1988-050 4/15/88* ORDINANCE NO. 88-50 AN ORDINANCE APPROVING SPECIAL USE Emmerich Park WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the property legally described in Parcel 1 of EXHIBIT A hereto is zoned R-6 Special Use and R-8 Special Use; and, WHEREAS, the Village has received a petition from the Buffalo Grove Park District requesting Special Use authorization and Preliminary Plan approval; and, WHEREAS, the Park District proposes to construct an addition to the existing maintenance building at Emmerich Park pursuant to the Preliminary Plan dated March 18, 1988, attached hereto as EXHIBIT B; and, WHEREAS, proper and due notice of the public hearing concerning the Special Use and Preliminary Plan was given and the public hearing was held; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the property on the terms and conditions herein set forth would further enable the Village to control the development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS as follows: 1. Applicable Law. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. 1 2. Authorization of Special Uses. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Special Use for Parcel 1 in accordance with the Preliminary Plan (EXHIBIT B) . 3. Exhibits. The development of Parcel 1 shall be in accordance with the following EXHIBITS, some of which were presented in testimony given by the Park District during the hearing held by the Plan Commission and reviewed by the Corporate Authorities prior to execution of this Ordinance. Said EXHIBITS are hereby incorporated by reference herein, made a part hereof, and designated as shown below. EXHIBIT A Legal Description EXHIBIT B,B-1, Preliminary Plan for Maintenance Facility by W-T B-2,B-3 Engineering, Inc. , dated March 18, 1988 Floor plan and building elevations (3 sheets) for Maintenance Facility by Cody-Braun and Associates, dated March 18, 1988 EXHIBIT C Landscape Plan for Maintenance Facility (no date) EXHIBIT D,D-1 Perspective sketch of Maintenance Facility looking southwest from northeast corner of Lake-Cook Road and Raupp Boulevard, by Cody-Braun and Associates, (no date) Aerial perspective sketch of Maintenance Facility looking east on Lake-Cook Road, by Cody-Braun and Associates, (no date) 4. Amendment of Special Use. If the Park District desires to amend the Special Use authorization as herein approved, including changes to the Preliminary Plan, such amendment will require review and approval by the Village. The Corporate Authorities may, at their sole discretion, require additional public hearings prior to approval of an amendment. The Village Manager is hereby authorized to approve minor changes as he deems appropriate. 2 EXHIBIT A Emmerich Park Parcel 1 Lot "F" in Buffalo Grove Unit No. 2, being a subdivision of the Northeast Quarter of the Northeast Quarter of Section 5, Township 42 North, Range 11, East of the Third Principal Meridian, except that portion taken for Lake Cook Road right-of-way, in Cook County, Illinois. 5. This Ordinance shall be in full force and effect from and after its passage. This Ordinance shall not be codified.
