Number 2716066, and amended by Letter of Amendment recorded October 25, 1988, as Document Number 2733855, Village of Buffalo Grove, Lake County, Illinois. Section 3. The outdoor recreational lighting as depicted on the EXHIBITS hereto shall be turned off no later than 10:30 p.m. each day. Lighting needed for security on the Property shall be reviewed and approved by the Village. 2 Section 4. This Ordinance shall be in full force and effect on and after its passage and approval.
