ORDINANCE NO. 88 61
GRANTING A VARIANCE FROM SECTIONS 17.48.020.F.5.C.,
17.48.020.F.6.a. and 17.48.020.F.6.b. OF THE
BUFFALO GROVE ZONING ORDINANCE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit
pursuant to the Illinois Constitution of 1970; and
WHEREAS, the Owner of the hereinafter legally described real
property has requested a variation from Sections 17.48.020.F.5.C.,
17.48.020.F.6.a. and 17.48.020.F.6.b. of the Buffalo Grove Zoning
Ordinance relative to the requirements of 1) a thirty (30) foot
parking setback on the North boundary of subject property, which
is adjacent to property zoned for residential use, 2) a sixty (60)
foot building setback on the North boundary, and 3) a six (6) foot
screen or fence on the North boundary; and
WHEREAS, the Zoning Board of Appeals has held a public
hearing, received testimony, prepared. minutes, made certain
findings and made an affirmative recommendation on said requests
for variation; and
WHEREAS, the Corporate Authorities of the Village of Buffalo
Grove hereby determine and find that said variation is in harmony
with the general purpose and intent of the Zoning Ordinance, that
the property in question cannot yield a reasonable return if
permitted to be used only under the conditions allowed by the
regulations of the zoning district in which it is located and the
plight of the owner is due to unique circumstances, and the
proposed variation will not alter the essential character of the
neighborhood;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1: The preceding WHEREAS clauses are hereby adopted
by the Corporate Authorities.
Section 2: A variation is hereby granted to 17.48.020.F.5.C.,
17.48.020.F.6.a. and 17.48.020.F.6.b. of the Buffalo Grove Zoning
Ordinance to the following legally described real property:
That part of Columbian Gardens Unit No. Four; being a sub-
division of part of the Southeast Quarter and part of the
East Half of the Southwest Quarter of Section 34, Township 43
North, Range 11, East of the 3rd Principal Meridian, according
to the plat thereof recorded June 26, 1929, as Document No.
339091 in Book "T" of Plats, Pages 84 and 85, which lies West

of the Commonwealth Edison Company right-of-way (said right-
of-way being a strip of land 210.0 feet in width lying West
of, parallel with, and adjoining the Westerly right-of-way
line of the Minneapolis, St. Paul and Sault Ste. Marie
Railroad) ; (excepting therefrom the following Lots, Lot 10 in
Block 6; Lots 5 and 6 in Block 7; and Lots 3, 4, 32 and 34 in
Block 9) in Lake County, Illinois.
The specific variations are 1) to vary the parking setback
requirement on the North boundary of the property by twenty (20)
feet to allow a ten (10) foot parking setback, 2) to vary the
building setback on the North boundary by thirty-five (35) feet to
allow a building setback of twenty-five (25) feet, and 3) to
eliminate the screening requirement on the North boundary.
Section 3: This ordinance shall be in effect from and after
its passage and approval. This ordinance shall not be codified.
