1986-001 ORDINANCE NO. 86® 1 AN ORDINANCE AMENDING A PLANNED UNIT DEVELOPMENT IN THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS (Buffalo Grove Partners, Ltd® Property) WHEREAS, the Village of Buffalo Grove is a Rome Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the hereinafter legally described real property is subject to a Planned Unit Development Agreement dated November 18, 1985, which was passed pursuant to Ordinance No® 85-79 ; and, WHEREAS, a request has been made to amend said Planned Unit Development Agreement, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: SECTION 1, The P.U.D. Agreement dated November 18, 1985 passed pursuant to Ordinance No. 85- 79 which covers the property legally described as follows: THAT PART OF THE SOUTHEAST QUARTER OF SECTION 33, TOWNSHIP 43 NORTH, RANGE Ll EAST OF THE THIRD PRINCIPAL MERIDIAN, BOUNDED BY A LINE DESCRIBED AS FOLLOWS; COMMENCING AT THE SOUTHEAST CORNER OF SAID QUARTER SECTION, 431.50 FEET FOR A POINT OF BEGINNING OF THE TRACT OF LAND TO BE DESCRIBED; THENCE CONTINUING SOUTH 890 32' 03" WEST ALONG THE SOUTH LINE OF SAID SOUTHEAST QUARTER, 327. 35 FEET TO THE EAST LINE OF THE WEST 34 RODS (561.00 FEET) OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SAID SECTION 33; THENCE NORTH 00' 37'57" WEST ALONG THE EAST LINE OF THE WEST 34 RODS, AFORESAID, 636.56 FEET TO A POINT ON SAID LINE 705.00 FEET SOUTH OF THE NORTH LINE OF SAID QUARTER QUARTER SECTION; THENCE NORTH 89' 08'53" EAST, 329.20 FEET; THENCE SOUTH 00027' 57" EAST, 637. 78 FEET TO THE POINT OF BEGINNING, IN LAKE COUNTY, ILLINOIS. is hereby amended pursuant to the Planned Unit Development Agreement Amendment dated January 6, 1986, attached hereto as Exhibit "A"® SECTION 2 This Ordinance shall be in full force and effect on and after its passage and approval® This Ordinance shall not be codified. CLAYTON, Village ). esident ATTEST„ Village Clerk Pro Tem PLANNED UNIT DEVELOPMENT AGREEMENT AMENDMENT BUFFALO GROVE PARTNERS, LTD. , PROPERTY This agreement (hereinafter referred to as the "Agreement") made and entered into this 6th day of January, 1986, by and between the VILLAGE OF BUFFALO GROVE (hereinafter referred to as "Village") by and through the President and Board of Trustees of the Village (hereinafter collectively referred to as the "Corporate Authorities") and AMERICAN NATIONAL BANK AND TRUST COMPANY OF CHICAGO, not personally but as Trustee under Trust #62100 dated August 29, 1984, (hereinafter referred to as "Owner") . W I T N E S S E T H: WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the provisions of the Constitution of the State of Illinois of 1970; and, WHEREAS, Owner is the Owner of a certain tract of land subject to a Planned Unit Development Agreement dated November 18, 1985 which was passed pursuant to Ordinance No. 85-79 ; and, WHEREAS, the Village and the Owner have determined that it is in their best interest to amend said Planned Unit Development Agreement. NOW, THEREFORE, in consideration of the premises, mutual covenants and i . agreements herein set forth, the parties hereto agree as follows: 1. Paragraph 24 of said Planned Unit Development Agreement dated November 18th, 1985, which was passed pursuant to Ordinance No. 85- 79 is hereby amended to read as follows: "24. Default. In the event Owner defaults, in his performance of his obligations set forth in this Agreement, then the Village, may, upon notice to Owner allow Owner sixty (60) days to cure default or provide evidence to the Village that such default will be cured in a timely manner if it cannot be cured during said period. If Owner fails to cure such default or provide such evidence as provided above, then, with notice to Owner, the Village may begin proceedings to terminate the special use for a Planned Unit Development and the property shall revert to its former R-8 zoning classification. In such even:t,, this;Agreement shall be considered to be the petition of the Owner for the R-8 zoning classification.
