ORDINANCE NO. 89- 38
AN ORDINANCE VACATING CERTAIN PUBLIC STREETS
and RIGHT OF WAYS IN COLUMBIAN GARDENS UNIT #2
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit
pursuant to the Illinois Constitution of 1970; and
WHEREAS, the hereinafter described public streets and right
of ways in Columbian Gardens Unit No. 2 are municipal right of
ways and are currently unimproved; and
WHEREAS, the Corporate Authorities have determined that the
nature and extent of the public use or public interest to be
subserved is such as to warrant the vacation of said public
streets and right of ways and that the relief to the public from
any burden and responsibility of maintaining same constitutes a
public use or public interest authorizing said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1: The preambles hereto are hereby incorporated and
made a part of this ordinance.
Section 2: The following described public streets and right
of ways be and hereby are vacated:
All of the public streets, alleys and right of ways
including Mercier Avenue and Newman Street falling within
that part of the Southeast 1/4 of Section 35, Township 43
North, Range 11, East of the Third Principal Meridian and
that part of Columbian Gardens Unit No. 2, being a
subdivision in part of said Section 35, according to the
plat thereof recorded July 10, 1926 as Document No. 282352,
described as follows: Beginning at the Southwest corner of
Lot 10 in Block 8 in said Columbian Gardens Unit No. 2;
thence North 22 degrees 00 minutes 09 seconds West along the
Westerly line of said Block 8, being also the Easterly line
of Milwaukee Avenue, 288.70 feet to the Northwest corner of
Lot 1 in Block 8 in said Columbian Gardens Unit No. 2;
thence North 67 degrees 59 minutes 51 seconds East along the
Northerly line of said Lot 1 and said Northerly line
extended Northeasterly, being also the Southerly line of
Marquette Place in said Columbian Gardens Unit No. 2, 140.00
feet to the Northwest corner of Lot 15 in Block 8 in said
Columbian Gardens Unit No. 2; thence Northeasterly along a
curved line convex, Southeasterly, having a radius of 209.80
feet, being tangent to said last described line at said last
described point and being 66.00 feet, as measured radially,
Southeasterly of and concentric with the Southeasterly line
of Lot 14 in Block 7 in said Columbian Gardens Unit No. 2,
an arc distance of 171.12 feet to an intersection with the

Northeasterly extension of the Southeasterly line of Lot 13
in Block 7 in Columbian Gardens Unit No. 2 (the chord of
said arc bears North 44 degrees 37 minutes 54 seconds East,
166.41 feet); thence North 67 degrees 59 minutes 51 seconds
East along said last described line, 49.61 feet to an
intersection with a line drawn at right angles to the
Northwesterly line of Lot 2 in Block 9 in said Columbian
Gardens Unit No. 2, said right angle line being drawn from
the Northwest corner of said Lot 2; thence South 22 degrees
00 minutes 09 seconds East along said last described right
angle line, 136.00 feet to the Northwest corner of Lot 2 in
Block 9 in said Columbian Gardens Unit No. 2; thence North
67 degrees 59 minutes 51 seconds East along the
Northwesterly line of said Lot 2, 130.00 feet to the
Northeast corner of said Lot 2; thence South 40 degrees, 06
minutes 09 seconds East along the Northeasterly line of
said Lot 2, 70.00 feet to the Southeast corner of said Lot
2, being also the Northwest corner of Lot 6 in Block 9 in
said Columbian Gardens Unit No. 2; thence North 67 degrees
59 minutes 51 seconds East along the Northwesterly line of
said Lot 6.= 143.40 feet to the Northeast corner of said Lot
6; thence South 40 degrees 06 minutes 09 seconds East along
the Easterly line of said Lot 6 and said Easterly line
extended Southeasterly, being a line 66.00 feet, as measured
at right angles, Westerly of and parallel with the Easterly
line of Long Beach Drive in said Columbian Gardens Unit No.
2, 257.51 feet to an intersection with a line 66.00 feet, as
measured radially, Southerly of and concentric with the
Northerly line of said Long Beach Drive; thence Easterly
along said last described concentric line, being a curved
line convex Southerly and having a radius of 442.30 feet, an
arc distance of 312.34 feet to a point of reverse curvature
(the chord of said arc bears North 86 degrees 16 minutes 41
seconds East, 305.89 feet); thence Northeasterly, Easterly
and Southeasterly along a curved line convex Northeasterly,
having a radius of 117.00 feet, being tangent of said last
described curved line at said last described point and being
66.00 feet, as measured radially, Southerly of and
concentric with the Northerly and Northeasterly line of said
Long Beach Drive, an arc distance of 226.73 feet to a point
of tangency in said line (the chord of said arc bears South
58 degrees 26 minutes 09 seconds East, 192.88 feet); thence
South 02 degrees 55 minutes 09 seconds East along a line
tangent to said last described curved line at said last
described point, said tangent line being 66.00 feet, as
measured at right angles, Westerly of and parallel with the
Easterly line of said Long Beach Drive, 40.80 feet to an
intersection with the Southerly line of Block 10 in said
Columbian Gardens Unit No. 2; thence South 87 degrees 00
minutes 51 seconds West along said last described Southerly
line, 148.89 feet to an intersection with a line described
as bearing North 00 degrees 00 minutes East (measure North
00 degrees 17 minutes 19 seconds East) from a point on the
South line of the Southeast 1/4 of said Section 35 which is
950.00 feet East of the intersection of the South line of
said Southeast 1/4 with the center line of Milwaukee Avenue;
thence South 00 degrees 17 minutes 19 seconds West (Deed
South 00 degrees 00 minutes East) along said last described
line, 320.92 feet to an intersection with the Northerly line
of Lake-Cook Road; the following 4 courses are long the
Northerly line of said Lake-Cook Road;
Thence North 89 degrees 42 minutes 50 seconds West,
523.32 feet; thence North 83 degrees 11 minutes 39
seconds West, 176.14 feet; thence North 89 degrees 42
minutes 50 seconds West, 207.11 feet; thence North 55
degrees 44 minutes 53 seconds West, 41.47 feet
To the Easterly line of Milwaukee Avenue, being a line 50.00
feet, as measured at right angles, Easterly of and parallel
with the center line of Milwaukee Avenue; thence North 21
degrees 46 minutes 55 seconds West along said last described

Easterly line, 236.25 feet to an intersection with the
Westerly extension of the Southerly line of Lot 10 in Block
8 in said Columbian Gardens Unit No. 2; thence North 87
degrees 00 minutes 51 seconds East along said last described
line, 5.94 feet to the place of beginning, in Lake County,
Illinois.
Section 3: A Plat of Vacation of said public streets and
right of ways is attached hereto and made a part hereof as
Exhibit "A".
Section 4: The Village of Buffalo Grove reserves to itself
a permanent easement and right-of-way over, under and upon said
vacated portion for the construction, repair, replacement and
maintenance of water, storm sewer, sanitary sewer, gas, electric,
telephone and other public utilities, and facilities and
appurtenances thereto.
Section 5: That title to said vacated public streets and
right of ways is hereby declared to be vested in the owners of
the subdivided land abutting said public streets and right of
ways.
Section 6: This ordinance shall be in full force and
effect from and after its passage by the affirmative vote of at
least three-fourths (3/4ths) of the Village Trustees then holding
office. This ordinance shall not be codified.
