ORDINANCE NO. 90- 40
AN ORDINANCE APPROVING A PRELIMINARY PLAN AND A SPECIAL USE
IN THE INDUSTRIAL ZONING DISTRICT, VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS

Illinois Route 22/Easton Avenue
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of
the Illinois Constitution of 1970; and,
WHEREAS, the hereinafter legally described real property is zoned in the
Industrial District; and,
WHEREAS, the Village has petitioned for approval of a Preliminary Plan
dated May 17, 1990 (revised) attached hereto as Exhibit A, a Preliminary
Engineering Plan dated May 17, 1990 (revised) attached hereto as Exhibit B, a
Traffic Control Signal Plan dated May 17, 1990 attached hereto as Exhibit C,
and a Conceptual Landscape Plan dated May 16, 1990 (revised) attached hereto
as Exhibit D, and approval for a Special Use in the Industrial District for
construction of a municipal fire station; and,
WHEREAS, notice of the public hearing for a Special Use and Preliminary
Plan approval was given and the public hearing was held; and,
WHEREAS, the Plan Commission determined that the criteria for a Special
Use as set forth in Section 17.28.040 of the Village's Zoning Ordinance has
been met and that proper justification has been provided to allow the
granting of a variation to Section 16.50.040.C.3 of the Development
Ordinance; and,
WHEREAS, the President and Board of Trustees after due and careful
consideration have concluded that the development of the Property on the
terms and conditions herein set forth would enable the Village to control
development of the area and would serve the best interests of the Village.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS:
Section 1. This Ordinance is made pursuant to and in accordance with
the Village's Zoning Ordinance, Development Ordinance and the Village's Home
Rules powers. The preceding whereas clauses are hereby made a part of this
Ordinance.
Section 2. The Corporate Authorities hereby adopt a proper, valid and
binding ordinance approving a Special Use for a municipal fire station,
approving the Preliminary Plan attached hereto as Exhibit A, the Preliminary
Engineering Plan attached hereto as Exhibit B, the Traffic Control Plan
attached hereto as Exhibit C, and the Conceptual Landscape Plan attached
hereto as Exhibit D, and granting a variation to Section 16.50.040.C.3 of the
Development Ordinance to waive the underdrain requirement in a stormwater
detention basin, and subject to publication and a public hearing to allow
variations of the parkway tree requirement along Illinois Route 22 and to the
required parking standard for the following legally described property:
That part of the Northwest Quarter of Section 21 all in Township 43
North, Range 11 East of the Third Principal Meridian described as
follows : Beginning at a point 1035.77 feet East of the Northwest corner
of the Northwest Quarter of Section 21; thence N 89°26'17" East along
the North line of the Northwest Quarter of said Section 21, a distance
of 259.76 feet; thence S 0°00'34" East a distance of 413.63 feet; thence
N 88°48'17" West a distance of 259.80 feet; thence N 0*00'34" West a
distance of 405.66 feet back to the point of beginning and containing
2.443 acres, in Lake County, Illinois.
Section 3. Development of the Property shall be in accordance with
Exhibits A, B, C and D attached hereto unless revisions are required to
comply with applicable State and Federal requirements.
Section 4. This Ordinance shall be in full force and effect on and
after its passage and approval. This Ordinance shall not be codified.
