1990-043 6/13/90 ORDINANCE NO. 90- 43 AN ORDINANCE AMENDING ORDINANCE NO. 90-40, BEING AN ORDINANCE APPROVING A PRELIMINARY PLAN AND A SPECIAL USE IN THE INDUSTRIAL ZONING DISTRICT, VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Villa e of Buffalo Grove Fire Station Number 27, Illinois Route 22 Easton Avenue WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the hereinafter legally described real property is zoned in the Industrial District; and, WHEREAS, the Village has approved Ordinance No. 90-40 authorizing a Special Use for a municipal fire station and approving a Preliminary Plan dated May 17, 1990 (revised) , a Preliminary Engineering Plan dated May 17, 1990 (revised) , a Traffic Control Signal Plan dated May 17, 1990, and a Conceptual Landscape Plan dated May 16, 1990 (revised; and, WHEREAS, Ordinance No. 90-40 grants a variation to Section 16.50.040.C.3 of the Village's Development Ordinance; and, WHEREAS, the Buffalo Grove Plan Commission has determined that a Village Development Ordinance variation is needed concerning parkway trees along Illinois Route 22, that a Village Zoning Ordinance variation is needed concerning the required parking standard for the fire station and that proper justification has been provided to allow the granting of said variations; and, WHEREAS, the President and Village Board of Trustees has provided public notice and conducted a public hearing to consider a variation to Section 16.50.120.I. 1.e. of the Village's Development Ordinance to waive the requirement for parkway trees along Illinois Route 22 and a variation to Section 17.36.040.G.15. of the Village's Zoning Ordinance to allow 22 1 off-street parking spaces instead of 30 spaces, pursuant to the Preliminary Plan dated May 17, 1990 (revised) attached hereto as Exhibit A and the Conceptual Landscape Plan dated May 16, 1990 (revised) attached hereto as Exhibit B; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that proper justification has been provided to allow the granting of a variation to Section 16.50.120.I.1.e of the Village's Development Ordinance and to allow the granting of a variation to Section 17.36.040.G. 15. of the Village 's Zoning Ordinance, and further that development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rules powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance amending Ordinance No. 90-40 and granting a variation to Section 16.50. 120.I.1.e of the Village's Development Ordinance to waive the requirement for parkway trees along Illinois Route 22 and granting a variation to Section 17.36.040.G. 15. of the Village's Zoning Ordinance to allow 22 off-street parking spaces instead of 30 spaces, pursuant to the Preliminary Plan attached hereto as Exhibit A and the Conceptual Landscape Plan attached hereto as Exhibit B for the following legally described property: 2 That part of the Northwest Quarter of Section 21 all in Township 43 North, Range 11 East of the Third Principal Meridian described as follows: Beginning at a point 1035.77 feet East of the Northwest corner of the Northwest Quarter of Section 21; thence N 89"26' 17" East along the North line of the Northwest Quarter of said Section 21, a distance of 259.76 feet; thence S 0"00'34" East a distance of 413.63 feet; thence N 88"48'17" West a distance of 259.80 feet; thence N 0"00'34" West a distance of 405.66 feet back to the point of beginning and containing 2.443 acres, in Lake County, Illinois. Section 3. Development of the Property shall be in accordance with the provisions of Ordinance No. 90-40, and Exhibits A - and B attached hereto unless revisions are required to comply with applicable State and Federal requirements. Section 4. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified. AYES: 4 - Marienthal.
