1995-029 3/16/95 ORDINANCE NO. 95- 29 AN ORDINANCE APPROVING A SPECIAL USE IN THE RESIDENTIAL ESTATE AND OFFICE AND RESEARCH DISTRICT, VILLAGE OF BUFFALO GROVE COOK AND LAKE COUNTIES,ILLINOIS Busch Grove Communijy Park Busch Road/Illinois Route 83Buffalo Grove Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS,the hereinafter legally described real property("Property")was classified in the R-E One Family Dwelling District and Office and Research District pursuant to the Stone Creek annexation agreement dated September 3, 1991 approved by Ordinance 91-75; and, WHEREAS,the Buffalo Grove Park District, as owner of the Property has petitioned to the Village for approval of a Special Use to develop public park and recreation facilities, including outdoor lighting, on the Property; and, WHEREAS, the petitioner proposes to develop said public park and recreation facilities in accordance with EXIIIBITS D through I as set forth in Paragraph 14 of the Busch Grove Community Park annexation agreement dated March 20, 1995 and approved by Ordinance 95- 26 ; and, WHEREAS,notice of the public hearing concerning the petition for approval of the Special Use was given and the hearing was held by the Buffalo Grove Plan Commission; and, WHFREAS,the Plan Commission determined that the criteria for a Special Use as set forth in Section 17.28.040 of the Village's Zoning Ordinance have been met and development of the Property would be compatible with adjacent properties; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would further enable the Village to control the development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS as follows: Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Special Use for public park recreation facilities pursuant to EXHIBITS D through I referenced herein for the following legally described Property: All that part lying northeasterly of the centerline of State Route 54 as now located of the following described property when taken as a tract: the east half of the northeast quarter of Section 32, Township 43 North,Range 11, East of the Third Principal Meridian, also part of the southwest quarter of the northwest quarter of Section 33 described as follows: Beginning at the southwest corner of the northwest quarter of said Section 33, Thence north on the section he 19/16 chains;thence south 09 degrees 15 seconds east, 0.06 chains; thence north 87 degrees 30 minutes west 39 links to the angle on the road; thence south 07 degrees east 13.24 chains to the half section line; thence west along the said line 2.15 chains to the point of beginning. (Except that part conveyed to the State of Illinois by Document 2262518 and recorded as Document 2268740) in Lake County, Illinois. Section 3. Said Special Use is subject to development of the Property in accordance with the terms and conditions of the Busch Grove Community Park annexation agreement dated March 20, 1995. Section 4. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
