1974-041 ORDINANCE NO. 74 - ^ -� AN ORDINANCE EXTENDING A SPECIAL USE FOR A PLANNED DEVELOPMENT WHEREAS, the Village Board of Trustees on December 12, 1972, by Ordinance No. 72-44 did approve an Amendment to the Annexation Agreement between Exchange National Bank of Chicago as Trustee, Chesterfield Development Corporation , and the Village of Buffalo Grove, dated November 24, 1969, which provided 'for a Planned Development under the Buffalo Grove Zoning Ordinance Article VI entitled Special uses on the property hereinafter described being: The West half of the South West quarter of Section 32, Township 43 North , Range 11 East of the Third Principal Meridian (except that part lying North of a line 1070.75 feet North of and parallel with the South line of said South West Quarter aforesaid) , in Lake County, Illinois; and WHEREAS, Section 4 entitled Procedures of Article VI entitled Special Uses of the Buffalo Grove Zoning Ordinance provides that after special uses are discontinued for a period of more than one year, the buildings and land shall only be used for uses permitted in the zoning district in which said special use is located; and WHEREAS, the developer has requested that this special use be continued for one year after the expiration of this Annexation Agreement, and its Amendment, and WHEREAS, the Village Board of Trustees has reviewed this request for this special use extension; NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: SECTION 1 . The special use for a Planned Development as set forth in Ordinance No. 72-44 which amends the Annexation Agreement approved by the Village Board of Trustees on November 24, 1969, is extended for one year until November 24, 1975. SECTION 2. The Annexation Agreement dated November 24, 1969, and Chicago, as trustee, Chesterfield Development Corporation , owner, every successor owner and assigns and successor developer shall be subject to and comply with all current and future applicable Ordinances of the Village of Buffalo Grove, and that the school donation, annexation fees, and any payments due or to become due the Village pursuant to the aforesaid Annexation Agreement, its amendment and Ordinances Numbered 72-44 and 69-22 shall be paid in accordance with said Agreement and Ordinance.
