1993-095 12/2/93 ORDINANCE NO. 93- 95 AN ORDINANCE APPROVING A REZONING FROM THE INDUSTRIAL DISTRICT TO THE B-3 PLANNED BUSINESS CENTER DISTRICT AND APPROVING A PRELIMINARY PLAN IN THE B-3 AND INDUSTRIAL DISTRICTS Comerica Bank, Southeast corner of Busch Road/Weiland Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property ("Property") legally described in EXHIBIT A attached hereto is zoned in the Industrial District; and, WHEREAS, LaSalle National Trust, N.A. as Trustee under Trust Number 100437 dated December 15, 1978 is the Owner of the Property and has petitioned to the Village for rezoning of Lot 1 of the Property to the B-3 Planned Business Center District and approval of a Preliminary Plan; and, WHEREAS, Comerica Bank - Illinois as Developer proposes to construct a banking facility on Lot 1 , a stormwater detention facility on Lot 2, and an access road on Lot 3 of the Property legally described in EXHIBIT A attached hereto pursuant to the following exhibits: EXHIBIT B Site Plan (Sheet SK-21 ) dated September 23, 1993 by Otis Associates, Inc. EXHIBIT B-1 Site Plan (Sheet SK-20) dated November 9, 1993 by Otis Associates, Inc. EXHIBIT C Preliminary Engineering Plan dated November 9, 1993 by Christopher B. Burke Engineering Ltd. EXHIBIT D Bank floor plan and elevations (Sheet SK-19) dated June 25, 1993 by Otis Associates, Inc. WHEREAS, notice of the public hearing concerning the petition for rezoning and approval of the Preliminary Plan was given and the public hearing was held by the Buffalo Grove Plan Commission; and, 1 3 B. Developer shall complete improvements to Weiland Road, including right-of-way dedication and sidewalk construction as required by the Lake County Division of Transportation and the Village. Said improvements shall be completed prior to occupancy of the banking facility on Lot 1 . C. Developer or Owner shall submit a plat of subdivision for the Property for review and approval by the Village and shall execute a Development Improvment Agreement pursuant to the Village Development Ordinance. D. Building appearance and materials, signage, lighting and landscaping proposed for the banking facility on Lot 1 of the Property are subject to review and approval by the Village's Appearance Commission and the Corporate Authorities. E. Exhibits B, B-1 and C notwithstanding, no variations to the Village Zoning Ordinance or Development Ordinance are granted by this Ordinance. Exhibit C notwithstanding, this Ordinance does not approve any building on Lot 3. Section 4, This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
