ORDINANCE NO. 75 - 42
AN ORDINANCE APPROVING AN AMENDMENT TO ANNEXATION
AGREEMENT DATED AUGUST 7, 1972
WHEREAS, On August 7, 1972, the Village and LaSalle Vational Bank
as Trustee under Trust Agreement dated August 2, 1971, Trust f42935 entered
into an Annexation Agreement for the annexation and development of the property
described in Exhibit A attached hereto and made a part hereof, and
WHEREAS, The owner-developer made application to the President and
Board of Trustees for a modification of the preliminary plan which had been
submitted to and approved by the President and Board of Trustees, and
WHEREAS, Pursuant to Statute and Village Ordinances p::blic hearings
were held by the Plan Commission and the President and Board of Trustees.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE Or BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS-
SECTION 1. The Annexation Agreement dated August 7, 1972, is hereby
amended as follows:
(a) The original plan as approved is hereby decl?red �-oid.
(b) The amended preliminary plan as submitted is approved.
(c) The total number of units shall be as follows: � -
0 232 Single family units
236 Townhouse ,nits "A"
43 Townhouse units
(d) Building and pavement coverage shall not exceed 24.4%.
(e) The land shall be developed in accordance with Plan Commission
Exhibit 102-29, a copy of which is attached hereto and made a
part hereof. No variance shall be permitted without the same
being submitted to the Plan Commission and prior approval of
the President and Board of Trustees.
SECTION 2. Except as herein modified all other provisions of the
original Annexation Agreement dated August 7, 1972, shall remain in full
force and effect.
SECTION 3. This Ordinance shall be in full force and effect from
and after its passage and approval.
