2017-03-20 - Ordinance 2017-012 - AMENDING ZONING ORD AND APPROVING SPECIAL USE FOR PLANNED DEVELOPMENT March 1 , 2017 ORDINANCE NO. 7- 012 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND APPROVING A SPECIAL USE FOR A RESIDENTIAL PLANNED DEVELOPMENT WITH VARIATIONS TO THE VILLAGE OF BUFFALO GROVE ZONING ORDINANCE AND DEVELOPMENT ORDINANCE Prairie Landing Townhomes 16406 Half Day Road,22927 Prairie Road and 2601 Prairie Road,Buffalo Grove,IL WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property("Property")hereinafter legally described in Exhibit A is currently zoned R-E and is commonly known as 16406 West Highway 22, 2601 N. Prairie Road, and 22927 N. Prairie Road, Buffalo Grove, Illinois-, and, WHEREAS, JTW Prairie Landing LLC ("Petitioner") proposes to construct a 12-unit tow nhome development on the Property ("Project") and has applied to the Village for a rezoning to the R-9 Multiple-Family Dwelling District and for the approval of a special use for a Residential Planned Unit Development, and certain variations from the Village Zoning Ordinance(Title 17 of the Buffalo Grove Municipal Code [the "Zoning Ordinance"]) and Development Ordinance (Title 16 of the Buffalo Grove Municipal Code [the"Development Ordinance"]) (collectively, the "Requests for Relief'); and, WHEREAS, the Planning & Zoning Commission held a public hearing on the Petitioner's application on March 1,2017, at which it received testimony on the Requests for Relief, and WHEREAS, the Planning & Zoning Commission, at the conclusion of the public hearing, made certain findings of fact and a recommendation to the Corporate Authorities of the Village of Buffalo Grove that they approve the Requests for Relief, and it prepared minutes of the public hearing-, and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the requested rezoning is in the public interest; and, WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the requested zoning and development ordinance variations are authorized by Section 16°10°050 and 17.52. 50 oft e Buffalo Grove Municipal Code, and, 2 WHEREAS, the proposed Project shall be constructed in accordance with and pursuant t o t he following exhibits: EXHIBIT A Legal Description EXHIBIT B Preliminary Plan Set, including preliminary engineering, landscape plan, preliminary plat of subdivision and floor plans and elevations NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby grant approval oft is Ordinance re-zoning the Property to R-9 Multiple-Family Dwelling District with a special use for a Residential Planned Unit Development and approval of a Preliminary Plan with the following variations: Zoning Ordinance 1. Variation to Section 17.16.060 decreasing the minimum lot area for a property in the R-9 District; and 2. Variation to Section 17.28.050 reducing the required perimeter setback as depicted on the Preliminary Plan; and 3. Variation to Section 7. 0.050 decreasing the minimum front, side, comer side and rear yard setbacks as depicted on the Preliminary Plan; and 4. Variation to Section 17.28.050 to allow for a density of 11.4 units per acre as depicted on the Preliminary Plan, Development Ordinance 1. A Variation to Chapter 16.50 reducing the minimum right-of-way and parkway requirements as depicted on the Preliminary Plan. Section 3, This Ordinance re-zoning the Property to R-9 Multiple-Family Dwelling District with a special use for a Residential Planned Unit Development and approval of a Preliminary Plan shall be subject t o t he following conditions: I. The proposed development shall be developed in substantial conforrinance to the plans attached as Exhibit B. 2. Prior to the issuance of a building permit, covenants and declarations shall be submitted in a manner acceptable to the Village Attorney. 3. On street parking shall be prohibited in a manner acceptable tote Village. Proper signage shall be provided by the Petitioner and approved by the Village. 3 4. The Petitioner shall consider installing a berm along the south and west property lines. The final landscape plan shall be revised in a manner acceptable to the Director of Community Development. 5. The Petitioner shall continue her discussions with the Noah's Landing Homeowners Association with regards to the shared maintenance and costs to the existing Noah's Landing detention pond. 6. Final engineering shall be reviewed and approved by the Village Engineer, Section 4. This Ordinance shall be in full force and effect from and after its passage, and approval.
