AN ORDINANCE AMENDING TITLE 15 OF THE
VILLAGE OF BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the
provisions of the Constitution of the State of Illinois of 1970.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT
AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK
AND LAKE COUNTIES, ILLINOIS AND PURSUANT TO ITS HOME RULE
AUTHORITY:
SECTION 1: Chapter 15.04 of the Village of Buffalo Grove Municipal Code is
hereby amended to read as follows:

15.04.020 Amendments.
The 201806 Edition of the International Building Code is amended as follows:
Section 101.1 Title. (Amend to read as follows.) These regulations shall be
known as the Building Code of the Village of Buffalo Grove, hereinafter referred
to as "this code".
Section 101.4.4101.4.3 Plumbing. (Amend to read as follows.) The provisions of
the Illinois Plumbing Code shall apply to the installation, alteration, repair and
replacement of plumbing systems, including equipment, appliances, fixtures,
fittings and appurtenances, and where connected to a water or sewage system and
all aspects of a medical gas system. The provisions of the Illinois Plumbing Code
shall apply to private sewage disposal systems.
Section 102.4 Referenced codes and standards. (Amend to read as follows.)
The codes and standards referenced in this code shall be considered part of the
requirements of this code to the prescribed extent of each such reference. Where
differences occur between provisions of this code and referenced standards, the
provisions of this code shall apply. The following codes and standards are not
adopted by reference:
IPC-2006 International Plumbing Code;
IPSDC-2006 International Private Sewage Disposal Code;

IZC-2006 International Zoning Code.
Section 105.2 Work exempt from permit. (delete.)
Section 106.2.1107.2.6.2 Compliance with site plan. It shall be the
responsibility of the builder/developer to submit to the Building and Zoning
Department a spot survey prepared by a Registered Land Surveyor after the
foundation is installed. This survey must be at a scale of not less than one inch
equal to thirty feet (1 "=30'). The survey must also indicate the elevation above sea
level of the top of the foundation wall and the top of the curb and sidewalk at lot
lines extended relative to a United States Geological Survey benchmark. No
construction will be allowed to proceed except for decking, underground water
and sewer, and related items until the spot survey is approved by the Building and
Zoning Department. This section applies to principal structures only and not to
additions or accessory structures.
Section 108.2109.2 Schedule of permit fees. (Amend by adding the following)
On buildings, structures, electrical, gas, mechanical and plumbing systems or
alterations requiring a permit, a fee for each permit shall be paid as required, in
accordance with the schedule as established by the Village of Buffalo Grove.
A. A fee for each plan examination, building permit and inspection shall be
paid prior to the issuance of permit(s) in accordance with the following schedule:
1. Building Permit Fees are set forth in Chapter 1.16 of this Code. Whenever
the cost of construction is a factor in determining a permit or plan review fee, the
valuation of building projects shall be established based on the greater of:
a. The cost of construction established by the International Code Council (ICC)
and published on their website. Adjustments to these figures shall be made on
March 1 of each year based upon ICC published data; or
b. The cost of construction as stated by the applicant or agent on the application
for the relevant permit.
2. Building plan review fees are set forth in Chapter 1.16 of this Code. Further,
an Amendment Form is required to be submitted detailing the changes for any

revisions from previously approved plans. For building plans that have been
previously reviewed and the permit issued, any revisions to any commercial
building plan or any residential building plan that, based upon the changes
proposed require the review of two or more disciplines, a plan review fee for the
Amendment Form is set forth in Chapter 1.16 of this Code.
3. Plumbing permit fees are set forth in Chapter 1.16 of this Code.
4. Electrical permit fees are set forth in Chapter 1.16 of this Code.
5. Mechanical permit fees are set forth in Chapter 1.16 of this Code.
6. Elevator permit fees are set forth in Chapter 1.16 of this Code.
7. Fire protection system fees are set forth in Chapter 1.16 of this Code.
8. Swimming Pool Fees. The installation permit fee for an above ground pool is
set forth in Chapter 1.16 of this Code and the installation fees for an in -ground
pool will comply with the building fee schedule. The installation fees outlined
herein shall be in addition to any electrical or plumbing fees that may be required.
9. Health Department Plan Review Fees. Plan review fees for the Health
Department are set forth in Chapter 1.16 of this Code.
10. Reinspection Fees. The aforementioned permit fees include one
reinspection. Any inspection or reinspection not covered by the fees designated in
this section shall be charged as set forth in Chapter 1.16 of this Code.
11. Work Prior to Permit. Where work has been started prior to the issuance the
permit fee shall be as set forth in Chapter 1.16 of this Code.
12. Certificate of Occupancy. The fee for Certificate of Occupancy, including
business license inspections, is set forth in Chapter 1.16 of this Code.
13. Zoning/Code Compliance Letter fee is set forth in Chapter 1.16 of this
Code.
14. Parking Lot Repairs/Restriping is set forth in Chapter 1.16 of this Code.
15. Fire Department Fees are set forth in Chapter 1.16 of this Code.
16. Temporary Foodservice Permit fee is set forth in Chapter 1.16 of this Code.
Section 112.1113.1 Appeal: (Amend to read as follows.) Any person shall have
the right to appeal a decision of the code official to the Village Manager. A letter
for appeal shall be based on a claim that the true intent of this code or the rules
legally adopted thereunder have been incorrectly interpreted, the provisions of
this code do not fully apply, or an equivalent or better method of construction is
proposed. All appeals shall be filed within thirty days of the decision of the code
official.
The Village Manager shall affirm, modify, or reverse the decision of the code
official.

Section 502.1501-.2-Address number-sIdentification. (Amend to read as

address identification. The address identification shall be le Bible and placed in a
position that is visible from the street or road fronting the property. Address
identification characters shall contrast with their background. Address numbers
shall be Arabic numbers or alphabetical letters. Numbers shall not be s elled out.
Each character shall be a minimum of 6 inches in hei ht with a minimum stroke
width of 1 inch. Where required by the fire code official address identification
shall be provided in additional approved locations to facilitate emergency
response. Where access is by means of a orivate road and the building address
cannot be viewed from the public way, a monument, pole or other approved sign
or means shall be used to identify the structure. Address identification shall be
maintained.
Section 603.1.2 Piping. (Amend to read as follows.) The use of combustible
piping materials shall be permitted when installed in accordance with the
limitations of the International Mechanical Code and the Illinois Plumbing Code.
Section 903.1.2 Sprinkler System Design Criteria: (Add Section 903.1.2 to read
as follows.)
Hydraulically calculated sprinkler systems shall be designed to maintain a
minimum of 10% or 5 psi pressure cushion (whichever is greater) between the
seasonal low water supply and the total sprinkler demand. The total sprinkler
demand shall include the sprinkler demand and hose stream demand, and/or
standpipe demand.
Section 903.2 Where Re uired. Amend to read as follows.' Approved

Exceptions: Amend to read as follows.)
1. One -family dwelling, which is hereby defined as a building designed
exclusively for use and occupancy by one family which building is entirely
surrounded by open space and said open space being on the same zoning lot as the
building.
2. Detached accessory buildings with an intended use that is incidental to that of
the primary building on the same lot of record as a detached one -family dwelling.
Detached accessory buildings shall include, but not be limited to, detached

garages, storage sheds, and animal habitats.
3. Detached accessory buildings with an intended use that is incidental to that of
the primary building on the same lot of record where the primary building is
classified as a Use Group B, F, I, M, S, and U that are less than two hundred and
fifty square feet in size. This exception shall not apply if the horizontal separation
between the accessory building is less than twenty five feet from any other
building or the accessory building and/or structure is used for the storage of the
following hazardous materials:
(a) Flammable and/or combustible liquids classified as Class IA, IB, IC, II, and
IIIA if the combined quantity exceeds 30 gallons. (113.562 liters).
(b) Flammable gas if the quantity exceeds 10 gallons (37.9 liters) and/or 333
cubic feet of gas (9,429.5 liters).
(c) Corrosives.
(d) Toxic agents.
(e) Oxidizers classified as Class 2, 3, or 4. Class 1 oxidizers shall not exceed 100
gallons (378.5 liters) and/or 1,000 pounds (373.2 kilograms).
(f) Unstable/reactives.
(g) Water reactives if the quantity exceeds 100 gallons (378.8 liters) and/or 1,000
pounds (373.2 kilograms).
(h) Pyrophoric materials (all classifications).
(i) Organic peroxides (all classifications).
0) Explosives (all classifications).
4. Picnic shelters, gazebos, pergolas, and detached public restroom facilities with
a minimum horizontal separation of twenty-five feet from all other buildings. This
exception shall not apply if the picnic shelter, gazebo, pergola, or detached public
restroom is equipped with a permanent heat producing appliance that utilizes
natural gas and/or propane as a fuel supply or if the detached public restroom
facility exceeds a total of four hundred square feet in size.

electrical power distribution equipment, batteries and standby engines, provided
that those spaces or areas are equipped throughout with an automatic smoke

Section 903.2.8 Group R. Amend to read as follows. An automatic s rinkler
s stem installed in accordance with Section 903.3 shall be provided throughout all
buildings with a Group R fim area unless listed in Section 903.2 Exceptions I
through 5.
Section 903.2.13 Other required suppression systems: (Amend to read as
follows.)
An approved automatic fire sprinkler system shall be installed in any existing
building, excluding one -family dwellings, when:
1. The total square footage of the building or contiguous space is expanded to
3,000 square feet or more regardless of building separation, fire rated assemblies,
and type of construction.
2. Reconstruction involves structural modifications equal to or greater than 50%
of the building.
4. In reems or- areas that are of nencombustible eenstr-ueAien with who!!

Section 903.4.3 Floor Control Valves: (Amend to read as follows.)
Approved supervised indicating control valves shall be provided at the point of
connection to the riser on each floor of a multi -story building and on each floor in
high-rise buildings.
Section 905.3.1 Building Height. (Amend to read as follows.)
Class III standpipe systems shall be installed throughout buildings over two
stories in height or more than two stories below the highest level of fire
department vehicle access.
Section 905.4 Location of Class I Standpipe Hose Connections. (Amend by
adding the following.)
7. In all warehouse storage areas exceeding 20,000 square feet, and where
storage heights exceed 12' high, provide inside 2-1/2" fire hose valves.
Locate the valves at each exterior access/egress door to the warehouse
and/or storage area. Provide additional 2-1/2" fire hose valves so that no
portion of the warehouse and/or storage area is more than 150' maximum
travel distance to a fire hose valve.
The fire hose valve system piping shall be:
a. A separate riser piping system.
b. The 2-1/2" valves shall be supplied by a minimum of 4" pipe with
2-1/2" drops to each valve.
Section 907.2 Where required: (Amend to read as follows.)
1. Every new and existing building, except one family dwelling, requiring an
electrical permit shall be required to have an approved automatic fire alarm
system.
2. All new required fire alarm systems shall transmit trouble, supervisory, and fire
signals directly to the Buffalo Grove Fire Department remote receiving station via
a wireless transmitter in accordance with NFPA 72. Only equipment certified and
approved by the remote receiving station, and/or its' designated proprietor may be
installed. The designated proprietary agent shall be the only authorized installer of
the approved radio transmitters. Existing systems shall be changed to wireless
upon alarm owners request, when the existing equipment is updated or where a
disconnection of the telephone lines has occurred for a time period of more than
thirty days.
3. All required fire alarm systems shall be connected to the Village of Buffalo
Grove remote receiving station in accordance with NFPA 72.
Exceptions:
(a) Smoke detectors in Use Group R-1 occupancy sleeping areas shall be installed
for alerting staff.
(b) Smoke detectors in occupancies in Use Group I-3 (907.2.6.3).

15.06.020 Amendments.
The 2006 2018 Edition of the International Property Maintenance Code is amended as
follows:
Section 101.1 Title. These regulations shall be known as the International Property
Maintenance Code of the Village of Buffalo Grove, hereinafter referred to as "this code."
Section 102.7 Referenced codes and standards. (Amend to read as follows.) The
codes and standards referenced in this code shall be those that are listed in Chapter 8 and
considered part of the requirements of this code to the prescribed extent of each such

reference. Where differences occur between provisions of this code and the referenced
standards, the provisions of this code shall apply.
The following codes and standards are not adopted by reference:
IPC-2006 International Plumbing Code;
IZC-2006 International Zoning Code.
Section 202 General definitions. (Amend by adding the following)
Motor Vehicle: Every vehicle which is self-propelled and every vehicle which is
propelled by electric power obtained from overhead trolley wires, but not operated upon
rails, except for vehicles moved solely by human power and motorized wheelchairs,
except that a recreational vehicle as defined in the Buffalo Grove Zoning Ordinance is
excluded.
Vehicle. Every device, in, upon, or by which any person or property is or may be
transported or drawn upon a highway, except devices moved by human power, devices
used exclusively upon stationary rail or tracks and snowmobiles as defined in the Illinois
Snowmobile Registration and Safety Act.
Section 302.8 Motor vehicles and vehicles. (Amend to read as follows.)
A. Except as provided in other regulations, no motor vehicle currently unregistered by
any state shall be parked, kept or stored on any property;
B. No motor vehicle or vehicle shall at any time be in a state of major disassembly,
disrepair, or in the process of being stripped or dismantled.
Exception: A vehicle of any type is permitted to undergo major overhaul, including
body work, provided such work is performed inside a structure or similarly enclosed area
designed and approved for such purposes;
C. All motor vehicles shall be parked on an approved paved surface.
Exception: Original stone driveways which were in existence at the time of the
issuance of the certificate of occupancy for the principal structure.

Section 101.1 Title. (Amend to read as follows.) These regulations shall be
known as the Fire Code of the Village of Buffalo Grove, hereinafter referred to as "this
code".
Section 102.6-102.7 Referenced codes and standards. (Amend to read as
follows.) The codes and standards referenced in this code shall be those that are listed in
Chapter 8045 and such codes and standards shall be considered part of the requirements
of this code to the prescribed extent of each such reference. Where differences occur
between the provisions of this code and the referenced standards, the provisions of this
code shall apply. The following codes and standards are not adopted by reference:
IPC-2006 International Plumbing Code;
WAJIG 2006 international x ildland Urban inteifaee Code.
Section 311.2.2 Fire Protection. Exceptions (Delete).

Section 505.1 Address numbers. (Amend to read as follows.)
Each structure to which an address number has been assigned shall have such
number displayed in a position easily observed and readable from the public right-of-
way. All numbers shall be in Arabic numerals at least six (6) inches high with a one (1)
inch stroke. The color of the numbers shall be in contrast with the background for the
numbers.
Section 506.1 Key boxes. (Amend to read as follows.)
All buildings or structures equipped with a fire alarm or fire suppression system
shall provide a fire department key box on the exterior of the building or structure. The
box shall contain keys to allow fire department entry in the event of fire alarm activation
or an emergency. The fire official may also require a fire department key box if access to
the building, structure or area is unduly difficult. All fire department key boxes, location
of the key boxes, and the number of key boxes required shall be approved by the fire
official.
Section 903.2 Where Re uired. Amend to read as follows. Approved
Automatic Sprinkler Systems in new buildings and structures shall be provided in
the locations described in Sections 903.2.1 through 903.2.12.
Exce tions: (Amend to read as follows.)
1. One -family dwelling, which is hereby defined as a building designed
exclusively for use and occupancy by one family which building is entirely
surrounded by open space and said open space being on the same zoning lot as the
building.
2. Detached accessory buildin s with an intended use that is incidental to that of
the primary building on the same lot of record as a detached one -family dwelling

Detached accessory buildings shall include but not be limited to detached
garages, storage sheds, and animal habitats.
3. Detached accessory buildings with an intended use that is incidental to that of
the primary building on the same lot of record where the primary building is
classified as a Use Group B F I M S and U that are less than two hundred and
fifty square feet in size. This exception shall not apply if the horizontal separation
between the accessory building is less than twenty five feet from any other
building or the accessory building and/or structure is used for the storage of the
following hazardous materials:
a Flammable and/or combustible li uids classified as Class IA IB IC II and
IIIA if the combined quantity exceeds 30 gallons. (113.562 liters).
(b) Flammable gas if the quantity exceeds 10 gallons (37.9 liters) and/or 333
cubic feet of gas (9,429.5 liters).
m(c) Corrosives.
(d) Toxic agents.
(e Oxidizers classified as Class 2 3 or 4. Class 1 oxidizers shall not exceed 100
gallons (378.5 liters) and/or 1,000 pounds 373.2 kilograms)_.
(f) Unstable/reactives.
(g) Water reactives if the quantity exceeds 100 gallons (378.8 liters) and/or 1,000
pounds (373.2 kilograms).
(h) Pyrophoric materials (all classifications).
(i) Organic peroxides all classifications).
(i) Explosives (all classifications).
4. Picnic shelters, gazebos, pergolas, and detached public restroom facilities with
a minimum horizontal separation of twent -five feet from all other buildin s. This
exception shall not apply if the picnic shelter, gazebo, pergola, or detached public
restroom is equipped with a permanent heat producing appliance that utilizes
natural gas and/or propane as a fuel supply or if the detached public restroom
facility exceeds a total of four hundred sc uare feet in size.
5. S aces or areas in telecommunications buildin , s used exclusively for
telecommunications equipment, associated electrical power distribution
equipment, batteries and standby engines, provided that those spaces or areas are
equipped throughout with an automatic smoke detection system in accordance

with Section 907.2 and are separated from the remainder of the building by not
less than 1-hour ire barriers constructed in accordance with Section 707 of the
International Building Code or not less than 2-hour horizontal assemblies
constructed in accordance with Section 711 of the International Buildin Code or
both.
Section 903.2.8 Group R. Amend to read as follows. An automatic s arinkler
s stem installed in accordance with Section 903.3 shall be provided throughout all
buildings with a Group R ire area unless listed in Section 903.2 Exceptions 1
through 5.
Section 903.3.1.1.1 Exempt Locations.(Delete Exemption Numbers 4 5 and 6).
Section 903.6 Fire Pumps: (Add Section 903.6 to read as follows.)
All fire pumps shall have an outside test header. All test headers shall be equipped
with outside stem and yoke (OS&Y) gate valves. Provide a ball drip between the OS&Y
control valve and the outside test header. The test header shall have a minimum 2- 1/2"
test valves required by NFPA 20. All fire pump test headers shall be wall mounted
outside of the building. Test headers are not permitted inside the fire pump room or
building.
Section 903.7 Exterior access to sprinkler valve room/fire pump room: (Add
Section 903.7 to read as follows.)
An exterior access door shall be required to provide direct access to the automatic
fire sprinkler valves/pump room for all new buildings. Doors shall be labeled "Fire
Equipment Room". In existing buildings, where possible, an outside access door shall be
provided. The fire pump room shall be constructed to provide a minimum of one hour fire
resistive rating.
Section 905.3.1 Building height. (Amend to read as follows.)
Class III standpipe systems shall be installed throughout buildings over two
stories in height or more than two stories below the highest level of fire department
vehicle access.
Section 905.4 Location of Class I standpipe hose connections. (Amend by
adding the following.)
7. In all warehouse storage areas exceeding 20,000 square feet, and where
storage heights exceed 12' high, provide inside 2-1/2" fire hose valves.
Locate the valves at each exterior access/egress door to the warehouse
and/or storage area. Provide additional 2-1/2" fire hose valves so that no
ortioia of the warehouse and/or storage area is more than 150' maximum
travel distance to a fire hose valve.
The fire hose valve system piping shall be:

a. A separate riser piping system.
b. The 2-1/2" valves shall be supplied by a minimum of 4" pipe with 2-
1 /2" drops to each valve.
Section 906.1 Portable fire extinguishers. (Amend to read as follows.)
Where required: A portable fire extinguisher shall be installed in the following
locations in accordance with NFPA 10, 2007 edition.
1. In all occupancies in Use Groups A-1, A-2, A-3, A-4, B, F-1, F-2, I-1, M, R-
I(except single family dwellings not used as adult care or child care facilities), S-1, S-2,
and H.
2. In all areas containing commercial kitchen exhaust hood systems Class K fire
extinguishers are required.
3. In all areas where fuel is used, stored or dispensed.
4. In all areas where flammable or combustible liquids is used in the operation of
spraying, coating, or dipping.
5. In all occupancies in Use Group I-3 at staff locations. Access to portable fire
extinguishers shall be permitted to be locked.
6. On each floor of structures under construction, except occupancies in Use
Group R-3.
7. In any laboratory, shop or other room of similar purpose.
8. Where required by sections indicated in Table 906.1 for various operations,
processes, structures and areas.
Section 907.10.1 Individual tenant identification: (Add Section 907.10.1 to
read as follows.)
All multi -tenant Use Group M buildings shall have individual sprinkler flow
switches and control valves. Sprinkler system activation shall include an outside
weatherproof clear strobe light over the entrance to each tenant space as directed by the
fire official. All outside strobe lights shall be minimum 75 candela.

Section 3301.1.35601.1.3 Fireworks. (Amend to read as follows.)
The possession, manufacture, storage, sale, handling and use of fireworks are
prohibited.
Exceptions:
1) Storage and handling and use of fireworks at display sites in accordance with
Sections 3304-5604 and 3308 55608.5 and NFPA 1123 or NFPA 1126 listed in Chapter
8035 of the 2006 2018 International Building.Fire Code.
2) The retail sale of approved consumer novelties as defined by this Ordinance
shall be permitted but only to persons 18 years of age or older. Such sales shall be
permitted only in buildings equipped with approved automatic sprinkler systems. The
display of consumer novelties in a building shall be separated from all exit doors by a
minimum distance of 20 feet or as approved in advance in writing by the Fire Chief. The
sale of consumer novelties shall not be permitted at any building or on any property
where flammable or combustible liquids or gases are sold or dispensed.
Section 3302.15602.1 Definitions. (Amend by adding the following)
CONSUMER NOVELTIES. Consumer novelties shall mean: (i) snakes, glow
worm pellets, smoke devices, trick snappers, trick matches, cigarette loads, auto burglar
alarms, toy pistols, toy canes, toy guns, and other devices in which paper or plastic caps
containing 0.25 grains or less of explosive compound are used, provided they are
constructed so that the hand cannot come in contact with the cap when in place for the
explosion, and (ii) toy pistol paper or plastic caps which contain less than 0.25 grains of
explosive mixture.
Section 3308.2.1 Outdoor displays. (Amend to read as follows.)
In addition to the requirements of Section 403, permit applications for outdoor
fireworks displays using Division 1.3G fireworks shall include a diagram of the location
at which the display will be conducted, including the site from which fireworks will be
discharged; the location of buildings, highways, overhead obstructions and utilities; and
the lines behind which the audience will be restrained. All outdoor fireworks displays
shall be electronically fired using approved electronic firing units and approved mortar
racks.
All outdoor fireworks displays shall comply with the provisions of the Illinois
Fireworks Use Act (425 ILCS 35), and the Pyrotechnic Distributor and Operator
Licensing Act (225 ILCS 227).

It shall be unlawful to display, sell, store, or advertise for sale any Class 1.3G or

Article 110.26(C)(2). Large Equipment. (Amend to read as follows.)
For equipment rated 1200 amperes or more and over 1.8m (6ft) wide that contains
overcurrent devices, switching devices, or control devices, there shall be one entrance to
the required working space not less than thirty-two (32) inches wide and -six and two
thirds (6-2/3) feet high at each end of the working space. Where the entrance has a
personnel door(s), the door(s) shall open in the direction of egress and be equipped with
panic bars, pressure plates, or other devices that are normally latched but open under
ample pressure.
A single entrance to the required working space shall be permitted where either of the
conditions in 110.26(C)(2)(a) or (C)(2)(b) is met.

Section 15.12.030 - Downspouts and sump pump discharges.
A. New Connections and New Construction. Except as set forth in subsection B of this
section, the following requirements for new connections and new construction apply:
1. Downspouts.
a. All downspouts or roof drains shall discharge onto the ground or be
connected to a storm sewer. No downspouts or roof drains shall be
connected to the sanitary sewer.
b. A downspout or roof drain shall be terminated no more than ten feet from
the building unless written approval is granted from the Village Engineer.
2. Footing Drains. Footing drains shall be connected to sump pumps and discharge
shall be made into a storm sewer. No footing drains or drainage tile shall be
connected to the sanitary sewer.
3. Floor Drains. Floor drains in basements shall be connected to a sump pump and
discharged to the sanitary sewer.
4. Sump Pumps.
a. Sump pumps installed to receive and discharge groundwaters or other
stormwaters shall be connected to the storm sewer. Sump pumps installed to
receive and discharge floor drain flow or other sanitary sewage shall be
connected to the sanitary sewer. A sump pump shall be used for one
function only, either the discharge of stormwaters or the discharge of
sanitary sewage.

b. Sump pump discharges to the storm sewer system shall be a conduit of four
inch minimum diameter P.V.C. pipe, at a minimum slope of one percent,
and a minimum depth from finished grade to the top of pipe of eighteen
inches.
B. Existing Stormwater Sump Pump Discharges. The discharge piping from existing
sump pumps installed to receive and discharge groundwaters or other stormwaters
shall be terminated no more than ten feet from the building unless written approval is
granted by the Village Engineer.
C. Unlawful Discharge. It is unlawful to cause or permit the discharge from any sump
pump, downspout or roof drain to flow onto public streets, sidewalks or parkways.

CONTRACTOR REGISTRATION

Section 15.32.010 - General provisions.
No person, firm, partnership, corporation, or other entity shall engage as a general
contractor, subcontractor, or construction manager for alarm, tarmac, carpenter, cement,
demolition, electrical, excavator, fence, irrigation, low voltage electrical, mason,
mechanical (heating & air conditioning), plumbing, sewer, fire suppression or any other
type of work that requires a building permit in the Village of Buffalo Grove, unless they
possess a current Contractor Registration in the Village of Buffalo Grove pursuant to the
requirements of this Chapter (Contractor Registration) and (except as set forth in Sections
15.32.020 and 15.32.030) pay the fee as set forth in Section 15.32.030.
Section 15.32.020 - Exceptions.
The following contractors will have to complete a Village of Buffalo Grove
Contractor Registration but are exempt from fee required in 15.32.010 because they are
licensed by the State of Illinois: plumbing, irrigation, roofing, radon, elevator, _alarm and
fire suppression/sprinkler.
Section 15.32.030 - Fees.
All Contractor Registration fees are based on a calendar year as set forth in Chapter
1.16 of this Code.
Section 15.32.040 - Additional requirements.
A. Electrical Contractors. Electrical contractors are required to provide a copy of their
current electrical registration. The Village honors registrations of any Illinois
municipalities that require a written exam or proof of having successfully passed a
written exam administered by the International Code Council prior to the issuance of
the license/registration.
Electrical Contractors. It shall be unlawful for any person to engage in the
business of electrical work, without being registered as an electrical contractor.
If such person is registered for the current year in another city or village within
the State of Illinois, in conformity with the State statutes, such electrical
contractor shall be required to show proof of such registration. The term
"electrical contractor" as used in this section shall be understood to mean any
person installing or altering electrical equipment for the utilization of electricity
supplied for light, heat or power, but not including radio apparatus or equipment
for wireless reception of sounds and signals, conductors and other equipment
installed under the jurisdiction of the Illinois Commerce Commission, for use in
their operation as public utilities. The term "electrical contractor" does not
include employees of an electrical contractor who perform or supervise work.
2. The Corporate Authorities, by virtue of the Illinois Compiled Statutes, requires
candidates for electrical registration to successfully complete a written
examination administered by the Village Electrical Commission or contractor
registration from any Illinois municipality that administers written examinations.
Those holding an electrical registration from the Village of Buffalo Grove shall
pay an annual registration fee as set forth in Chapter 1.16 of this Code.

Homeowners. The requirement for an electrical contractor may be waived with
special permission from the Building Commissioner or Electrical Inspector if the
homeowner provides acceptable evidence to the Village of their qualifications to
perform electrical work. However, if upon inspection the Village determines that
the work is not progressing satisfactorily in a workman -like manner with the
applicable codes as determined solely by the Village, the Village may require
that the homeowner immediately hire an electrical contractor to complete the
work in conformance with the applicable codes.
4. Where a registered electrician or electrical contractor is found doing electrical
work without a permit on two separate occasions within any twelve-month
period, a hearing shall be held by the Electrical Commission, in the presence of
the Electrical Inspector, at which time the permit privileges of said electrician or
electrical contractor may be suspended for a period of time not to exceed one
year.
5. In cases of emergency, the Electrical Inspector has the authority to disconnect
current to any electrical equipment found to be unsafe.
B. Irrigation. Irrigation contractors are required to provide a copy of their current State
of Illinois Department of Public Health Certificate of Registration.
C. Plumbing. Plumbing contractors are required to provide a copy of their State of
Illinois or City of Chicago license, and provide a copy of their State of Illinois
Plumbing Contractor Registration. The plumbing contractor shall provide a letter of
intent for each project. The letter shall be on company letterhead, signed by the
license holder and contain the corporate seal or be notarized.
The requirement for a licensed plumbing contractor may be waived when a
homeowner requests to perform the work with special permission from the Building
Commissioner or Plumbing Inspector if the homeowner provides acceptable evidence to
the Village of their qualifications to perform plumbing work and proof that they have
been the principal resident of the property for a minimum of six months prior to the
beginning of work. However, if upon inspection the Village determines that the work is
not progressing satisfactorily in a workman -like manner with the applicable codes as
determined solely by the Village, the Village may require that the homeowner
immediately hire a licensed contractor to complete the work in conformance with the
applicable codes.
D. Roofing. Roofing contractors are required to provide a copy of their current State of
Illinois Roofing License.
E. Sprinkler/Fire Suppression. Sprinkler/Fire Suppression contractors are required to
provide a copy of their current Fire Sprinkler Contracting License.
F. Alarm. Alarm contractors are required to provide a copy of their current State of
Illinois Alarm Contractor license.
G. Radon. Radon contractors are required to provide a copy of their current State of
Illiinois Radon Mitigation Professional License.
H. Elevator. Elevator contractors are required to provide a copy of their current State of
Illinois Elevator Contractor License.
Section 15.32.050 - Review panel.
A. Any contractor working in the Village may have their contractor registration
revoked by the Village Review Panel after notice and hearing as provided for in this
Chapter for any of the following causes: (i) noted code violations are not corrected
during the construction of a permitted improvement, (ii) there is a failure to obtain
final inspections, (iii) permits are not obtained for work being done, (iv) consumer
fraud, or (v) violation of applicable Village regulations. The Village Review Panel
shall be comprised of the Community Development Director, or designee, the
Deputy Building Commissioner%Operatio,Deputy Building
and the Plan Reviewer.
B. Notice of the hearing for revocation of a contractor's registration shall be given in
writing, setting forth the grounds of the complaint and the time and place of the
hearing. Such notice shall be (i) mailed at least five days prior to the date set for the
hearing by certified mail to the contractor at the contractor's last known address; or
by personal service.
Section 15.32.060 - Appeal.
Any person shall have the right of an appeal of the decision of the Review Panel in
the revocation of a Contractor Registration to the Village Manager. Such appeal shall be
taken by filing with the Village Clerk, within ten days after notice of revocation, a written
statement under oath setting forth specifically the grounds for appeal.
The Village Manager shall affirm, modify, or reverse the decision of the Review
Panel. The decision of the Village Manager on such appeal shall be final.
SECTION 13. Chapter 15.36 of the Village of Buffalo Grove Municipal Code is
hereby amended to read as follows:
Chapter 15.36
RESIDENTIAL RENTAL HOUSING PROGRAM
Section 15.36.010 - Purpose.
The purpose of this Chapter is to provide for the licensing and inspection of rental
residential property so as to protect the public health, safety, and welfare of the people of
the Village including:
A. To protect the public health and safety by insuring rental units comply with
minimum housing standards of Village ordinances;
B. To protect the character and stability of residential areas;

C. To correct and prevent housing conditions that adversely affect or are likely to
adversely affect the life, safety, general welfare and health, including the
physical, mental and social well being of persons occupying dwellings;
D. To prevent the overcrowding of dwellings by requiring compliance with
minimum space standards per occupant for each dwelling unit;
E. To facilitate the enforcement of minimum standards for the maintenance of
existing residential building and thus to prevent slums and blight;
F. To preserve the value of land and building throughout the Village.
Section 15.36.020 - Provisions of inspection rights and penalties.
This Chapter shall not be construed as to restrict the right of this Village to inspect
any property nor to seek penalties for violations of other provisions of this Code.
Section 15.36.030 - Definitions.
A. "Code Official" means the Building CommissionerDeputy Building

of
the Village or their- designated r-epFesentati vedesignee.
B. "Conditional license" means a limited approval of the premises for a period of up to
six months when a property cannot fully comply with all the applicable requirements
of the Village of Buffalo Grove due to special circumstances (e.g. weather
conditions, unavailability of required materials or services, or other circumstances
approved by the Code Official).
C. "Member of the owner's family" means an individual related by blood, adoption or
marriage.
D. "Owner" shall include, but not by way of limitation, a beneficiary of a trust.
E. "Premises" means a lot, plot or parcel of land including the interior and exterior of
any structures thereon.
F. "Property agent" means a person, operator, firm, partnership, corporation, or other
legal entity designated in writing by the property owner to the Code Official to
manage a rental residential property including the authority to receive notices or
citations.
G. "Rental residential property" means residential structures or individually titled
dwelling units let or intended to be let for rent or lease including single-family
detached structures.
H. "Tenant" means an occupant of rental residential property.
I. Words or phrases as used in this Chapter and not defined in this section shall be
defined as provided by the Village of Buffalo Grove's Property Maintenance Code
and building codes.
Section 15.36.040 - License required.

A. It is unlawful for any person, firm, partnership, corporation, or other legal entity to
operate, maintain or offer to rent within the Village of Buffalo Grove a rental
residential property whether vacant or not without first obtaining a license or a
temporary certificate as provided in this Chapter.
B. It is unlawful for a person to occupy a rental residential property, or for any owner
or property agent to allow anyone to occupy a rental residential property which is not
licensed or which is without a temporary certificate as provided in this Chapter.
C. It is unlawful for any person, firm, partnership, corporation, or other legal entity to
offer for rent or to occupy any vacant dwelling unit or any dwelling unit that
becomes vacant in a rental residential property for which a license is under
suspension.
D. This Chapter shall not apply to the following structures:
1. Owner -occupied residential dwelling units;
2. Residential dwelling units occupied by a member of the owner's family;
3. Residential buildings or dwelling units which are vacant and which are not
intended to be let for rent;
4. Hotels, motels, and other structures which rent rooms to occupants which are
primarily transient or extended stay in nature;
5. Dwellings, buildings, structures and uses owned by other governmental
agencies and public housing authorities.
6. Nursing homes and convalescent care facilities.
E. A license or a temporary certificate for a rental residential property cannot be
transferred to another residential property nor a succeeding owner.
Section 15.36.050 - License application and requirements.
A. Each applicant for a license to maintain a residential property for the purpose of
renting it to others shall file a written application with the Code Official stating:
1. The full legal name, address, and home and work telephone numbers of each
and every owner;
2. If the residential property is held in trust, state the name, address, work phone of
the trustee and each beneficial interest holder;
3. The address of the rental residential property;
4. The number of dwelling units within the rental property;
5. The name, address, and phone number of any management company retained as
property agent for the property and the name, address, and phone number of the
person specifically assigned to the rental residential property;
6. The name, address, and twenty -four-hour phone number or numbers of a
responsible person who, in emergency situations, will be available on a twenty-
four -hour basis and who has the authority to make repairs as needed.

B. Whenever there is a change in ownership of a rental residential property or the
owner's property agent, the owners shall with thirty days of such changes, file an
updated written notice with the Code Official indicating such changes.
C. Each application for a new license or a renewal of any existing license shall be
accompanied by an annual fee as set forth in Chapter 1.16 of this Code.
D. A license period shall commence on January 1 st of a given year and shall terminate
on December 31 st of that year.
E. All license fees shall be due payable upon submission of the license application or
renewal forms. If the annual registration fee is not paid by January 1 st the fee shall
be doubled except the annual fee for the initial application shall be doubled but only
if as a result of enforcing a violation of this Chapter.
F. Units that were initially not a rental and converted to rental property after July 1 sc
shall pay one-half the annual license fee.
G. No structural, mechanical, electrical, or plumbing alterations or repairs, or any
remodeling shall be made to the units in a licensed property unless all zoning and
building code requirements have been met and applicable building pen -nits obtained
and inspections approved.
H. A copy of the record of tenant names required under Section 15.36.100(A) shall be
kept on file by the property owner and/or property agent and made available upon
request to the Code Official or designee.
Section 15.36.060 - Inspection requirements —License issuance or denial.
A. Upon submission of a completed application for a license or license renewal for any
one- or two-family rental residential property and the payment of all required fees,
an inspection of the one- or two-family rental residential property shall be scheduled
and must be performed within the first three months of the license year, or partial
license year.
B. Upon submission of a completed application for a license or license renewal for any
multifamily rental residential property and the payment of all required fees, an
inspection of the multifamily rental residential property shall be scheduled and must
be performed within the current license year, or partial license year.
C. A licensing inspection of rental residential property shall include the premises and,
in the case of multi -family rental residential property, a percentage of the individual
dwelling units with a minimum of at least one dwelling unit. The Code Official or
designee shall determine which dwelling units are to be inspected.
D. When a licensing inspection of a rental residential property reveals any violations of
applicable codes, a compliance time frame will be set by the Village inspector. In
establishing a compliance time frame, the Village inspector shall determine the
reasonable minimal time necessary to correct the violations based upon the number
and severity of the violations. The Village inspector shall provide a copy of the
written inspection report. Such inspection report shall be left at the property with the

owner, agent or tenant who was present for the inspection and shall include the
following:
1. A description of the property sufficient for identification;
2. The inspection report listing the violations of applicable codes;
3. The inspection report indicating the date upon which the licensing reinspection
will occur; and
4. An explanation that if upon completion of the licensing reinspection the
requirements of applicable Village codes have not been met, then the license
may be denied or revoked.
E. A licensing reinspection shall be conducted at the end of the compliance time frame.
Upon completion of the licensing reinspection of the rental residential property, the
Code Official shall;
1. Approve the license if the rental residential property meets the requirements of
applicable Village codes; or
2. Approve a conditional license if the property cannot be fully licensed due to
special circumstances; or
3. Issue a written denial of the license if the requirements of Village codes have
not been met. The written denial shall specify the defect(s) that remain and shall
be transmitted by regular U.S. mail to the applicant.
A conditional license may be issued for a term not exceeding six months to those rental
properties which cannot be fully licensed due to special circumstances, (e.g. weather
conditions, unavailability of required materials or services, or other circumstances
approved by the Code Official). Any property which has not met the requirements of the
applicable Village codes by the end of the conditional licensing term shall be considered
unlicensed.
F. All additional inspections made necessary because of cited violations not being
corrected at the time of the initial license reinspection shall be subject to a fee as set
forth in Chapter 1.16 of this Code. The conditional license and the full rental
residential license shall not be issued and the property shall not be considered
property licensed until all reinspection fees are paid.
G. Applications for license renewals shall be made in the same manner as for new
applications except that such applications shall state thereon such fact.
Section 15.36.070 - Enforcement.
It shall be the duty of the Village Building and Zoning Department to enforce the
provisions of this Chapter as authorized by the Buffalo Grove Municipal Code and the
Property Maintenance Code as adopted and amended from time to time by the Village.
15.36.080 - Violations.
The following shall constitute violations of this Chapter:

A. Failure of the owner or owners of the rental residential property to license such
property with the Village;
B. Failure of the occupants of the rental residential property to vacate such
property within sixty days after receiving notice from the Code Official that
such property is not properly licensed;
C. Failure of the owner or owners of the rental property to vacate all tenants from
such property within sixty days after the license has been revoked;
D. Failure of the owner or owners of the rental property to maintain the structure
and premises in compliance with applicable building, property maintenance and
zoning ordinances;
E. Any person other than one authorized by the Code Official who removes or
defaces any notices which have been posted pursuant to this Chapter shall be
liable for the penalties provided for by this Chapter.
Section 15.36.090 - License —Suspension and revocation.
A. A license may be suspended when any violation of applicable Village codes has
been identified by the Village and the property owner has been properly notified of
the violation and given a reasonable period of time in which to correct the violation,
but has failed to do so. A license may also be suspended when any information
provided in the license application is determined by the Code Official to be false.
B. When an inspection of a licensed rental residential property reveals any violation of
applicable codes, a compliance time frame will be set by the Code Official using the
standard as set forth in Section 15.36.060(D). The Code Official shall provide notice
by personal service or send notice to the property owner or the listed property agent
by regular U.S. mail at the last address provided on the most recent license
application. Such notice shall include the following:
1. Description of the property sufficient for identification;
2. A statement listing the violation(s) of applicable codes;
3. A statement indicating the date upon which a reinspection will occur; and
4. An explanation that if upon completion of the reinspection the requirements of
applicable Village codes have not been met, then the license for the rental
residential property will be suspended.
C. A reinspection will be conducted at the end of the compliance time frame. If the
Code Official finds that the requirement of applicable Village codes have not been
met upon the completion of such reinspection, then the license for the rental
residential property shall be suspended.
D. When a license is suspended, the Code Official shall send notice to the property
owner or the listed property agent at the last address provided on the most recent
license application. Such notice shall be sent by certified mail, return receipt
requested. The notice shall include the following:
Description of the property sufficient for identification;

2. A statement of the reasons for the suspension;
3. A statement of the property owner's right to appeal the suspension;
4. If the property owner changes his address or changes property agents and fails
to notify the Building and Zoning Department, such notice shall be sufficient if
sent by certified mail to the owner or his property agent's last address provided
on the last license application.
E. A property owner whose license has been suspended may request a reinspection
prior to revocation. If, upon reinspection, the Code Official finds that the licensed
property in connection with which the notice was issued is now in compliance with
this Chapter, then the Code Official may reinstate the license. The request for a
reinspection shall not stay the revocation of the license unless the Code Official
grants such request pursuant to a showing of good cause by the property owner.
F. Any person whose license has been suspended shall be entitled to appeal the
suspension to the Village President by filing a petition within twenty days after the
date of suspension. The Code Official shall transmit to the Village President copies
of all records and notices upon which the suspension is based. A hearing shall be
scheduled as soon as practical upon receipt of a timely petition. The Village
President in considering any such petition may immediately revoke the license,
continue the suspension to a definite compliance date with revocation being the
penalty for noncompliance, or dismiss the charges and reinstate the license.
G. A license may be revoked when a petition for appeal has not been filed within
twenty days following the date of issuance of an order of suspension, or, if the
suspension is sustained after appeal. A license may also be revoked when in the
opinion of the Code Official emergency conditions exist in a rental residential
property that require the immediate vacating of a structure as specified in the
Village's Property Maintenance Code.
H. A license which has been properly revoked as provided in this section shall not be
reinstated. The property owner may, however, obtain a new license after all
violations have been corrected and by following the procedures for obtaining a new
license and payment of appropriate fee(s) as set forth in this Chapter.
I. If a license is revoked without having the opportunity of a suspension hearing, the
property owner has the right to appeal that revocation. Such appeal shall conform to
subsection (F) of this section. Such an appeal shall operate as a stay of the revocation
until such time as the Village President renders a decision on the appeal.
J. Whenever a license is revoked, the Code Official shall send notice to the property
owner or the listed property agent at the last address provided on the most recent
license application. Such notice shall be sent by certified mail, return receipt
requested. The Code Official shall also notify all tenants of the rental residential
property by posting a notice on all entrances to the rental residential structure. The
notice to the tenants shall include the following:
1. You are hereby notified that the license for this structure has been revoked
pursuant to Chapter 15.36 of the Buffalo Grove Municipal Code.

2. You must vacate this structure within sixty days of the date of this notice.
3. If you fail to vacate this structure, you will be in violation of Chapter 15.36 of
the Buffalo Grove Municipal Code and subject to a fine pursuant to Chapter
1.08 of the Buffalo Grove Municipal Code.
K. Whenever an owner or property agent of a rental property fails to license such
property with the Village, the Code Official shall notify all tenants of the rental
property by posting a notice on all entrances to the rental property indicating the
following:
1. You are hereby notified that the owner or agent of this rental structure has failed
to license this rental property with the Village of Buffalo Grove in violation of
Chapter 15.36 of the Buffalo Grove Municipal Code.
2. You must vacate this structure within sixty days of the date of this notice.
3. If you fail to vacate this structure, you will be subject to a fine pursuant to
Chapter 1.08 of the Buffalo Grove Municipal Code.
Section 15.36.100 - Owner responsibility.
A. The owner of a rental residential property shall maintain a record for each property
with the full legal names of every tenant in each dwelling unit.
B. The owner or property agent of a rental residential property shall provide each
tenant with the name and telephone number of a responsible person who, in
emergency situations, will be available on a twenty -four-hour basis and who has the
authority to make repairs as needed.
Section 15.36.110 - Inspection access.
If any owner, property agent, occupant or other person in control of a rental
residential property or a dwelling unit contained therein fails or refuses to consent to free
access and entry to the property or a dwelling unit under his control for any inspection
pursuant to this Chapter, the Code Official or their designee may apply to the circuit court
for a search warrant or other appropriate court order authorizing such inspections.
Section 15.36.120 - Violation —Penalty.
Any person, firm or corporation violating any of the provisions of this Chapter, in
addition to other legal and equitable remedies available to the Village shall be punished
according to the provisions of Chapter 1.08, General Penalty. Each day during which a
violation of this chapter continues or is permitted to exist shall be considered a separate
and distinct offense.
SECTION 14: Should any section or provision of this Ordinance be declared invalid by a
court of competent jurisdiction, such decision shall not affect the validity of the
Ordinance as a whole or any part thereof other than the part declared to be invalid.

SECTION 15: The adoption by reference of the various codes, standards and regulations
herein is pursuant to the Village's Home Rule authority and specifically preempts and is
in lieu of the requirements of Section 1-3-1 and 1-3-2 of the Illinois Municipal Code, 65
ILES 5/1-3-1 and 5/1-3-2.
SECTION 16: Any person violating the provisions of this Chapter shall be punished
according to the provisions of Chapter 1.08 General Penalty.
SECTION 17: This Ordinance shall be in full force and effect from and after its passage,
approval and publication. This Ordinance may be published in pamphlet form. The
implementation of this Ordinance shall be delayed until March 1, 2019.
