GRANTING APPROVAL OF AN AMENDMENT TO ORDINANCE NO. 2012-46 FOR AN
ADDITION WITH A PARKING VARIATION TO THE VILLAGE OF BUFFALO GROVE ZONING
ORDINANCE

WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS, the real property ("Property") hereinafter legally described in Exhibit A is zoned
B3 and is commonly known as 1151 W. Lake Cook Road, Buffalo Grove, Illinois; and,
WHEREAS, on September 12, 2010, the Village Board approved Ordinance No. 2012-46
granting an amendment of the Planned Development to construct a 6,105 square foot building on
the Property; and,
WHEREAS, Burdeen's Jewelry LTD. ("Petitioner") proposes to construct a 6,105 square foot
addition to the existing building; and,
WHEREAS, said improvements require approval as an amendment to Ordinance No. 2012-
46 along with a variation for parking pursuant to the Village Zoning Ordinance (Title 17 of the
Buffalo Grove Municipal Code); and,
WHEREAS, the Village Plan Commission conducted a public hearing on July 13, 2016
concerning an amendment to Ordinance No. 2012-46 along with a variation for parking and,
WHEREAS, the Plan Commission determined that the petition meets the standards for a
variation set forth in Section 17.52.070 of the Buffalo Grove Zoning Ordinance; and,
WHEREAS, the Plan Commission voted 9 to 0 to recommend approval of the petition with
variations; and,
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and
find that the standards for variation have been met, as set forth in Section 17.52.070 of the Village
of Buffalo Grove Zoning Ordinance, in that the Petitioner has shown: (1) The property in question
cannot yield a reasonable return if permitted to be used only under the conditions allowed by the
regulations of the zoning district in which it is located except in the case of residential zoning
districts, (2)The plight of the owner is due to unique circumstances, and (3) The proposed variation

will not alter the essential character of the neighborhood
WHEREAS, the proposed project shall be constructed in accordance with and pursuant to
the following exhibits:

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS:
Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning
Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a
part of this Ordinance.
Section 2. The Corporate Authorities hereby grant approval of an amendment to Ordinance
No. 2012-46 along with a variation for parking pursuant to the Village Zoning Ordinance subject to
the following conditions:
1. The proposed development shall be developed in substantial conformance to the plans
attached as part of the petition. A final landscape plan shall be submitted prior to the
issuance of a building permit.
2. Any future use for the property, other than a Jewelry Store, shall require Village approval.
Section 3. This Ordinance shall be in full force and effect from and after its passage, and
approval.This Ordinance shall not be codified.
