1975-010 ORDINANCE NO. 75 ZQ - AN ORDINANCE AMENDING AN ORDINANCE APPROVING AN ANNEXATION AGREEMENT DATED JUNE 79 1970 WHEREAS, the Village Board of Trustees on June 8, 1970, by Ordinance No. 70-16 did approve an Annexation Agreement between the Wheeling Trust and Savings Bank as Trust 723 and the Village of Buffalo Grove dated June 8, 1970, which provided for a B-2 Zoning District Classification for parcel "A" and R-9 Zoning District Classification for parcel "B" described below, subject to sundry restrictions : Parcel "A" That part of the Southwest k of Section 33, Township 43 North, Range 11 East of the 3rd Principal Meridian described as follows: Beginning at a point in the center line of State Route No. 83, said point being 108.0 feet north of (measured perpendicular to) the south line of said southwest thence West , parallel with the south line of said southwest -4, 377.01 feet ; thence North 1 degree 31 minutes 20 seconds East , 51 .05 feet; thence North 81 degrees 2 minutes 22 seconds West 183.90 feet ; thence North 11 degrees 33 minutes 16 seconds West, 250. 85 feet ; thence East 528. 83 feet to the center line of Illinois State Route 83; thence southeasterly along j said center line to the point of beginning in Lake County, Illinois. Parcel "B" That part of the southwest 4 of Section 33, Township 43 North, Range 11 East of the 3rd Principal Meridian, described as follows : Commencing at a point in the center line of Illinois State Route 83, said point being 108.0 feet north of (measured perpendicular to) the south line of said southwest ; thence west parallel with the south line of said southwest �, 377.01 feet; thence North 1 degree 31 minutes 20 seconds East, 51 .05 feet; thence North 81 degrees 2 minutes 22 seconds West, 183.90 feet; thence North 11 degrees 38 minutes 16 seconds West, 216.60 feet , to a point for a point of beginning of the parcel of land intended to be described; thence South 86 degrees 2 minutes 10 seconds West, 201 .50 feet; thence North 22 degrees 12 minutes 30 seconds West, 74.07 feet; thence North 2 degrees 34 minutes 21 seconds East , 23. 72 feet ; thence North 41 minutes 51 seconds West, 428.40 feet; thence East 391 .40 feet to a point 280.0 feet west of the center line of Illinois Route 83; thence South 8 degrees 48 minutes East parallel with said center line, 412.0 feet; thence East 280.0 feet to the center line of said Route 83; thence South 8 degrees 48 minutes East along said center line, 66.0 feet; thence West, 528. 83 feet; thence South 11 degrees , 38 minutes 16 seconds East, 34.25 feet to the point of beginning , in Lake County, Illinois. and, WHEREAS, the owner of record of Parcel A seeks to extend the provisions of said agreement with respect to zoning and other provisions beyond its terminal date of June 7, 1975, and current statutes permit of agreements up to 10 years. NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, THAT SECTION 1 . The terms and conditions of an Annexation Agreement between the Wheeling Trust and Savings Bank as Trust 723 and the Village of Buffalo Grove as approved on June 8, 1970 by Ordinance No. 70-16 are extended as to Parcel A until December 1 , 1975. SECTION 2. The owner of record of Parcel A and their successors in title are hereby bound by all of the terms and conditions of aforesaid Annexation Agreement and this amendment thereto, except that all ordinances effective as of the date hereof and any future ordinances and amendments thereto are legal and binding on the owner of parcel and successorls in title. SECTION 3. This Ordinance shall be in full force and effect from and after its passage, approval , and publication according to law. AYES ( NAYES ABSENT O PASSED this o? 7 day of 1975.
