1987-050 ORDINANCE NO. 87-50
AN ORDINANCE APPROVING A PRELIMINARY PLAN
(Dojutrek Property, 940 E. McHenry Road)
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of
the Illinois Constitution of 1970; and,
WHEREAS, the Property legally described in attached EXHIBIT A is zoned
in the R-3 One-Family Dwelling District with a Special Use; and,
WHEREAS, the Village has received a petition for Preliminary Plan
approval for the Property; and,
WHEREAS, the Owner proposes to construct a single-family residence and
subdivide the Property pursuant to a Preliminary Plan dated April 9, 1987
attached hereto as EXHIBIT B and also a Plat of Subdivision dated June 15,
1987 (revised) attached hereto as EXHIBIT C; and,
WHEREAS, proper and due notice of the public hearing concerning the
Preliminary Plan was given and the public hearing held; and,
WHEREAS, the President and Board of Trustees after due and careful
consideration have concluded that the development of the Property on the
terms and conditions herein set forth would further enable the Village to
control the development of the area and would serve the best interests of the
Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS as follows:
1. Applicable Law. This Ordinance is made pursuant to and in
accordance with the Village's Zoning Ordinance, Development Ordinance and the
Village's Home Rule powers. The preceding whereas clauses are hereby made a
part of this Ordinance.

2. A proval of Preliminar Plan. The Corporate Authorities hereby
adopt a proper, valid and binding ordinance approving a Preliminary Plan
attached hereto as EXHIBIT B, for the Property legally described in attached
EXHIBIT A.
3. Approval of Develo ment Ordinance Variations. Said Preliminary
Plan is hereby approved with the following variations of the Village of
Buffalo Grove Development Ordinance, Title 16 of the Municipal Code:
a. 16.50.070.D.2. to waive the requirement to dedicate 4' of
right-of-way on Route 83.
b. 16.50.080.A.1. to waive the sidewalk requirement on Route 83.
C. 16.50.080.A.2. to allow a gravel driveway.
d. 16.50.090 to waive the bike path requirement.
e. 16.50.100.C. to waive street light requirement on Route 83.
f. 16.50.120.A. to waive the parkway tree requirement.
g. 16.30.140 to allow installation of three permanent monuments
rather than the required five monuments.
4. Special Conditions. Approval of the Preliminary Plan and
Development Ordinance variations are hereby made subject to the following
restrictions:
a. Any further subdivision of the Property will cause the
non-conforming use on Parcel B (Lot 2) to be eliminated;
b. Any further subdivision of the Property will cause the
variations granted herein to be eliminated, and Property will
be brought into full compliance with the Development Ordinance
regulations;
C. If Parcel B (Lot 2) is sold, the non-conforming use on said
Parcel will be eliminated;

d. At such time as a Village public water main is located within
two-hundred (200) feet of the Property on Illinois Route 83,
the Property will be connected to said Village main; said
restriction does not include any water main on Shady Grove
Lane.
5. This Ordinance shall be in full force and effect from and after its
passage. This Ordinance shall not be codified.

and Board of Trustees with the vote being as follows on the motion to pass
Ordinance #87-50:

ABSENT: 1 - Shields
Motion declared defeated.
