1988-108 11/7/88 ORDINANCE NO. 88-108 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE ORDINANCE OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS (Archdiocese Pro ert -_Lexington Development Corporation) WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the hereinafter legally described property was annexed to the Village of Buffalo Grove by Ordinance 85-25 on May 20, 1985 which Ordinance was re-acknowledged by Ordinance 88-99 on October 17, 1988, and by Ordinance 88-100 on October 17, 1988, and is zoned in the R-E (Residential-Estate) District; and, WHEREAS, the Village has received a petition for rezoning to the R-4 District and Preliminary Plan approval for 134 single-family dwelling units; and, WHEREAS, notices of a public hearing concerning zoning and the Preliminary Plan have been given and a public hearing held; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would further enable the Village to control the development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS as follows: Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. 1 Section 2. The Comprehensive Zoning Ordinance of the Village of Buffalo Grove, Cook and Lake Counties, Illinois, as amended is further amended by rezoning the following described property from the R-E (Residential-Estate) District to the R-4 (One-Family Dwelling) District, and approving a Preliminary Plan dated September 12, 1988 attached hereto as EXHIBIT A and a Preliminary Engineering Plan dated October 14, 1988 (revised) attached hereto as EXHIBIT B: The East 1/2 of the East 1/2 of the West 1/2 of the Southeast 1/4 of Section 5, Township 42 North, Range 11 lying East of the Third Principal r Meridian, in Cook County, Illinois, and also The West 30 acres of the East 1/2 of the Southeast 1/4 of Section 5, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, and also The South 13.793 chains of the West 60 acres of the West half of the Southeast quarter of Section 5, Township 42 North, Range 11 East of the Third Principal Meridian, (except the West 14.50 chains thereof) , in Cook County, Illinois. Section 3. Approval of the rezoning and Preliminary Plan is hereby made subject to the following conditions: a. Lexington Development Corporation shall pay the Village's share of the cost of a traffic signal at Dundee Road if the Village determines that a signal is warranted; b. The following variations of the Village's Development Ordinance are hereby granted: 2 i. Section 16.50.040.C.3 - to allow a 4:1 side slope instead of a 6:1 side slope; ii. Section 16.50.040.C.4 - to allow a 3: 1 side slope with natural wetland grasses and ground cover instead of a 2:1 side slope and natural stones for a permanent pond [wetland area] ; and to allow a minimum pond [wetland area] bottom elevation of 6 to 10 feet instead of 15 feet; iii. Section 16.50. 130.B.2 and B.4 - to allow slopes of 3: 1 in rear yard locations where the site adjoins other properties. C. Lexington Development Corporation shall comply with the recommendations from the Buffalo Grove Park District as delineated in the memo dated October 12, 1988 from Michael Rylko, attached hereto as EXHIBIT C. Section 4. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
