1991-043 Y Y 3/15/91 ORDINANCE NO. 91- 43 FIRST AMENDMENT TO THE CHEVY CHASE BUSINESS PARK EAST PLANNED UNIT DEVELOPMENT ORDINANCE (Angus Chemical Company) WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, TCC Chevy Chase Business Park, an Illinois limited partnership (hereinafter referred to as the "Developer") is the developer of a certain tract of property comprising 16.817 acres legally described in EXHIBIT A attached hereto, which exhibit is made a part hereof (hereinafter referred to as the "Property") and which real estate is within the corporate limits of the Village; and, WHEREAS, the Property was zoned in the B-3 Planned Business Center District with approval of a Planned Unit Development and Preliminary Plan by Ordinance 88-102, dated October 17, 1988; said plan depicts three one-story office buildings; and, WHEREAS, the Developer has petitioned to rezone the Property from the B-3 District to an Office and Research Planned Unit Development; and, WHEREAS, the Developer proposes to revise the Preliminary Plan to construct a two-story office and research facility for the Angus Chemical Company in lieu of the two one-story office buildings; and, WHEREAS, the proposed Angus Chemical Company building will have a first phase building area of 62,500 gross square feet, with two building additions of 10,800 gross square feet each planned for construction in a second phase, all pursuant to the following exhibits: EXHIBIT B Overall site plan dated January 7, 1991 by Wilson/Jenkins EXHIBIT C Preliminary Engineering Plan dated March 6, 1991 by Cowhey Gudmundson Leder, Ltd. 1 EXHIBIT D Conceptual Landscape plan dated March 14, 1991 by The Brickman Group, Ltd. EXHIBIT E Building elevations dated February 22, 1991 by Loebl Schlossman & Hackl, Inc. WHEREAS, the Buffalo Grove Plan Commission has held a public hearing concerning the Planned Unit Development ordinance amendment and revised Preliminary Plan pursuant to Chapter 17.28 and 17.48.010 of the Zoning Ordinance and the Plan Commission has determined that said amendment and revision are consistent with the design and intent of the Chevy Chase Business Park East P.U.D. approved by Ordinance 88-102; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1 . This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance, and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid, and binding ordinance amending the Planned Unit Development approved by Ordinance 88-102 by rezoning the Property from the B-3 District to an Office and Research Planned Unit Development and approving a revised Preliminary Plan as depicted on EXHIBITS B, C, D and E attached hereto. Section 3. Development of the Property shall be in accordance with attached EXHIBITS B through E, and shall be in accordance with the terms and conditions set forth in Ordinance 88-102 unless specifically amended by this 2 Ordinance. The one-story office buildings for Tracts D and E depicted on EXHIBIT B are not approved. Development of the Property is subject to the following conditions: a. The Developer shall be allowed to "landbank" certain parking areas as depicted on EXHIBIT C, and said areas shall be landscaped as approved by the Village. The Village shall determine, when said landbanked areas are required to be converted into parking spaces. b. The areas depicted on EXHIBIT C as future building additions are subject to review and approval by the Appearance Commission and Village Board. C. Landscaping as approved by the Village shall be provided to the eastern limit of the Property. d. Developer shall design and provide a schedule for completion of the bikepath east and north of the Property to East Chevy Chase Drive. Said design and schedule are subject to Village approval. The Developer shall construct said bikepath at the direction of the Village. e. Developer shall reserve land on the north side of the northern retention pond as depicted on EXHIBIT C and shall bond for the cost of construction of a bikepath on said reserved land. Said bikepath is subject to Village approval, and said bond shall be in a form approved by the Village Attorney and shall have a term of five years from the date of this Ordinance. Section 4. The following variations of the Village's Development Ordinance are hereby granted: a. Section 16.20.060.A.2. - To allow a conceptual grading plan for the entire site at the time of Preliminary Plan approval, with detailed grading plans to be provided at the time of individual building permit application. b. Section 16.50.040.C.4. - To allow a retention pond depth of twelve (12) feet, to allow a pond side treatment approved by the Village of a material other than natural stones, and to waive the requirement for mechanical aeration of the stormwater detention pond. The variation concerning pond depth shall pertain only to the easterly pond as depicted on EXHIBIT C. Section 5. This Ordinance shall be in full force and effect on and after its passage and approval.
