1975-041 ORDINANCE NO. 75 - 41
AN ORDINANCE AMENDING AN ORDINANCE APPROVING
AN ANNEXATION AGREEMENT DATED JUNE 7, 1970
WHEREAS, the Village Board of Trustees on June 8, 1970, by
Ordinance No. 70-16 did approve an Annexation Agreement between the Wheeling
Trust and Savings Bank as Trust 723 and the Village of Buffalo Grove dated
June 8, 1970, which provided for a B-2 Zoning District Classification for
parcel "A" described below, subject to sundry restrictions:
PARCEL "A"
That part of the Southwest 4 of Section 33, Township 43 North, Range 11
East of the 3rd Principal Meridian described as follows: Beginning at a
point in the center line of State Route No. 83, said point being 108.0
feet north of (measured perpendicular to) the south line of said southwest
1/4; thence West, parallel with the south line of said southwest 1/4, 377.01
feet; thence North 1 degree 31 minutes 20 seconds East, 51 .05 feet; thence
North 81 degrees 2 minutes 22 seconds West 183.90 feet; thence North 11 degrees
38 minutes 16 seconds West, 250.85 feet; thence East 528.83 feet to the center
line of Illinois State Route 83; thence southeasterly along said center line to
the point of beginning in Lake County, Illinois .
and,
WHEREAS, by the terms and commitments of said annexation agreement,
the same is legal and binding for a period not to exceed 5 years from its
date of execution, and
WHEREAS, the owner of record of Parcel A seeks to extend the
provisions , of said agreement with respect to zoning and other provisions
beyond its terminal date of December 1 , 1975, and current statutes permit
of agreements up to 10 years .
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, THAT:
SECTION 1 . The terms and conditions of an Annexation Agreement
between the Wheeling Trust and Savings Bank as Trust 723 and the Village
of Buffalo Grove as approved on June 8, 1970, by Ordinance No. 70-16 are
SECTION 2. The owner of record of Parcel A and their successors
in title are hereby bound by all of the terms and conditions of aforesaid
Annexation Agreement and all ordinances effective as of the date hereof and
any future ordinances and amendments thereto. The same are legal and binding
on the owner of said parcel and successor/s in title.
SECTION 3. This Ordinance shall be in full force and effect from
and after its passage, approval , and publication according to law.
